2 Tenders will be issued to eligible contractors provided they produce definite proof of valid registrations from an appropriate authority not below the rank of Executive Engineer. 3. While applying for issue of Tender documents, Contractor(s) shall submit attested copies of registration certificate, along with attested copies of partnership deed duly registered in court (wherever contractor is a partnership firm), attested copies of memorandum of article of associations duly registered in court (wherever contractor is company), attested copy of power of attorney duly registered in court (wherever contractor is power of attorney holder The written application for issue of tender forms in prescribed format (tender application form available free of cost) shall be received in the above office up to the time and date specified above in Para 1.VI and tenders will be sold to eligible contractors on payment of cost of tender papers (as mentioned in Para 1.X) on or before the time and date as mentioned above in Para 1.VII. The tender fee is not refundable and is payable in the form of Demand Draft / Bankers Cheque payable at Bhubaneswar only drawn on any Nationalized Bank / Scheduled Bank (guaranteed by R.B.I) in favor of Account officer, BSNL Civil Division Bhubaneswar or in cash to SDE(C), BSNL Civil sub-Division, Koraput 4. Completed tenders will be received in the office of the Sub-Divisional Engineer,BSNLCivilSub- Division,Koraput on the date as mentioned in Para 1. VIII above up to 15:00hrs and will be opened at15:30 Hrs on the same date as mentioned above in Para 1.IX in presence of the intending contractors or their authorized representatives. 5. The Earnest Money in full shall be deposited by the Contractors by cash or in the form of Receipted Treasury Challan / Deposit at Call Receipt / Demand Draft issued by any Nationalized Bank /Scheduled Bank (Guaranteed by R.B.I) payable at Bhubaneswar only and drawn in favor of the Accounts officer, BSNL Civil Division, Bhubaneswar along with the tender documents.. 6. While submitting the tender bids, Tenderers shall submit Earnest Money Deposit in a sealed envelop of small size marked as “A : EARNEST MONEY” and the tender documents in the second envelop marked as “B: TENDER” and both these envelops shall be put and submitted in a third sealed cover , The Name of work , Estimated cost put to tender , and the date of opening , Name of the contractor with address etc shall be clearly indicated on all the three envelops properly by the contractors. While opening the tenders by the Sub-Divisional Engineer, envelop marked A shall be opened first and incase the EMD is not found in the proper and prescribed form, envelop B of the Tender shall not be opened and such tender shall be summarily rejected. 7. Tenders of contractors who do not deposit Earnest Money in the above manner and shape are liable to be rejected. 8. The tender papers shall not be issued by post. 9. It may be noted that conditional tenders or tenders with conditional rebates shall be summarily rejected. 10. If any of the above mentioned date happens to be closed holiday the same activity will be carried forward to the next working day. 11. Page 3 of 26 NIT & Application for participation in tender (I) Click the “Tender File” of the respective work to download the Tender Documents Part-I, which consists of (a) NIT (b) BSNLW-6 (c) BSNLW-8 (d) Additional conditions and specifications (e) Special conditions if any and (f) Schedule of quantities etc. (II) The rate can be quoted on down loaded Scheduled in Part –I which shall be submitted in the office of the Sub-Divisional Engineer I, BSNL Civil Sub- Division Koraput. (III) The general condition of contract in NIT Part-II is available at the office of S.D.E. (C) BSNL Civil Sub- Division Koraput. (This is optional only. This part is not required to be submitted with tender documents. However the conditions and general terms as per the copy available in the office of the Sub- Divisional Engineer©, BSNL Civil Division Koraput will form part of agreement subsequently) (IV) Mode of payment of Tender Cost /EMD/and submission of tender for down loaded tender forms. The tender shall be submitted in four sealed envelopes as below: (a) The first sealed envelop should contain the tender cost as per para 4 above along with pre-qualification documents as per para 2&3 above. (b) Second sealed envelope should contain EMD in the required format as detailed in para-6 above. (c) Third sealed envelope should contain tender document as downloaded duly quoted (Part I only). All the three envelopes should be clearly marked about the contents i.e. Marked C Tender Applications and tender cost (Envelope No.1) Marked E EMD (Envelope No.2) Marked T Tender Documents (Part .I) duly filled up (Envelope No.3) (d) All the above three sealed envelopes will be sealed in fourth envelope for submission. All envelopes should be marked “e-Tender” with name of work and the name of Agency written on them.

The duly filled in “e-Tenders” shall be received as per date and up to specified time as per para 1.VIII and as per Para 5 as mentioned above. At the time of opening of tender, envelope No.1 (Tender Application and tender cost Marked C) as stated above shall be opened and the eligibility and tender cost asked for, shall be checked. If found ineligible, the EMD marked E (Envelope 2) and financial bid document (Envelope No.3) Marked T shall not be opened. Tender cost shall be non-refundable; however the EMD of ineligible bidders shall be refunded. If found eligible then the envelope No-2 Marked E will be opened, if the EMD deposit is not as per the details in para 6 above the envelope No.3 Marked T (Financial bid) will not be opened and the tender shall be rejected summarily. The prospective tenderers are advised to seek any clarification from Sub-Divisional Engineer about eligibility conditions (Para 2 above) prior to submission of tenders to avoid disappointments letters on. BHARAT SANCHAR NIGAM LIMITED (A Govt Of India Enterprise) NOTICE INVITING TENDER 1.0 Wax sealed item rate tenders are invited for and on behalf of the B.S.N.L. from approved & eligible contractors of B.S.N.L (Civil wing) for the work of Refer NIT para 2, column II).

