1 [1008-1] 1 2 3 4 5 6 7 8 9 A BILL 10 11 TO DEVOLVE THE AUTHORITY FOR APPOINTMENTS 12 AND RECOMMENDATIONS FOR APPOINTMENTS FOR 13 BOARDS AND COMMISSIONS FROM THE LEGISLATIVE 14 DELEGATION REPRESENTING BEAUFORT COUNTY TO 15 THE GOVERNING BODY OF BEAUFORT COUNTY AND TO 16 PROVIDE EXCEPTIONS. 17 Amend Title To Conform 18 19 Be it enacted by the General Assembly of the State of South 20 Carolina: 21 22 SECTION 1. (A) Except as provided in subsection (B), all 23 appointments or recommendations for appointments to offices, 24 boards, and commissions affecting only Beaufort County which by 25 statute or resolution are made by or upon the recommendation of 26 the House Delegation, Senate Delegation, or Joint Legislative 27 Delegation of Beaufort County must be made by or upon the 28 recommendation of a majority of the members of the governing 29 body of Beaufort County. 30 (B) The application of subsection (A) does not include: 31 (1) any office elected by the members of the General 32 Assembly in joint session or any office, board, or commission 33 appointed, elected, or recommended by members of the General 34 Assembly for a position representing a judicial circuit or 35 congressional district; 36 (2) any recommendation for a magistrate appointed as 37 provided in Section 22-1-10; 38 (3) any recommendation for a master-in-equity appointed as 39 provided in Section 2-19-110; 40 (4) members of the Beaufort County Board of Elections and 41 Registration;

1 [1008] 1 1 (5) members of the county transportation committee as 2 provided in Section 12-28-2740; 3 (6) the Commissioners of Pilotage for the Port of Port Royal 4 as provided in Section 54-15-10; 5 (7) appointments to the Technical College of the 6 Lowcountry Commission as provided in Section 59-53-910; 7 (8) any offices, boards, and commissions whose duties and 8 responsibilities are totally within the boundaries of a municipality, 9 which appointments must be made by the governing body of the 10 municipality in which is located a majority of the customers served 11 by that office, board, or commission; 12 (9) Coastal Empire Mental Health Center Board of 13 Directors; 14 (10) Beaufort-Jasper Higher Education Commission; 15 (11) Lowcountry and Resort Island Tourism Commission; 16 (12) Beaufort-Jasper Water and Sewer Authority Board of 17 Directors; 18 (13) Broad Creek Public Service Commission; 19 (14) Fripp Island Public Service District; 20 (15) Hilton Head Island #1 Public Service District; or 21 (16) South Island Public Service District. 22 (17) The county Veterans Affairs officer as provided in 23 Section 25-11-40. 24 25 SECTION 2. This act takes effect upon approval by the 26 Governor. 27 ----XX----
