Appendices .. 13 RESUME OF BUSINESS TRANSACTED DURING THE FIRST SESSION OF THE THIRTEENTH KERALA LEGISLATIVE ASSEMBLY The Thirteenth Kerala Legislative Assembly was constituted on May 14, 2011 after the general Election held on April 13, 2011. A Seven member Ministry Headed by Shri Oommen Chandy assumed office on 18th May, 2011 and the Ministry was expanded with the induction of 13 more Ministers on 23rd May, 2011. The summons dated May 25, 2011 for the First Session of the Thirteenth Kerala Legislative Assembly was issued to the Members on May 25, 2011. The session commenced at 9 a.m. on Wednesday, June 1, 2011 and adjourned sine-die at 2.50 p.m. on Wednesday, July 20, 2011. The House met on the following days viz., June 1, 2, June 24, 27, 28, 29, 30 July 8, 11, 12, 13, 14, 15, 18, 19, 20 (16 days of sittings). The House transacted business for 83 hours and 56 minutes. Oath of Office : The Members assembled for making oath or affirmation at 9.00 a.m. in the Assembly Chamber on June 1, 2011. Shri N. Sakthan who was appointed by the Governor to perform the duties of the Speaker under Article 180 (1) of the Constitution was in the Chair. The Secretary informed the House that under Article 180 (1) of the Constitution of India the Governor has appointed Shri N. Sakthan to perform the duties of the Speaker and that under Article 188 of the Constitution the Governor has appointed Shri N. Sakthan as the person before whom members of the newly constituted Legislative Assembly shall make and subscribe oath or affirmation according to the form, set out for the purpose in the Third Schedule of the Constitution. One hundred and thirty nine elected members and one nominated member made and subscribed oath or affirmation and signed in the Roll of Members. Election of Speaker : Two Members viz. Shri A. K. Balan and Shri G. Karthikeyan had been duly nominated as candidates for election as Speaker. The election was conducted at 9.00 a.m. on June 2, 2011. Altogether 141 Members including Protem Speaker and nominated member cast their votes. Shri G. Karthikeyan secured 73 votes and Shri A. K. Balan secured 68 votes. Shri G. Karthikeyan was declared elected as Speaker.

Announcement regarding recognition as the Leader of Opposition : On June 2, 2011, Speaker announced that Shri V. S. Achuthanandan, Leader of the Communist Party of India (Marxist), Legislature Party has been recognised as the Leader of Opposition since he is the leader of the largest party in the opposition. Governor’s Address : The Governor Shri. R. S. Gavai addressed the Members of the Legislative Assembly at 9 a.m. on June 24, 2011. The discussion on the Motion of Thanks to the Governor’s Address commenced on June 27, 2011 with Shri Ramesh Chennithala moving the following motion : “2011 Pq¨ 24-˛mw XobXn Kh¿Æ¿ \nb-a-k-`-bn¬ sNbvX {]kw-K-Øn\v \nb-a-k-`mw-K-߃ Kh¿Æ¿°v \µn tcJ-s∏-Sp-Øp-∂p.

The discussion on the Motion of Thanks lasted for 3 days, viz. June 27, 28 and 29, 2011. The motion was adopted on June 29, 2011. The House devoted 11 hours and 54 minutes for the discussion on the Motion of Thanks and 53 Members including Ministers participated in the discussion. On July 15, 2011, The Speaker reported to the Assembly the Governor’s Reply to the Motion of Thanks adopted by the House. Panel of Chairmen : On June 27, 2011 the following members were nominated to the panel of chairmen for the session. Shri K. Sivadasan Nair Shri Abdurahiman Randathani Shri Koliakode N. Krishnan Nair Announcement Regarding Government Chief whip : On June 27, 2011 the Speaker informed the House that Shri P. C. George is appointed Government Chief whip. Obituary Reference : On June 27, 2011, the Speaker made references on the demise of former Minister A. Sujanapal, former members M. R. Gopalakrishnan, R. Parameswaran Pillai and V. Krishnadas. As a mark of respect to the deceased the members stood in silence for a while. 3

