Statement Showing Stamp Duty Payable Under the Bombay Stamp Act, 1958

Sub: Revised rate for the payment of stamp duty u/s 5(c), 19(2), (3) and 43 (f) of the Bombay Stamp Act, 1958.

Government of Maharashtra, General Stamp Office has vide their letter no. STP/CL/8013 dated 6th November, 2001 issued the following directive to the Exchange in the matter of stamp duty chargeable on transactions related to purchase or sale of shares, scrips, stock, bonds, debenture stocks or any other marketable security. Relevant parts of the said letter are reproduced here below :

Quote –

Sub: Payment of stamp duty u/s 5 (c), 19 (2), (3) and 43 (f) of the Bombay Stamp Act, 1958

“The stamp duty on the instrument relating to the purchase or sale of shares, scrips, stock, bonds, debenture stocks or any other marketable security of a like nature in or of any incorporated company or other body corporate is chargeable @ rupee one for every rupees 10,000/- or part thereof (i.e. 0.01%) of the value of the security at the time of its purchase or sale, as the case may be irrespective of its delivery or no delivery.

However, it has been noticed that the Share Brokers used to pay stamp duty on the delivered shares only barring few exceptions because of heavy duty on the undelivered shares. With a view to reduce burden of stamp duty on the delivered sharesThe Government of Maharashtra, Revenue and Forest Department, Mantralaya, Mumbai vide order no. Mundrank 2001/1381/CR-234/M-2, dated 30th August, 2001 has reduced from 1st April 2001 to 31st March, 2003, the stamp duty chargable on the instrument under the said Article 5 (c), 19 (2) & (3) and 43 (f) of schedule I to the said Act, pertaining to the undelivered share from rupee one for every Rs. 10,000/- or part thereof to twenty paise for every Rs. 10,000/- or part thereof (i.e. 0.002%)

Further, vide registration and other related laws (Amendment) Act, 2001 notified in the Gazette of India dated 24th September, 2001 “books may also be kept in computer floppies or diskettes or in any other electronic form”. As a result, transaction on proprietary account which did not require generation of any contract notes or agreements shall also be chargeable to stamp duty at the prescribed rates effective from 24th September, 2001.

A copy of the above referred Government order and the Gazette of India notification and proforma for payment of stamp duty are enclosed herewith with a request to circulate it amongst all the Brokers on your list with a direction to them to submit the information of the transaction occurred with effect from 1st April 2001 till date in the prescribed format.”

- Unquote Similarly, Government of Maharashtra, General Stamp Duty office has vide letter dated November 03, 2001 intimated the Exchange of the stamp duty payable in respect of transactions in the Wholesale Debt Market Segment. The text of this letter is as below :

Quote –

“ The Stamp duty on the instrument relating to the purchase or sale of Government security is charge to maximum Rs. 1000/- on wholesale debt market.

A copy of the Performa for payment of Stamp duty on wholesale debt market is enclosed herewith alongwith a request to circulate it among all the Brokers on your list with a direction to them to submit the information of the transaction done by them monthwise”.

Trading members may kindly be guided accordingly and ensure compliance in terms of the transmission of the data to the stamp authority in the respective formats as prescribed (which are also enclosed)
