Approve June 27, 2013 Regular Meeting Minutes. On a motion from Commissioner Hose, seconded by Commissioner Dicus, the minutes were approved. The vote was unanimous.

Approval of the Police Officer Selection Process as a Continual Hire The previous eligibility register for this position expired in June 2013. Commissioner Hose was questioning whether or not the Police Department was in violation of Civil Service Rule 2-1-0. Which states “Statutes of the State of Utah require that all applicants for employment under Civil Service be subject to examination. The examination must be public, competitive, and administered without cost to the applicants.” The Commission was unable to reach Attorney Stan Preston, so this item was tabled until a conference call could be held. Approval of Police Lieutenant Promotional Process The previous eligibility register for this position expired in May 2013. On a motion from Commissioner Hose, seconded by Commissioner Dicus, the Police Lieutenant Promotional Process was approved. The vote was unanimous.

Approval of the Reinstatement of Police Information Specialist, Sherry Durfee Police Information Specialist, Sherry Durfee, resigned from the Police Department on 7/21/2012. Ms. Durfee has requested that Chief Burbank reinstate to her former position. Chief Burbank would like to recommend the Commission’s approval to reinstate Ms. Durfee/

On a motion from Commissioner Dicus, seconded by Commissioner Hose, the reinstatement of Police Information Specialist Sherry Durfee was approved.

Approval of Police Officer Selection Process as a Continual Hire

SALT LAKE CITY POLICE DEPARTMENT Police Officer Testing and Selection Process

I. SUMMARY

Performs a wide variety of police functions, including but not limited to: Crime suppression, crime prevention, protection of personal liberties, regulation of non-criminal conduct, and provision of services. Police Officers are given specific work instructions by superior officers on new assignments, but work independently in performing regularly assigned duties.

II. MINIMUM QUALIFICATIONS

1. Graduation from high school or possession of GED certificate. 2. Must be a U.S. Citizen on/by the date of the first examination. 3. Must be at least 21 years of age on/by the date of the first examination. 4. Successful completion of Civil Service examination process which may include written examination, physical examination, background investigation, physical agility test, computer voice stress analysis, psychological examination and evaluation, drug screen, and oral interview. 5. Successful completion of Utah NPOST exam prior to designated application deadline. 6. Graduation from Peace Officers Standards and Training Academy within six (6) months of hire. 7. Considerable human relations and communications skills. 8. Ability to work independently, make critical decisions, and use initiative and common sense. 9. Must have valid Utah Driver License or the ability to obtain one within 30 days of employment. III. APPLICATION

To apply for this position, interested candidates must complete and submit an online application and attach a copy of their Utah National Police Officer Selection Test (NPOST) results on the City’s website at www.slcgov.com/jobs. If a candidate does not have computer access, he/she may go to SLC Human Resources located in the City and County Building at 451 South State Street, Suite 115, Salt Lake City, for assistance. Applications and/or Utah National Police Officer Selection Test results turned in after the designated application deadline will not be accepted.

IV. ACCOMMODATIONS

Candidates may request reasonable disability-based accommodation for any part of the examination process. Requests accompanied by medical documentation must be submitted to Candace Roberts at least ten (10) business days prior to the examination date.

V. TESTING AND SELECTION PROCESS

The testing and selection process for this position consists of the following phases:

1. UTAH NPOST SCORES (pass/fail and hurdle exam) All candidates must turn in a copy of their Utah National Police Officer Selection Test (NPOST) scores prior to the application deadline. If the candidate pool is large a cutoff or “pass rate” may be determined by the Utah NPOST scores, and will consider the natural break, adverse impacts and departmental need.

2. WRITTEN EXAMINATION (hurdle exam) On the day of the written examination candidates are required to present photo identification (i.e. driver license, passport, or military I.D. card). Identification must display date of birth. Candidates must be 21 years of age on or by the date of the written examination. The multiple-choice exam is designed to measure each candidate’s proficiency in spelling, grammar, punctuation, and sentence structure specific to the English language. The exam will also help determine which candidates possess skills to effectively work with the public and other members of the department. A cutoff or “pass rate” may be determined by the written exam scores, and will consider the natural break, adverse impacts and departmental need. The written exam will identify a candidate that closely match the needs of the Department and is primarily intended as a hurdle exam to advance those candidates to the next phases of the process. Candidates invited to this phase will be notified of the event date, time, and location.

3. PHYSICAL AGILITY TEST (pass/fail and hurdle exam) On the day of the physical agility test, candidates are required to present photo identification (i.e. driver license, passport, or military I.D. card), Release of Information Form, Background Personal History Questionnaire, DD-214 (if applicable), and additional background documents to check-in at the examination site. Identification must display date of birth. The physical agility test consists of the following four exercises: push-ups, sit-ups, vertical jump, and a mile and a half (1.5) run. Candidates are required to pass the physical agility test at 50% in each area to continue with the selection process. Examination results from any other jurisdictions may not be substituted for Salt Lake City Police Department’s physical agility test for Police Officer. Candidates reaching this phase will be notified of the event date, time, and location.

4. PRESENT POLICE OFFICER ELIGIBILITY REGISTER TO THE CIVIL SERVICE COMMISSION

5. BACKGROUND INVESTIGATION (pass/fail) The top candidates from the eligibility register will be required to undergo a background investigation. The investigation may include, but is not limited to, the following: employment history, driving history, arrest and conviction record, financial responsibility, and interviews with family members, neighbors, supervisors, co-workers, and friends.

