Local Government Official Information and Meetings Act 1987 Re: SHA - Heather du Plessis- Allen

I refer to your email, which we received on 7 May 2015, requesting information on all SHAs considered by Auckland Council including: the location; the final decision on approval; and the reason for the decision if anything other than approval.

All decisions on Special Housing Areas (SHAs) are treated as confidential until the information has been released by the Mayor/Deputy Mayor. Locations of the 84 approved SHAs are listed on the council website.

All approaches or inquiries made to the council about possible SHAs are treated as being made in confidence. The council, therefore, treats the information it receives from landowners during these approaches as subject to an obligation of confidence.

The inquires and communications will usually contain plans and proposal document that are the intellectual property of the person making the enquiries and have commercial value which would prejudice the party supplying it if the papers were disclosed.

While the above applies, what follows are likely reasons why locations may be declined SHA designation:

• Infrastructure constraints • Incorrect zoning • Outside the Rural-Urban Boundary • Absence of high level structure plan • No concept plan (insufficient information) • Non priority - Greenfield • Outstanding height issues with Proposed Auckland Unitary Plan • Lack of clarity about developer's intentions • Heritage issues • Inconsistent with Proposed Auckland Unitary Plan
