FARIBAULT COUNTY BOARD OF COMMISSIONERS OFFICIAL PROCEEDINGS APRIL 7, 2009

The Faribault County Board of Commissioners met in regular session at the Courthouse in the City of Blue Earth at 9:00 a.m. on April 7, 2009. The following members were present: Butch Erichsrud, Bill Groskreutz, Tom Loveall, John Roper, and Tom Warmka, Commissioners. Auditor/Treasurer/Coordinator John Thompson and County Attorney Brian Roverud were also present.

The meeting was called to order by Chairman Loveall. The pledge of allegiance was recited.

Warmka/Groskreutz motion carried unanimously to approve the synopsis and official proceedings of the March 17, 2009 regular meeting.

Erichsrud/Groskreutz motion carried unanimously to approve the amended agenda of April 7, 2009.

The calendar was updated. No member of the public appeared to make comment.

Committee reports were given. Groskreutz reported on the Go Minnesota directors meeting and the Minnesota Social Services Association (MSSA) conference; Erichsrud reported on the Resource Conservation & Development Council meeting; Warmka reported on the Wind Energy meeting, Association of Minnesota Counties regional meeting and wind energy meeting; Roper reported on the MSSA conference and Blue Earth City Council meeting; and Loveall reported on Region 9 energy meeting and land use seminar.

Tax Clerk Lorrie Krosch met on treasurer’s office business.

Groskreutz/Warmka motion carried unanimously to approve a subordination of loan to Meldon Elmore on Parcel No. 18.033.0401 contingent upon the report on the valuation of the loan.

04-07-09 26 Warmka/Groskreutz motion carried unanimously to approve a subordination of loan to Eric Boertje for an SSTS loan on Parcel No. 13.027.0101.

Sheriff Mike Gormley met regarding office business.

Warmka/Groskreutz motion carried unanimously to approve a $2,000 Safe and Sober Grant from the Minnesota Office of Traffic Safety overtime grant.

Groskreutz/Warmka motion carried unanimously to approve a 911 service agreement with the Winnebago Cooperative Telephone Association.

Warmka/Roper motion carried unanimously to approve the purchase of seven radios for $2,121.73 and repeater for $7,515.39 from Alpha Wireless of North Mankato.

Groskreutz/Roper motion carried unanimously to approve the purchase of an in-building amplifier/booster for cell phones from Wilson Electronics of St. George, UT for $850.

Gormley reviewed the projected budget savings by various reasons.

Central Services Director Brenda Ripley met regarding office business.

Groskreutz/Warmka motion carried unanimously to approve the hiring of the following full-time dispatch/jailers: Jessica Duit, Stephanie Krosch, and Kristin McClain effective February 17, 2009; Amber Porter effective March 17, 2009; and Mitchell Murphy effective May 1, 2009.

Warmka/Roper motion carried unanimously to approve advertising for two part-time transit driver positions.

Erichsrud/Warmka motion carried unanimously to accept the resignation of Jolene Krussow from the County Attorney and Library Services office effective April 10, 2009 and the resignation of Richard Holmseth from the Transit Department effective May 15, 2009.

Transit Director Bonita Zimmer met regarding office business.

04-07-09 27 Groskreutz/Erichsrud to approve Resolution 09-CB-05 for the purchase of a transit bus not to exceed $64,000. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

R E S O L U T I O N

WHEREAS, Faribault County operates a transit system; and

WHEREAS, Faribault County desires to purchase, through the State of Minnesota Cooperative Procurement Process, a vehicle to be used in the transit system, and

WHEREAS, the vehicle cost is allocated 100% Federal share of the “contract amount”, and

WHEREAS, Faribault County staff has reviewed the vehicle options offered by approved multiple contracting vendors, and

WHEREAS, the staff recommends purchasing a vehicle from North Central Bus Sales of St. Cloud, Minnesota for the reason of fleet consistency and past vendor performance, and

NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners hereby authorize the purchase of a new transit bus from North Central Bus Sales in the approximate amount of $64,000.