6. COMPUTER VOICE STRESS ANALYSIS (CVSA) (pass/fail) The top candidates passing the background investigation will be required to complete a Computer Voice Stress Analysis evaluation. This instrument is used for truth verification which measures “micro tremors” in the voice, then provides the examiner a visual chart which is interpreted as deceptive or non-deceptive. The examination uses only a microphone and no wires are attached to the subject.

7. PSYCHOLOGICAL EXAMINATION AND EVALUATION (pass/fail) The top candidates passing the Computer Voice Stress Analysis and Background Investigation will be required to complete and pass a thorough psychological examination and evaluation. It is important to note that the examination is not designated to measure mental health.

8. INTERVIEW The top candidates from the eligibility register who have successfully completed a computer voice stress analysis, background investigation, and psychological examination and evaluation and will be contacted by phone and invited in for an interview with the Police Chief.

9. MEDICAL EXAMINATION AND DRUG SCREEN (pass/fail) After receiving a conditional offer of employment candidates must successfully complete and pass a thorough medical examination, including a drug screen. Physicians who perform the medical examination consider the severity of any problem in making the pass/fail decision. VI. COMPONENTS, WEIGHTS, AND RANKING

The Police Officer testing and selection process will consist of the following components and weights:

Utah National Police Officer Selection Test (NPOST) Scores 20% Written Examination 80%

Veterans Preference Points Honorable Discharge 5% on top of overall score Disabled Veteran 10% on top of overall score

Candidates will be ranked according to their final score and placed on the Police Officer eligibility register.

The Police Department presented their process for entry-level police officer testing in the July 18, 2013 Civil Service Commission Meeting. In the minimum qualifications for the City’s position of police office, one of the requirements stated that in order for candidates to apply, they needed to submit an NPOST examination score prior to the application deadline. This exam is POST (Police Officers Standard and Training) mandated, as a state-wide entry-level test for Utah. The NPOST is administered on various campuses and testing sites throughout the State of Utah. The fee for NPOST is $25.

A question came forward during the entry-level police officer selection process discussion. The Civil Service Commission asked for counsel from their Attorney Stan Preston via email immediately following the meeting held on Thursday, July 18, 2013. The question is below:

Since the NPOST is required upfront, is the Police Department in violation of Civil Service Rule 2-1-0 (Under Entering the Civil Service): “Statutes of the State of Utah require that all applicants for employment under Civil Service be subject to examination. The examination must be public, competitive, and administered without cost to the applicants.” Attorney Preston responded to the above question via email on Thursday, July 18, 2013 at 10:25 p.m. He advised the Civil Service Commission of the following:

“I don’t see any problem with this. I assume the referenced statute is Utah Code Ann. § 10-3- 1007, which states:

All applicants for employment in the classified civil service shall be subject to examination, which shall be public, competitive, and free. Examinations shall be held at such times and places as the civil service commission shall from time to time determine, and shall be for the purpose of determining the qualifications of applicants for positions. Examinations shall be practical and shall fairly test the fitness in every respect of the persons examined to discharge the duties of the positions to which they seek to be appointed, and shall include tests of physical qualifications and health.

This statute requires that applicants are subject to a free examination (which the City conducts) to determine qualifications. For purposes of this statute, I do not believe it matters that other required examinations conducted by other entities charge a fee. Provided that the civil service commission does hold the required free examination, there is no problem requiring an NPOST examination score as well, particularly where that is a state-wide entry level standard test that all public safety officers undergo.”

The Commission noted following clarification from Attorney Preston, that the Police Officer Selection Process remains compliant as it continues to be public, competitive, and free.

On a motion from Commissioner Hose, seconded by Commissioner Dicus, the Police Officer Selection Process was approved as originally submitted on Thursday, July 18, 2013 as a Continual Hire Process.

Police Specialist Hourly Selection Process

AUGUST 2013

I. SUMMARY:

Under the general direction of the Police Department’s Administrative Services Bureau Deputy Chief, incumbent greets and assists members of the general public, customers, visitors and public officials who are seeking assistance and/or general public safety information. Responds to calls. Directs, coordinates, and transfers inquiries and requests, as needed, on behalf of the City’s Police, Fire & 911 Communications agencies.

This is a non-benefitted, part-time position limited to work less than 20 hours per week. II. ELIGIBILITY REQUIREMENTS: Eligible applicants must meet the following minimum requirements:

MINIMUM QUALIFICATIONS:

1. Must possess a High School Diploma or G.E.D.

2. Ability to understand, follow and give clear directions and instructions.

3. Knowledge of public safety operations, department systems. policies and procedures.

4. Ability to deal with high risk, stressful and potentially volatile situations and culturally diverse people.

DESIRED QUALIFICATIONS:

Preference may be given to individuals with former Police Officer work experience.

Each behavior dimension will be rated separately on a 1-to-5 scale, with 1 being the lowest score and 5 being the highest score. Scores will be totaled from the "raw" ratings. The scores will be statistically analyzed, weighted appropriately, and converted to a percentage.

Candidates will be ranked according to their final score and placed on the Police Specialist Hourly eligibility register.
