REGULAR MEETING NOVEMBER 17, 2015 10:00 AM A regular meeting of the North Wildwood City Council was held on the morning of the above date in the City Hall. The President of Council stated, “The meeting is now open. Adequate notice of this meeting has been provided by posting a copy of the notice of the time and place of this meeting on the City Clerk’s bulletin board and by mailing a copy of the same to The Herald, The Press and Wildwood Leader on January 7, 2015.” ROLL CALL: Present were Mayor Patrick Rosenello, President of Council Salvatore Zampirri, Councilpersons David Del Conte, Margaret Bishop, James Kane, Joseph Rullo and Kellyann Tolomeo. Councilman Edwin Koehler was not present. Also present were City Administrator Kevin Yecco, Solicitor Andrew Cafiero and Engineer Ralph Petrella.

MAYOR ROSENELLO then presented a proclamation from the City to Mr. Henri J. Bedard, which was read by DEPUTY CITY CLERK VANSANT:

Proclamation from the Office of the Mayor: Whereas, Henri J. Bedard has lived in the City of North Wildwood since 1951, when he opened Henri J’s Service Station; and

Whereas, Mr. Bedard was drafted into the United States Army in 1944, ultimately serving in the 83rd Signal Company of the 83rd Infantry Division; and

Whereas, as a member of the 83rd Division Mr. Bedard participated in the liberation of France and Western Europe from Nazi tyranny during World War II; and

Whereas, Henri J. Bedard was recently honored by the French General Consulate in New York City as a recipient of the Insignia of Chevalier of the Legion of Honor, designated by the President of the French Republic and awarded by the President of the American Society of the French Legion of Honor; and

Whereas, this prestigious distinction underlines the deep appreciation and gratitude of the French people for Mr. Bedard’s contribution and the commitment of all American soldiers to secure final victory in World War II.

Now, Therefore, Be it Resolved, that the Mayor and City Council of the City of North Wildwood hereby honor and congratulate Henri J. Bedard for his designation as Chevalier of the Legion of Honor by the French Government.

Be it Further Resolved, that to commemorate this award Mayor Patrick T. Rosenello does hereby designate Tuesday, November 17, 2015 as “Henri J. Bedard Day” in the City of North Wildwood.

MINUTES: On a motion by Bishop, seconded by Tolomeo, that the minutes of the regular meeting of November 4, 2015 be approved as read. Carried.

APPOINTMENTS:

Ratification of Employment Status Change-DPW Superintendent

ADMINISTRATOR YECCO stated that documentation regarding this ratification was circulated to each council member making them fully apprised of the status change.

On a motion by Tolomeo, seconded by Kane, the above status change be confirmed. Carried.

On a motion by Rullo, seconded by Bishop, that the above reports be received and filed as presented. Carried.

ORDINANCES:

ORDINANCE NO. 1688 – On a motion by Kane, seconded by Rullo, that Ordinance No. 1688 be placed on its second reading. Carried. The Deputy City Clerk read Ordinance No. 1688 by its title, known as “An Ordinance Rezoning Block 244, Lot 1 (Bill Henfey Park) From R-1 To ROSE. “ This Ordinance has been published according to Law, posted on the City Clerk’s bulletin board with copies available in the City Clerk’s Office on request. The President of Council stated this was the time and place to hold a public hearing on Ordinance No. 1688 and asked if anyone present had any objections to the passage of this Ordinance. Hearing none, he then asked the Deputy City Clerk if she had received any objections in writing, the Deputy City Clerk stated none, the President of Council declared the hearing closed. On a motion by Kane, seconded by Bishop, that Ordinance No. 1688 be passed on its second reading and published according to Law, the roll being called, all voting in the affirmative, the President of Council declared Ordinance No. 1688 duly adopted.

ORDINANCE NO. 1689 – On a motion by Tolomeo, seconded by Del Conte, that Ordinance No. 1689 be placed on its second reading. Carried. The Deputy City Clerk read Ordinance No. 1689 by its title, known as “An Ordinance Amending And Supplementing Ordinance 582, As Amended And As Codified In Chapter 344 Of The Code Of The City Of North Wildwood, Pertaining To The Rental Of Property“. This Ordinance has been published according to Law, posted on the City Clerk’s bulletin board with copies available in the City Clerk’s Office on request. The President of Council stated this was the time and place to hold a public hearing on Ordinance No. 1689 and asked if anyone present had any objections to the passage of this Ordinance. Hearing none, he then asked the Deputy City Clerk if she had received any objections in writing, the Deputy City Clerk stated none, the President of Council declared the hearing closed. On a motion by Tolomeo, seconded by Koehler, that Ordinance No. 1689 be passed on its second reading and published according to Law, the roll being called, all voting in the affirmative, the President of Council declared Ordinance No. 1689 duly adopted.

ORDINANCE NO. 1690 – On a motion by Del Conte, seconded by Rullo, that Ordinance No. 1690 be placed on its first reading. Carried. The Deputy City Clerk read Ordinance No. 1690 by its title, known as “An Ordinance Providing for the Consolidation of the Zoning Board of Adjustment and the Planning Board Pursuant to N.J.S.A. 40:55D-25c(1).”

MAYOR ROSENELLO stated that currently the type of application dictates whether it will be held before either the Planning Board or Zoning Board. Consolidating these boards will eliminate inconsistency and will result in a fair hearing. The Board will be slightly larger. There have been resignations on the Planning and Zoning Boards; anyone who is interested in becoming a board member will be put on a wait list as openings become available in the future.

On a motion by Tolomeo, seconded by Kane, that Ordinance No. 1690 be passed on its first reading and published according to Law, the Deputy City Clerk called the roll, all voting in the affirmative, the President of Council declared Ordinance No. 1690 passed on its first reading. RESOLUTIONS: # 223-15 RE: Refund for Overpayment of Real Estate Taxes

The above resolution was offered by Bishop, seconded by Tolomeo, the roll being called, all voting in the affirmative, the President of Council declared the resolution duly adopted.

# 224-15 RE: Cancellation of Real Estate Tax Lien

The above resolution was offered by Rullo, seconded by Kane, the roll being called, all voting in the affirmative, the President of Council declared the resolution duly adopted.

Mayor Rosenello thanked Councilman James Kane for his assistance with organizing the donation of two Segways for the party.
