Please Find Below Grievance Wording Reflecting Various Scenarios in Which You Should Identify

You have or will soon receive the National Model Work Description for your position. Your work description should also be accompanied by a point rating allotted by factor to your position, as well as a copy of the organization chart depicting your position’s place in the organization. You should also receive the notice of classification for your revised work description.

Please find below grievance wording and other information reflecting various scenarios in which you should be able to identify your situation.

SCENARIO 1

If you are not in agreement with the revised work description for your position

This scenario applies if you do not believe that the revised work description is complete and current, i.e. if the employer is requesting that you perform duties, which are not in the revised work description. You will have to provide a list of the missing duties and demonstrate that the performance of these duties is at the request of the employer.

Please note the Employee’s statement on the signature page of your work description, which reads: “I have been given the opportunity to read and comment on the content of this work description.” You can sign the statement and add that you are not in agreement with the content of your work description or that you are signing it under duress. Some of you might also refuse to sign it altogether.

Three (3) grievances must be filed at the same time : work description, classification and acting pay.

Work Description grievance

Timelines: You have twenty-five (25) working days after you receive your work description to file a statement of duties grievance.

Wording

“I grieve the employer’s failure to provide me with a complete and current statement of duties and responsibilities. This violates article ___ (Statement of Duties) of my collective agreement.”

Corrective action requested “That the additional duties reflecting my work be added to my work description. To be made whole.”

The following documentation will have to be provided to your UCTE Union Representative prior to the grievance being heard, but not necessarily at the time your grievance is filed.

 The contested work description;  The list of missing duties;  Evidence that the performance of the missing duties is at the request of the employer.

DO NOT ATTACH THE LIST OF MISSING DUTIES TO YOUR GRIEVANCE FORM.

Classification grievance

Timelines: When a classification grievance is presented at the same time as a work description grievance, the classification grievance is put on hold pending the outcome of the work description grievance. If the work description remains unchanged, the classification grievance is reactivated. If the work description is modified, a new classification decision will be issued and a new classification grievance will have to be filed within thirty-five (35) calendar days.

Wording

“I grieve the classification of my position.”

Correction action requested

“That my position be classified upwards. To be made whole.”

The following documentation must be provided to your UCTE Union Representative prior to the file being sent to the PSAC Representation Section. Please note that classification grievances are assessed by a PSAC Grievance & Adjudication Officer who specializes in classification matters:

 Your official work description;  The current classification group and level;  The current point rating by factor and rationale;  The current organization chart;  Additional information you deem useful (e.g. the classification group and level of your supervisor’s position and applicable work description). Acting Pay grievance

Timelines: When an acting pay grievance is filed at the same time as a work description and classification grievance, the acting pay grievance will be put on hold until the outcome of the classification grievance is known and a classification decision is rendered.

Wording

“I grieve that the employer is not paying me appropriately for the duties I am performing. I am asked to perform duties of a higher position. As a result, the employer is not following the provisions of Article __ (Pay Administration) of my collective agreement.”

Corrective action requested

“That I be paid in accordance with my collective agreement for the performance of the duties mentioned above, retroactive to the date on which the performance of these duties began. To be made whole.”

The following documentation must be provided to your UCTE Union Representative prior to the grievance being heard:

 Your former work description;  Your complete and current work description;  The classification evaluation (rationale) with the effective date;  Examples and evidence from you demonstrating when you began to perform the duties in the complete and current work description.

SCENARIO 2

If the revised work description for your position is complete and current, but you are not in agreement with the classification level related to it

Please note that if you are not contesting the content of the work description, your classification grievance will be considered valid even if the work description is not signed by you.

Also, your classification grievance will be considered valid, should you choose not to sign the notice of classification for your position.

Two (2) grievances must be filed: Classification and acting pay. Classification grievance

Timelines: You have thirty-five (35) calendar days after you receive the notice of classification for your position to file a classification grievance. There is only one level for classification grievances, the final level. The grievance should be presented to your immediate supervisor or local officer-in-charge.

Wording

“I grieve the classification of my position.”

Correction action requested

“That my position be classified upwards. To be made whole.”

Timelines: When an acting pay grievance is filed at the same time as a classification grievance, the acting pay grievance will be put on hold until the outcome of the classification grievance is known and a classification decision is rendered.

Wording

“I grieve that the employer is not paying me appropriately for the duties I am performing. I am asked to perform duties of a higher position. As a result, the employer is not following the provisions of Article 65 (Pay Administration) of my collective agreement.”

Corrective action requested

“That I be paid in accordance with my collective agreement for the performance of the duties mentioned above, retroactive to the date on which the performance of these duties began. To be made whole.”
