1. PURPOSE.

The purpose of this Notice is to inform all Public Housing Agencies/Indian Housing Authorities (HAs) that the Department has entered into an Inter-agency Agreement with the Army Corps of Engineers (Corps) to conduct modernization inspections of developments undergoing modernization on behalf of the Department.

2. BACKGROUND.

The Department requested and received budget authorization in the Fiscal Year 1993 to allow it to contract for assistance to conduct modernization inspections and provide technical assistance to HAs. After exploring all the options, it was decided that the Department would enter into an Inter-agency Agreement (IAA) with the Corps to conduct modernization inspections on behalf of HUD. On September 28, 1993, an IAA was executed between HUD and the Corps to this effect. Implementing instructions for the execution of the IAA are attached.

3. INSPECTION PROCEDURE. Briefly, the inspection process will be as follows:

a. Public Housing Division Directors (PHDD) and Office of Native American Program Administrators (ONAPA) shall prepare schedules of the inspections to be performed. These schedules will be based on the risk analysis model being used for monitoring modernization projects, complexity of the modernization projects, and the availability of inspection funds for the Field Office. A copy of the schedules shall be submitted to the Headquarters. Revisions/adjustments to the schedules may be made as appropriate.

b. Field Offices shall decide as to the type(s) of inspection (physical inspection, contract administration review, drawings and specifications review, final inspection or any combination of these items), and the time frame when the inspections are to be conducted. A detailed description of these tasks is given in paragraph I of the attached Implementing Instructions.

c. Based on the priorities fixed by the PHDD/ONAPA, the PHDDs/ONAPAs, with Field engineers assistance, shall prepare work order(s) on the form attached and fax or mail overnight the work order(s) to the Corps for signature.

d. The Corps Divisional office, after signing the work order(s), shall make arrangements to perform the inspections stated in the work order(s).

e. Where the modernization work is carried out by contract, the PHDDs/ONAPAs shall request the HA to provide to the Corps a set of plans and specifications for the modernization project to be inspected by the Corps for its review.

f. The Corps shall contact and advise the HA as to when it will perform the inspection.

g. After completion of on-site inspection, the Corps shall discuss the deficiencies found, if any, with the HA Executive Director or his/her representative.

h. The Corps shall submit its written report of the inspection to the Field Office/ONAP within 5 working days after the inspection.

i. The PHDD/ONAPA shall review the report and, if satisfactory, accept it and forward a copy to the HA within 10 working days of the receipt of such report, if possible but no later than 30 calendar days.

j. The HA shall report to the PHDD/ONAPA of the corrective action taken, if any required, within 30 working days of the receipt of the copy of the written report from the HUD.

IMPLEMENTING INSTRUCTIONS Guidance for Executing the Memorandum of Agreement between The Department of Housing and Urban Development and The Department of the Army

I DEFINITIONS

A. Plans and Specifications means the documents developed by an architect/engineer (A/E) for procuring equipment or construction services.

B. Physical Inspection means monitoring the construction and performing designated tasks for assuring good quality of construction of the modernization of public/Indian housing (HA) developments. Major tasks include:

1. reviewing the plans and specifications in preparation for conducting the on-site inspection of a development where work is carried out by contract;

2. conducting on-site construction inspections to assure compliance with plans and specifications, modernization and energy conservation standards and other federal requirements;

3. preparing a report on each inspection including listing of the identified deficiencies and proposed solutions to correct them;

4. discussing the deficiencies before leaving the site with the HA's Executive Director or designee;

5. submitting a written inspection report to the Department of Housing and Urban Development (HUD) Field Office within five working days of the inspection;

6. recommending to the HUD Field Office whether a follow-up visit is needed to assure that deficiencies identified have been corrected;

7. participating in the final inspection of modernization developments, if directed by the Field Office.

C. Substantial Completion of Construction Contract The construction is considered substantially completed when the contract work has reached a completion status of approximately 98 percent, excluding seasonal work beyond the contractor's control.

D. Final Inspection is conducted in the presence of the Construction Contractor, HA and Corps of Engineers (Corps) representative (if directed by the Field Office) when the construction work is substantially complete (as defined in subparagraph B). The deficiencies to be completed/corrected by the contractor are to be listed in a punch list prepared by the HA representative.

