Statesman’s Signature 2008 Stallion Service Contract

This agreement for stallion service is between Marthe Reynolds, owner of the Morgan Stallion named Statesman’s Signature AMHA # 142813 (herein called the “stallion owner”) and ______, owner of the Mare described below (herein called the “mare owner”).

DNA Record & Cooled Semen Permit: The stallion owner certifies that both a DNA record and Cooled Semen Permit for Statesman’s Signature have been established with the American Morgan Horse Association Registry.

Foal Registration: If the mare is a registered Morgan, the owner agrees that the resulting foal will be registered with the AMHA within 6 months of foaling.

Breeding Season: The 2008 breeding season is defined as April 1st through August 1, 2008. If the mare owner needs to extend the season due to extenuating circumstances, the stallion owner agrees to accommodate as much as possible. Please note: Statesman's Signature is a show horse. Collections will be scheduled around his showing schedule from April - August. Every effort will be made to accommodate collections for the mare owner to the fullest extent possible.

Number of Shipments: The stallion owner agrees to supply up to three shipments of cooled semen for the above named mare, should they be required, during the 2007 breeding season. Additional shipments may be negotiated.

Collection of Semen: Pine Bush Equine on the grounds of Blue Chip Farm Inc, 807 Hoagerburgh Road, Wallkill, NY 12589, will perform collection of semen. Semen will be shipped from Blue Chip Farm Inc.

Ordering & Shipment of Semen: Blue Chip Farm Inc. will ship "cooled" semen via overnight delivery by Federal Express, Airline, or several other overnight carriers. Please inquire with stallion owner as to specific carriers not listed above. Shipments Monday through Friday can be made with dependable next day delivery to most locations. Saturday and Sunday shipments are NOT available, so the mare owner and the veterinarian must plan accordingly as they will not be able to receive shipments Sunday or Monday. Same day shipping is possible with

The stallion owner requests several days’ initial warning of a pending shipment if possible. Notice of an actual required shipment must be given to the stallion owner no later than 4 PM the evening before shipment, or shipment is not guaranteed.

Insemination of Mare: A qualified veterinarian must perform the insemination of the mare. The mare owner certifies that the veterinarian who will do the insemination of the mare practices reproduction as part of his/her regular practice.

Fees and Discounts:

 Breeding and Booking Fees: The breeding (stud) fee for the 2008 season is $1000, which includes a $350 non-refundable booking fee. Personal checks will be accepted. Payments are due as follows:  Booking Fee of $350 is due to stallion owner by check with signed contract prior to shipment.  The balance of $650 is due by check when the mare is determined to be safely in foal at 90 days post insemination. A post-dated check, dated 90-days from insemination, will be held until mare is determined to be safely in foal.

 On-site AI service is available. AI on-site fee is $50. Please contact the stallion owner directly (Marthe Reynolds 845.255.2089, [email protected])

 Other Fees: The mare owner is responsible for the semen collection fee, the shipping cost and the container rental cost. In order to assist in financial planning these fees are estimated below. The mare is charged only the exact cost incurred for these fees at the time that they are incurred. On-site AI will not incur shipping or container fees. Collection, Shipping and Semen Transport Box charges are payable directly to Blue Chip Farm Inc. via personal check or credit card. Cost breakdown as follows: Collection: 250.00 Shipping: Approximately 40.00 - 60.00 Semen Transport Box: 30.00

Insurance: Neither the stallion owner, Blue Chip Farm Inc. nor Pine Bush Equine responsible for misdirected, damaged or lost semen shipments. It is recommended that the mare owner insure the shipment for the loss which will be incurred (veterinary fees etc) should a shipment not arrive as expected.

90 Day Confirming Pregnancy Check: When an early pregnancy check indicates a pregnancy, the mare owner agrees to have the mare rechecked for pregnancy at approximately 90 days post insemination. If the mare is determined to still be in foal at this pregnancy check, the balance of the stud fee is then due, and is at that point non-refundable. The mare owner’s post-dated check will be deposited. If the mare owner decides not to have the pregnancy confirmed at 90 days, the mare will be assumed pregnant, and the stud fee is then due, and is at that point non-refundable.

Non-Conceiving Mares: Should the mare not conceive during the 2008 breeding season or conceives and then loses the pregnancy before the 90 day check, the mare owner is not obligated to pay the stud fee. The booking fee remains non- refundable. Since the stud fee is not paid until the mare conceives, this contract does not roll over to 2009. The mare owner may choose to breed back during the 2009 breeding season under a new contract, if the stallion is available, but is not obligated to do so. If the mare owner chooses to breed back during the 2009 breeding season, he/she will be obligated to pay a new booking fee and submit a new 2009 contract.

Live Foal Protection: Once the mare is declared to be in foal at the 90 day confirming pregnancy check and the stud fee paid, the stallion owner gives the following protection: Should the mare abort or not produce a live foal, the stallion owner will supply up to three semen shipments during the 2009 breeding season for that mare at no cost to the mare owner except for collection, shipping and container fees. Written certification by a licensed veterinarian that the mare aborted or did not produce a live foal may be requested. Should the stallion be sold, deceased, gelded or physically incapable of breeding, the above protection clause is void.

Mare Substitution: If the mare is determined unfit for breeding during the 2008 breeding season, another mare owned or leased by the mare owner may be substituted during the 2008 breeding season. Statesman’s Signature Stallion Service Contract Page 4 of 4
