The Regular Meeting of the Glendive City Council Was Held on Wednesday, November 5, 2008

The regular meeting of the Glendive City Council was held Tuesday, May 5, 2015. Mayor Jerry Jimison called the meeting to order with the following Council members present: Doug Baker, Leon Baker, Mike Dryden, Betsey Hedrick, Kevin Peña, and Gerald Reichert. Others present included: Treasurer Darci Saeman, Fire Chief George Lane, Director of Operations Kevin Dorwart, Assistant Police Chief Brad Mitchell, Public Works Director Jack Rice, and Recreation Director Dean Svenvold. Anthony Varianno from the Ranger-Review was also present; along with, numerous members of the public. Council members Rhett Coon and Matt Hull were absent.

Approve the minutes of the April 21, 2015 public hearing on Tax incentive for remodeled property – L. Baker moved to approve the minutes of the April 21, 2015 public hearing on Tax incentive for remodeled property; second by Hedrick. The motion passed.

OLD BUSINESS Ordinance Committee 4-27-2015 4 PM

Members present: Mayor, Hedrick, L Baker, D Baker Others: Anthony Varriano (ranger review) Roger Schaff, Gary Witso, Chief Lane, Chief Ulrich, Jack Rice & Pete public works, Dean Rec. Dept.

Agenda: 1. Amend parking ordinance to include boats, campers and trailers.

Action: A discussion was heard by all and the language of the ordinance was modified and the new language purposed will go back to city attorney for approval.

City Attorney reviewed and corrected language April 30th so committee recommends council approve the addition of new language to parking ordinance paragraph H of City code 6-2-6 Parking Restrictions.

6-2-6: PARKING RESTRICTED:

A. No person shall park any motor vehicle upon any street, roadway or thoroughfare or on and in any other public place for the principal purpose of:

1. Displaying such motor vehicle for sale.

2. Greasing or repairing such vehicle except repairs necessitated by an emergency. 3. Storing such motor vehicle not then in transit or actual use and service.

B. No person shall park any vehicle upon a street in such a manner or under such conditions as to leave available less than ten feet (10') of the width of the roadway for the free movement of vehicular traffic.

C. No person shall stop, stand or park any vehicle within an alley for a period of time longer than is necessary for the reasonably expeditious loading or unloading of such vehicle.

D. No person shall stop, stand or park a vehicle within an alley in such a position as to block the driveway or entrance to any abutting property.

E. No person shall stop, stand or park a vehicle in a yellow or no parking zone.

F. No owner or person in charge of a motor vehicle shall park or permit to be parked on any street, avenue or alley any motor vehicle in excess of five (5) days.

G. No person shall move a vehicle not lawfully under his control into any prohibited area or away from a curb such distance as is unlawful. (Ord. 02-2003, 5-20-2003)

H. No per shall stand or park any wheeled trailer of any size on City owned streets or boulevards from November 1, to April 1. From April 1 to October 31, wheeled trailers may be parked for a period not exceeding five (5) days consecutively on City street. From April 1 to October 31. any trailer must be moved off the City street after five (5) days. Construction related trailers may be parked for five (5) days consecutively during all months of the year. Construction related trailers must obtain a permit from the City of Glendive Building Department if they are to be parked on a City street for a period exceeding five (5) days. The permit shall allow a construction related trailer to be parked for a consecutive period of thirty (30) days on a City street for a fee of fifty dollars ($50) and must be posted on that trailer. Any wheeled trailer must not block any sidewalk or boulevard owned by the City of Glendive.

***During L. Baker’s reading of the Ordinance committee report, he asked his fellow Council members to read Paragraph “H” as it was just added to the Ordinance. He also stated that he received a letter in the mail from Bruce Miller regarding the permit required for construction related trailers (an item in the new paragraph.) Miller stated that with this required permit, businesses will have to pay $50 every 30 days which adds up to $600/year and stated the $600/year will add up quickly. He would like to see this part of the ordinance changed to maybe a $100.00/year permit plus provide proof of business license. Hedrick added that she, too, received a letter from Bruce Miller and would like to see this Ordinance go back to the Committee to review and possibly simplify.

Personnel Committee 4-27-2015 4:30 PM

Agenda: 1. Request to adjust wages for temporary summer help by public works. Action: Committee recommends $10.00 per hr 2. Permission to advertise for full time dispatch position at GPD Action: Committee recommends advertisement for full time dispatcher position. 3. Request to adjust wages for temporary summer help by $1.00 at rec. dept. Action: Committee recommends approval of the request 4. Interview for full time firefighter Action: Committee scheduled the interview for May 4th.

