5 ORDINANCE 2006-1391-E 6 AN ORDINANCE CREATING A NEW SUBPARAGRAPH (D) 7 TO SECTION 120.209, ORDINANCE CODE, ALLOWING 8 ANY TIME SERVICE RETIREE OF THE CITY OF 9 JACKSONVILLE GENERAL EMPLOYEES RETIREMENT 10 PLAN, WHO OTHERWISE QUALIFIES, TO BE RE- 11 EMPLOYED BY THE CITY ON A PART-TIME OR 12 TEMPORARY BASIS WITHOUT THE CESSATION OF 13 RETIREMENT BENEFITS PAYABLE TO SUCH RETIREE 14 PURSUANT TO CHAPTER 120, ORDINANCE CODE, 15 BECAUSE OF, AND DURING, SUCH RE-EMPLOYMENT; 16 EMPOWERING THE PENSION BOARD OF TRUSTEES TO 17 ADOPT SUCH RULES NECESSARY TO IMPLEMENT THE 18 BENEFITS SET FORTH IN THIS ORDINANCE IN 19 ACCORDANCE WITH APPLICABLE FEDERAL AND STATE 20 LAWS; PROVIDING AN EFFECTIVE DATE. 21

22 WHEREAS, Chapter 120, Part II, Section 120.209(c), Ordinance 23Code, provides, among other things, that retirement benefit 24payments pursuant to Chapter 120, Ordinance Code, to a retiree of 25the City of Jacksonville General Employees Retirement Plan shall 26cease if that retiree becomes re-employed by the City, for as long 27as that retiree is re-employed by the City; and 28 WHEREAS, the City desires to create a new subparagraph (d) to 29Section 120.209, Ordinance Code, to allow any time-service retiree 30of the City of Jacksonville General Employees Retirement Plan, who

1otherwise qualifies, to be re-employed by the City on a part-time 2or temporary basis without the cessation of retirement benefits 3payable to such retiree pursuant to Chapter 120, Ordinance Code, 4because of, and during, such re-employment (the “Enhancement”); and 5 WHEREAS, the City, through the Board of Pension Trustees, has 6engaged Actuarial Concepts, Inc. to incorporate, factor and project 7the impact of the Enhancement to the City of Jacksonville General 8Employees Retirement Plan; and 9 WHEREAS, Actuarial Concepts, Inc. has incorporated, factored 10and projected the impact of the Enhancement to the City of 11Jacksonville General Employees Retirement Plan and, in connection 12therewith, has prepared a Statement of Actuarial Impact, which is 13attached as Exhibit 1, stating that the Enhancement will have no 14actuarial impact on the pension plan; and 15 WHEREAS, the Board of Pension Trustees has received, analyzed 16and considered the Statement of Actuarial Impact, and the City has 17determined it is in the best interest of the employees and citizens 18of the City to adopt and approve the Enhancement; now, therefore,

19 BE IT ORDAINED by the Council of the City of Jacksonville: 20 Section 1. Incorporation of Recitals. The recitals set 21forth above are true and correct and incorporated herein by this 22reference. 23 Section 2. Creation of New Subparagraph (d) to Section 24120.209, Ordinance Code. A new subparagraph (d) to Section 25120.209, Ordinance Code, is hereby created to read as follows: 26 (d) Notwithstanding the provisions of subparagraph (c) to 27Section 120.209, Ordinance Code, or any other City ordinance to the 28contrary, any time service retiree of the City of Jacksonville 29General Employees Retirement Plan, who otherwise qualifies, may be 30re-employed by the City on a part-time or temporary basis without 31the cessation of retirement benefits payable to such retiree 2 2 1 Enacted 2/27/07

1pursuant to Chapter 120, Ordinance Code, because of, and during, 2such re-employment. For purposes of this subparagraph (d), the 3term “part-time” shall mean a position routinely requiring fewer 4than 25 hours of work per week (50 hours per pay period) on a 5regular and recurring basis, and the term “temporary” shall mean a 6full-time temporary position required for less than six months on a 7special assignment or to replace an employee on leave. In no event 8shall any time service retiree of the City of Jacksonville General 9Employees Retirement Plan acquire time service credit under Chapter 10120, Ordinance Code, during, or in connection with, such re- 11employment. 12 Section 3. Authorization. The Pension Board of Trustees 13is hereby authorized and empowered to make and adopt such rules as 14the Pension Board of Trustees deems necessary to implement the 15benefits set forth in this ordinance in accordance with applicable 16federal and state laws. 17 Section 4. Effective Date. This Ordinance shall become 18effective upon signature by the Mayor or upon becoming effective 19without the Mayor’s signature. 20Form Approved: 21
