1. INFORMATION AND GUIDANCE ON MEDICAL MARIJUANA/CBD OIL

Below are the Law Department’s answers to frequently asked questions regarding law enforcement and medical marijuana/CBD oil:

What are the limitations regarding possession of CBD Oil in Ohio? SB 57 legalized the selling of hemp products containing up to 0.3% Tetrahydrocannabinol, or THC (including hemp derived CBD oil), outside of medical marijuana dispensaries. Products containing less than 0.3% THC are legal to possess and use in Ohio; therefore, a person can possess CBD oil with less than 0.3% THC without a medical marijuana license. What are the limitations regarding possession of medical marijuana in Ohio? • Per O.R.C. 3796.22, a patient in Ohio with a medical marijuana card or a patient’s caregiver may possess up to a 90-day supply of marijuana as well as possess paraphernalia specified by the state pharmacy board to consume the marijuana.  Ohio Administrative Code Section 3796:8-2-04 specifies what a 90-day supply is.

• Per O.R.C. 3796.06(B)(1), a patient may not smoke medical marijuana using “combustion,” but vaporization is permitted. • A medical marijuana card does not give the patient license to break other laws that are generally applicable to intoxicated persons (e.g. operating a vehicle, carrying a firearm etc.). Example of Registry Card

Can an Ohio medical marijuana card be revoked and what is the process? • Yes, under Ohio Administrative Code Section 3796:7-2-08(B).  This section specifies the grounds for potential revocation and process. See also Ohio Administrative Code Section 3796:7-2-09.

What action can officers take if they come into contact with a holder of a medical marijuana card who is violating the rules, i.e. criminal or administrative enforcement? • Officers who have determined that a patient is violating the rules can report the individual to the State Pharmacy Board at (614) 466-4143. A registered patient cannot be criminally charged with:

 Obtaining, using, or possessing medical marijuana.

 Possessing paraphernalia or accessories the state pharmacy board has approved.

 This also applies to a caregiver obtaining or possessing medical marijuana for a patient, or helping the patient use medical marijuana.

• A caregiver can be criminally charged for using medical marijuana personally (that was prescribed to the patient). What should officers do BEFORE signing any criminal charges? • Before signing criminal charges against a license holder, an officer needs to determine that the marijuana was not medicinal; or for paraphernalia that the item was not permitted by the pharmacy board. Officers should determine if there is a valid medical marijuana card and that the marijuana in question is in fact medicinal by reference to the packaging.

 A valid medical marijuana card + the marijuana is medicinal = no criminal charges

o Ohio Administrative Code Section 3796:7-2-05 requires a patient and caregiver to have their card with them when in possession of medical marijuana.

o Per Ohio Administrative Code Section 3796:7-2-05(G), medical marijuana is supposed to be kept in the packaging from the dispensary.

 If a person cannot satisfy either of those requests, the officer should ask whether the person can provide any other form of proof such as the person contacting the State Pharmacy Board or the dispensary. Officers cannot call to verify the information because the information is the patient’s health care information. Example: If a patient illegally consumes medical marijuana by smoking it, criminal charges are not appropriate for possession unless the source was not from a dispensary (though the individual could be cited for using paraphernalia, if any, because no paraphernalia will be permitted for smoking marijuana). Can the City of prohibit officers from using or possessing medical marijuana/CBD Oil? • Yes, refer to O.R.C. 3796.28.

2. REQUESTING DONATED TIME FOR JOSHUA PHILLIPS

Police Officer Joshua Phillips, District Two, has exhausted his leave time balances due to an extended medical leave.

Any Department member wishing to voluntarily donate time to Police Officer Phillips should complete the Donation of Time Processing Form, attached to these Staff Notes, and submit it electronically to [email protected] or forward it through interdepartmental mail to Ms. Charlene Childress, Finance Management. Be certain to include, a signed copy of the Form 25S with the donation form, as referenced below.

Additionally, complete a Form 25S, Request for Leave of Absence, listing Joshua Phillips’s name, district/section/unit, the type of time and number of hours being donated. • Sick time may not be donated • Sworn personnel may donate vacation, comp., or holiday time • Civilian personnel may donate vacation or comp. time The donor’s rank and signature must appear on the Form 25S, and it should be submitted through the normal chain of command.

3. CLEVES POLICE DEPARTMENT OPEN WARRANTS AND CAPIAS MANAGEMENT

The Cleves Police Department has been disbanded. Subsequently all police services are now handled by the Hamilton County Sheriff’s Office. The Central Warrants Processing Unit (CWPU) is currently managing all processing for the open warrants and capias that are still active.

Effective immediately, if directed to issue a recite for an existing warrant or capias that originated out of Cleves, complete a Notice to Appear (NTA) and send it to CWPU (the same as for City or County case recites). CWPU will provide a date and time for the individual to appear at the Cleves’ Mayor’s Court.

4. S.T.A.R.S. DATA

Attached to these Staff Notes is the most current Strategic and Tactical Analytic Review for Solutions (STARS) Data. Department personnel are directed to review this information to ensure they remain familiar with crime patterns and trends occurring within the City and their areas of responsibility.

I wanted to be sure you were informed that Officer Jennifer Hoff performed at an exemplary level when she responded to our crime report after the brazen break-in we experienced through our main, lighted entrance at Captain’s Watch. You may already be aware of this event and the related video footage requested by Officer Hoff. Officer Hoff and / or the CPD also secured video footage from our neighbors at Adams Place which enabled, at least, the make and possibly model of the vehicle driven by our burglar.

I know that this case will be handled by investigators going forward but wanted you to know how impressed we were with Officer Hoff’s attention to detail and follow-up.

I just want to commend PO Hoff for being so attentive to us. I will re-send, if needed, printed on letterhead, if the positive note could be placed in her file.

We discovered our LED board out again last night at about 2330. It was raining too hard today to get up there and check, so I had not alerted you guys yet. It is a pretty widespread outage, so we don’t really have a guess on equipment failure or gunshot damage.

Officer Hoff just reached out to me because she noticed on patrol. I really, truly, appreciate her attentiveness and her taking the time to reach out to me.

We are going back up tomorrow to investigate the cause.