1.1 The work is estimated to cost Rs(refer NIT, Para 1, Col III) This estimate, however, is given merely as a rough guide. 1.2 Tenders will be issued to eligible contractors provided they produce definite proof from the appropriate authority not below the rank of Executive Engineer, of having satisfactorily completed requisite number of works of magnitude as specified in brief NIT. It is clarified that the works done for Central Government / State government / PSU shall only be considered for eligibility.

Criteria of eligibility for issue of tender documents: -(refer NIT also for additional condition) 1.3 Deleted. 1.4 Deleted.

2 Agreement shall be drawn with the successful tenderer on prescribed Form No. B.S.N.L. W-8, which is available as a B.S.N.L. Publication, Tenderer shall quote his rates as per various terms and conditions of the said form which will form part of the agreement.

3 The time allowed for carrying out the work will be as per para 1, Col V, from the fifteenth day or as mentioned in the award of work (whichever is less) day after the date of written order to commence the work.

4 The site for the work is available. The tenderer should fully satisfy himself about the approaches and leads etc. to the site, constraints etc. in the availability of space at or around the work site for storing of construction materials, equipment, manpower, labourers etc. and should quote his tender accordingly.

5 The last date of receipt of applications for issue of tender forms & date of issue of tender forms will be as follows : Last date of receipt of application (with enclosures): - (refer NIT, para 1.VI) Last date of issue / sale of tender forms: - (refer NIT, Para 1.VII)

6 Tender documents consisting of plans, specifications, the schedule of quantities of the various classes of work to be done and the set of terms and conditions of the contract to be complied with by the contractor whose tender may be accepted and other necessary documents can be seen in the office of the Sub-Divisional Engineer(C), BSNL Civil Sub-Division, Koraput between 11:00 hrs. & 16:00 hrs. everyday except on Sundays and Public Holidays. Tender documents, excluding standard form, will be issued from his office, during the hours specified above, on payment of Rs.(refer NIT, para 1.X & para 4) in cash or Crossed Indian Postal Order / Money Order in favour of Accounts Officer BSNL Civil Division, Bhubaneswar and payable at Bhubaneswar only.

7 Tenders which should always be placed in sealed envelop, with the name of work & due date written on the envelopes, will be received by the Sub-Divisional Engineer(C), BSNL Civil Sub-Division, Koraput upto 15:00 hrs on date (refer brief NIT, para 1. VIII) and will be opened by him or his authorized representative in his office on the same day at 15:30 hrs. The tender shall be accompanied by Earnest Money of Rs.(refer brief NIT, para 1.IV & para 6) in form of Demand Draft / Deposit at Call Receipt of a Scheduled Bank guaranteed by R.B.I. issued in favour of Accounts Officer, BSNL Civil Division, Bhubaneswar and payable at Bhubaneswar only. The Earnest Money shall be placed in separate sealed envelop annexed with the envelop containing the Earnest Money shall be opened first. The tenders of tenderers, who do not deposit & place the Earnest Money in the prescribed form & manner, shall be summarily rejected.

Additions Corections: Deletions: Over-writings:- Ommisions: - Contractor EE(C) NIT Part-I, page no 7 8 The description of the work is as follows: (refer NIT para 1 column II) IX.1 Copies of other drawings and documents pertaining to the work will be open for inspection by the tenderers at the office of the above-mentioned officer. IX.2 Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves before submitting their tenders as to the nature of the ground and sub-soil (so far as is practicable), the form and nature of the site, the means of access to the site, the accommodation they may require and in general, shall themselves obtain all necessary information as to risks, contingencies and other circumstances which may influence or affect their tender. A tender shall be deemed to have full knowledge of the site whether he inspects it or not and no extra charges consequent on any misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and maintaining at his own cost all materials, tools & plants, water, electricity, access, facilities for workers and all other services required for executing the work unless otherwise specifically provided for in the contract documents. Submission of a tender by a tenderer implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the work to be done and of conditions and rates at which stores, tools and plant, etc. will be issued to him by the Government and local conditions and other factors having a bearing on the execution of the work.

10 The competent authority on behalf of the B.S.N.L. does not bind himself to accept the lowest or any other tender, and reserves to himself the authority to reject any or all of the tenders received without the assignment of any reason. All tenders in which any of the prescribed conditions is not fulfilled or any condition including that of conditional rebate is put forth by the tenderer, shall be summarily rejected.

11 Canvassing whether directly or indirectly, in connection with the tenders, is strictly prohibited and the tenders, submitted by the contractors, who resort to canvassing, will be liable to rejection.

