SJA Chokeables photo competition – terms and conditions

Promoter / entrants

1. The Promoter is St John Ambulance of 27 St John’s Lane, London EC1M 4DA (“SJA”). 2. All entrants must be UK and Republic of Ireland residents aged 18 or over. 3. Entrants into the competition shall be deemed to have accepted these terms and conditions. 4. The competition will commence at 12.30pm on 16 February 2015 and all entries must be received by 2pm on 27 February 2015. SJA accepts no responsibility for any entries that are incomplete, illegible or corrupted or which fail to reach SJA by the relevant closing date for any reason. Proof of sending is not proof of receipt. Entries via agents or third parties are invalid. 5. SJA reserves the right in its absolute discretion to extend the closing date where the entries received are of insufficient quality. 6. To enter, entrants must upload a photo of their baby in the ‘comments’ section of one of the posts requesting Chokeables competition entries on SJA’s Facebook page (https://www.facebook.com/SJA?fref=ts). 7. Entrants may submit as many entries as they wish but no entrant may win more than one prize. 8. No purchase is necessary; it is free to enter this competition. 9. By submitting an entry, each entrant grants SJA permission to use their name, town and county of residence for the sole purpose of identifying them as the author of their entry and/or as a winner of the competition. 10. SJA will comply with the Data Protection Act 1998 and will not use entrants’ personal data for any purpose which the entrant has not consented to. SJA will not pass any entrant’s details to a third party unless it has the entrant’s express permission to do so. 11. By entering this competition, all entrants consent to the use of their personal data by SJA for the purposes of the administration of this competition. 12. Entrants agree that if they are chosen as a competition winner they will take part in reasonable post event publicity, and agree to the use of their names and photographs in such publicity.

Entries

13. By entering this competition each entrant confirms that his/her entry is their wholly-owned creation and, to the extent that such entry makes use of any third party materials or trade marks, that these have been fully cleared unless they are no longer protected by copyright or other intellectual property rights. 14. Each entrant confirms that his/her entry does not show inappropriate or dangerous behaviour, is not otherwise obscene, defamatory, distasteful, offensive, or in breach of any applicable law or regulation, and is not in breach of any confidentiality obligations owed by the entrant to third parties. 15. Each entrant confirms that any adult depicted in his/her entry has given their consent to the image being used in connection with this competition and in accordance with these terms and conditions. 16. Each entrant confirms that, where any individual aged less than 18 years is depicted in his/her entry, the parent or guardian of that individual has given their consent to the image being used in connection with this competition and in accordance with these terms and conditions. Where the entrant is the parent or guardian of an individual so depicted, they confirm that they consent to the image being used in connection with this competition and in accordance with these terms and conditions. 17. Entrants will hold SJA harmless from any claims in relation to their entry that the entry infringes the personal or proprietary right of any other person. 18. By submitting an entry, each entrant grants SJA a worldwide, perpetual, royalty-free, non- exclusive licence to edit, publish, translate, modify, adapt, make available and distribute the entry throughout the world in any media now known or hereafter invented. Each entrant undertakes to complete any necessary documentation to formalise the licence.

Winner selection

19. 10 winners will be selected. The winners will be the owners of the Facebook accounts from which the winning photos, as judged by a jury composed of SJA employees, are posted. 20. Full details of the jury can be obtained on request by emailing [email protected] 21. When choosing the winners the jury will be looking for the photos which they feel feature the cutest and messiest babies. 22. The winners will be announced on the SJA Facebook page no later than 6 March 2015.

Prizes

23. The prizes are (a) one of 10 sets of first aid kits and manuals and (b) (for the winner with the best overall entry as chosen by the jury) a first aid training course for up to 10 people. 24. The winner of the first aid training course will be contacted within 30 days of the announcement of the winners to arrange the provision of the course. SJA will use reasonable endeavours to agree a date and location for the course which is mutually convenient for SJA and the winner. If it is not possible to identify both a suitable location and a suitable date falling within the next six months, SJA reserves the right to treat the prize as having been rejected by the winner. 25. The winner will be entitled to nominate up to nine individuals to attend the training course with them. SJA should be provided with advance notification of any special assistance that any attendee is likely to need during the running of the course. 26. The winners of the first aid kits and manuals will have their prizes posted to them within 30 days of the announcement of the winners. 27. The prizes are non-transferable and no cash or credit alternatives will be substituted for the prizes on offer. 28. Prizes are subject to availability. In the event of unforeseen circumstances, SJA reserves the right (a) to substitute alternative prizes of equivalent or greater value and (b) in exceptional circumstances to amend or foreclose the promotion without notice. No correspondence will be entered into. 29. SJA reserves the right to refuse to honour any entry or to recover the full value of any prize if it considers there has been an abuse or breach of the terms and conditions of this competition. 30. Any rejected or unclaimed prize may be awarded to other entrants at the absolute and sole discretion of SJA.

General

31. This competition is in no way sponsored, endorsed, administered by or associated with Facebook. By participating, entrants hereby release and hold harmless Facebook from any and all liability associated with this competition. Entrants acknowledge that all information and material that they submit to enter this competition is submitted to SJA and not to Facebook, and they agree that Facebook shall not be liable to them in any way in respect of this competition. 32. SJA accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the competition or accepting / participating in any prize. 33. Nothing in these rules shall have the effect of excluding or restricting SJA’s liability for personal injury or death caused by the proven negligence of its employees or contractors. 34. SJA reserves the right to amend these terms and conditions at any time, with the amended terms to be published on SJA’s website. 35. In the event of a dispute over interpretation or implementation of the rules on any matter related to the competition, the decision of SJA is final and no correspondence will be entered into. 36. These terms and conditions are governed in accordance with the laws of England and Wales and subject to the exclusive jurisdiction of the English courts.
