Policy Developments in Light of COVID-19

MoRTH to encourage domestic firms to bid for road projects • The Ministry of Road Transport and Highways (MoRTH) is planning to change the bidding norms to ensure that more Indian companies qualify for major projects without tying up with foreign firms. The plan is in line with the central government’s ‘Atmanirbhar Bharat’ initiative. • Reportedly, a panel set up by the ministry to prepare a road map for the roads sector has recommended amendments to the eligibility norms for construction of tunnels of length upto 500 metre, by doing away with the experience components of building similar road tunnel projects. The panel has recommended that entities with an experience in metro rail tunnels should be allowed to bid for such projects. The panel has also called for relaxation of similar norms for four/six lane highway projects.

Government fast-tracks payment cycle for stressed road developers

• To help infrastructure developers reeling under Covid-led challenges, MoRTH and the National Highways Authority of India (NHAI) have adopted faster payment mechanisms and shortened the cash cycle for road developers contracted with them, to ensure project execution does not suffer during the lockdown. • According to MoRTH data, between April and May 2020, it disbursed Rs 187 billion to developers, up 46 times from the Rs 4 billion released in the year-ago period. NHAI disbursed Rs 102.95 billion between March 22 and March 31 2020, and another Rs 150 billion in April-June 2020. Both MoRTH and NHAI have migrated from a milestone-based payments system to a monthly payments mode.

NHAI launches portal for rating of concessionaires, contractors and consultants • NHAI has developed a Vendor Performance Evaluation System to establish a transparent and comprehensive performance rating system for its consultants, contractors and concessionaires. The vendors will be required to conduct a self assessment and upload the documents related to the project activities being executed by them, on the portal. • The submissions will be reviewed at multiple levels by NHAI, based on which the vendor's rating will be generated. The vendors who fail to upload the requisite documents on the portal will not be allowed to participate in the NHAI’s bidding process.

Bid due date extended for TOT Bundle IV

• NHAI has extended the bid submission due date for Bundle IV of the toll-operate-transfer (TOT) model by another two months, from July 31, 2020 to September 30, 2020. • The bid due dates for the bundle have been extended multiple times during the COVID-19 crisis, as the investors are seeking more time to assess market conditions before bidding for the bundle.

Other Policy Developments

NHAI launched ‘Hari Path’ app to monitor plantation along national highways • NHAI has developed a mobile app ‘Hari Path’ to monitor location, growth, species details, maintenance activities, targets and achievements of each of its field units for each and every plant under all plantation projects.

• Besides, the authority has also recently undertaken ‘Harit Bharat Sankalp’, a nation-wide plantation drive which is in line with its commitment to promote environment protection and sustainability. Under this initiative, NHAI planted over 2.5 million plants in 25 days along the stretches of the national highways between July 21, 2020 to August 15, 2020. The drive takes the total cumulative number of plantations done during the current year to 3.52 million.

MoEFCC relaxes plantation norms for highway projects

• The Ministry of Environment, Forest and Climate Change (MoEFCC) has relaxed norms of forest clearance for national highway projects, allowing state agencies to take up compensatory afforestation in degraded forest land instead of non-forest land, as per existing rules. • NHAI wanted a relaxation in forest clearance rules to seemingly skip finding non-forest land for compensatory afforestation (CA) while forest land was diverted for development of highway infrastructure.

Other Policy Developments NHAI partners with IIT Delhi for AI deployment in highway projects • NHAI has signed a memorandum of understanding (MoU) with the Indian Institute of Technology, Delhi (IIT) to set up a Centre of Excellence (CoE) for use of Artificial Intelligence (AI) in data-driven decision making and advance data management system for highways. • Under the partnership, IIT Delhi will work with NHAI on developing advance analytics based on AI and Machine Learning, prepare simulation models, enhance data storage and retrieval capacities to further strengthen NHAI’s capabilities in data-driven decision making. FASTag made mandatory for availing all discounts on NH toll plazas • The MoRTH has made the use of FASTag mandatory for availing return journey discount or any other exemptions on toll fee plazas. Besides, a gazette notification dated August 24, 2020 to amend the National Highways Fee (Determination of Rates and Collection) Rules, 2008 has been notified in this respect. • The ministry has notified a draft notification dated September 1, 2020 to seek comments and suggestions from the stakeholders on making FASTag mandatory for old vehicles sold before December 1, 2017. The amended provision in the Central Motor Vehicles Rules (CMVR), 1989 is proposed to be put in force with effect from January 1, 2021.