12 The competent authority on behalf of B.S.N.L. reserves to himself the right of accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted.

13 The Company or firm or any other person shall not be permitted to tender for works in BSNL Civil Zone in which his near relative (S) (directly recruited or on deputation in BSNL) is / are posted in any capacity either non-executive or executive employee. Near relative (S) for this purpose is / are defined as: - (i) Member of Hindu Undivided family (HUF). (ii) They are Husband and wife. (iii) The one is related to other in the manner as father, mother, son(s) & son’s wife (daughter –in-law), Daughter (s), Daughter’s husband (son-in-law), brother (s), brother’s wife, sister (s), sister’s husband (brother-in-law).

The contractor shall also intimate the names of persons who are working with him in any capacity or are subsequently employed by him and who are near relative to any executive / gazetted officer in the BSNL or Department of Telecom or in the Ministry of Communications.

All the intending tenderers will have to give a certificate that none of his / her such near relative (s) as defined above is / are working in the concerned BSNL Civil Zone where he is going to apply for tender / work. The format of the certificate is to be given as “I, ______s/o Shri______Resident of ______here by certify that none of my relative (s) as defined above is / are employed in concerned BSNL Civil Zone. In case at any stage, it is found that the information given by me is false / incorrect, BSNL shall have the absolute right to take any action as deemed fit without any prior intimation to me”.

Name of Contactor : - Signature of Contactor The certificate in case of proprietorship firm shall be given by the proprietor; for Partnership Firm, certificate shall be given by all partners and in case of Limited Company, by all Directors of the company. However, Government of India / Financial Institutions nominees and independent non-official part time Directors appointed by Govt. of India or the Governor of the State are excluded from the purview of submission of this certificate while submitting tenders by Limited Companies.

Any breach of these conditions by the Company or Firm or any other person, the tender/work will be cancelled and Earnest Money / Security Deposit will be forfeited at any stage, whenever it is so noticed. The department will not pay any damages to the company or firm or the concerned person. The Company or firm or the person will also be debarred for further participation in the tender in the concerned BSNL Civil Zone. Further, any breach of this condition by the tenderer would also render him liable to be removed from the approved list of contractors of this Department. If however the contractor is registered in any other Department he shall also be debarred from tendering in BSNL for any breach of this condition.

14 No Engineer of gazetted rank or other Gazetted officer employed in Engineering or Administrative duties in an Engineering Department of the Government of India is allowed to work as a contractor for a period of two years after the date of his retirement from Government service, without previous permission of the Government of India in writing. The contract is liable to be cancelled if either the contractor or any of his employee is found any time to be such a person who had not obtained the permission of the Government of India as aforesaid before submission of the tender or engagement in the contractor’s service.

16 The tender for the work shall remain open for acceptance for a period (60) sixty days from the date of opening of the tenders. If any tenderer withdraws his tender before the said period or makes any modifications in the terms and conditions of the tender which are not acceptable to the BSNL, then the BSNL shall, without prejudice to any other right or remedy, be at liberty to forfeit 50% of the earnest money as aforesaid.

17 The successful tenderer shall be required to execute an agreement with the Engineer-in-charge in the Performa annexed to the tender document, within 15 days of issue of letter of acceptance by the B.S.N.L. in the event of failure on part of the successful tenderer to sign the Agreement, the earnest money will be forfeited and the tender cancelled.

18 This Notice inviting Tender (B.S.N.L.-6) shall form a part of the contract document. The contract shall be deemed to have come into effect on issue of communication of acceptance of the letter in favour of the successful tenderer /contractor. On such communication of acceptance, the successful tenderer /contractor shall, within 30 days from such date, formally sign the agreement consisting of :-

a) The notice inviting tender, all the documents including additional conditions, specifications and drawings if any, forming tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto. b) Standard B.S.N.L. W.-7/8 c) Agreement signed on non-judicial paper as per Performa annexed to the to the tender document. 19 First running account bill shall be paid only after signing of the agreement / contract by both the parties.

20 For Hindi version of BSNL W 6 & 8 please refer Tender part two document. For all corrections please refer to English version only. In case, there is any difference or ambiguity in any of the provision of BSNL W-6 & 8 in Hindi version and English version, English version shall prevail and shall be final and binding on NIT

SPECIFICATIONS AND CONDITIONS

Name of work: Refer NIT.

(I) General :

(1) The work shall in general conform to the relevant specifications of the CPWD specifications for works 1996 (All Volume) corrected vide up to date correction slip.

(2) Should there be any difference between the specifications mentioned above and the specifications given in the schedule of quantities, the latter shall prevail.

(3) If the specification for any item are not available in the CPWD specification cited above relevant BIS specification should be followed.

(4) In case BIS specification are also not available, the decision of Engineer-in-charge given in writing based on acceptable sound engineering practice and local usage shall be final and binding on the contractor.

