MINUTES REGULAR MEETING OF THE CITY COUNCIL APRIL 17, 2012

Mayor Dale Lisher opened the meeting at 7:00 PM and led in the Pledge of Allegiance. Present were council members Jeremy Alexander, Mike Morgan, Mike Towne and Andy Tweit, maintenance supervisor Steve Howerton and city clerk Barb Wilson. Guests attending were Matt Anderson, Avista, Andy Grant, Latah County Rec District, Aaron Heinen and Lisa Wolfe from JK Park & Rec, Kevin Renford, South Latah Highway District and Sandy Rollins, Latah County Disaster Services.

Mike Morgan made a motion, with Mike Towne seconding to amend the agenda (according to Idaho Code 67-2343) to include Sandy Rollins with Latah County Disaster Services. All were in favor.

Matt Anderson with Avista said they are in the process of changing out the power poles from Wells Fargo to the Old Chevron Fuel Plant. The poles they are replacing were extremely old. They will hot patch, concrete and restripe over the asphalt. Some underground work is taking place which will look better. There are too many waterlines and it would be too expensive to do all work underground. The project should take 5 – 6 weeks and they hope to be done by Locust Blossom on May 26. If they are not done by that date they will clean-up the area.

Steve Howerton sent a request to the tree committee to remove the Locust tree south of 5th Street, as it will interfere with the pole and the crane.

On Thursday, April 19, at 1:00 AM Avista will shut down power to Archies Restaurant. They should be done by 4:30 AM. Customers will be notified in advance of power outages.

Andy Grant from Latah County Rec. District gave an update on the trail area between Juliaetta and Kendrick that was damaged from the high water on March 26. They have enough rock for now but will need more for an additional 500+ feet. They should be completed with the repair sometime between August and September. The Highway District said they might be able to fix the paving if the County buys the mix. The total cost of the project is $13,250 and 800 tons of rock was used. The JK Park and Rec District dedicated $5000 to get the project started. The County Commissioners said they could possibly help. They will not qualify for Homeland Security Funds. The Commerce Department requires it to be an imminent threat to provide funding. Janice McMillan from the Economic Advisory Council said the state doesn’t consider it a threat. Any request for grants must be written by a certified grant writer. Paving and repair will take further discussion with the county. They will spread the rock with a grader and then roll out. The City of Kendrick received a bill from L&S Construction for repair of the North stream bank within the city limits of Kendrick to protect the storm drain. L&S used 61.1 tons of rock. We are still waiting for a bill from Pat Henderson for the 407 ton of rock. We have an estimate from Herco of $7195 for asphalt repair and replacement.

Aaron Heinen said the JK Park and Rec District will move $22,000 from a CD account into the general trail fund to help with finishing repairs on the trail. They currently have $20,000 in the general fund which will brings the total in the general trail fund to $42,000.

A preliminary report has been submitted to Boise and they will make a final decision.

Sandy Rollins with Latah County Disaster Services said the county extended the Disaster Declaration for 30 days. Each request will be looked at on a merit by merit basis. There are no guarantees that we will receive funding. The funds would be for storm drain repair only, not for trail repair. Jay should have answers by Friday. Local resources have been exhausted. The county does not have any funds to cover this. A 50/50 match does not have to be cash. It can be overtime from the normal hours. We have to move ahead assuming there won’t be any outside funds. Worst case scenario, it can take years to be reimbursed.

Pat Henderson provided 1235 tons of rock for trail repairs and stream bank protection. The City of Kendrick used 407 tons of rock. The price of the rock was $16.00 a ton, not the $15.00 a ton that was previously reported. This increases the price for rock from $6105 to $6512.

The L&S Construction costs were $5267.66

For Herco to repair a patch strip 11 X 200 it is estimated the cost will be $7195. This will include sod cutting, re-prepping gravel and 2” of hot mix.

It is possible to apply to the State Parks for funding but they only take applications in January and the work wouldn’t be able to be completed until August 2013.

The seal coat we got in the past was 40,000.

Aaron Heinen suggested we wait to repave the section of the trail between Kendrick and Juliaetta.

Andy Grant said we can apply for funding through the Department of Commerce. There is not a match with them.

Aaron Heinen made a motion and Lisa Wolfe seconded to help pay for expenses for trail repairs. A total of $25,000 can be spent on trail repairs. Aaron thanked the South Latah Highway District for donating their time and equipment to repair the trail in between Juliaetta and Kendrick.

Sandy Rollins said we are restricted to damage that occurred in the March 26 – 31, timeframe to be considered part of the severe spring weather with the Department of Commerce.

Steve Howerton said a week ago Wayne Deeds and Jonathan Van Etten drove onto the trail by the Sperry Grade Bridge to get to three old vehicles abandoned along the Potlatch River. They want to remove these vehicles to salvage. They will not be allowed to cross the trail when removing the vehicles. They could possibly pull them along the creek bed to avoid the trail. They will be liable for any damage. These gentlemen asked to be on the city council agenda but did not show up for the meeting so this could not be discussed with them at the meeting. A liability letter will be required before any salvage work could be started.

