On motion of Mr. , seconded by Mr. , the following resolution was offered: RESOLUTION NO. A resolution authorizing the Planning Department and the Planning Advisory Board to conduct a text study of Chapter 25 Planning and Development, Article VI Comprehensive Plan, Chapter 33 Unified Development Code, and Chapter 40 Zoning of the Jefferson Parish Code of Ordinances, with the intent of creating definitions, standards, and regulations for health care facilities, including but not limited to clinics, ambulatory surgery centers, and urgent care centers and amending zoning districts as appropriate; to conduct a zoning and future land use study with the intent of amending the official maps as appropriate to maintain consistency between zoning and land use; to establish interim development standards during the study; and to provide for related matters. (Parishwide) WHEREAS, clinics, ambulatory surgery centers, and urgent care centers are currently allowed in the GO-2, GO-1, H-1, H-2, BC-1, C-1, BC-2, C-2, and MUCD zoning districts under the broad clinic definition; and WHEREAS, ambulatory surgery centers and urgent care centers are currently not defined in Chapter 40 Zoning and by interpretation are considered clinics if they do not provide overnight lodging or hospitals if facilities for overnight stay are provided; and WHEREAS, the H-1 and H-2 Medical Service Districts allow medical uses and medical supportive uses including clinics, hospitals, medical offices, nursing homes, and assisted living facilities and are the designated healthcare-related zoning districts in Chapter 40; and WHEREAS, greater clarity of health care facilities, what services they provide, and where they are appropriately located may be needed because of the differences in the urgency of conditions treated, the type or seriousness of the procedures performed, and the proximity to certain services and uses; and WHEREAS, a study of both zoning text and maps is necessary to determine if any changes are needed in how the zoning code and map address health care facilities; and WHEREAS, interim zoning regulations are needed to provide clarification and ensure that standards are in place that support the intent of the study. NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council, Jefferson Parish, Louisiana, acting as governing authority of said Parish: SECTION 1. That the Planning Department and the Planning Advisory Board are hereby authorized to conduct a text study of Chapter 25 Planning and Development, Article VI Comprehensive Plan, Chapter 33 Unified Development Code, and Chapter 40 Zoning of the Jefferson Parish Code of Ordinances, with the intent of creating definitions, standards, and regulations for health care facilities, including but not limited to clinics, ambulatory surgery centers, and urgent care centers and amending zoning districts as appropriate; to conduct a zoning and future land use study with the intent of amending the official maps as appropriate to maintain consistency between zoning and land use; to establish interim development standards during the study; and to provide for related matters. SECTION 2. That interim development standards are hereby in effect that establish the following definitions: Ambulatory surgery center shall mean a health care facility where same-day surgical procedures are performed that do not require overnight stay and at least one dedicated operating room is provided; also known as outpatient surgery center or same- day surgery center. Clinic shall mean an establishment, not including an ambulatory surgery center or urgent care center, used by physicians, surgeons, dentists, physiotherapists, psychiatrists, or practitioners in related specialties where patients who are not lodged overnight are admitted for examination and treatment. Urgent care center shall mean an outpatient health care facility designed to evaluate and treat conditions that generally are not severe enough to require treatment in a hospital emergency room but still require immediate treatment usually beyond normal physician office hours or before a physician appointment is available. SECTION 3. That interim development standards are hereby in effect that allow an ambulatory surgery center or an urgent care center only in the H-1 Medical Service District (Article XVII) or H-2 Medical Service District (Article XVIII) and subject these uses to the parking requirement for clinics in Sec. 40-662. SECTION 4. The interim development standards set forth in this resolution are in accordance with and by the authority of Sec. 33-2.23 and Sec. 40-880 of the Jefferson Parish Code of Ordinances providing, in pertinent part, that when a zoning or land use study has been initiated by resolution of the Jefferson Parish Council and pending final disposition of said amendment, supplement, change, zoning or land use study, the Council may establish interim development standards or invoke a moratorium on the issuance of certificates of use and occupancy or building permits for a building, structure or occupancy which would be prohibited by passage of the proposed amendment, which shall be in effect for twelve (12) months and may be extended by the Council for not longer than one (1), six (6) month period. SECTION 5. That the Council Chairman or in his absence the Vice-Chairman be and is authorized to execute any and all documents necessary to give full force and effect to this resolution.