Additions Corections: Deletions: Over-writings:- Ommisions: - Contractor EE(C) NIT Part-I, page no 15 (5) The work will carried out in accordance with the architectural drawing and structural drawings to be issued by the Engineer-in-charge. The structural and architectural drawing shall have to be properly corrected before executing the work. In case of any difference notice between Architectural and Structural drawings, the contractor shall obtain the decision in writing of the Engineer-in-charge. For items where so desired samples shall be prepared before starting the particular item of work for approval of the Engineer-in-charge and nothing extra shall be payable on this account.

(II) The following modifications to the above specifications shall however apply: -

(1) EARTH WORK: -

(a) Surplus excavated earth which is beyond the requirement of the BSNL shall have to be disposed off by the contractor at his own cost after obtaining written permission of the Engineer-in-charge and no payment will be made by the Department for disposal of surplus excavated earth.

(b) The contractor shall, at his own expense and without extra charge, make provision for all shoring, pumping, dredging or bailing out water if necessary. The foundation trenches shall be kept free from water while all the works below ground level are in progress, without any extra payment. The water may be coming from any source.

(2) PLAIN CEMENT CONCRETE AND REINFORCED CEMENT WORK: -

(a) Stone Aggregate :-

Stone aggregate used in the work shall be hard broken stone to be obtained from approved source (quarries) at ______and shall conform to the relevant provisions in the C.P.W.D. Specifications 1996 (Vol.II) as mentioned in para (I) above. (b) Coarse Sand :- Coarse sand used in the work shall be obtained from approved source at ______and conform to relevant provisions in the specifications 1996, vol.II as mentioned in para-I (1) above as per grading zone-III in case of RCC Work & Brick Work and grading zone-IV for plastering.

(c) Fine Sand :-

Fine sand used in the work shall be obtained from approved source at ______and shall conform to the relevant provisions in the CPWD Specifications 1996 (Vol. II) as mentioned in para I (1) above as per grading zone IV. In case sand available at above source does not conform to the required specifications coarse sand shall be fixed in it to the required specifications. Nothing extra shall however be paid for it.

NOTE: -

Where only one variety of sand is available, the sand will be served for use in finishing work, as directed by the Engineer-in-charge, in order to obtain smooth surface and nothing extra will be paid on this account.

(d) Sand for filling in plinth :

The sand for filling in plinth under floor shall be obtained from approved source at ______and shall conform to clause-2.22.1 of CPWD Specifications-1996.Vol. I.

(3) Brick Work :-

Brick used in the work shall be FPS to be obtained from approved kilns at ______. They shall be well burnt and shall have a compressive strength of not less than ______Kgs./Sq. cm. and water absorption percentage of not more than 20% of its dry weight when immersed in the water for 24 hours. In all other respects they shall conform to the bricks of class designation provisions in CPWD Specifications for works 1996 (vol. II) with up to date correction slip.

Stone used in stone masonry work shall be hard granite / basalt / quartz stone / sand stone obtained from approved quarry at ______and shall conform to the relevant in the CPWD specification-1996. Vol- II as mentioned in para –I (1) above.

(5) Wood Work :-

Timber required for manufacture of chowkhats / Frames and shutters for doors, windows, ventilators, partitions etc. in the work shall be Kiln seasoned and preservative treated. The moisture content of the wood used in the work shall not be more than that stipulated in the clause of CPWD specification for works 1996 (vol. III) as mentioned in para I (1). The rate quoted for various items shall be inclusive of Kiln seasoning and preservative treatment of wood. In other respects the wood used in the work shall conform to the provisions in specifications-1996 Vol. III as mentioned in para-I (1) above.

(6) Steel Work :-

6.1. All steel doors, windows, steel ventilators, steel glazing, steel grill and pressed steel frames shall be according to the Architects detailed drawings and obtained from approved supplier. These shall conform to C.P.W.D. Specifications for works 1996 (vol. III) as mentioned in para I (1) above. In the case of composite steel windows the rates shall include the cost of coupling mullions and transom etc. The process of welding adopted shall be flash butt welding.

6.2. Where windows with inside openable shutters are fixed along with windows with shutter openable outside, such inside openable windows shall be fitted with suitable friction hinges level handles or otherwise as approved by the Engineer-in-charge of the work. For such windows, cement concrete blocks of size 15cm x 23cm x 10cm shall be provided in place of 2 nos. of 15cm x 10cm x 10cm blocks. Nothing extra shall be paid on this account.

6.3. In case of steel windows and doors, steel glazing, steel ventilators, rolling shutters, grill etc. approved quality priming coat of zinc chromate primer shall be applied over and above a shop coat of primer nothing extra shall be payable for providing shop coat primer.

(7) Flooring:-

Cast-in-situ mosaic flooring, plain cement concrete flooring, precast terrazzo tiles, Kota stone flooring and precast cement chequered tiles flooring shall be done as per C.P.W.D. Specification for works 1996 (all volume) as mentioned in para I (I).

7.01. Abrasion test for Terrazzo tiles: -

When the terrazzo tiles are tested in the manner specified in the CPWD specifications 1996 average wear shall not exceed 15mm and wear on any individual specimen shall not exceed 4mm.

