Information concerning ownership of a home at Fairway Patio Homes Property Owners Association, Inc., also known as The Fairway at Tiburon, is addressed in this booklet. Should you require additional information regarding the Association, please contact one of the Board members.

The Fairway at Tiburon This Association is a not-for-profit corporation formed for the purposes of maintaining common facilities and preservation of the landscaped areas. The ownership of your home is subject to certain protect covenants, conditions and restrictions for the mutual benefit of the members/owners. Each owner shall have a right and easement of enjoyment in and to the common area and their property without disturbances or activities that would interfere with the rights, comforts or convenience of his or her neighbors.

The Fairway is within the Sanitary Improvement District (SID) 158 jurisdiction and all homes are subject to their annual tax levee assessment. This assessment is part of your Sarpy County property tax statement.

GOVERNANCE

Covenants and By Laws The most current set of these documents is on file with the Sarpy County Register of Deeds office and were filed on November 19, 2015.

Voting Rights All owners are entitled to one vote for each lot owned. When one or more persons hold an interest in any lot, all such persons are members, but in no event shall more than vote be cast with respect to any lot.

Administration A Board of Directors of five (5) is elected by the members to represent your interests as an owner and to conduct the affairs of the Association. Board members must be property owners in good standing and are not paid for their service. The Board establishes policies and procedures to carry out the services and business of the Association. Service on the Board is encouraged to all home owners in the Association. The current Board members are:

Budget The Association has numerous operating expenses such as: Maintenance costs for common areas, trees, lawns and the irrigation system for all Fairway properties. A budget is prepared and approved annually by the Board. From this budget, the Board establishes the assessment fees to be collected from the property owners on a monthly basis.

Assessment Fees/Dues Assessment fees commence on the first day of the month following the close of escrow on the purchase of property in the Fairway. Monthly fees can be paid by ACH bank withdrawal by or mailing a check to the fiscal manager listed below:

Once assessments/dues are more than thirty (30) days in arrears, they accrue a penalty/finance charge at the rate of sixteen (16%) per annum. The Board files liens on properties with delinquent assessments and interest as appropriate.

To ensure adequate reserve funding, new homeowners will make a one time capital contribution of One Hundred Five dollars $150. These funds are directly deposited into the Association’s bank account.

Insurance Insurance and liability coverage is provided by the Association for the common areas only. It is the responsibility of each property owner to provide and pay for his own property and liability insurance.

Common Areas The common areas at the Fairway consist of the entry boulevard, streets and parkways. The entrance monument, parkway median and perimeter walls/fences are all part of the

2 common area. These areas are not to be obstructed or used for any purpose other than ingress and egress to the homes and garages. It is the responsibility of each occupant to store any articles as not to be unsightly or hindrance to others.

SERVICES AND MAINTENANCE

Snow Removal The Association is responsible and contracts for snow removal from all common area walkways and streets. This will include stoops, steps, sidewalks, driveways and mailbox access areas. Sand and ice-melt will be applied as necessary. Board policy requires removal upon official snowfall of three (3) inches or more. All areas to be completely cleared within forty-eight (48) hours after snowfall has stopped. Drifting snow after initial snow removal must be addressed by property owners. Snow removal from decks and patios is the property owner’s responsibility.

Sarpy County is responsible for snow removal from all streets.

Trash Service All curbside garbage collection is picked up weekly on Wednesdays. Receptacles are furnished by Premier Waster Solutions 402-339-1229 and should be placed outside early on the morning of pickup. Recycling containers or garbage containers shall be secured so that litter is not strewn throughout the neighborhood. Cost of trash collection is included in each home owner’s property tax assessment by SID 158.

Mail Service Mail service is delivered to the cluster mail boxes located on the entrance median. Individual keys for your assigned box can be obtained from your realtor at the time of closing or at Stoney Ridge Post office, 5720 S 142 Street, Phone 402-891-8961.

Landscaping The Association is responsible for maintenance and repair of trees, shrubs, and other common area landscaping at the expense of the Association. The property owners are responsible for maintaining personalized landscape areas and flower beds installed by current or former property owners.

The Association contracts for lawn services in the Fairway. Lawn service will include fertilizing, mowing, power raking and aerating of lawn areas and maintaining and servicing the irrigation system that serves the lawns in the Fairway. Special lawn services, such as over-seeding, may be the completed by property owners.

POLICIES AND RULES

Pets Two (2) domestic household pets are permitted, provided they are on a leash at all times when outside of the home and patio area of the property owner. Pets are not permitted to run loose outside the lot of the owner. Any damage or unpleasantness caused by the pet will be sole responsibility of the pet owner that could result in the levy of a fine for each violation. Please pick up all pet waste during walks in the common areas and in

3 your yard. No such pet will be kept, bred or maintained for commercial purposes. Only “invisible” fencing will be allowed to contain pets to their premises.

Parking Each owner shall have ready access to their garage or parking space. No owner shall permit the use of their parking space to another occupant. The Association shall have the right to remove such vehicles at the expense of the owner. No automobile or vehicle repair will be permitted outside of garages on any lot at any time. All garage doors must remain closed at all times except when cars are entering or exiting the garage.

DESIGN STANDARDS

Antennas External radio, television, or other antennas are not permitted without prior approval of the Association.

Architectural Review Committee The purpose of the Architectural Review Committee is to establish and preserve a harmonious design and to protect the value of the property in the Fairway. The Committee consists of three (3) members who are appointed by the Board to review all plans and specification submitted for the proposed improvement or construction upon any lot. The Committee strives to maintain the beauty and inherent value of the Fairway. Prior to changes to the home exterior or property, the improvements must be approved by the Committee.

AMENITIES

Tiburon Golf Club This course is among Nebraska’s highest rated golf courses, measuring over 7,000 yards with four lakes and 70 sand bunkers. Currently, the course is open to the public on a restricted basis. Private memberships and golf leagues are available. Further information about the golf club is available from the Club at 402-895-2688.

Tiburon SID Swimming Pool The Tiburon pool and bath house is available for use on a membership basis. This is operated by the SID 158 Board of Directors and located near the Fairway. More information is available at the website http://tiburonpool.com or phone 402-891-4832.

Tiburon Park A public park with a developed playground area is located at 178th Street and Cornhusker Road. Note: The park does not have restroom facilities.