MoRTH calls for reducing road construction cost by 25 per cent

• MoRTH has called for reducing the cost of road construction by 25 per cent, and identifying modern and green technologies that contribute towards the aim. • The ministry has also asserted that specific areas such as hilly areas, border areas and coastal areas need different approach and technologies for road construction. The ministry has also stressed upon using local indigenous material such as jute and coir for road strengthening purposes.

• MoRTH has surpassed its target for construction of national highways for April-August 2020. During this period, 3,181 km national highway length has been constructed against the target of 2,771 km for the period. • This includes 2,104 km constructed by State Public Works Departments (PWDs), 879 km by NHAI and 198 km by the National Highways and Infrastructure Development Corporation Limited (NHIDCL). • Further, about 3,300 km length of national highway works have been awarded in this year till August, which is more than double of the 1,367 km awarded during the same period last year. Sanctions have been issued for construction of 2,983 km of national highways all over the country during this period. This includes 1,265 km by PWDs, 1,183 km by NHAI, and 535 km by NHIDCL.

• NHAI has awarded highest length of projects during 2020-21 till date as compared to the projects awarded during same period in last three years. • During April-August 2020, NHAI has awarded 26 projects with a total length of 744 km, compared to 676 km awarded in 2019-20, 368 km 2018-19 and 504 km in 2017-18. Capital cost of these 26 projects stands at over Rs 310 billion, which includes cost of civil construction, land acquisition, and other preconstruction activities. • NHAI has set a target of awarding 4,500 km of highway during current financial year and is likely to exceed the same.

• NHAI has finalised a plan to build 22 expressways spanning about 7,800 km by March 2025, with an investment of Rs 3.3 trillion. For many of these projects, bids will be invited next year. The government plans to complete 272 km Bengaluru-Chennai expressways and 281 km Bengaluru Satellite Town Ring Road by March 2024. • Some of the other major expressways and economic corridors to be complete by 2025 include Hyderabad-Vishakhapatnam, Chennai- Selam, Solarphur-Kurnool, Nagpur-Vijayawada.

• NHAI will soon approve 1,500 km of highway projects in the coastal regions of the country to improve coastal connectivity. The authority has already identified 1,500 km four-laning projects. • The coastal connectivity projects are expected to come up with an estimated investment of about Rs 500 billion.

Loans/Bonds

• NHAI has formed an SPV for financing, construction and operation of the Delhi-Mumbai expressway. The 1,300 km expressway is one of the flagship projects of the central government’s Bharatamala Pariyojana. • The SPV has been registered under the name of DME Development Limited and will be wholly owned by NHAI. The SPV will raise debt on its balance sheet, while NHAI will retain the operational control during construction and operation and maintenance periods. The toll on the projects housed in the SPV will be collected by NHAI and that SPV will get the annuity payments without any construction and tolling risks. • In July 2019, NHAI and National Investment and Infrastructure Fund (NIIF) had signed a memorandum of understanding to form the SPV in order to arrange funds to build large-scale highway projects in India. Reportedly, NIIF was not willing to share risks in the SPV as a result of which, NHAI has decided to move ahead with the plan independently.

• Cube Highways and Infrastructure Pte. Limited has announced an agreement with State Bank of India (SBI) for a Rs 35 billion term loan facility to purchase TOT Bundle III auctioned by NHAI. The financing raised from SBI is a 20-year facility with an interest rate of 8%. • The company had won the TOT Bundle III with a bid of Rs 50.11 billion in December 2019. However, the transaction was delayed because of the impact on toll revenues following the COVID-19 outbreak and the nationwide lockdown.

• The Expressways Industrial Development Authority (UPEIDA) has signed a loan agreement worth Rs 59 billion a consortium of six banks led by the Bank of Baroda for the project. Other banks in the consortium include Union Bank of India, Bank of Maharashtra, Indian Bank, Bank of India and UCO Bank. Meanwhile, UCO Bank has additionally provided a loan acceptance letter worth Rs 5 billion for the expressway project.

• Uttar Pradesh government is expected to raise funds worth Rs 29 billion from the Housing and Urban Development Corporation Limited (HUDCO) for the Ganga four-lane expressway project. • The project involves construction of 628 km four lane access-controlled expressway (expandable to six lanes) over Ganga river from Meerut to Prayagraj in Uttar Pradesh at an investment of Rs 360 billion.

