General Terms and Conditions to the running of seminars for training as green building experts 1. Scope. The following Terms and Conditions govern the contractual relationship between the participants of seminars „Applied German Green Building Concepts “ (here- after referred to as „event“) and the Chamber of skilled crafts Trier, the EIC Trier and the BFT (hereafter referred to as „Passive house experts“). Deviating Terms and Conditions of the participant do not apply. 2. Registration/Confirmation. You can register via Internet, letter, fax, e-mail. The registration becomes legally binding with our confirmation in writing. 3. Performance. The participation fee is understood as per person and event date plus statutory turnover tax. It includes event documents, lunch and drinks during the course and Excursions. The „green building experts“ reserve the right to replace announced lecturers by other speakers and to change the event programme if necessary while retaining the overall character of the event. The participants will be informed promptly if holding an event is impossible due to force majeure, inability of a lecturer to attend, disruptions at the event venue or because of too few participants. Cancellation because of too few participants will be announced no later than 2 weeks before the event. Event fee is refunded in these cases. There is no claim to compensation for travel and overnight accommodation costs or for lost working time, unless such costs are incurred due to grossly negligent or wilful conduct on the part of the „green building experts“. If performance disruptions arise the „green building experts“ commit to contribute in as much as reasonably possible to remedy or contain the disruption. 4. Admission to the examination. If the event serves as preparation for external examination (e. g. an examination of the chamber of Trade) the responsibility to inform oneself about the admis- sion requirements is on the participant. It does not legally affect this contract, if the participant fulfils the admission requirements or not. Maturity and Payment, Default, Offsetting. The participation fee is due on receipt of the invoice. If the participant is in default with payment, the „green building experts“ are entitled to demand default interest of 5% over the basic lending rate [§247 paragraph 1 BGB – German Civil Code] p.a. if Passive house experts can assert a higher default if it evidences this damage. In the same manner, the participant is entitled to prove that damage has either not arisen at all or is significantly less than that asserted by the „green building experts“. Payment is made on account. It is not possible to pay by sending cash or cheques; the „green building experts“ assume no liability in case of loss. The participant can only offset with claims if they are established with lawful finality or acknowledged by green building experts in writing. The participant is only entitled to exercise a withholding right if his counterclaim is founded in the same contractual relationship. 6. Cancellation. Cancellation (only in writing) is possible free of charge up to 14 days before the event begins. For later cancellations, half of the attendance fee will be charged plus a lump sum compensation of 100 EUR. Cancellation must be made in writing. For non-attendance, the full participation fee is charged. We will gladly accept a substitute participant for no extra charge. The participant is generally entitled to prove that the cancellation has not caused any damage at all or that the damage has been significantly less than the cancellation fee retained by the green building experts. 7. Copyrights. The event documents are protected under copyright law. Replication, forwarding or using the event documents otherwise is only permitted with the explicit written consent of green building experts. 8. Retention of title. All teaching materials in the course are deemed the unconditional ownership of the green building experts. Reproduction and resale of teaching materials are not admitted. 9. Liability. green building experts shall only be liable for damage which is proved as the result of gross negligence or intended infringement on its part or on its employees‘ part in particular in cases of damages and/or loss of participants‘ property. Liability for a violation of injuries to life and limb or health is not affected. Applicable law, jurisdiction and place of fulfilment. German law applies under exclusion of UN commercial law. Place of fulfilment and jurisdiction for all disputes is Trier. 11. Ineffective provisions. Should individual or several provisions of these conditions be or become invalid in whole or in part, the validity of the remaining provisions and of the contract shall not be affected. 12. Cancellation policy for consumers. (1) Right of revocation: The participant can revoke the contract declaration within two weeks in text form (e.g. letter, fax, e-mail) without stating reasons. This due period begins after receipt of this information in text form, but not before contract conclusion and also not before we have fulfilled our information obli- gations pursuant to Art. 246 § 2 in conjunction with § 1 section 1 and 2 EGBGB and our duties according 312 g, section 1, clause 1 BGB (German Civil Code) in conjunction with 246 § 3 EGBGB. The due time allowed for revocation is deemed observed if the revocation is sent in good time. In the case of an effective revocation, the reciprocally received performances must be returned and any possibly enjoyed usefulness (e.g. interest) surrendered. Obligations to refund payments must be fulfilled within 30 days. This period begins for you with dispatch of the revocation declaration, and for us with receipt of the same. Your revocation right in the case of a service extinguishes prematurely if your contract partner commenced service performance before the end of the revocation period with your explicit consent or if you have exercised your revocation right.
