Sick Leave

An officer or employee will be granted leave of absence on account of illness as provided in the Sick Leave Directive.

Who does it apply to? This applies to:  Public service officers  Temporary employees engaged under section 148(2)(a) of the Public Service Act 2008  General employees engaged under section 147(2)(a) of the Public Service Act 2008 where indicated in the Schedule.

This directive does not apply to:  Employees engaged on a casual basis under sections 147(2)(b) and 148(2)(b) of the Public Service Act 2008.

Broad overview

Use of sick leave for family illness purposes

An employee with responsibilities in relation to either members of their immediate family or members of their household who need the employee's care and support is entitled to use sick leave for absences to provide care and support for such persons when they are ill.

The employee shall, if required, produce a medical certificate or statutory declaration stating that the person requiring care is ill.

The entitlement to use sick leave is subject to:  the employee being responsible for the care of the person concerned  the person concerned being o a member of the employee's immediate family o a member of the employee's household o the term 'immediate family' includes . a spouse (including a former spouse, a de facto spouse and a former de facto spouse) of the employee . a child (including an adult child, an adopted child, a foster child, a step child or an ex-nuptial child), parent, grandparent or sibling of the employee or spouse of the employee.

The employee shall, wherever practicable, give their supervisor notice prior to the absence of the intention to take leave, the name of the person requiring care and their relationship to the employee, the reasons for taking such leave and the estimated length of absence. If it is not practicable for the employee to give prior notice of absence, the employee shall notify the supervisor by telephone of such absence at the first opportunity on the day of absence.

Graduated return to work programs

In relation to graduated return to work programs where the Government Superannuation Office is involved, the Department will pay for the hours teachers are on duty, with payment for the remaining period being by way of superannuation benefits.