7.02. Rate for the items of flooring is inclusive of provision of sunk flooring and finishing of edges of the same in bath, kitchen, toilets etc. and nothing extra shall be paid on this account unless otherwise specified.

7(a) Water Supply and Sanitary Installations.

All the G.I. pipes and S.C.I. soil pipes shall be I.S.I. marked. In case I.S.I. marked materials are not available, the best available material in the market shall be used after obtaining written approval of the Engineer-in-charge.

(8) SAMPLE OF MATERIALS

8.1. Sample of all materials and fixtures such as doors, windows, mosaic etc., Sanitary, Water supply, drainage fittings, and fixtures shall be submitted well in time and got approved from the Engineer-in-charge of work in writing before placing orders for entire quantity required for completion of work.

Additions Corections: Deletions: Over-writings:- Ommisions: - Contractor EE(C) NIT Part-I, page no 17 8.2. Approval of sample work of repetitive/typical nature prior to general execution of work shall be as enumerated hereafter.

(a) Samples of typical portion of works of repetitive nature such as typical room, toilet room or any other work desired by the Engineer-in-charge of the work shall be prepared by the Contractor under the directions and to the satisfaction of the Engineer-in-charge and got approved from him in writing before commencement of these items for the entire work.

(b) The works shall be so arranged to be carried out that the requirements for preparation of samples are observed and fulfilled without any detriment to the general progress of work. In other works, this will not be allowed to have any effect on the general progress of work or on any of the terms and conditions of the contract. No claims of any kind whatsoever including the claim of extension of time will be entertained due to the incorporation of this requirement.

8.3. Equivalents for the various materials and the materials of approved make shall be got approved from the Engineer-in-charge of work in writing before using them on the work.

(9) TESTS:-

9.01. Materials brought at site of work shall not be used in the work before getting satisfactory test results, some of the important tests are enumerated in the Annexure-I (Page No.175 to 179) enclosed. For details relevant provisions in C.P.W.D. specifications for works 1996 (Vol. I) as mentioned in para –I (1) shall be referred to.

9.02. Normally part is to payment shall be allowed in this running account bills only if the materials conforming to C.P.W.D. Specifications for works 1996 (vol. I) as mentioned in para I ( 1 ) used in the work are tested and test results are found to be satisfactory by the Engineer-in-charge.

9.03. The Engineer-in-charge of work shall check the test results and satisfy himself before allowing any payment in the running/final bill.

(10) SECURED ADVANCE: -

10.01. Secured advance on bricks, stone, stone aggregates brought at site for use in the work shall be paid only after receipt of satisfactory test results from the laboratory.

10.02. Secured advance on steel windows, ventilators shall be paid only after the Engineer-in-charge has personally verified that the materials brought at site of work for use in work conform to the sample approved by him.

10.03. Secured advance wherever admissible on water supply, sanitary installation, drainage, materials and fittings shall be allowed only after the Engineer-in-charge has verified that materials brought at site have been checked by him personally and are in conformity with the sample approved by him.

10.04. Secured advance for terrazzo tiles shall be paid only after satisfactory results are received from laboratory.

(11) PROGRAMME FOR EXECUTION OF WORK: -

11.01 The contractor shall submit a ``Bar Chart`` to the Engineer-in-charge indicating the duration of various construction activities for technical as well as non-technical block, quarters etc. separately within a month from the date of award of work. The total time taken for various activities should not exceed the stipulated time of completion specified in NIT.

11.2 The work shall be executed as per program approved by Engineer-in-charge of the work. No claim whatsoever will be entertained on this account.

12. MISCELLANEOUS: -

12.1. The rate for all items of work wherein cement is used is inclusive of charges for curing.

12.2. The rates for every item of work to be done under this contract shall be for all heights, depths lengths and widths of the structure (except where specially mentioned in the item) and nothing extra will be paid on this account.

12.3. The water supply, sanitary installation and drainage work shall carried out in a manner complying, in all respect with the requirement of relevant bye-law of the local Municipal authority of the place at no extra cost of the department.

12.4. The contractor shall take all precautions to avoid all accidents by exhibiting necessary caution boards such as day and night boards; speed limit boards flags, red lights and providing barriers etc. He shall be responsible for all damages and accidents caused due to negligence on his part. No hindrance shall be caused to traffic during the execution of work. Nothing extra shall be paid on this account.

12.5. Any damage done by the contractor to any existing work during the course of execution of the awarded to him shall be made good by him at his own cost.

12.6. The contractor will work in close liason with the contractors doing the works of water supply, sanitary, drainage arrangements, electrical installation and any other works and adjust plan of his work accordingly.

12.7. Royalty at the prevalent rates shall have to be paid by the contractor on the stone aggregate, coarse sand and fine sand etc. collected by him for the execution of the work direct to the Revenue Authority of the State Govt. concern. ``No Demand`` certificate from the state authority concerned shall be obtained before the final bill is paid, failing which recovery will be effected from him at the prevalent market rates.

