14. General Summary of Function/Purpose of Position This position serves as the Foreign Labor Certification Officer (FLCO) for the State of Michigan. The FLCO performs work as assigned and under the supervision of the State Monitor Advocate (SMA). The FLCO is the State Workforce Agency’s (SWA) officer that reviews and approves all foreign labor applications under the H-2A and H-2B visa programs. The FLCO is responsible for reviewing and submitting prevailing wage and practice surveys to the CNPC, satisfying application requirements under 20 CFR 655. Will prepare H-2A and H-2B training modules and train One-Stop and state staff. The FLCO will respond to all H-2A and H-2B inquiries from employers and employer representatives. The FLCO will maintain constant communication with the Chicago National Processing Center (CNPC) to ensure all foreign labor requests meet federal and state requirements. Will process housing inspection requests with Michigan Department of Agriculture and Rural Development. Maintain all H-2A and H-2B data and prepare reports. 15. General Summary: Percentage: 70

Under the direction of the SMA will oversee all responsibilities under the foreign labor certification program. Review and approve all H-2A and H-2B foreign worker requests.

Individual tasks related to the duty:

• Review all H-2A and H-2B foreign worker requests to ensure compliance. • Identify deficiencies and communicate with CNPC, and, or, employer. • Correct deficiencies. • Daily correspondence with CNPC to address issues with H-2A application form, ETA790. • Communicate as needed with local One-Stops to ensure Order Holding Office (OHO) responsibilities are followed. • Assist with preparation of annual summery report of JS services to Migrant and Seasonal Farmworkers (MSFW) based on statistical data and activities set forth in the federal regulations. • Assist with preparation of quarterly LEARS report to USDOL under the supervision of the SMA. • Assist SMA with training for One-Stop Service Centers staff and state staff on provision of services to MSFWs and employers. Duty 2

Review and finalize all prevailing wage and practice survey results prior submitting to SMA and CNPC. Individual tasks related to the duty:

• Identify employers in wage reporting areas involved in the harvest of specific fruits and vegetables. • Contact employer’s in-person, by telephone, e-mail and mail, to gather information to establish prevailing wages and practices. • Will work closely with outreach staff to obtain most accurate wage/practice information possible. • Communicate with SMA unit staff any issues arising from data collected. • Will assist train outreach staff in proper methods of conducting surveys. • Maintain records of all completed surveys. • Research and analyze collected wage and practice data collected. Duty 3

Field checks for H-2A worksites. Individual tasks related to the duty:

• Will conduct field checks at H-2A worksites where US workers are hired. • Conduct field visits where problems arise. • Prepare field check reports. • Identify any apparent violations and attempt informal resolution. • Receive complaints and process accordingly. Duty 4

Other duties as assigned. Individual tasks related to the duty:

• Participate in unit and division planning sessions. • Gather and summarize materials and data for planning purposes. • Participate in MI Works! Centers partnership meetings. • Make public presentation to employers, labor organizations, and community groups regarding services available from the Migrant Farmworker and Foreign Labor programs • Attend and participate meetings relating to MSFWs and/or employers, when necessary.

16. Describe the types of decisions made independently in this position and tell who or what is affected by those decisions. Decisions regarding daily activities of the position, decisions regarding training venues and delivery of training and reference material approved by SMA. Contacting and referring complaints to proper enforcement agency, ensuring complainant will not have to wait extensive time to have complaints resolved. Establishing a prevailing wage or practice without approval from CNPC, agricultural employers and workers are affected with wages and benefits. Providing proper training and technical guidance to One-Stops in provision of Foreign Labor services.

This position requires in and out of state travel and unusual hours. Prolonged sitting in transit and at worksites on a regular basis. Flexible and possibly long working hours in order to carry out goals and objectives.

Updated to reflect concentration on FLC duties This position has changed in structure as it now falls under the administration for the Office of Talent policy and Planning as a result of the MSFW program being reintroduced back into state government. This required the WDA to review job structure and duties as they pertain to the grant. This area is a total reorganization and update of duties.

25. What is the function of the work area and how does this position fit into that function? Responsibilities of this position include, but are not limited to: 20 CFR 655, and will serve as the states foreign labor certification officer. Departmental Analyst 10 One year of professional experience.

Departmental Analyst P11 Two years of professional experience, including one year of experience equivalent to the intermediate (10) level in state service.

KNOWLEDGE, SKILLS, AND ABILITIES:

• Ability to interpret federal regulations and policies. • Ability to read, write and communicate in Spanish. • Knowledge of the foreign labor, specific to H-2A and H2B • Microsoft Word, Excel, Spreadsheet, PowerPoint.

The FLCO should meet the following criteria: (1) Speak, read and write Spanish or other languages significant of the MSFW population in the state, (2) have substantial work experience in farmworker activities.
