CERTIFICATE OF NEED NEWSLETTER February 16, 2006

The moratorium established by Executive Order 2005-1376, dated December 29, 2005 has expired. Therefore, all Certificate of Need applications will now be processed in accordance with the appropriate batching cycle.

On January 31, 2006, Governor Fletcher signed new administrative regulations affecting the establishment and expansion of certain health care facilities and services. Specifically, these regulations include the 2006 Update to the 2004-2006 State Health Plan (900 KAR 5:020), the Certificate of Need Administrative Regulation (900 KAR 6:050), and the Certificate of Need Application Fee Schedule (900 KAR 6:020). Copies of these items can be obtained at www.chfs.ky.gov/ohp/con.

The above regulations were filed both as emergency regulations and ordinary regulations. A public hearing on these administrative regulations shall, if requested, be held on March 21, 2006, at 9:00 a.m. in the Health Services Auditorium, Health Services Building, First Floor, 275 East Main Street, Frankfort, Kentucky. Individuals interested in attending this hearing shall notify the Office of Legal Services in writing by March 14, 2006, five (5) workdays prior to the hearing, of their intent to attend. If no notification of intent to attend the hearing is received by that date, the hearing may be canceled. The hearing is open to the public. Any person who attends will be given an opportunity to comment on the proposed administrative regulation. A transcript of the public hearing will not be made unless a written request for a transcript is made. If you do not wish to attend the public hearing, you may submit written comments on the proposed administrative regulation. You may submit written comments regarding this proposed administrative regulation until close of business March 31, 2006.
