GROUNDS

I. General section 1. Reason for submission 1.1. Name Draft decree on the technical specifications for fire protection equipment. 1.2. Identification of problems Pursuant to § 101 of Act No 133/1985 on fire protection, as amended, the Ministry of the Interior is authorised, in implementing § 24(2), to lay down the technical specifications for fire protection equipment. In order to fulfil this statutory mandate, Decree No 255/1999 on the technical specifications for fire protection equipment was issued, the main purpose of which was to lay down uniform technical and tactical requirements for fire protection equipment used by all fire protection units of the various fire protection service providers. This particularly concerns requirements for high efficiency in deployment and safe use and protection of firefighters' health during an emergency response, because fire protection equipment is particularly in environments with an increased safety risk. The scope of the proposed changes, however, requires the issue of a new regulation. 1.3. Identification of objectives to be achieved By issuing the decree, improved conditions will be achieved for making use of current technological advances in the production of fire protection equipment taking into account important new tactical requirements in firefighting practice. 1.4. Identification of risks associated with inaction The draft decree responds to major changes arising from new technical regulations, for example: ČSN EN 469:2006, ČSN EN 137:2007, ČSN EN ISO 7225:2007, ČSN EN 15614:2008, ČSN EN 471+A1:2008, ČSN EN 1149-5:2008, ČSN EN 443:2008, ČSN EN ISO 5077:2008ČSN EN ISO 14116:2008, ČSN EN 1028-2+A1:2008, ČSN EN 1028- 1+A1:2009, ČSN EN 14466+A1:2009, ČSN EN ISO 11612:2009, ČSN EN ISO 13769:2009, ČSN EN ISO 105-C06:2010, ČSN EN 1089-3:2012, ČSN EN ISO 6330:2012 and ČSN EN ISO 105-E04:2013. It is impossible to ignore these changes, due to the need to protect firefighters and improve their safety at work, particularly with regard to the demand for highly-efficient fire protection equipment during emergencies. If a new decree were not issued with uniform technical specifications for fire protection equipment for all fire protection services, standardisation of conditions for all fire protection service providers would not be achieved and there would not be a clear-cut determination of conditions for producing fire protection equipment in the manufacturing sector. 2. Proposed alternatives: 2.1. Option 1 – doing nothing If the current Decree No 255/1999 on the technical specifications for fire protection equipment remains valid without changes, the technical and tactical specifications for fire protection equipment will not be adapted to the current requirements of fire-fighting practice

1 and for managing emergency responses and the European Union’s requirements for technical regulations would not be complied with. 2.2. Option 2 Given the scope of the changes to the technical specifications for fire protection equipment, an amendment to the existing decree would be unclear and complicated for the organisations concerned, particularly in terms of practical application. 2.3. Option 3 A new draft decree will enable the purchase of fire protection equipment with more efficient technical and tactical parameters. Individual technical specifications are set out clearly and unambiguously in the draft annexes in accordance with new technical regulations. 3. Assessing the impacts of the individual options Employing option 1 would reduce the quality of fire protection units’ emergency responses. Ignoring the new European Union technical regulations aimed at reducing work-related risks to firefighters and increasing the efficiency of fire protection equipment during emergency responses would result in an unjustifiable reduction in the technical standard of fire protection equipment used in emergencies, and would therefore restrict the successful management of fire risk. We do not recommend the proposed option 2 given the extent of the incorporated changes. The proposed option 3 would mean incorporating the European Union’s technical regulations and clearly and comprehensively establish technical specifications in individual annexes in order to improve the quality and efficiency of fire protection equipment during emergencies. Based on the above, the adoption of option 3 is recommended. 4. Consultation When preparing the draft decree, all proposed amendments were discussed with all regional fire and rescue brigades and with the technical and educational establishments of the General Directorate of the Fire and Rescue Service. All comments have been incorporated. Manufacturers and importers of fire protection equipment have also been consulted. Their technical comments were also taken on board. 5. The organisations concerned Providers of fire protection services: The Fire and Rescue Service of the Czech Republic, municipalities and firms which must have fire protection units under the Fire Protection Act, manufacturers and importers of fire protection equipment. 6. Assessing conformity of the draft legal regulation with the constitutional order of the Czech Republic The draft legal regulation is in accordance with the law of the Czech Republic, the Constitution of the Czech Republic and the Charter of Fundamental Rights and Freedoms and other constitutional laws, particularly with Article 2(3) and Article 79(3) of the Constitution of the Czech Republic.

