3) ACIL Antitrust Statement Uttenweiler
a) The Essential Principles of ACIL Sections provides that meetings must comply with the antitrust rules that apply to trade associations. This means that, during any ACIL meeting, there shall be no discussion of the following: current or future prices of services; price lists or procedures for coordinating price changes, sales quotas, allocation or division of territories or clients; boycotting any party or denying any party access to markets, products, or information; commercial practices of competitors or clients; anything dealing with trade abuses or excluding or controlling competition. There is a degree of constitutional protection from antitrust liability when dealing in good faith with taking positions on legislation. Nonetheless, following the foregoing will help avoid potential problems.

6) NETTCP – Progress Report – Jerry Weathers and S. Bowser
a) Jim Kuhn and Jerry Weathers met with Chris Bowker – Aug 14 – Jim Mahoney – Nettcp board member
i) Key player – discussion followed general prepared outline for the MOU
(1) Fairly well aligned but need to work on final agreement
(2) Outcome – pilot course in Ohio – supported by NETTCP
(a) Targeting week of Nov 11 (T-W-Th)
(3) Summary of the meeting has been distributed
(4) Ohio was not expecting a certification course but a workshop
(a) Discussions on this issue will continue
(5) ODoT seems to be on board with a positive consideration of a NETTCP / ACIL partnership
ii) Details may be set in approximately one week
7) NACLA and US Army Corps of Engineers - Update Bush / Uttenweiler
a) Working at contact will continue
8) A.O.B.
9) Next CMET Executive Committee meeting will be October 6, 2013 at the ACIL Annual Meeting in Scottsdale, AZ