12.8. The contractor shall maintain in good condition all work during execution till completion of entire work allotted to him.

12.9. The contractor shall cause the site to be cleared thoroughly of rubbish, scaffolding materials etc. before the actual date of completion of the work as well from time to time as per directions of the Engineer-in-charge of the work.

12.10. The contractor shall engage licensed plumbers for sanitary, water supply, drainage work and also get all the materials and system (including the materials supplied if any, by the department) tested by the Municipal Authority wherever required at his own cost including testing fees, transport and according to municipal bye-laws and the contractor shall produce necessary certificate from the municipal authorities after completion of work. Nothing extra will be paid on this account.

13. WATER PROOFING TREATMENT: -

13.1. All the items for water proofing treatment in schedule of quantities shall be guaranteed for five years in the case of bitumen felt treatment by the undertaking contractors as per proforma prescribed vide page ______. The water proofing treatment work should be got done through an approved specialised agency.

SPECIFICATION FOR WATER PROOFING TRETMENT TREATMENT FOR ROOF SURFACE: -

1.1. The brick bats used on the work shall be from well-burnt bricks. The proprietory waterproofing compound shall conform to I.S. 2645-1975. In water proofing treatment, stone aggregate shall be used instead of brick aggregate without any extra cost wherever required by the Engineer-in-charge.

1.2. The finished surface after water proofing treatment shall have a minimum slope of 1 in 80.

Additions Corections: Deletions: Over-writings:- Ommisions: - Contractor EE(C) NIT Part-I, page no 19 1.3. While treatment of roof surface is done, it shall be ensured that the outlet drain pipes have been fixed & mouth of the entrance have been rounded off properly for easy flow of water.

1.4. The surface where the water proofing is to be done shall be thoroughly cleaned with wire brushes. All loose scales shall be removed and dusted off and applied with a coat of neat cement slurry admixed with proprietory water proofing compound to penetrate into crevices and fill up all the porosities in the surface.

1.5. MEASUREMENT :-

Clear measurements from wall to wall only shall be measured for payment. No deduction in measurements shall be made for either openings or recess for chimney stacks, roof lights and the forming such openings. For similar areas exceeding 0.40 sqm deductions will be made in measurements for full opening and nothing extra shall be paid for making such openings.

1.6 RATE: - The rate shall include the cost of all labour and materials involved in all the operations described above.

15. CONDITION REGARDING THE PAYMENT OF WATER CHARGES, SEWER CHARGE ETC. IN CONNECTION WITH THE WATER USED FOR CONSTRUCTION PURPOSE.

Both the water charges (if any) and sewerage charges, incidental to water used for construction purpose shall be borne by the contractors/Agency under the following cases: -

(a) In case of temporary water connection from municipal main :- Water charges and sewerage charges (including the water used for construction purpose) have to be borne by the contractor/Agency.

(b) Water used from other sources :- Prior permission for using the water for construction purpose has to be obtain from municipal Corporation/Local bodies by the contractors/Agency. Water charges, sewerage charges, if any and other charges for use of water from other source for construction purpose have to be borne by the contractors/Agency.

16. Any infringement and/or breach of the above specification and condition(s) etc. shall render the contractor liable to action(s) under various clauses of the contract and such action stipulated in the conditions therein.

ADDITIONAL CONDITIONS OF CONTRACT

1. The contractor shall be bound to observe all the rules, regulations, restrictions etc. as per requirements and decisions of the Engineer-in-charge and nothing extra shall be paid on this account.

2. No compensation shall be payable to the contractor for any damage caused by thefts, fire, rains, floods, lightening, wind, storm, earthquake, riots or by any other cause whatsoever during execution and till completion and handing-over of the work. Contractor shall make good all such damage at his own risk and cost and no claim on this account shall be entertained.

3. Other agencies / contractors like electrical contractor, Lift installation agency, Fire water piping Contractor, horticulture contractor, Termite treatment contractor etc. will also be simultaneously executing their works like electrification, lift, fire water piping, horticulture or external services and other building works for the same project along with this work in particular. The contractor shall be bound to coordinate his activities as per direction of the Engineer-in-charge with an objective of proper completion of the project in best public interest. No claim in this matter shall be entertained and nothing extra shall be paid on this account.

4. Some restrictions may be imposed for regulating the construction activities, storage of materials, entry and movement of the personal for security reasons by the competent security in – charge or by the Engineer-in-charge and in such case the contractor shall be bound to follow all such restrictions / instructions and nothing extra shall be payable on this account.

5. The contractor shall be bound to comply with proper and legal orders and directions of the local or any other competent public authority or municipality and shall abide by their direction, rules and regulations and shall bear all fees and charges including sewerage charges if any/ which he may be liable to pay as per such directions, rules etc.

