CALL TO ORDER
EXECUTIVE SESSION The motion was made and passed to go into Executive Session pursuant to Virginia Code, 2.2- 3711-A (15), for the purpose of conducting a Next Friend review. Member present was Michael Williams. Also present were Horizon Behavioral Health representative Kathy Crone, Blue Ridge Residential Services representative Courtney Campbell, sponsor Jimeah Horsly, friend Inger Brister and the consumer. The subcommittee heard the review. Ms. Brister will participate via conference call during the January meeting, when a vote can be held. CVCS LHRC Minutes 2 November 16, 2016
The motion was made and passed to go into Executive Session pursuant to Virginia Code, 2.2- 3711 (15), for the purpose of discussing the restrictive treatment plans for individuals receiving service. This review necessarily involved discussion and consideration of mental and medical records excluded and information excluded from the Freedom of Information Act. Member present was Michael Williams.
The subcommittee heard reviews of plans from Able, Blue Ridge Residential, DePaul, and Wall. Suggestions were offered. Plans are to be presented to the full Committee in January.
Links to Life representative Linda Coley presented plans for 2 individuals. The subcommittee determined that neither are restrictions.

Human Rights Poster: For now, do not change the phone number or name you have on your poster(s). You will be notified if changes need to be made.
HR Contact: For our region, 1&2, a Triage Model is in place, meaning that when you call Cassie Purtlebaugh (804-382-3889) she will triage the issue to the advocate most experienced in that area. For example, Lana Hurt is the ID/DD Community Advocate.
New HR Regs: are still awaiting the governor’s signature. You will receive an e-mail when they are officially in effect. At that time, you will not have to submit quarterly and annual reports or attend meetings. Meeting attendance will only be required for: Next Friends, restriction plans, new services, new affiliates, and at the HR Advocate’s request.
Attendance Changes in Effect NOW: - Attendance NOT required: If you are already affiliated, new addresses, closings/discontinuations, and moves are automatically approved and do not require meeting attendance, as long as you send an affiliation letter to Ms. Mayhew, Ms. Hayes, and your licensing specialist. The letter must include addresses of moves, new sponsored sites, etc.
- Attendance IS required: New services are also automatically approved, but do require an affiliation letter, meeting attendance and presentation.
- Attendance Location: Because of the recent consolidation of LHRCs, you may attend a meeting in another region for affiliation requests only. Next Friends and restrictions must stay in our region. Ms. Long will send you specific information about this soon.
Advocates’ Duties: half of advocates’ time is now to be spent in the community, conducting training and making announced and unannounced visits. CVCS LHRC Minutes 3 November 16, 2016
Quarterly Reports: Ms. Long complemented everyone on quarterly reports, which have greatly improved.
Seclusion Reports: are still required annually, even if you do not use seclusion. These are to be submitted to Mary O’Clair. Note: staff physically blocking a door is a form of seclusion; a door can be blocked only for safety of the individual and peers.
Note on Term: Do NOT use “mentally retarded (MR)”; the approved terminology is “intellectually disabled (ID).”
Investigations: Training investigators will be training providers to conduct investigations, and trainings may be done on Webinars. Fedora training already done will be recognized.
PUBLIC COMMENT TIME Ms. Cabaniss brought up issues with Logisticare, a statewide subcontractor paid by Medicaid. They are not under DBHDS, so are not held to the same standards as you are. Ms. Long recommended reporting problems to Logisticare and let them you are going to contact Medicaid as well. Contact the client’s case manager and the Commissioner or Central Office. Note: Mr. Taylor said that Logisticare is up for renewal with Medicaid currently, so now is the best time to report issues.