Reference regarding Mumbai Bomb Blasts : The Speaker made a reference regarding the bomb blasts that occurred at Mumbai on July 13, 2011. Shri Oommen Chandy, Chief Minister and Shri V. S. Achuthanandan, Leader of Opposition associated themselves with the sentiments expressed by the Chair. As a mark of respect to those who died in the blasts, the Members stood in silence for a while. Election of Deputy Speaker : On July 28, 2011 the Speaker informed the House that two members viz. Smt. E. S. Bijimol and Shri N. Sakthan had been duly nominated as candidates for election as Deputy Speaker. Election was then conducted. Speaker also cast the vote. Shri N. Sakthan secured 73 votes and Smt. E. S. Bijimol secured 67 votes. Shri N. Sakthan was declared elected as Deputy Speaker. Questions : Details regarding the number of questions received and the number of questions answered on the floor of the House etc. are given in Appendix I. Adjournment Motion : During the session 11 notices of Adjournment Motion were received. None out of them was admitted. Details of adjournment motions in respect of which consent was withheld after hearing the views of Ministers concerned on the floor of the House are given in Appendix II. Palissery for shouting slogans, shrieking and advancing towards the Chief Minister and thereby violating the code of conduct for Members of Kerala Legislative Assembly, while the Chief Minister was replying to the notice to move adjournment motion. Announcement regarding Constitution of Special Legislature Committee : On July 20, 2011 the Speaker informed that a Special Legislature Committee consisting of nine members was constituted to enquire into the allegations raised by Shri P. C. Vishnunadh in the House on 12th July, 2011 against the Leader of Opposition. 5

Rulings by the Speaker : 1. On June 27, 2011 as a reply to a point of order raised by Shri Kodiyeri Balakrishnan on transferring the notices of starred questions to unstarred, the Speaker gave a ruling that the admissibility of questions and the transferability of starred notices to unstarred are unquestionably vested upon the Chair under Rule 38 (1) and 39. The notices of starred questions given by Shri M. Hamza and Shri M. A. Baby are of sub judice in nature and hence they could not have been admitted as starred questions. 2. On the same day the Speaker gave another ruling that the members of the respective constituencies shall be informed of all the Government functions which Ministers attend. Besides, when the Assembly is in session no meeting of the Government Committees shall be convened wherein a member has to participate. 3. On July 13, 2011 the Speaker gave ruling that the Legislature Committee will enquire into the allegations raised by Shri P. C. Vishnunadh against the Leader of Opposition during the general discussion on the Revised Budget. Statement under Rule 300 : On July 15, 2011 Minister for Food, Civil Supplies and Registration made a statement regarding the relaxation of rules for applying to the scheme of supplying food grains for Rupees Two to the ration card holders in the State. On July 18, 2011 Minister for Power made a statement regarding the measures taken by the Government to redress the complaints about frequent power failure and the difficulties in obtaining electricity connection to those who have not been allotted building number. Motion Under Rule 130 and Substantive Motion under Rule 275 : On July 18, 2011 Shri. Shri T. M. Jacob, Minister for Food, Civil Supplies and Registration replied to the points raised in the discussion. Then Shri T. M. Question of Breach of Privilege : On July 20, 2011 the Speaker informed the House that the following notices of Question of Breach of Privilege were under consideration of the Chair. 1. Notice given by Shri Kodiyeri Balakrishnan against Chief Minister alleging that the announcement of the policy and Hundred Days programme of the Government by the Chief Minister while the Thirteenth Kerala Legislative Assembly was in its first session and ahead of the Governor’s Address to the House amounted to breach of privilege. 2. Notice given by Dr. T. M. Thomas Isaac against the Minister for Finance, Law and Housing for the references made by the latter on 14-7-2011 during his reply to the General discussion on the Budget. Legislative Business : I. Bills passed The following Bills were introduced, taken into consideration and passed by the Assembly during the session : 1. The Kerala Tax on Paper Lotteries (Amendment) Bill, 2011. 2. The Kerala Conservation of Paddy Land and Wet Land (Amendment) Bill, 2011. 3. The Kerala Appropriation (Vote on Account No. 2) Bill, 2011. Details regarding the date of introduction and passing of Bills are given in Appendix V. The salient features of the Bills are given in Appendix VI. 7