6. All Cement bags and similar perishable items shall be stored by the contractor in a separate godown which shall be exclusively constructed by the contractor for this purpose at his own cost as per general guidelines given in the “Sketch of Cement Godown” in Part-II of the tender document. The dimensions given in the said sketch are only indicative and the contractor shall be bound to construct the storage godown of sufficient size so as to properly store the quantity of cement required for consumption for not less than ONE MONTH. Such godown shall have weather proof roof and watts. The godown shall be provided with a single door with arrangement for locking if simultaneously with two locks. The keys of one of the locks shall always remain in possession of the representative of the Engineer-in-charge and that of the other locks shall be with the authorized agent of the contractor available at the site of the work so that the cement is removed from the godown according to the daily requirement with the knowledge of the both the parties and the account of cement shall be maintained in the register issued by the Engineer-in-charge for the purpose. The contractor shall be fully responsible for the safe custody of the all the materials even if the materials are kept and stored under double lock system. The account of daily receipts and issues of the cement bags shall be maintained in the said register which shall be signed daily by the contractor or by his daily authorized agent in token of correctness of the entries.

7. No departmental cement shall be issued to contractor for constructing cement godown, his site office, water storage tanks for storing construction water, for constructing labour, hutments, for rectification of defective work. Cement consumed in such activities shall be treated as unauthorized consumption and shall liable to be recovered at the rates referred to and specified under clause –42(ii).

8. The contractor shall be fully responsible for the protection of the sanitary, water supply and other fittings and fixtures against all damage, pilferage and breakage during the period of installation and thereafter until the building is handed over to the authorized representative of the Engineer-in-charge under written acknowledgement.

9. Before collection of storage or stacking of materials in the compound as required for bonafide use in the work, the contractor shall take instructions from the Engineer-in-charge for proper allocation of space. No excavated earth or construction material shall be stacked / stored or labour hutments constructed on areas where construction activities for other structures, building, roads, underground-services, compound walls etc. are to be commenced. The decision of the Engineer-in-charge in such matters shall be final and binding.

10. If as per rules of the local municipality the hutments for labour etc. are not to be erected at the site of work by the contractor, the contractor shall provide such accommodation for labour as is acceptable to competent local authority and nothing extra shall be paid to contractor on this account.

11. The contractor shall be bound to preserve and maintain in perfect condition all the works executed till the completion of the entire work allotted to him. Where phased delivery is contemplated the provisions mentioned above shall apply to each such phase. Nothing extra shall be payable to the contractor on this account. ------x------ADDITIONAL SPECIFICATIONS

1. These specification shall be read and followed in addition to the normal specifications applicable to the contract as mentioned under Schedule E of ‘Part-I’ of the tender document.

2. The rates of items of excavation in earthwork shall be inclusive of disposal of surplus excavated earth beyond the requirements of Engineer-in-charge, to the nearest dumping ground as approved by the competent local authority and as per directions of the Engineer-in-charge, at the risk and cost of the contractor. Only the earth required for back filling or for filling within the compound / premises as per requirements of the Engineer-in-charge shall be kept within the premises as approved by the Engineer-in-charge. Nothing extra on this account shall be payable to the contractor.

3. Unless otherwise specified in the Schedule of quantities of items, the rates for all items of the work shall be inclusive of pumping out or bailing out water encountered from any / many sources such as rain, sub-soil water, flood or any other cause whatsoever. The foundation pits trenches etc. shall be kept free from water while the works below ground level are in progress. Nothing extra on this account shall be payable to the contractor.

4. Wherever the earth is brought from outside for filling it shall be of good quality free from vegetable matter and shall be obtained from approved quarries or from any other source which shall be got approved in writing by the contractor from the Engineer-in-charge before commencement of the work. Nothing extra on this account shall be payable to the contractor.

5. All stone aggregate and stone ballast shall be of hard stone variety to be obtained from approved quarries or from other source which shall be got approved in writing by the contractor from the Engineer-in-charge before commencement of the work. Nothing extra on this account shall be payable to the contractor.

6. Wherever any reference to any publication of Bureau of Indian Standards occurs in the specifications or Tender documents or in any matter whatsoever related with this contract, it shall be deemed to be inclusive of revisions, amendments etc. issued, if any, up to the date of receipt of tenders. Nothing extra on this account shall be payable to the contractor.

7. The contractor shall be bound to produce and submit samples of all the materials, fittings to be provided in the work sufficiently in advance of the actual requirement and shall obtain written approved from the Engineer-in- charge. Contractor shall be bound to provide the materials, fittings etc. strictly as per approved samples. Contractor shall also be fully responsible for all delays in the work due to late submission of samples for such approval and also due to rejection of samples of materials etc. not conforming to the specifications or schedule of quantities of items of work.

8. Wherever any reference to brand name or make or manufacturer about any product is made in the schedule of quantities of items of work only article product / material so specified shall be provided and used by the contractor. For providing and using the equivalent of such article / product / material, the contractor shall be bound to obtain the written approval from the Engineer-in-charge prior to any such use. Engineer-in-charge shall have full powers in the matter to decide duly considering technical and financial aspects whether a particular brand of product as claimed by the contractor is actually and really is equivalent to that specified in the schedule of quantities for which the contractor has contracted rates. Nevertheless, in case the prevailing price of such equivalent article/product/material including its cost of transportation at work-site is less than the prevailing price of the brands specified in the schedule of quantities of items, then necessary recoveries / deductions shall be made from the contractor’s bills.

