LICENSING AND CONDITIONS OF USE FOR DIGITAL PUBLICATION

YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS. THIS AGREEMENT LICENSES THIS DIGITAL PUBLICATION TO YOU AND CONTAINS LIABILITY AND WARRANTY DISCLAIMERS. BY USING THIS DIGITAL PUBLICATION YOU ARE ACCEPTING AND AGREEING TO THE TERMS AND CONDITIONS OF THIS AGREEMENT.

This digital publication is owned by the Appraisal Institute and is protected by the United States copyright laws and international treaty provisions. The contents of this digital publication are the intellectual and proprietary products of the Appraisal Institute and you may not, in whole or in part, sublicense, assign, transfer, reproduce, copy, modify, disseminate, create derivative works based on, enter into a computer database, or otherwise utilize in any form or manner or by any means except for the user’s individual and personal use and reference without the prior written consent of the Appraisal Institute.

In using this digital publication, you accept and agree to be bound by the terms and condition set forth in this non-exclusive, non-transferable, limited License Agreement. This digital publication may be used only pursuant to the terms and conditions of this License Agreement. Any breach or violation of this agreement by user shall result in immediate termination of user’s license to this digital publication and be subject to any necessary legal action by the Appraisal Institute to remedy user’s breach or violation for which user shall be liable for any reasonable attorneys’ fees and court costs. Termination of user’s license agreement shall include but not be limited to user’s loss of access to this digital publication.

THE APPRAISAL INSTITUE DOES NOT WARRANT, GUARANTY, OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF THIS DIGITAL PUBLICATION IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTESS, OR OTHERWISE AND DOES NOT WARRANT THAT THIS DIGITAL PUBLICATION WILL BE WITHOUT ANY DEFECTS OR ERROR FREE. THE APPRAISAL INSTITUTE EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES NOT STATED HEREIN.

This License Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, U.S.A., without giving effect to any principles of conflicts of laws. User consents to the exclusive jurisdiction and venue of courts in the County of Cook, State of Illinois, U.S.A. in all disputes arising out of or relating to the use of this digital publication.

This License Agreement constitutes the entire agreement between the Appraisal Institute and the user with respect to this digital publication and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the Appraisal Institute and the user with respect to this digital publication.

If any provision of this License Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this License Agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing, signed by both parties.

A printed version of this License Agreement and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to this License Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained by the Appraisal Institute.
