1 [3402-1] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO AMEND SECTION 2-17-10 AND 8-13-1300, BOTH AS 12 AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, 13 RELATING TO DEFINITION OF TERMS IN MATTERS 14 RELATING TO CAMPAIGN PRACTICES AND IN MATTERS 15 RELATING TO LOBBYISTS AND LOBBYING, 16 RESPECTIVELY, INCLUDING THE DEFINITION OF 17 LEGISLATIVE CAUCUS COMMITTEE, SO AS TO PROVIDE 18 THAT SUCH A CAUCUS MAY BE CREATED BASED UPON 19 A SPECIAL LEGISLATIVE INTEREST. 20 Amend Title To Conform 21 22 Be it enacted by the General Assembly of the State of South 23 Carolina: 24 25 SECTION 1. Section 2-17-10(11) of the 1976 Code is amended to 26 read: 27 28 “(11) ‘Legislative caucus’ means: 29 (a) a committee of either house of the General Assembly 30 controlled by the caucus of a political party or a caucus based upon 31 racial or ethnic affinity, or gender; 32 (b) a party or group of either house of the General Assembly 33 based upon racial or ethnic affinity, or gender. However, each 34 house may establish only one committee for racial-, ethnic-, or 35 gender-based affinity. 36 (c) ‘Legislative caucus’ does not include a legislative special 37 interest caucus as defined in Section 2 - 17 - 10(21).” 38 39 SECTION 2. Section 2-17-10 of the 1976 Code is amended by 40 adding the following numbered subsection at the end to read: 41

1 [3402] 1 1 “(21) ‘Legislative special interest caucus’ means twelve or 2 more legislators who, based upon a special interest, seek to be 3 affiliated for use of General Assembly facilities and employees 4 under such terms and conditions as granted by the Speaker of the 5 House of Representatives or the Senate Operations and 6 Management Committee. Each legislative special interest caucus 7 must register with the clerk’s office of the Senate or House of 8 Representatives in a manner mandated by the clerk’s office. 9 However, each legislative special interest caucus must provide, 10 and the clerk’s office must maintain a record of: 11 (a) the name and purpose of the caucus; 12 (b) the names of all caucus members; and 13 (c) the date of creation, and dissolution, if applicable. 14 The clerk’s office must maintain these records for at least four 15 years following the dissolution of the caucus. A legislative special 16 interest caucus may include, but is not limited to, a representation 17 of sportsmen and women desiring to enhance and protect hunting, 18 fishing, and shooting sports.” 19 20 SECTION 3. Section 8-13-1300(21) of the 1976 Code is amended 21 to read: 22 23 “(21) ‘Legislative caucus committee’ means: 24 (a) a committee of either house of the General Assembly 25 controlled by the caucus of a political party or a caucus based upon 26 racial or ethnic affinity, or gender; however, each house may 27 establish only one committee for each political-, racial-, ethnic-, or 28 gender-based affinity; 29 (b) a party or group of either house of the General Assembly 30 based upon racial or ethnic affinity, or gender; 31 (c) ‘Legislative caucus’ does not include a ‘legislative 32 special interest caucus’ as defined in Section 2 - 17 - 10(21).” 33 34 SECTION 4. Section 2-17-90(A)(1) of the 1976 Code is amended 35 to read: 36 37 “(1) as to members of the General Assembly, a function to 38 which a member of the General Assembly is invited if the entire 39 membership of the House, the Senate, or the General Assembly is 40 invited, or one of the committees, subcommittees, joint 41 committees, legislative caucuses or their committees or 42 subcommittees, legislative special interest caucuses, or county 43 legislative delegations of the General Assembly of which the

1 [3402] 2 1 legislator is a member is invited. However, the Speaker of the 2 House and Speaker Pro Tempore of the House may be included in 3 an invitation to one of the above groups. In addition, invitations 4 may be extended and accepted when the invitation is extended to 5 all members in attendance at (a) national and regional conventions 6 and conferences of organizations for which the General Assembly 7 pays annual dues as a membership requirement and (b) American 8 Legislative Exchange Council conventions and conferences; 9 10 SECTION 5. This act takes effect upon approval by the 11 Governor. 12 ----XX---- 13
