CALL TO ORDER
Chair Hartzell called the meeting to order at 7:00 p.m. Roll call was taken.
I. CONSENT AGENDA ITEMS
Minutes Dated: 1. February 14, 2017
Commissioner Callahan made a motion to approve the consent agenda. Commissioner Hungerford seconded the motion.
Roll Call Vote: Ayes from Commissioners Hartzell, Callahan, Smelser, King, Hungerford & Brumester. The motion was passed with a unanimous vote.
II. CPA-01-17/LDC-01-17/LDC-02-17 SUNTREE, INC REZONE & LDC AMENDMENT
Chair Hartzell read the hearing script in to the record. He asked the Commissioners for any Declarations of Exparte Contact, Bias or Conflict of Interest.
None Declared
Chair Hartzell asked the audience if there are any challenges to any Commissioners Exparte Contact, Bias or Conflict of Interest.
None Challenged

Steve Koper, Planning Manager, made the following comments: Requesting a comprehensive plan / zoning map amendment Showed the vicinity map of the site 8.1 acres located on the SW corner of Sunnyside Rd and 169th Showed existing and proposed zoning maps The surrounding area makes the zone change appropriate and well supported Showed a conceptual plan of the self-storage building with climate control this concept is internal as opposed to other self-storage developments. Showed the proposed LDC text amendment for this application – the text amendments limit it to this specific site only – it is very defined Compared the existing CCC zoning against the proposed MCC zoning for trip counts – this change would lover the number of trips Staff recommends approval The limitation of the zone is 6 Commissioner King asked why is the text specific to this site o The property was first zoned with the EHVCP and then rezoned to the current CCC – with the poor site visibility and the right in-right out limitation the zoning isn’t feasible to CCC No additional correspondence were received
AKS Engineering – Joey Sheer 12965 SW Herman Rd #100 Tualatin, OR 97062
Mr. Sheer gave the following comments: Thanked staff for their assistance and hard work on this application Agree with the findings and conditions of the staff report Three property owners have come together for maximizing the properties totaling over eight acres The site faces physical constraints with slopes, creeks and conservation easements There is limited access and visibility with the usable frontage short and close to the intersection The zone change is from CCC to MCC The MCC zoning added flexibility to help mitigate some of the challenges of the site and help allow buildability of the site Applicant supports the clarification to the text made by staff The site would unlikely be able to accommodate the onsite parking that other uses would require due to low trip generation This will allow for an upscale self-storage building ideally suited for this site and brings another business to the city This is a needed service for both businesses and residents This site would have low traffic use, doesn’t drain emergency services and would build part of the Scouters Mtn regional trail connection Agree with the staff and finding and request recommendation of approval to the City Council

Mr. Schroedl made the following comments: Is in favor of this development Is concerned about the safe access to school and sidewalks Will this be an ADA public sidewalk
Richard Dent 13245 SE 169th Happy Valley, OR 97086
Mr. Dent made the following comments: Live on the corner of 169th and Sunnyside Rd If he were to develop his property would his access be affected with this zone change o Steve Koper stated that this application would not affect his current access – if he were to develop his property he would be required to close the current access and take access thru the site – would have to relocate his current access Would he be able to withdraw his application before the city council were to approve it o Yes, you can withdraw your application any time prior to a city council approval
AKS Engineering – Joey Sheer 12965 SW Herman Rd #100 Tualatin, OR 97062
Mr. Sheer made the following comments: There is currently and existing sidewalk on Sunnyside Rd – once a specific development is started then sidewalks would be defined and required to meet city requirements 169th is a private road and would have improvements and ADA sidewalks The existing access to 169th isn’t affected by the zone change – it would be defined by any future development Not sure what the developer has for future plans on this site It is an asset to the city to have the Mt Scott Regional Trail built
Chair Hartzell continued reading the hearing script into the record. Chair Hartzell asked the applicant if they would like to waive the seven (7) days allowed to include additional data to the Planning Commission.
The applicant does wish to waive the seven (7) days.
Public testimony closed at 7:38p.m.
Planning Commission continued with the following discussion: Like the use for this site – the marketing analysis is on the spot Love the mixed use of the site Low traffic impact is good Don’t see any downsides The City’s Engineer has a conditioned this with a trip cap and limits future trip potential to the site
Commissioner Hungerford made a motion to recommend approval of CPA-01-17/LDC-01-17/LDC-02-17 Suntree, Inc Rezone & LDC Amendment, to the City Council. Commissioner Callahan seconded the motion. City of Happy Valley Planning Commission Minutes July 11, 2017 Page 4 of 4

Commissioner King made a motion to adjourn the meeting. Commissioner Callahan seconded the motion.
