Section 396120 of the 1976 Code, as added by Act 22 155 of 1987, is amended to read: 23 24 “Section 396120. As used in this chapter: 25 (a) ‘Administrator’ means the Administrator of the Department 26 of Consumer Affairs. 27 (b) ‘Club’ means any person presently or hereafter engaged in 28 selling, furnishing, or making available to members, either as 29 principal or agent, motor club services. 30 (c) ‘Club representative’ means any individual in this State 31 designated by the club who acts or aids in any manner in the 32 solicitation, negotiation, or renewal of service contracts. This 33 definition does not include any individual performing only work of 34 a clerical nature in the office of a club or providing an application 35 to a potential club member. 36 (d) ‘Insurance service’ means any act by a club to sell or 37 furnish to a member insurance benefits, including, but not limited 38 to, accidental injury and death benefits when the insurance is 39 issued only by an insurance company duly authorized to do 40 business in this State. 41 (e) ‘Motor club service’ means the rendering, furnishing, or 42 procuring of, or reimbursement for, any of the following: towing

[4633] 2 1 service, bail and arrest bond service, emergency road service, 2 claim adjustment service, legal service, theft service, map service, 3 emergency travel expense service, community traffic safety 4 service, license service, merchandise and discount service, travel, 5 touring, and travel information service, guaranteed hotel/motel 6 rates service, new car pricing service, financial service, check 7 cashing service, personal property registration service, credit card 8 service, and insurance service, but does not include supplying 9 services through a telematics system and buying and selling 10 service to any member of the club. 11 (f) ‘Service contract’ means any written agreement whereby 12 any club, for a consideration, promises to render, furnish, or 13 procure for any member a motor club service. 14 (g) ‘Telematics system’ means vehicle equipment that employs 15 global positioning systems and wireless communications systems 16 to collect and deliver information or services to and from a motor 17 vehicle.” 18 19 SECTION 2. This act takes effect upon approval by the 20 Governor. 21 XX 22