9. The slope in the finished floor of toilets, bathrooms, balconies, staircase landings etc. shall not be flatter than 1:100 towards the outlets and there shall be no stagnation of water or back flow of water. In case of default the contractor shall not be entitled to any payment for such area and in addition shall be bound to pay a compensation of Rupees Five Hundred Per Square Meter of such area.

10. Any cement slurry added over a base surface or for continuation of concreting for better bond is added to have been built in the item unless otherwise specified and nothing extra shall be payable or extra cement considered with consumption on this account.

11. Rates of all items in which use of cement is involved shall be inclusive of curing. Contractor shall be bound to make all the arrangement like those sufficient good quality water, man power, T & P, pump pipe, ladders, scaffolding, gunny cloth and all other materials / items etc. needed for thorough and effective curing of all the concrete / RCC items throughout the prescribed period and ensure that the concrete / RCC surfaces remain wet / damp throughout the curing period prescribed. In case the Engineer-in-charge is of the opinion (which shall be final and binding upon the contractor) that proper or sufficient or through curing is not being done by the contractor, The Engineer-in-charge shall have full powers to make all the arrangements which he deems fit and proper entirely at the risk and cost of the contractor and without giving him any notice, for proper effective and thorough curing of the concrete / RCC items. The contractor shall have no claim whatsoever in this regard.

The rates shall be inclusive of the materials / articles required for mandatory testing as per frequency specified in the specifications and the contractor shall be bound to make all the arrangements required on his part to ensure that all the mandatory tests are carried out as and when required during progress of the work as per the frequency of testing specified in the specifications. The Engineer-in-charge reserves the right of not allowing any payment to the contractor in respect of those quantities of items of work for which the condition of mandatory testing of materials is not fulfilled satisfactorily by the contractor.

13. Engineer-in-charge shall have the right to demand from the contractor the submission of certified copies of original cash-memos, invoice, bills, challans etc. in connection with the materials procured by the contractor for bonafide use in the work and the contractor shall be bound to produce such documents as are required by the Engineer-in-charge without any extra charges.

14. For Proprietary items / articles / materials required and specified in the work, the contractor shall make all efforts and place the procurement order well in advance of the actual requirement of such materials / articles etc. to the relevant manufacturers / suppliers under intimation to the Engineer-in-charge so as to get timely supply of such materials. In case of delay on the part of contractor in placing the proper purchase order or delay in procurement of such items/ materials/articles by the contractor, the contractor shall not be entitled for EXTENSION OF TIME for such delay.

15. Underground and overhead water storage tanks, piping system, fittings, accessories etc. for water supply, sanitary, and drainage arrangements shall be as per rules and regulations of the competent local authority and the contractor shall be bound to engage the licensed / approved plumbers for such works. Nothing extra on this account shall be payable to the contractor.

16. The contractor shall be bound to arrange and provide within 30 days of the commencement of work the following testing equipment’s in the working condition at the work site and shall keep them well maintained in the proper working condition till completion of the work for use by the Departmental officers or the Engineer-in-charge. Nothing extra on this account shall be payable to the contractor. (i) One Weighing Balance of capacity not less than 10 kg. and capable of weighting up to less count of One Gram, With full set of approved weights.

(ii) One set of Vernier Calipers with a least count of 0.05mm.

(iii) One set of Micrometer Screw Gauge with a least count of 0.01mm.

(iv) One Spirit Level of not less than 30 cm long and capable of checking both horizontal and vertical surfaces.

(v) Standard Dumpy level with Leveling staff.

(vi) Two Graduated Glass Cylinders for checking silt content of sand.

(vii) Slump cone Test Apparatus as per Bureau of Indian Standards.

(viii) A set of minimum Twenty number of 15 x 15 x 15 cm. Cube moulds conforming to BIS specifications.

(ix) Rebound Test Hammer.

(x) Ball and Pin Hammer weighing about 400 grams.

(xi) Magnifying Glass of about 75mm dia.

(xii) Two Measuring Tapes one of 3 Meters and the other of 20 Meters length. In case the contractor fails to fulfill this condition or fails to provide any of the items mentioned above. He shall be liable to pay a compensation of Rupees Five Hundred per Day of default or part thereof to the

17. Unless other wise provided in the schedule of quantities of items of work the rates tendered by the contractor shall be all inclusive and shall apply to all heights lifts and leads and depths of the building and nothing extra shall be payable to the contractor on this account.

18. The structural and architectural drawings issued by the Engineer-in-charge and being followed for execution, shall at all times be properly co-related by the contractor or his technical representative / staff before executing any work and required clarifications shall be obtained from the Engineer-in-charge. In case of any discrepancy in the item given in the schedule of quantities of items appended with the tender and the architectural drawings relating to the relevant item, the former shall prevail unless and otherwise approved in writing by the Engineer- in-charge.

19. Welding wherever it appears shall mean continuous fillet welding.