Loans/Bonds

• The Maharashtra State Road Development Corporation (MSRDC) is planning to explore innovative funding mix for its upcoming road projects. The corporation is reportedly looking at a mix of government support and funds from multilateral agencies. It is also considering to raise money by offloading its equity up to 49 per cent at an appropriate time.

• NHAI has cut the interest rate on its capital gains bonds from 5.75 per cent to 5 per cent with effect from August 1, 2020. The lower rate will apply only to fresh bonds, where payment has been received after August 1, 2020. The reduction will not apply on existing bonds. The NHAI capital gain bonds have a lock-in period of five years.

• The Resolution Professional (RP) of Gwalior Bypass Project Limited (GBPL), on behalf of the Committee of Creditors, has issued a letter of intent (Lol) dated August 13, 2020 to PNC Infratech Limited with regard to the resolution plan submitted for GBPL, which is undergoing corporate insolvency resolution process under the provisions of lnsolvency and Bankruptcy Code, 2016. Besides, the said Lol has been accepted by the company.

Grants/Allocations

• The central government has sanctioned Rs 8 billion for the Gwalior-Chambal expressway project. The 404 km expressway will connect Rajasthan's Kota and Uttar Pradesh's Etawah, along the bank of the river Chambal. Besides, the Madhya Pradesh government has announced that the expressway will be renamed as Shri Atal Bihari Vajpayee Chambal Progressway.

• The central government has increased funding for border road development projects and raised the allocation for maintenance of border roads. Funding for road development projects in border areas has been raised from Rs 3.4 billion to Rs 4.4 billion for 2020-21. Besides, the budget for maintenance of border roads has gone up from Rs 1.2 billion to Rs 2.2 billion.

• The Public Works Department, Rajasthan (PWD) has sanctioned funds worth Rs 19.83 billion for upgradation of rural roads under Pradhan Mantri Gram Sadak Yojana (PMGSY-III). The scope of work involves development of 374 rural roads. Of the total, funds worth Rs 19.37 billion and Rs 460 million have been allocated for upgradation of 3,623 km long roads and development of six bridges, respectively.

Impact of COVID-19 on Road Projects

• The ratings agency ICRA predicts the execution of road projects in 2020-21 to be in the range of 9,000- 9,200 km, almost 10% lower than in 2019-20, due to COVID-19 related lockdowns and restrictions. ICRA noted that typically the fourth quarter (January-March) is the key working season for road contractors. However, a good part of March 2020 was lost on account of lockdown and restricted movement of goods and personnel in the run up to the lockdown.

• The construction work for the Delhi-Meerut expressway project has hit another hurdle due to labour shortage as more than 80 construction workers have either tested positive for COVID-19 or are under quarantine, while many more have migrated to their home towns. Of about 2,000 workers recruited for Phase II of the project, only about 1,200 workers are available to work on-site. • Besides, Phase IV of the project is also facing a shortfall of about 700 workers. Currently, about 74% construction work has been completed on Phase IV, while about 84% construction work has been completed on Phase II. Both packages are expected to be completed by December 2020. • The Delhi-Meerut expressway project comprises four phases, of which the construction work is underway for the 19.8 km Phase from UP Gate to Dasna and the 32 km Phase IV from Dasna to Meerut. The Phase I from Akshardham to UP Gate and Phase III from Dasna to Hapur are already operational.

• Labour shortage has hit the development works under Phase II of the NH-66 bypass project in Kerala. As a result, NHAI has pushed the completion of deadline of the project from October 2020 to January 2021. • The deadline had already been extended from May 2020 to October 2020 two months ago. Currently, only about 50 per cent labour is available to execute the project. So far, about 87 per cent of the work has been completed on the project. The construction of underpasses, bridges and culverts has been completed.

• The project entailing four-laning of 40 km Parwanoo – Solan section of NH-22 in Himachal Pradesh has been delayed on account various roadblocks. The project is set to miss its extended deadline of September 30, 2020, chiefly due to lack of coordination among the executing agencies and labour shortages amid the COVID-19 pandemic. • Although the new deadline has not been set for the project, it is now expected to be completed by end-2020. GR Infraprojects Limited, the contractor, has so far completed 88 per cent construction work on the project, which is expected to cost Rs 7.49 billion.