Assessing conformity of the draft legal regulation with international treaties to which the Czech Republic is bound and its compatibility with European Union regulations The draft presented is not contrary to the Czech Republic’s obligations arising from its membership in the European Union, in particular, the Treaty of Accession of the Czech Republic to the European Union, the general principles of the law and the judicature of the European Court of Justice. The draft lays down the technical specifications for fire protection equipment in the Czech Republic, while at the same time maintaining the procedure under Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998, as amended by Directive 98/48/EC of the European Parliament and of the Council of 20 July 1998 and Council Directive 2006/96/EC of 20 November 2006 and Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012. 9. Assessing the current relationship and the impact of the proposed solution in relation to gender equality The draft legal regulation does not have an impact on gender equality. 10. Corruption risk assessment There are no corruption risks associated with the draft regulation. As part of the corruption risk assessment, it can be stated that the draft decree lays down specifications for fire protection equipment. These specifications are intended to standardise the use of fire protection equipment, which, in terms of public procurement, definitely has a positive impact (it concerns setting out specifications which are the starting point for awarding a public procurement contract). Therefore, the regulation’s scope includes a reasonable set of relations, regulated by it and neutral in terms of corruption risk. 11. Impact of the proposed solution on protection of privacy and personal data. The draft decree has no impact on the protection of privacy and personal data. 12. Anticipated social and environmental impact of the proposed legal regulation The presented legal regulation has neither a social impact nor a negative environmental impact. 13. Assessment of the economic impact of the proposed solution The presented legal regulation has no economic impact on fire protection service providers. There is no resulting obligation to urgently reequip units with new types of fire protection equipment as it is possible to continue using existing equipment corresponding to the existing legislation. The proposed changes will not significantly increase the purchase price of the equipment. The manufacturers and importers of fire protection equipment will have to respond to the new decree by adapting equipment to the required specifications. This may have an impact on the final market price of products, but since the decree responds in particular to progress made in the development of equipment and changes in related European standards, it may be noted that manufacturers would have to factor any costs into the product price even if a new decree were not issued. 14. 3 II. Special section

Pertaining to § 1(1) In paragraph 1, the subject of the regulation is indicated, being the technical specifications for fire protection equipment which must be satisfied for that equipment to be included in fire protection units’ kit. This does not affect the provisions of other legal regulations (§ 12 of Act No 22/1997 on technical requirements for products and amending and supplementing certain acts, as amended), under which fire protection equipment also includes stipulated products and must also fulfil, apart from the technical specifications set out in the decree, basic technical requirements under the provisions of relevant government regulations.

Pertaining to § 1(2) Paragraph 2 (a) to (i), sets out the fire protection equipment for which the draft directly lays down technical specification in letter (a) and in annexes 1 to 9. Changes to form and content in the technical specifications set out in individual annexes are re-determined. Individual annexes have been drawn up so that their content is divided in a uniform manner. The first paragraph of each annex always clearly defines the piece of equipment being addressed and its use. This definition is supported by an indicative reference to the relevant European or international standard. The technical specifications which are the subject matter of these standards and whose application is defined by another legal regulation (e.g. Government Regulation No 21/2003 laying down technical requirements for personal protective equipment, or Government Regulation No 173/1997 laying down selected products for assessing conformity) is not provided in the annexes, although they are valid alongside the technical specifications in the draft. Further technical specifications define specific properties required for use in fire protection units. This mainly concerns cases where the standard allows for more than one level of implementation, but in terms of use in the Czech Republic, only a certain level of implementation is suitable, or it concerns requirements aimed at ensuring mutual compatibility of fire protection equipment and its uniform appearance to identify members of fire protection units during emergencies. References to Czech technical standards are drawn up within the meaning of Article 45a(1) of Government Legislative Rules as last amended, in the form of an indicative reference. The specified standards will be notified in accordance with § 4(a)2 of Act No 22/1997 on technical requirements for products and on amending and supplementing certain acts, as amended, and in the manner set out in Annex 1 to these grounds. Variant or optional provisions are set out in the decree because it is necessary to take account of the various requirements of fire protection service providers. The decree thereby draws attention to the usual or more practical solutions. The mandatory application of these solutions, however, is not necessary and in some cases (e.g. for use in community voluntary fire brigade units) would unjustifiably increase the price of the fire protection equipment. Detailed reasoning behind the content of the individual annexes shall be given under the individual letters of paragraph 2.