II. Introduction of The Kerala Finance Bill, 2011 The Kerala Finance Bill, 2011 was introduced in the Assembly on 19-7-2011. III. Laying of Bills assented to The Following Bills as assented to by the Governor, were laid on the Table of the House by the Secretary : 1. The Advocates Welfare Fund (Amendment) Act, 2010 (Act 2 of 2011). 2. The Kerala Veterinary and Animal Sciences University Act, 2010 (Act 3 of 2011). 3. The Kerala University of Health Sciences Act (Act 4 of 2011). 4. The Kerala University of Fisheries and Ocean Studies Act, 2010. (Act 5 of 2011). 5. The Agricultural Workers (Amendment) Act, 2010 (Act 7 of 2011). 6. The Kerala Public Ways (Restriction of Assemblies and Procession) Act, 2011 (Act 9 of 2011). 7. The Kerala Appropriation Act, 2011 (Act 10 of 2011). 8. The Kerala Appropriation (Vote on Account) Act, 2011 (Act 11 of 2011). IV. Reference of Bills to Subject Committees and Presentation of the Subject Committee Reports Two Bills were referred to the respective Subject Committee and the Committee Reports on the Bills were presented to the House. Details of the Bills are given in Appendix VII. V. Bills published and circulated to Members Seven Bills were published and circulated to the Members. Details of the Bills are given in Appendix VIII. Financial Business : 1. Revised Budget for 2011-2012 Revised Budget for 2011-12 together with the Alteration Memorandum was presented by the Minister for Finance, Law and Housing on 8th July, 2011. The General discussion commenced on 12th July, 2011. Three days were allotted for 8 the general discussion on the Budget. The House devoted 11 hours and 8 minutes for this business. 54 Members (including Chief Minister and Minister for Finance, Law and Housing) participated in the discussion. 2. Vote on Account The Vote on Account for three months (August to October 2011) was presented on 8th July 2011. The Minister for Finance, Law and Housing moved the motion regarding Demands for Grants on Account towards defraying charges for the months August to October 2011 on 19-7-2011. Discussion and voting on the Vote on Account was held on the same day. The House devoted 5 Hours and 2 Minutes for the business. Twenty (20) Members (including Minister for Finance, Law and Housing) participated in the discussion. The Kerala Appropriation (Vote on Account No. 2 ) Bill, 2011, in respect of the Demands for Grants on Account was introduced, considered and passed on 20th July 2011. Private Members’ Business :

According to the Calender of sittings of the First Session of the Thirteenth Kerala Legislative Assembly, only one day ie., 15th July 2011 was set apart for transacting Private Members’ Business. The House devoted 1.15 hours in toto for Private Member’s Business on that day. Private Members’ Bills : On the allotted day for transacting Private Members’ Business i.e., on 15th July 2011 motions for leave to introduce seven Private Members’ Bills were included in the list of Business and all the seven motions for the same were considered by the House. The Minister for Finance, Law and Housing opposed all the motions. The discussions on the motion for leave to introduce the Bills were inconclusive. Details regarding the name of Members who moved the motions for leave to introduce the Bills and the result thereof on these motions are given in Appendix IX . 9