Public Works Director John McDonald met regarding office business. The annual report was presented. A construction update was given.

Warmka/Roper motion carried unanimously to advertise for bids on project number SAP 22-631-09 on CSAH 31 with bid opening May 13, 2009 at 11:00 a.m.

Mike Kearns of CAM and Steve Johnson of Vetter Johnson Architects met regarding law enforcement center issues.

Groskreutz/Warmka motion carried to approve change orders of $24,194.75 on P.N. 05- 1-295 and authorized the County Auditor/Treasurer to sign the change orders. Commissioner Erichsrud voted no.

Erichsrud/Roper motion carried unanimously to accept quote from Dakota Food Equipment in the amount of $40,534.42 for kitchen equipment.

04-07-09 28 Warmka/Erichsrud motion carried unanimously to approve the quote from Heymann Construction for access flooring in the amount of $4,105.

Warmka/Erichsrud motion carried unanimously to accept the low quote from Culligan, Inc. of Fairmont for a water softner system in the law enforcement center for $15,625.00. One other quote was received from Tonna Mechanical, Inc. for $31,000.00.

Warmka/Roper motion carried unanimously to hire an engineer to inspect the installed system.

Warmka/Erichsrud motion carried unanimously to approve Resolution 09-CB-06 naming the Fifth Judicial District to be the fiscal agent and grant applicant for the Faribault, Martin, and Jackson multi-county adult drug court program. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

R E S O L U T I O N

WHEREAS, the counties of Faribault, Martin, and Jackson have signed a Memorandum of Understanding to develop a multi-county adult drug court program and;

WHEREAS, the multi-county drug court is fully operational in the three counties, and;

WHEREAS, the Fifth Judicial District Office has agreed to be the fiscal agent and grant applicant.

NOW, THEREFORE, BE IT RESOLVED that the County Board agrees that the Fifth Judicial District be the fiscal agent and grant applicant for the Faribault, Martin, and Jackson Multi-county adult drug court program.

Groskreutz/Warmka motion carried unanimously to appoint Mark Seedorf of Wells to the Corrections Advisory committee for a two year term ending December 31, 2010.

Warmka/Erichsrud motion carried unanimously to appoint Alice Moon of Kiester to the Economic Development Authority for a five year term ending December 31, 2013.

Groskreutz/Roper motion carried unanimously to approve the revision of the Department of Corrections contract for secretarial services.

Warmka/Groskreutz motion carried unanimously to adopt Resolution 09-CB-07 proclaiming April as Child Abuse Prevention Month in Faribault County. Commissioners Erichsrud, Groskreutz, Loveall, Roper, and Warmka voted yes.

R E S O L U T I O N

WHEREAS, child abuse prevention is a community problem and finding solutions depends on involvement among people throughout the community;

WHEREAS, the effects of child abuse are felt by whole communities and need to be addressed by the entire community;

WHEREAS, effective child abuse prevention succeeds because of partnerships created between parents, practitioners, schools, faith communities; health care organizations, law enforcement agencies, and the business community;

WHEREAS, family-serving, youth-focused prevention programs offer positive alternatives for young people and encourage parents and youth to develop strong ties to their communities;

WHEREAS, all citizens need to be more aware of child abuse and neglect and its prevention within the community, and be involved in supporting parents to raise their children in a safe, nurturing society.

NOW, THEREFORE, we, Faribault County Commissioners, hereby proclaim April as Child Abuse Prevention Month in Faribault County and call upon all citizens, community agencies, religious organizations, medical facilities, and businesses to increase their participation in efforts to prevent child abuse and neglect, thereby strengthening the communities in which we live.

Warmka/Erichsrud motion carried unanimously to set the mileage reimbursement rate at $.10 below the IRS reimbursement rate effective April 8, 2009.

Groskreutz/Warmka motion carried unanimously to pay bills totaling $135,776.70 as follows:
