AIRWORTHINESS DIRECTIVES, MODIFICATIONS AND REPAIRS

1. GENERAL

1.1 This chapter prescribes the requirements for approval of modifications and repairs to aircraft, and procedures to be followed in respect of Airworthiness Directives.

1.2 An aircraft type is defined by its Type Certificate plus any relevant Supplemental Type Certificates. Any alteration of the aircraft as defined in its Type Certificate data is a modification. For a modification stated and received from the type certificate holder or equivalent (FAA 21/EASA 21) organization shall be subjected for CAAN approval before any modification can be embodied.

1.3 In the interest of safety, the Director General may order that an aircraft or aircraft component be modified or receive special inspections. Such orders are Airworthiness Directives and compliance is mandatory. The Director General shall, upon receipt of Mandatory Continuing Airworthiness Information from the state of design and/or designated contracting states, adopt the mandatory information directly or assess the information received and take appropriate action.

1.4 Any Modification or alteration on aircrafts or components received from Type certificate holder or manufacturer is acceptable to CAAN and such modification may not need approval from CAAN.

1.5 An aircraft which suffers a defect or damage may be repaired necessary to restore its Airworthiness. An aircraft that suffers any structural damage shall be only repaired by structure repair specialist properly authorized by CAAN. If structure damage is beyond 6 inches in dimension the organization has to provide all the details of the damage including repair scheme from the type certificate holder or approved equivalent organization for approval from CAAN. If the repair is covered in structural repair manual and is subjected for removal and replacement of complete structural parts can be repaired only by qualified and authorized structural

personnel.

2. AIRWORTHINESS DIRECTIVES

2.1 The organization shall ensure effective tracking system to ensure that they are receiving all the applicable Airworthiness Directives and other mandatory publication of the affecting aircraft which are issued by: a)The CAAN in case of local special conditions for safety, The Airworthiness Authority of the State in which the aircraft was manufactured. b)The effectivity of the airworthiness directives that are received from state of type certificate holder is mandatory on which basis the type certificate validation has been issued by CAAN.

Note: It is also advisable to receive and study Airworthiness Directives relevant to the aircraft issued by other States in which the aircraft type is operated and may be complied upon the evaluation as in operators exposition.

3. APPROVAL OF MODIFICATIONS

All modifications and repairs shall comply with airworthiness requirements acceptable to CAAN

3.1 An aircraft modification may be mandatory, i.e. prescribed by an Airworthiness Directive or may be optional. Both mandatory and optional modifications may be embodied only in accordance with approved data. Data specified in paragraph 3.2 are hereby approved by the Director General; paragraph 3.3 prescribes the procedure for obtaining approval of other data.

3.2 The following data are approved by the Director General for the modification or repair of aircraft or aircraft components. Subject to compliance with the applicability, limitations and conditions prescribed in this data, no further approval is required when applying it to the modification or repair of aircraft.

a)Instructions given by the manufacturer of the aircraft or aircraft component in the maintenance, overhaul or repair manual for the aircraft or component type or in Service Bulletins or equivalent documents. b)Airworthiness Directives (or equivalent mandatory orders) issued by the Airworthiness Authority of the State of Manufacture of the aircraft or aircraft component, if these give specific instructions for modification or repair. 3.3 For the approval of modification data other than that given in paragraph 3.2, the following procedure must be followed:

a)An application for approval must be made to the CAAN. A modification approval may be granted if the Director General is satisfied with the following conditions. i) proposed modification has supplemental Type Certificate (STC). ii) proposed modification in connection with the submitted STC must have concurrence/ references from the manufacturer/ state of manufacturer. iii) operator has made an arrangement either from own source or by contracting for the compliance of the proposed modification. Approval may be granted to an organization for compliance on proposed modification only if the STC holder has issued its consent or No Technical Objection. b)The application must be accompanied by detailed drawings and other technical data adequate to define completely the proposed modification. 3.4 If the embodiment of the modification or repair will affect the data in the Flight Manual or the approved Maintenance Schedule or Operator's Maintenance Procedure Manual, proposed amendments to these documents shall be submitted with the application for approval.

3.5 If any tests or inspections, including flight tests, are required to show compliance with the Airworthiness design standards, the Airworthiness Inspection Division shall be notified in advance with a written request to depute an authorized person and be provided with the opportunity to witness or participate in the tests as he may require.

3.6 If approval of a modification necessitates arranging for investigations or tests to be made either inside or outside of Nepal, the applicant for approval shall be responsible for any costs involved in performing the investigation or tests and shall indemnify the Director General and his staff against accident and damage, including damage to third parties, arising from the tests.