APPENDIX VI SALIENT FEATURES OF THE BILL

1. THE KERALA TAX ON PAPER LOTTERIES (AMENDMENT) BILL, 2011

At present, a promoter registered under the Kerala Tax on Paper Lotteries Act, 2005 (20 of 2005) has to remit tax of rupees seven lakhs for ordinary draws and rupees seventeen lakhs for bumper draws. As part of improving the financial income of the State, the Government have decided to enhance the present rate of tax for ordinary draw to rupees twenty five lakhs and for bumper draw to rupees fifty lakhs. 2. As per section 10 of the said Act, every promoter registered under section 7 shall submit on the first day of every month, to the Assistant Commissioner a statement containing such particulars, as may be prescribed, relating to the draws to be conducted during the month commencing from the next succeeding month and shall pay in advance the full amount of tax payable by him under the Act. The Government consider that in order to receive the advance tax in such way in respect of the lottery relating to which the tax is to be paid, a provision that the concerned State Government or Union Territory or Country organising that lottery shall submit a certificate specifying that the provisions of the Lotteries (Regulation) Act, 1998 (Central Act 17 of 1998) and the Rules made thereunder have been complied with and also certain other details relating to the lottery, have to be incorporated in the said State Act. 3. As the Legislative Assembly of the State of Kerala was not in session and the above proposal had to be given effect to immediately, the Kerala Tax on Paper Lotteries (Amendment) Ordinance, 2010 (53 of 2010), was promulgated by the Governor of Kerala on the 12th day of September, 2010 and published in the Kerala Gazette Extraordinary No. 2076, dated 13th September, 2010. 4. Though a Bill to replace Ordinance No. 53 of 2010 by an Act of the State Legislature was published as Bill No. 393 of the Twelfth Kerala Legislative Assembly, the same could not be introduced in, and passed by, the Legislative Assembly of the State of Kerala during its session which commenced on the 21st day of December, 2010 and ended on the 3rd day of January, 2011. Therefore, the Kerala Tax on Paper Lotteries (Amendment) Ordinance, 2011 (4 of 2011) was promulgated by the Governor of Kerala on the 22nd day of January, 2011 and the same was published in the Kerala Gazette Extraordinary No. 150, dated 23rd January, 2011. 55

Though a Bill to replace Ordinance No. 4 of 2011 by an Act of the State Legislature was published as Bill No. 406 of the Twelfth Kerala Legislative Assembly, the same could not be introduced in, and passed by, the Legislative Assembly of the State of Kerala during its session which commenced on the 4th day of February, 2011 and ended on the 24th day of February, 2011. Therefore, in order to keep alive the provisions of the said Ordinance, the Kerala Tax on Paper Lotteries (Amendment) Ordinance, 2011 (29 of 2011) was promulgated by the Governor of Kerala on the 17th day of March, 2011 and the same was published in the Kerala Gazette Extraordinary No. 653, dated 18th March, 2011. 6. The Bill seeks to replace Ordinance No. 29 of 2011 by an Act of the State Legislature.

2. THE KERALA CONSERVATION OF PADDY LAND AND WETLAND (AMENDMENT) BILL, 2011

As per section 12 of the Kerala Conservation of Paddy Land and Wetland Act, 2008 it has been authorised to appoint an officer of the Revenue Department not below the rank of Revenue Divisional Officer as the authorised officer. It is the said authorised officer to inspect whether any provisions of the Act has been violated and also to take initial steps to seize and confiscate any vehicles or instruments used or intended to be used. The power to enter any premises and to inspect for the said purpose is also with such officer. Usually the illegal reclamation are reported before the Village Officer. Since the actions taken as per this by the Village Officer or Deputy Tahasildar or Tahasildar is not in accordance with the existing provisions, the actions taken by such officers will become violative of law. Further, since the officers below the Revenue Divisional Officer do not now have the power to enter into any premises and to conduct inspection and seize the vehicles and instruments etc. used against the provisions of the Act as per section 19 of the Act also, the Government consider it necessary to empower the Government to appoint an officer not below the rank of Village Officer for the purposes of the said sections. As per section 13 of the Act, the Collector is empowered only to take appropriate steps to restore to the original position of any paddy land reclaimed. The Government have decided to give this power in the matter of reclamation of wetland also. The Government consider that the said amendments are necessary to implement the provisions of the Act more effectively. 56

As the Legislative Assembly of the State of Kerala was not in session and the above proposal had to be given effect to immediately, the Kerala Conservation of Paddy Land and Wetland (Amendment) Ordinance, 2011 (38 of 2011) was promulgated by the on the 27th day of April, 2011 and the same was published in the Kerala Gazette Extraordinary No. 929, dated the 28th day of April, 2011. The Bill seeks to replace Ordinance No. 38 of 2011 by an Act of the State Legislature.