4 Pertaining to § 1(3) In accordance with Article 45a(1) of the Government Legislative Rules as last amended, it is stated that the selected technical requirements specified in the annexes to this act shall be construed as having been met if the specified standard or part thereof, which contains the detailed technical requirements, is observed. These selected requirements are then defined in the text of the annexes by a basic technical requirement and identified by the text "in accordance with the specified standard", etc. These requirements may also be met using a different technical solution guaranteeing the same or a higher level of protection of authorised interests.

Pertaining to § 1(2)(a): The technical specifications for the digital terminal used in the PEGAS radio network (new annex). Fire protection units, in addition to analogue radio sets whose technical specifications are set out in Annex 1, also use digital terminals in the PEGAS radio network (name registered as a registered trademark of the Ministry of the Interior for its collective radio network). In the draft, the technical specifications of these terminals were supplemented with a reference to the TETRAPOL standard pursuant to ITU (International Telecommunications Union) regulation ITU-R M. 2014-1, Digital land mobile systems for dispatch traffic.

Pertaining to § 1(2)(b): Technical specifications of radio set The following amendments are incorporated into the draft: - A more precise specification of the emission type. - An increase in the minimum number of channels. - An increased required frequency coverage. - A requirement for the option to set 2 levels of RF power. - A reduction in the requirement for the output of audio amplifiers. - An amendment of the definitions of the requirement for selective call formats.

Pertaining to § 1(2)(c): Technical specifications for portable engine-driven fire pumps (replacing Annex 4 to Decree No 255/1999.) Pertaining to point 2: specification established for marking a portable engine-driven fire pump. Pertaining to point 7: a reduction in the minimum number of branches. Its adaptation is expected with regard to the fire pump's nominal output. Pertaining to point 9: added requirement for the optional continuous charging of an accumulator battery provided this forms part of the machine.

Pertaining to § 1(2)(d): The technical specifications for a self-contained open-circuit compressed air breathing apparatus (replacing Annex 3 to Decree No 255/1999.) Pertaining to point 18: the added requirement for the pressure cylinder or pressure cylinder valve to have a safety component which, in case of damage to the valve, restricts the flow of leaking gas from the pressure cylinder. This is currently standard equipment which significantly increases the safety of persons handling pressure cylinders during implementation and maintenance. Pertaining to point 20: the added option of equipping the face mask with a device for voice communication using a radio set or other means of communication.

5 Pertaining to § 1(2)(e): Technical specifications for helmets (replacing Annex 2 to Decree No 255/1999.) Pertaining to points 2 and 3: only formally revised, requirements in terms of electrical resistance and "frost resistance" are also the subject matter of the current version of the decree. The requirement to meet optional requirements in terms of resistance against radiant heat has been removed as it is currently mandatory in view of the basic technical requirements for the product in accordance with NV 21/2003, and it is the subject of a harmonised standard (see Article 4.7 of ČSN EN 443). Pertaining to point 6: requirements for the face mask have been removed. These are mandatory in view of the basic technical requirements for the product in accordance with NV 21/2003 and they are the subject of harmonised standard ČSN EN 14458, referred to in Article 4.1.5 of ČSN EN 443. The text has been modified so that it refers to "face protector", although the standard construes both a face protector as well as just an eye protector under the term face mask. If an eye protector is used on the helmet, it must comply with the relevant standard. It must also be possible to use it independently of the face protector. Pertaining to point 7: a requirement for the interchangeability of helmet parts during maintenance has been included. Pertaining to point 8(a): an added provision on the applicability of the face mask. Pertaining to point 8(d): an added provision on self-adhesive components. Pertaining to point 9: amended technical specifications on the colour of helmets. During the term of the decree’s validity, it was noted that the luminescent yellow-green colour displays were not durable and their contribution to improving firefighters' visibility was debatable due to the relatively short period of time during which the luminescent effect is perceptible on helmets. Pertaining to point 10: the added option for the helmet in the kit of the Fire and Rescue Service of the Czech Republic to have a shell surface in a colour other than the colour stated above. It will be only used on the basis of a decision by the management of the Fire and Rescue Service of the Czech Republic on the introduction of helmets in another colour to identify higher officers.

