AN ACT Relating to Donated Dental Services and Making an Appropriation Therefor

AN ACT relating to donated dental services and making an appropriation therefor. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

SECTION 1. A NEW SECTION OF KRS CHAPTER 211 IS CREATED TO READ AS FOLLOWS: (1) As used in this section, unless the context requires otherwise: (a) "Department" means the Department for Public Health; and (b) "Program" means the Donated Dental Services Program established in Section 2 of this Act. (2) The Donated Dental Services Program is hereby established in the Department for Public Health. The department, in consultation with the Dental Lifeline Network or its designee, shall maintain the program through which volunteer dentists provide comprehensive dental care for needy, disabled, aged, and medically compromised individuals who cannot afford necessary treatment but are ineligible for public assistance. Eligible individuals may be treated by the volunteer dentists in their private offices or other appropriate locations. Eligible individuals shall not be required to pay a fee or cost. (3) The contract shall specify the responsibilities of the administering organization that may include: (a) Maintaining a network of volunteer dentists, including dental specialists,

volunteer dental laboratories and other appropriate volunteer professionals, to donate dental services to eligible individuals; (b) Maintaining a system to refer eligible individuals to appropriate volunteers; (c) Implementing on a continuing basis a public awareness campaign to educate eligible individuals about the availability of the program; (d) Providing appropriate administrative and technical support to the program; (e) Submitting an annual report to the department that: 1. Accounts for program funds;

2. Reports the number of individuals served by the program and the number of dentists and dental laboratories participating as providers in the program; and 3. Other information required by the department; and (f) Performing, as required by the department, any other duty relating to the program.

Section 2. There is appropriated to the Department for Public Health from the General Fund $70,000 in fiscal year 2014-2015 and $70,000 in fiscal year 2015-2016 for the Donated Dental Services Program established in Section 1 of this Act. Notwithstanding KRS 45.229, any General Fund appropriation unexpended at the end of fiscal year 2014-2015 shall not lapse but shall be carried forward into the next fiscal year.

Section 3. This Act shall be known and may be cited as the "Donated Dental Services Act."

Section 4. Whereas there is pressing need for oral health services in Kentucky, an emergency is declared to exist, and this Act takes effect upon its passage and approval by the Governor or upon its otherwise becoming a law.
