On motion of Mr. Lagasse, seconded by Mr. , the following ordinance was offered: SUMMARY NO. 22754 ORDINANCE NO. An ordinance approving the Preliminary and Final Plat of resubdivision of Lot A, Square 9, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, into Lots A1, A2 & A3, Sq. 9, Fos Place Addition No. 3 Subdivision, in accordance with plan by Dufrene Surveying & Engineering, Inc., dated July 19, 2008, which lots are owned by The Four Columns, Inc., Deip Ngoc Dong, Dong Giang, Hue Ngoc Gianc, Nam Huu Giang, Dong Khanh, Inc., Thi Be Nguyen Chaung, San Hoa Chung, Truyen T. Vu, Van Kien Luu and Kimle To Luu Van, and approving and accepting the Final Plat of said subdivision. (Council District 2) WHEREAS, Truyen T. Vu is the owner of Lot A, Unit 1, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Gene Friedman, Notary Public, dated November 8, 1988 registered in COB 2080, Folio 0069, Parish of Jefferson; and WHEREAS, Hue Ngoc Giang and Nam Huu Giang are the owners of Lot A, Unit 2, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated November 10, 1988 registered in COB 2101, Folio 0061, Parish of Jefferson: and the owners of Lot A, Unit 3, Fos Place Addition No. 3, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated February 6, 1992 registered in COB 2647, Folio 0220, Parish of Jefferson; and the owners of Lot A, Unit 6, Fos Place Addition No. 3, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated October 1, 1992 registered in COB 2779, Folio 0230, Parish of Jefferson; and the owners of Lot A, Units 13, 14, 15, 16, 17, 18, 19, and 20, Fos Place Addition No. 3, Jefferson Parish, Louisiana, which they acquired by Act before Duane D. Dunn, Notary Public, dated August 21, 2002 registered in COB 3082, Folio 0210, Parish of Jefferson; and WHEREAS, Dong Khanh, Inc. is the owner of Lot A, Units 4, 8, and 9, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated November 12, 1988 registered in COB 2159, Folio 0128, Parish of Jefferson, and the owner of Lot A, Unit 10, Fos Place Addition No. 3, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated February 6, 1992 registered in COB 2647, Folio 0220, Parish of Jefferson; and is the owner of Lot A, Unit 12, Fos Place Addition No. 3, Jefferson Parish Louisiana, which they acquired by Act before Perter C. Bertucci, Notary Public, dated January 9, 1992 registered in COB 2625, Folio 0147, Parish of Jefferson; and WHEREAS, Thi Be Nguyen Chung and San Hoa Chung are the owners of Lot A, Unit 5, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated May 15, 1989 registered in COB 2203, Folio 0280, Parish of Jefferson; and WHEREAS, Dong Giang and Van Kien Luu are the owners of Lot A, Unit 7, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated May 29, 2001 registered in COB 3054, Folio 0421, Parish of Jefferson; and WHEREAS, Diep Ngoc Dong, Giang Dong, Kimle to Luu Van and Luu Kien Van are the owners of Lot A, Unit 11, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before David Dowell, Jr., Notary Public, dated January 5, 2006 registered in COB 3159, Folio 0337, Parish of Jefferson; and WHEREAS, The Four Columns, Inc. is the owner of Lot A, Unit 21, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana, which they acquired by Act before Peter C. Bertucci, Notary Public, dated May 15, 1989 registered in COB 2203, Folio 0280, Parish of Jefferson; and WHEREAS, said owners desire to resubdivide said Lot into Lots to be designated as Lots A1, A2, and A3, Sq. 9, Fos Place Addition No. 3 Subdivision; and WHEREAS, said subdivision shall contain no public improvements, therefore the Preliminary Plat and Final Plat may be approved and accepted in combination in accordance with Section 33-2.26(d); and WHEREAS, the Planning Director of this Parish has caused to be duly advertised as prescribed by law, a public hearing in connection with the resubdivision of said lots; and WHEREAS, a public hearing was held by the Planning Advisory Board, in accordance with the law: NOW THEREFORE, THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS: SECTION I. That the Preliminary Plat of Dufrene Surveying & Engineering, Inc. dated July 19, 2008 showing the resubdivision of Lot A, Square 9, Fos Place Addition No. 3 Subdivision, Jefferson Parish, Louisiana into Lots A1, A2, and A3 in said square in accordance with said plan, is hereby approved. SECTION II. That the Final Plat of Dufrene Surveying & Engineering, Inc., dated July 19, 2008 showing the resubdivision of Lot A, Square 9, Fos Place Addition No. 3, Subdivision, Jefferson Parish, Louisiana into Lots A1, A2, and A3 in said square in accordance with said plan, is hereby approved and accepted. SECTION III. That the parking spaces, drive aisles and the 25’ common driveway servitude between and within Lots A1, A2 and A3 shall be used jointly, and are hereby cross-dedicated for use by all lots, owners, clients, invitees and customers to the extent of satisfying the parking requirements for said lots; said cross-dedication cannot be renounced or revoked without the written permission of the Director of Inspection and Code Enforcement. SECTION IV. That the Parish of Jefferson has not examined or reviewed the title of any portion of land shown, or any restrictive covenants or restrictions placed on said property, and that the action of the Parish in this matter does not imply (1) that the applicant’s or owner’s title or ownership is valid, (2) that there are or are not any restrictive covenants or other restrictions on said property, or (3) that any restrictive covenants or restrictions that may be on said property are enforceable or are not enforceable. SECTION V. That the Chairman of the Parish Council of Jefferson Parish, or in his absence the Vice Chairman, is hereby authorized, empowered, and directed to sign all documents and acts necessary and proper in the premises to give full force and effect to this ordinance. This ordinance having been submitted to a vote, the vote thereon was as follows: YEAS: NAYS: ABSENT: This ordinance was declared to be adopted on the 24th day of June, 2009 and shall become effective as follows, if signed forthwith by the Parish President, ten (10) days after adoption; thereafter, upon the signature by the Parish President, or, if not signed by the Parish President, upon expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter. If vetoed by the Parish President and subsequently approved by the Council, this ordinance shall become effective on the day of such approval.