Pertaining to § 1(2)(f): Technical specifications for emergency response clothing I (replacing Annex 5 to Decree No 255/1999.) The requirement for minimum coverage of coat and trousers has been removed. It is mandatory in view of the basic technical requirements for the product in accordance with NV 21/2003, it is the subject of harmonised standard ČSN EN 469 (see Art. 4.5). Pertaining to point 3: specific requirements for resistance to abrasion, colour fastness and resistance to rubbing, which will ensure greater durability and the usable value of the clothing. Deleted paragraphs on under and outer articles of clothing and configuration, positioning belt and marking clothing with a badge. It is mandatory in view of the basic technical requirements for the product in accordance with NV 21/2003, it is the matter of harmonised standard 469 (Art. 4.4, 4.8 and 7). Deleted article on professional repairs as it is redundant; the equipment must fulfil a protective function throughout its lifetime and does not change with the repairs. The technical specifications apply to acquisition rather than use. Pertaining to point 5: the added provision on an option to equip clothing with various technical components that are commonly placed on clothing. The intention behind the draft is

6 to support the technological development of clothing. Pertaining to point 6: an added provision on the option to equip clothing by reinforcement in various areas. This is commonly used. Deleted requirement for single-row fastening system and in-set sleeves on the coat. Pertaining to 8(c): dimensions of the internal pocket re-defined as minimum dimensions. Deleted paragraph on the system of signalling a removed under garment. Pertaining to point 9: a change in the positioning of the name tag and personal identification number, rank marking added. Pertaining to point 12: an added provision on the option to equip trousers with pockets. This is commonly used. Pertaining to point 14: an added provision on the option to equip trousers with an inner cuff. This is commonly used. Pertaining to point 13: supplemented chapter on workmanship of clothing to ensure a higher quality of the clothing in fire protection units. Pertaining to points 15 and 16 - "High-profile material" (previously "reflective marking"): The specific requirements for the positioning of bands from the edge of the coat and from the end of sleeves and trouser legs have been deleted in light of comments that this cannot be executed in some sizes. Adjusted dimensions of the border with the sign FIREFIGHTERS and font to make it uniform for both emergency response clothing and work uniform II (Annexes 6, 7 and 9). It is now possible, under the sign FIREFIGHTERS, to place another similar sign indicating affiliation with a fire protection unit. Chapter on protective clothing accessories completely deleted. A new Annex 8 created.

Pertaining to § 1(2)(g): Technical specifications for emergency response clothing II (replacing Annex 9 to Decree No 255/1999.) New division of Annex as in Annex 6. Separate requirements for jacket, trousers, workmanship and high-profile material. Pertaining to point 3: specified requirements for resistance to abrasion, colour fastness and resistance to rubbing, which will ensure greater durability and the usable value of the clothing. Pertaining to point 4: an added provision on the option to equip the clothing with various technical components that are commonly placed on clothing but not made possible by the valid decree. The intention behind the draft is to support the technological development of clothing. Pertaining to point 5: an added provision on the option to equip clothing with reinforcement in various areas. This is commonly used. Pertaining to point 7: compared to the previous version, some requirements have been deleted for simplification in terms of cut. Pertaining to point 8: a change in the positioning of the name tag and personal identification number, rank marking added. Pertaining to point 11: an added provision on the option to equip the trousers with pockets. This is commonly used. Pertaining to point 12: an added chapter on workmanship of clothing to ensure a higher quality of the clothing in fire protection units. To points 13 and 14 - "High-profile material" (previously "reflective marking"): The specific requirements for the location of bands from the edge of the coat and from the end of sleeves and trouser legs have been deleted in light of comments that this cannot be executed in some sizes. Adjusted dimensions of the border with the sign FIREFIGHTERS and font to make it uniform for both emergency response clothing and work uniform II (Annexes 6, 7 and 9). It is

7 now possible, under the sign FIREFIGHTERS, to place another similar sign indicating place of dislocation of a fire protection unit. Completely deleted chapter on materials and marking.

Pertaining to § 1(2)(h): Technical specifications for accessories (replacing Part IV of Annex 5 to Decree No 255/1999.) Because of the broad application of this equipment in recent years, a separate annex has been created. The original content has been modified in the following points. Pertaining to point 1: due to the nature of the clothing, the options only to add accessories to the version with long sleeves and with trouser legs have been restricted. Pertaining to point 2: requirement to conform with general requirements for protective clothing has been added. Pertaining to point 3: requirements have been updated in terms of flame resistance and the reference to the standard for materials with limited flame expansion has been updated. At the same time, resistance against heat at 180 ± 5 °C is required. Pertaining to point 4: newly introduced requirements for colour fastness, dimension stability and resistance to rubbing, which will ensure greater durability and the usable value of the clothing. Pertaining to point 6: newly introduced requirement for option to launder at a defined temperature. Pertaining to point 12: introduced option to place badge and patch on the undershirt.