E. Contract Administration means Corps review of HA procurement procedures for professional A/E and construction services and procuring equipment and materials in accordance with 24 CFR 85.36 and either 24 CFR 968.110(j) for Public Housing or 24 CFR Part 905, Subpart B, for Indian Housing. This includes but is not limited to:

1. determining that the solicitation procedures including advertisement and award as well as the contract documents satisfy 24 CFR 85.36 and all HUD requirements. Note: For Indian Housing Authorities, it includes compliance with 24 CFR Part 905, Subpart B, and Indian preference requirements;

2. overseeing HA contracts to ensure that the frequency and quality of inspections by the HA A/E is adequate for contract completion in accordance with the plans and specifications. Note: For force account, frequency and quality of HA's inspections for completion of force account work;

3. assuring contract modifications are: within scope and not already a part of the executed contract (repetitive); essential to the completion of the contract work; and related additive/deductive costs and time extensions are reasonable; and

4. determining that payments to the contractors adequately reflect the completion status of the contract work and are consistent with the schedule of payments.

F. Adequacy of Plans and Specifications means the review of proposed bidding documents including plans and specifications to assure that they are in accordance with the current Federal requirements and are free from omissions that may lead to contract modifications during the construction contract (Bidability, Constructability, Operability (BCO) Review). This is not applicable to force account labor.

______G. HUD's Inspection Procedures are provided in the Monitoring Guidebook dated April, 1993 - Construction Quality Review of Public and Indian Housing. The Corps is not limited to using only the checklist provided in the Monitoring Guidebook, but shall use its knowledge and expertise to assure that the modernization meets: the plans and specifications; the Modernization Standards in HUD Handbook 7485.2 , as revised; the Lead-Based Paint "Interim Guidelines for Hazard Identification and Abatement in Public and Indian Housing"; and the general construction industry performance standards.

H. Work Order is the document prepared by HUD which requires specific inspection and review actions to be carried out by the Corps staff. It includes the type of work, schedule of work and estimated costs (to be provided by the Corps) and is signed by both HUD Regional Contracting Officer and the Corps.

I. Force Account Labor is labor directly employed by the HA on either a permanent or a temporary basis.

II STATEMENT OF WORK

A. The Corps under this agreement shall: furnish all materials, equipment, services, and facilities; provide its own transportation; and execute tasks incident to or stated in the work orders and described in the definitions. When acting as HUD's agent, the Corps shall: have right of entry and free access to the development; and inspect all work as directed in the work order (including materials, equipment and fixtures furnished, installed or stored in and about the development).

B. The Corps shall designate a contact person in each of its Division offices. The HUD Field Office Public Housing Division Directors and the Office of Indian Programs (OIP) Directors or their designees shall prepare work plans with the assistance of the Corps. The work plans shall: be prioritized by the HUD Field Office; contain the developments to be inspected; specify the frequency of inspections; identify tasks to be performed for each inspection; and include the estimated cost of the task as provided by the Corps Division. HUD Field Office (Public/Indian Housing Director) shall be responsible for monitoring the HA where the development(s) are to be inspected according to the work plan schedule.

C. The HUD Field Office shall prepare a work order quarterly for HAs to be reviewed on the attached form. The work order shall contain the tasks to be performed by the Corps at identified development(s) at a particular HA and the period in which they are to be performed. Tasks typically included in the work order are described in the Section I, DEFINITIONS. Any specific instructions to the Corps concerning inspection/review of development(s) shall be put in the comments section of the work order by the HUD Field Office. For Public Housing, the HUD Field Office Public Housing Director shall deliver or fax the work order to the HUD designated Contracting Officer for signature. For Indian Housing, the OIP Director shall prepare the work order

3 ______and forward it to the HUD designated Contracting Officer for signature. Subsequently, the work order shall be delivered or faxed by the Field Office Public Housing Director/OIP Director to to Corps Division Office for accomplishing the requested inspections.