Personnel Committee Report – 05/04/15 1. Interviewed Jeremiah Orr. For full time fire fighter!

Action: Committee recommends hiring Jeremiah Orr for full-time fire fighter effective June 1st!

Glendive Study Commission Update – Jim Squires – Jim Squires reported the mayor, department head and all Council member interviews are complete, 326 questionnaires have been returned, and Theresa Rankin has compiled the results from the questionnaires and has made them available to each member. Members of the Study Commission have spoken to the Noon Lions, Rotary, and Toastmasters and are waiting to speak at a Kiwanis meeting and to Economic Development. The commission has two forms of government it is currently looking at. Dryden asked Squires if the Commission can only recommend one thing and Squires stated that yes; the Commission can only recommend one thing. They either recommend change or no change.

Community Clean-up Week – April 20th – 25th – Clean up week was held from April 20th-April 25th and Mayor Jimison stated only $1,732 of the $3,000 available was used. The Chamber of Commerce was closed three out of the five days during that week so that caused some confusion for obtaining the coupons. Dryden confirmed with Mayor Jimison that the $1,732 will be divided equally between the City, County and WBI.

2015 Legislative update – Local option tax, HB602, SB416 & HB402 – Mayor Jimison updated the Council on the results of the 2015 Legislature. The City of Glendive received no help from the Government as the Governor is saying each City needs to start standing on its own feet. The local option tax didn’t get introduced; HB602 (adding $1.00-$5.00/night tax on motels and which Dorwart worked really hard on) got tabled as Mayor Jimison stated the Legislature didn’t want the Cities handing this money. SB416, which was introduced by the Senator from Scobey and was an infrastructure bill, came within one vote of passing. HB402 (another infrastructure bill) was passed by the Senate, but the House had left and gone home for the Session.

PUBLIC COMMENT Jennifer Walter from Windfall Remodeling, 308 Clay, approached the Council regarding the Ordinance amendment. Her business seconds Bruce Miller’s letter and Walter’s stated that Windfall Remodeling has at least one trailer, if not more trailers, at each worksite. The $50 every 30 days for each trailer will add up quickly. Dryden asked Walter how long they are each job site. She stated anywhere from 1 to 60 days depending on the job they are doing as they also do remodeling.

NEW BUSINESS Request from ABC Baseball Board for fireworks at Opening Ceremonies on May 9, 2015 – Hedrick moved to approve the request from ABC Baseball Board for fireworks at Opening Ceremonies on May 9, 2015; second by D. Baker. Chief Lane stated the board will be using Class C fireworks (which is what we buy) so he doesn’t see any problems. There is also water readily available. The motion passed.

Request for Boundary Line relocation – Mitchell-Merrill Avenue Minor Subdivision – Dryden moved to approve the request for Boundary Line relocation – Mitchell-Merrill Avenue Minor Subdivision; second by Pena. Alex Burkhalter, Housing Solutions, LLC, approached the Council and explained this is just an administrative thing. Holiday Inn owned both lots when the hotel and parking lot were built and this will just clean up everything. Mayor Jimison asked Burkhalter to update the Council on the progression of Yellowstone Commons. Burkhalter stated this has been three years in the making and is now within 30-60 days of obtaining the Certificate of Occupancy. The carpet is down in one building and the other building is getting carpet next week. He also stated it is nice to have local management in Action for Eastern Montana. There has been a lot of interest with 15 to 16 applicants in process right now. Each application is very time consuming because of the income restrictions. Mayor Jimison commended Burkhalter on his hard work. Fire Chief Lane added the sprinkler and fire alarm system testings’ are complete and also gave the FUPR committee a heads up stating he will be requesting the access road to the apartment complex be designated a “Fire Lane” so nobody can park on that street. Burkhalter added he has “No Parking” signs ordered and they will be placed along that street also. Dryden asked Burkhalter how the apartment complex will be managed. Burkhalter stated that he himself is a 15-year owner with Sparrow Management managing the complex. Sparrow will report to him and he in turn will report to his investors. He commended the employees at Action for the site “labor” they have been providing during the construction phase. The motion passed.