The minutes from the March 27 meeting were reviewed. Andy made a motion and Jeremy Alexander seconded to approve the minutes as amended. All were in favor.

The disbursements were reviewed. Mike Towne asked for further clarification between the three different sanitation bills from the City of Moscow, Latah County Solid Waste and Latah Sanitation. Barb Wilson will research this and report back at the next city council meeting. Jeremy Alexander moved and Mike Morgan seconded to approve the disbursements. All were in favor.

MAINTENANCE DEPARTMENT:

Steve presented a Seepage Test Report from Progressive Engineering. We failed the seepage test. The average leaking was 1.6541 inches per day. If the ponds weren’t leaking they should have been increasing due to the rain. Water samples downstream are still fine.

Steve told Nick Rawlis that we would send a letter to Jim Carpenter about the 3’ Storm Drain Pipe. Idaho Transportation Department should have some of the financial responsibility for the repairs to save the pipe. Doral said it was the City of Kendrick’s responsibility to maintain the trail, but Steve feels they should assist because the storm drain was in jeopardy. CLERK/TREASURER: No report.

URBAN FORESTRY: Andy Tweit said that Urban Forestry felt Avista should pay for removal of the Locust tree. They will be receiving a $300 grant for the Arbor Day Event. The city would need to pay the bills. The Arbor Day Event will consist of a breakfast from 7:00 AM – 9:30 AM at the Grange Hall. There will be a play presentation at 9:00 AM. The breakfast will be followed with a tree planting in the Kendrick City Park. They wanted to put up a flag for the event. It was suggested they contact Frank Dammerell at the VFW. They also asked if they could put trash from the event in the city trash cans. This is ok. The next Urban Forestry meeting is May 8, at 7:00 PM.

PLANNING & ZONING: Mike Morgan The next meeting is April 23. They will discuss a well for Roger Eberhardt. This is within the city limits area of impact.

PARK & REC: Mike Towne There are separate funds dedicated to the trail than other Park and Rec. expenses.

FIRE DEPARTMENT: Jeremy Alexander East B Street is blocked with vehicles. There has been a complaint that the Deeds vehicles are blocking the street and emergency vehicles would not be able to respond.

The Fire Department has asked that they not receive conditional use permit notices and that these should come to the city. Barb Wilson will check into having them removed.

NEW BUSINESS:

Ordinance 734 was reviewed. This ordinance will repeal ordinance 733 that contained incorrect land descriptions. Mike Towne made a motion and Andy Tweit seconded to approve ordinance 734. All were in favor.

Grant Administrator We received applications from CEDA and Walter Steed. Mike Towne made a motion and Andy Tweit seconded that we select CEDA. All were in favor. Barb will send a letter to both candidates informing them of the decision.

Design Professional Service Engineer The top three applicants were Century West Engineering Corp., Mountain Waterworks and T O Engineers. A discussion took place about the top three candidates. Century West seem more inside the box. Would they take into consideration what the city could afford? T O Engineers seemed like a great candidate. They had more tunnel vision for land application. Mountain Waterworks has Dr. Wallace on their team. He consults with different engineering firms and has a good working relationship with DEQ. He carries a lot of weight in the engineering community. They don’t just boiler plate the project. They will try to design around our current rate. All of the top three firms are capable. Mike Towne felt Century West had the strongest presentation. They had a huge amount of grant writing experience. Mountain Waterworks changed their firm’s concept to work with smaller cities to keep costs down. Mike Towne made a motion and Jeremy Alexander seconded to select Mountain Waterworks to lead our wastewater upgrade project. All were in favor. Barb Wilson will send a letter to all candidates informing them of the decision.

Swimming Pool Cindi Stockard has requested $100 to go towards her grant writing class that will cost $400. Mike Morgan made a motion and Mike Towne seconded to provide $100 to Cindi. All were in favor. Lifeguards will make $8.50 an hour. Returning lifeguards this year are Trevor Case of Deary, Marissa Fry of Troy, and Dylan White of Kendrick. New lifeguards will be Hannah Thomas of Troy, and Shyanne Welles of Juliaetta. Returning Head Lifeguard Cassie Cannon will make $9.00 an hour and New Pool Manager Cindi Stockard will make $10.00 an hour. Andy Tweit made a motion and Jeremy Alexander seconded to hire the lifeguards at the above wages. All were in favor.

Steve Howerton said he needs summer help. A decision was made to hire Steve Wilson at $12.00 an hour to help Steve. Mike Towne made a motion and Mike Morgan seconded to hire Steve Wilson. All were in favor.

At 9:14 Andy Tweit made a motion with Mike Morgan seconding to go into Executive Session to discuss personnel issues (in accordance with Idaho code 67-2345).

At 9:27 Andy Tweit made a motion and Jeremy Alexander seconded to go into Regular Session.

Jeremy Alexander made a motion and Mike Towne seconded to increase the City Clerk’s wage by 50 cents an hour on May 14, and another 50 cents an hour on August 14. All were in favor.

Andy Tweit moved and Jeremy Alexander seconded to adjourn the meeting at 9:29 PM. All were in favor.