D. After receiving the work order, the Corps shall contact HUD Field Office representative to receive further instructions regarding the contact person on-site and the HA phone number for contacting the HA before inspection. The HUD Field Office representative shall advise the HA to be inspected to provide a set of the development(s) plans and specifications (where the work is being carried out by contract) to the Corps for its review before the on-site inspection. The HUD representative also shall inform the HA of the date and time of the inspection to be conducted by the Corps representative after confirmation by the Corps. The Corps shall review the development(s) plans and specifications furnished by the HA prior to the inspection. For contract administration review, the HUD Office shall advise the HA to provide access by the Corps representative to all necessary records of the particular project(s) for contract administration review. For adequacy of plans and specifications review, the HUD Field Office shall advise the HA to provide a set of contract documents including the bid documents in sufficient time for the Corps to review before the project is advertised for bids.

E. If the HUD Field Office determines that it is necessary to make changes to an existing work order, an amended work order may be issued any time following the procedures for issuing a new work order.

F. The Corps shall: include in each inspection report any identified safety or health hazard; discuss identified hazards with the HA's Executive Director or designee before leaving the site; immediately notify the HA's Executive Director or designee, and the HUD Field Office representative of any observed safety or health hazards which endanger life or threaten serious injury or property damage.

III REPORTING

A. After completion of an inspection, the Corps shall prepare an inspection report which shall cover one or more of the following:

1. For Physical Inspection:

a. Any deviations from the plans and specifications of executed contracts; any contract modifications which have not been approved or documented; and instances of deviations from the HUD modernization and energy conservation standards and Lead-Based Paint Guidelines;

b. Any deficiencies in construction materials or procedures and recommendations to correct deficiencies;

c. Any deficiencies in contract administration and recommendations for immediate and long term corrective measures; and

d. Recommendations for follow up inspection(s) to assure that the deficiencies are corrected.

2. For Contract Administration:

Any deficiencies/irregularities found in the contract administration to the HUD Field Office within 5 working days of completion of the review. The HUD Field Office, after review of the report, shall advise the HA of any corrective action required in that project or future projects.

3. For Review of Plans and Specifications (before project advertisement):

Any deficiencies of Federal requirements found to the HUD Field Office within 5 working days of completion of the review. The HUD Field Office shall review the report and advise the HA of any corrective action before the project is advertised for bids.

B. For physical inspections, the Corps shall discuss the inspection findings and/or recommendations and the corrective action required with the HA on-site representative and shall submit the report to the HUD Field Office within five working days of the inspection. The HUD representative shall examine the report for completeness and shall send a copy to the HA with a form transmittal letter to be signed by the Field Office Public Housing Division Director/OIP Director. If warranted, the HUD representative shall contact the Corps representative to discuss the areas of concern on the report and advise on corrections. The report shall reach the HA within ten working days, if possible but no later than 30 calendar days, after the on-site inspection is completed. Within 30 working days of the inspection, the HA shall furnish the HUD Field Office a written report of actions taken or to be taken as appropriate to remedy the finding and/or accomplish the recommendations contained in the HUD-approved Corps inspection report. A copy shall be provided to the Corps.

C. The Corps shall provide HUD Headquarters a summary report within 60 days after the end of each Fiscal Year summarizing the major defects found during the inspections for each Region. The report shall address, but not be limited to, the following categories: conformance of plans and specifications with the HUD modernization and energy conservation standards contained in 24 CFR Part 965, Subpart C and 24 CFR Part 905, Subpart I; adherence to construction schedule; major deficiencies in the construction materials and workmanship; major deficiencies in the contract administration; and recommendations for improvement in carrying out the modernization work.

D. The Corps shall submit quarterly and annual financial reports reflecting the funds expended and remaining for each Field Office/OIP to the HUD Field/OIP Office and Headquarters. HUD Headquarters may rearrange the allocation of funds for each Field Office based on the quarterly reports and the projected need for inspections by each Field Office. The HUD Field Office/OIP shall amend its schedules according to the available funds.

These implementing instructions may be modified or amended only by written, mutual agreement of both parties.

Column 8. Insert the estimated cost of those inspections. The estimate should be determined with the help of the Corps of Engineers personnel.
