The Transport Accident Commission (TAC) ‘Subaru 5-Star Shoot Out’ Promotion

Conditions of Entry

By entering this competition, you accept these terms and conditions:

1. Entry is free to all persons attending a United home game in the 2020/21 season (as amended), with standard terms and conditions of entry into the venue being incorporated into these terms and conditions.

2. Subject to the below terms, to be eligible to win the competition, you must be a resident of at the time of taking part in the competition, aged 18 years or over, and hold a valid driver’s licence issued in any Australian State or Territory, and not be an employee, or related to an employee, of the TAC or one of its agencies connected with this competition.

3. players who are currently or have represented (within the last three years) Victoria or Australia at a national or international level are ineligible to enter.

4. The TAC reserves the right to verify eligibility of all entrants. The TAC may require such information as it considers reasonably necessary for this purpose and the prize may be withheld unless and until the TAC is satisfied with the verification.

5. You can only enter once and must use an original entry form (photocopies are not accepted).

6. The competition will start at 3.00pm on Sunday 10 January 2021 and will close at 11.59pm on Monday 31 May 2021

Rules of the Shoot Out Competition

• At each Melbourne United home game, during a break in play, two participants, who are not alcohol impaired (as assessed at our sole discretion), will be selected from the crowd at random to participate in the competition. Selections are made by Melbourne United staff and made at our sole discretion, are non-transferable, and not subject to negotiation.

• The two participants will be taken onto the main basketball court to complete a shoot- out challenge at half time (the competition). Each participant will each have 5 separate shots at the basket from the free-throw line. The participant’s feet must remain behind the free-throw line at all times while shooting.

• If there is a tie, the participants will keep shooting at the basket until someone misses, with the other person being declared the winner (subject to these terms and conditions).

• The participant who makes the most amount of scoring shots will qualify for the shoot- out challenge (competition) final at Melbourne United’s last home game of the season.

• All fans can also enter via the Wild Card competition for inclusion in the competition final. This is an online entry form. TAC’s activation agency will select one winner at random who will go straight through to the final shoot out/ knock out round.

• At the end of the season it is anticipated there will be 13 participants being the winners of each shoot-out challenge from every Melbourne United home game and the Wild Card entrant (14 anticipated participants total).

• All 14 qualifying participants will be required to show their valid Victorian drivers licence before being accepted to the final shoot out.

• Competition final rules: The final shoot out will be a knock out round. All participants will line up in single file behind the free-throw line. The first and second participants will each get a basketball. The first participant will shoot their basketball at the basket. If the shot goes into the basket the participant throws the ball to the next participant in the line and moves to the end of the line. If the shot misses the participant may get their own “” (one rebound per participant, per shot) but must do so before the next participant in the line has made a successful shot at the basket. After the first participant in the line has made their shot from the free-throw line the next participant shoots their ball. If the first participant has not got their “rebound” by the time the next participant in the line has successfully made their shot from the free-throw line, the first participant is knocked out of the competition. Each participant continues until there is only one participant left. This person will be the winner of the Subaru.

• In the event that the general public are unable to attend matches due to COVID-19 restrictions, TAC’s activation agency Graffiti will draw one winner at the end of every Melbourne United home game from the online Wild Card entries. The final shoot out would take place in a controlled environment in line with restrictions at the time.

7. Each home game winner and Wild Card entry must consent to a driver’s licence search. The home game winner’s and Wild Card entry motor vehicle licence must not have been suspended or cancelled in the two years prior to the date of entry or incurred no more than 5 demerit points in the last five years, to be determined by the TAC in its absolute discretion.

8. If you are the winner and the TAC has approved your driver’s licence check, subject to these terms and conditions, you will receive a 2021 Subaru Forester 2.5i Sport AWD, registration and delivery valued at RRP $46,764. You must produce identification in a form acceptable to the TAC before you collect the prize.

9. The prize is not exchangeable or redeemable for cash. As well as being announced as such at the time, the TAC will contact the winner by telephone and mail and publish the winner’s name on Monday May 31 2021 on www.tac.vic.gov/fivestarshootout. Each entrant agrees that entry into the competition constitutes permission to use any photographs and/or videos of the winner for promotional purposes.

10. If the winner does not claim the prize by Friday 4 June 2021 their prize will be forfeited, and a winner will be drawn from all entries into the competition.

11. The TAC accepts no responsibility for late, lost, incomplete or misdirected entry forms. Entry forms that are submitted become the property of the TAC.

12. The TAC, Melbourne United, Subaru Australia will not be liable to you for any loss or damage which is suffered or incurred (including but not limited to indirect or consequential loss), in connection with any personal injury or damage to property suffered or sustained as a result of entering or taking part in this competition or as a result of accepting the prize or attending the event, except for any liability which cannot be excluded by law.

13. The Transport Accident Commission (ABN 22 033 947 623) of 60 Brougham Street, Geelong 3220 is the promoter of this competition. Any decision made by the TAC about this competition is final and no correspondence will be entered into.

14. The TAC may need to disclose your personal information to its activation agency (Graffiti) to help the TAC run this competition and with Melbourne United. Any personal information you supply us is protected by the Privacy & Data Protection Act 2014 (Vic).

15. Entry into this competition is deemed acceptance of these terms and conditions.

16. The TAC reserves the right to disqualify you from this competition if it has reason to believe that efforts have been made to distort the competitive process or the spirit of the promotion.

17. If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

18. This competition and all issues arising out of it shall be governed in accordance with the laws of the state of Victoria and are subject to the exclusive jurisdiction of the courts of Victoria or any court exercising valid jurisdiction.