8 Pertaining to § 1(2)(i): Technical specifications for work uniform II (replacing Annex 6 to Decree No 255/1999.) The Annex has been completely revised. Pertaining to point 1: inserted reference to § 1(1)(b) of Decree No 97/2008 on standard service uniforms of officers of the Fire and Rescue Service of the Czech Republic, their use and means of external marking, and standard service card, and § 43(1) and (2) of Decree No 247/2001 on the organisation and activities of fire protection units, as amended. In order to ensure interdependence of the stated laws and regulations. Pertaining to point 3: new part of uniform introduced - polo-shirt (material defined in point 5 and cut in point 15). Pertaining to points 4, 6 and 7: for shirt, trousers and cap, specified requirements for resistance to abrasion, tensile strength, resistance to further tearing, colour fastness, resistance to rubbing and resistance to water vapour, a maximum change in dimensions following laundering and seam resistance, which will ensure greater durability and the usable value of the clothing. Pertaining to point 8: newly introduced requirement for the option to launder at a defined temperature. Pertaining to point 9: in contrast to the original four garment variants, only two have been re- defined and they are characterised by their exclusively required properties, in particular in terms of resistance to heat and flame (points 10 to 12). Variant A is a replacement of the previous variants 100 % Aramid and 50 %/ 50 % Aramid/Viscose FR. Variant B replaces the variants 100 % cotton and 65 % / 35 % polyester/cotton. Pertaining to points 13, 14 and 16 to 20: minor adjustments, a simplification of requirements for the clothing cut. The cuts of variants A and B only differ in the application of a yellow- green trimming ribbon and high-profile material. The cap is the same for both variants (with the option of applying the sign "FIREFIGHTERS" on the front of the cap and a trimming ribbon into the edge of the peak). Pertaining to point 21: an added chapter on the workmanship of the clothing to improve the quality of the clothing in fire protection units. Pertaining to point 22: the sign "FIREFIGHTERS" in a border is only positioned in variant A, as is the case with the accentuating band. Pertaining to point 23: in contrast to the yellow-green trimming ribbon, in the case of the high-profile material, the retroreflection colour or coefficient is precisely determined. Chapter on winter hood deleted. A hood for firefighters shall be used under the helmet in accordance with ČSN EN 13911.

Pertaining to § 1(2)(j): Technical specifications for underwear (replacing Annex 7 to Decree No 255/1999.) The validity of the original Annex 7, which laid down the technical specifications for short and long-sleeved T-shirts, has been extended to cover underwear in general, including underpants. References to some invalid standards have been deleted. Pertaining to point 3: requirements specified for colour fastness, a change in dimensions and resistance to rubbing, which will ensure greater durability and the usable value of the clothing. Pertaining to point 4: in the basic variant, only 60 %/40 % cotton/viscose material is allowed (the cotton/polyamide option did not have good results in use). Pertaining to point 5: alternatively, it is possible to use another material, provided it achieves the requirements referred to in this point. The draft thereby responds to requirements for introducing functional underwear, while maintaining thermal resistance at the level of mixed cotton/polyester material.

9 Pertaining to point 10: option introduced to place a badge and patch on the T-shirt.

Pertaining to § 2: Currently, fire protection units use equipment which satisfies the conditions laid down by Decree No 255/1999 on the technical specifications for fire protection equipment, as amended. In order to maintain the continuity of the equipment included in fire protection units, a transitional provision shall be laid down which allows for the continued use of equipment fulfilling the conditions of the earlier regulation.

Pertaining to § 3: In point 1, the existing valid Decree No 255/1999 on the technical specifications for fire protection equipment is deleted, which shall be replaced by the new decree. At the same time, in points 2 and 3, Decree No 456/2006 and Decree No 102/2009 amending Decree No 255/1999 are deleted. In addition, by a separate draft, part eleven of Government Regulation No 352/2000 amending some decrees of ministries and other administrative offices shall be cancelled. Part eleven relates to an amendment to Decree No 255/1999.

Pertaining to § 4: This is a technical regulation. In accordance with Article 48 (7) of Government Legislative Rules, the Decree was notified in accordance with Directive 98/34 /EC of the European Parliament and of the Council of 22 June 1998, as amended. "As amended" is understood to mean Directive 98/34/EC of the European Parliament and of the Council of 22 June 1998, as amended by Directive 98/48/EC of the European Parliament and of the Council of 20 July 1998 and Council Directive 2006/96 /EC of 20 November 2006 and Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012.

Pertaining to § 5: Effectiveness is anticipated as of … Effectiveness is determined as of the above stated date in view of the ongoing legislative process which relates to the procedure in the matter of approving technical regulations (Article 48 of the Legislative Rules - notification).
