Senior Issues (B) Task Force Conference Call June 9, 2016

The Senior Issues (B) Task Force met via conference call June 9, 2016. The following Task Force members participated: Mike Rothman, Chair (MN); Kevin M. 1. Adopted revisions to the Long-Term Care Model Act (#640), the Long-Term Care Insurance Model Regulation (#641) , and the NAIC Guidance Manual for Rating Aspects of the Long-Term Care Insurance Model Regulation

Mr. McKinney gave an overview of the work completed by the Long-Term Care Consumer Disclosure (B) Subgroup. He then offered an amendment to clarify the intent of the Subgroup in regards to Section 6L and Section 6K in the Long-Term Care Insurance Model Act (#640). Mr. McKinney made a motion, seconded by Mr. Johnson, to adopt the report of the Long- Term Care Consumer Disclosure (B) Subgroup as amended. The motion passed.

Commissioner Rothman asked for any comments to the report. Gayle L. Woods (OR) submitted a comment regarding Section 6D2a of the Long-Term Care Model Act (#640). Ms. Woods was not present on the call and David Torian (NAIC) read Ms. Woods’ comment to the Task Force. She suggested changing the word “of” to the word “or” in Section 6D2a. Ms. Boroff made a motion, seconded by Mr. McKinney, to adopt the change. The motion passed.

Commissioner Rothman recognized Brenda Cude (University of Georgia) to explain her comment to page 23 of Model 641. Dr. Cude was not present and Mr. Torian explained Dr. Cude’s comment. Commissioner Rothman asked for a motion. No motion was given and the comments were not adopted.

Bonnie Burns (California Health Advocates—CHA) thanked Mr. McKinney for the good work of the Subgroup in addressing consumer language. Commissioner Rothman raised the issue of inflation protection Ms. Burns brought to his attention and stated that the Task Force would examine this matter at a future meeting.

Commissioner Rothman asked for a roll call vote to adopt the Long-Term Care Consumer Disclosure (B) Subgroup report on Model 640, Model 641, and the NAIC Guidance Manual for Rating Aspects of the Long-Term Care Insurance Model Regulation, as amended. The motion passed.

Having no further business, the Senior Issues (B) Task Force adjourned.
