HYDE PARK CITY PLANNING COMMISSION May 17, 2017
The Hyde Park City Planning Commission meeting began at 7:00 P.M. and was conducted by Chairman Mark Lynne.

APPROVAL OF MINUTES Brandon made a motion to approve the minutes of the Planning Commission meeting held May 3, 2017 as is. David seconded the motion. Mark Lynne, David Zook, Melinda Lee, Brandon Buck, Tiffany Atkinson and Connor Balls voted in favor.

CITY COUNCIL REPORT Council member Brad Robinson reported on City Council meeting held May 10, 2017: 1. Approved the Subdivision ordinance changes regarding open space and Bonus Density. 2. Approved the sewer rate increase at 42%, with a reduced increase for those using less water. 3. Accepted an annexation request from Larsen Miller. 4. Agreed to consider reimbursement for Planet Auto’s qualifying expenses, according to ordinance. 5. Departments: a. Potholes are filled. b. Bridge on 200 South fixed. c. Hyde Park Canyon in need of cleanup. Not eligible for Eagle Scout projects due to private, not public, benefit. Discussed posting signs about a public road through private property. d. Storm water relief options discussed.
PUBLIC HEARING – JUNIPER ACRES SUBDIVISION PRELIMINARY PLAT REVIEW (Administrative) The Public Hearing was opened and closed due to no public comment. The commission reread the minutes from the LUA. Dan Turner answered David’s question regarding storm water, noting a detention pond in Juniper Hollow. David made a motion to approve the Preliminary Plat for Juniper Acres Subdivision as proposed. Brandon seconded the motion. Mark Lynne, David Zook, Melinda Lee, Brandon Buck, Tiffany Atkinson and Connor Balls voted in favor. 1 HYDE PARK CITY MASTER TRAILS PLAN (Legislative) Connor asked how our plan meets up with Smithfield City’s plan. Brad pointed out there are few connections between them. Discussed bike lanes and North Logan’s 800 East in particular. They are allowing the lines to fade now but plan to re-stripe when it becomes continuous with Hyde Park. Brad noted we need to define cross sections for each of the new designations including bikes and parking. Two sections were added: 1. Connecting the brown dotted line near Kal Ridge Subdivision, along Rio Davis’ property, 800 East Canyon Road. 2. Connecting 200 South between 250 East and 100 East, dotted blue line (?). Everyone agreed there should be some kind of ‘trail’ on 200 South from the CMPO road to 700 East. The cross sections need to come soon but are not required to pass the Trails Plan. David noted the Subdivision ordinance will also need amending so developers comply with the plan.
KENNEL PERMITS (Legislative) The Commission discussed the maximum number of dogs to be allowed and the proposed “agriculture venture” option. A penalty needs to be attached for better compliance. Melinda is against allowing more than two or three dogs. She explained the great system already in place: (1) People can live in the county with larger lots and the most freedom, or (2) they can live in a city providing more conveniences but having more restrictions, or (3) they can choose to live in an HOA offering more benefits but coming with the most restrictions. This system works well because people can choose where/how they want to live. Problems arise when you live in one and expect the benefits of another. Multiple dogs are a benefit of living in the county. Melinda believes most city residents oppose three or more dogs per property. All agreed some reference to “cats” needs to be added so that Animal Control may intervene when necessary. Brandon noted Providence City has varying penalties depending on the frequency of offenses. David suggested more research be done. Connor accepted the assignment to further research other cities’ allowances, restrictions and penalties.
REVIEW NUMBER AND TYPE OF SUBMISSION OF DRAWINGS (Legislative) Everyone quickly understood and agreed to revise the required number of copies and drawings submitted to the city for review. We prefer a digital copy and fewer hard copies. This applies to construction drawings, Sketch Plans, (Preliminary Plats were already addressed) and Final Plats. Mark made a motion to approve the changes and forward them to City Council for consideration. Brandon seconded the motion. Mark Lynne, David Zook, Melinda Lee, Brandon Buck, Tiffany Atkinson and Connor Balls voted in favor.
MINOR SUBDIVISIONS (Legislative) This item was not discussed and will be carried forward to the June 21 agenda.
WATER TRANSFER/DEDICATION TO CITY (Legislative) Mark noted Providence City approved a resolution that developers unable to obtain water rights shall pay the city $3,000 per acre foot. Brad had first-hand experience and said he was unable to find water rights because cities are buying them up whenever possible. He paid the fee but feels the practice is ‘hoarding’ on the city’s part. All agreed it seems like a conflict to have a city’s first right of refusal requirement while requesting developers find water rights. David suggested having a fee based on resolution adopted by the City Council, instead of stating a dollar figure in the ordinance. Our city should be putting money into a fund to purchase water shares when they become available.

Mark & Melinda briefly shared some of the LUAU training from May 13, specifically business licensing, building permits and holding bonds for infrastructure improvements.