Recommend Ordinance amendment to add boats, trailers, and campers to Ordinance 6-2-6 – Reichert moved to recommend Ordinance amendment to add boats, trailers, and campers to Ordinance 6-2-6; second by Pena. Mayor Jimison stated if this recommendation is approved tonight, the first reading of the Ordinance will be at the May 19th meeting and the second reading at the June 2nd meeting. Pena asked Mayor Jimison if changes can still be made to the Ordinance after the first reading. Mayor Jimison stated yes, changes can still be made. Reichert asked L. Baker the reason for splitting up the year in the Ordinance. L. Baker stated he had been thinking about the Ordinance a lot and was just trying to move the process ahead. Reichert asked what the thinking/reasoning was behind the year split. L. Baker stated mainly just thinking about the snow. The City Attorney suggested the seasonal trailer parking after speaking with Police Chief Ulrich. Reichert verified that if a 1-Ton pickup is hooked up to a stock trailer, it is considered for immediate use and doesn’t apply to the Ordinance. Mayor Jimison stated the winter exception was brought up by the Police Chief and City Attorney. The motion passed with Hedrick voting no and Dryden abstaining as he had stepped away from the meeting for most of this discussion.

Approve raising starting wage to $10.00/hour for Public Work’s temporary summer workers – D. Baker moved to approve raising starting wage to $10.00/hour for Public Work’s temporary summer workers; second by Hedrick. Rice stated his department currently has two summer workers and two more are starting at the end of the month. The motion passed.

Approve wage adjustment of $1.00/hour for Recreation Department’s temporary summer workers – Pena moved to approve wage adjustment of $1.00/hour for Recreation Department’s temporary summer workers; second by Hedrick. Svenvold stated his hiring is looking a little better as a few more applications have trickled in. The motion passed.

Approve advertising for Full-time permanent dispatcher at Police Dept. effective May 6, 2015 – Hedrick moved to approve advertising for Full-time permanent dispatcher at Police Dept. effective May 6, 2015; second by Reichert. Pena verified with Assistant Chief Mitchell that Susannah Krug is the dispatcher who is leaving. The motion passed.

Recommend hiring Jeremiah Orr as FT Firefighter effective June 1, 2015 pending successful background check – D. Baker moved to recommend hiring Jeremiah Orr as FT Firefighter effective June 1, 2015 pending successful background check; second by Pena. Chief Lane stated Orr is from Missoula and is on the Missoula Rural Fire Department. Chief Lane is happy to have him. The motion passed.

FYI - Public hearing – May 19th @7:10 pm – Zone change request – Change 29.9 acres of State owned property at 700 Little Street from R1 (Single family) to RP (Residential professional) – Hedrick asked about the 29.9 acres. Mayor Jimison stated the state owns 29.9 acres. D. Baker asked if this zone change request is the MHP and Mayor answered yes.

Accounts Payable Claims: $1,265,235.81 – L. Baker moved to approve Accounts Payable Claims in the amount of $1,265,235.81; second by Dryden and the motion passed.

Payroll for April: $225,744.96 – Hedrick moved to approve payroll for April in the amount of $225,744.96; second by Pena and the motion passed. DEPARTMENT HEAD COMMENTS PD: Assistant Chief Mitchell stated his department has been very busy with a lot of training in the last month. He stated the new patrol car is in use and was badly needed.

Fire: Chief Lane has been busy on the building side with garages, Yellowstone Commons and a lot of fire inspections. He participated in the Torch Run which went from the EPEC to the bowling alley. RW5 (Wild land truck) had the new tranny installed so it is up and running. The snorkel is still out of service.

Operations: Dorwart has been busy with WRRF administrative work.

PW: Rice stated he has been with WRRF & MDT Urban planning. The crew has been busy getting the park sprinklers up and running. Rice also stated the skimmers at the pool have been installed, the new diving boards should arrive next week and new cement will be poured next week. Reichert added that Glendive isn’t the only town/city with pot holes. He was in Dickinson recently and said their roads are terrible. The winter was not kind to the roads. Dryden stated one of the road signs by the Whistle Stop was face down. Rice said he would check on it on his way home.

Recreation: Svenvold stated he had early sign ups for pool passes for swim team members. Sign-ups for swimming lessons, etc. will start on May 26th. Applicants for pool instructors, cashiers, etc. are slowly coming in. Classes will be held in June for both lifeguards and for swim instructors. The Splash Park just needs to be cleaned up and it will be ready to open. He doesn’t open the splash park until it is 70˚ or warmer.

OTHER BUSINESS Jim Squires reminded everyone about National Day of Prayer on Thursday, May 7th at Gazebo Park. National Day of Prayer has been running nationally for 64 years.
