417 BACKGROUND A permit application for the construction of additions to the dwelling was received on July 27, 2006 without any supporting documentation. Based on staff's initial screening of the property it was thought that this proposal was relatively straight forward. However, upon review of the geotechnical study it became apparent the site has a serious issue with respect to slope instability.

On November 15, 2006, TRCA staff requested that the applicant submit a geotechnical study which would assess the stability of the existing slope located to the rear of the property. On February 23, 2007, TRCA staff received a geotechnical study entitled, "Geotechnical Investigation Report, Assessment of Slope Stability, Existing House Foundation," prepared by Soil-Eng, dated January 9, 2004. Based on staff discussion with the agent, it is TRCA's understanding that the geotechnical study was originally commissioned in late 2003, at a time when the present owner was considering purchasing the subject property.

On April 23, 2007, staff provided a letter to the applicant explaining that the proposal does not comply with TRCA's Valley and Stream Corridor Management Program (VSCMP) (i.e. proposed works do not meet our requirement of being setback a minimum of 10 metres from the long term stable slope line) and the permit application could not be recommended for approval. On June 8, 2007 staff provided further written comments to the applicant that confirmed agreement with the applicant's consultant that remedial works in the form of a shoring structure are required on the property in order to stabilize the existing dwelling and surrounding land before any consideration of additions or accessory structures could be considered. To date, the applicant has appeared unwilling to follow the recommendations provided by his own geotechnical consultant, which were prepared in January 2004.

PROPERTY LOCATION AND DESCRIPTION The subject property is located on the east side of Hadrian Avenue. Hadrian Avenue is located in a residential area east of Islington Avenue and north of Highway 401 in the City of Toronto. There is an existing single family dwelling with an attached garage and rear patio on the property. The southerly (garage) portion of the dwelling is situated at the top of slope, while the northerly portion of the dwelling maintains a setback of approximately 7 metres (23') from the top of slope. The majority of the property is located within the regulated area and is associated with a steep, forested slope of the main Humber River Valley. A topographical map identifying the subject property and the adjacent valley is included as Attachment 1.

TRCA JURISDICTION Pursuant to Ontario Regulation 166/06, "The Authority may grant permission for development in or on the areas described in the Regulation if in its opinion, the control of flooding, erosion , dynamic beaches, pollution or the conservation of land will not be affected by the development." Therefore, a permit may be refused if, in the opinion of the TRCA, any of these five tests are affected. Before refusing permission, TRCA must hold a hearing to which the applicant and other interested persons are a party (Conservation Authorities Act, R.S.O. 1990, c. C.27 -28 (12)).

It should be noted that TRCA reviews all permitting requirements in concert with our VSCMP policies. The VSCMP integrates TRCA's public safety responsibilities and reaffirms its commitment to ecosystem planning at a watershed level. The VSCMP outlines policies for minor additions and accessory structures within highly urbanized areas, such as the area surrounding and including the subject property.

419 THE PROPOSAL The application is for a 2.4 metre x 4.5 metre (8'x 15') one storey addition with basement attached to the rear of the existing dwelling. The addition would accommodate a handicap accessible bathroom on the first floor. The rear addition would maintain a setback of approximately 4.6 metre (15') from the top of slope. A single car garage addition having dimensions of 6 metre x 3 metre (20' x 10') is also proposed to be attached to the south side of the existing one car garage. The garage addition would be located at the top of slope. A raised wooden deck having dimensions of 2.4 metre x 5.4 metre (8 x 18') is proposed to be constructed above the existing concrete patio which is located at the top of slope. All of the proposed works are located within an area of slope instability.

EROSION (SLOPE INSTABILITY)/CONSERVATION OF LAND It is the opinion of TRCA technical staff that the proposal further impacts slope stability within the valley corridor, as it is anticipated that the additional load from the proposed structures will exacerbate the existing downward movement of the slope. Without the implementation of remedial works on the property, the rate and extent of cracking in the existing and proposed foundations is expected to increase.

As can be seen on the site plan drawing (Attachment 2), TRCA staff has outlined the approximate location of the physical top of valley bank, as well as the location of the long term stable slope line as determined by the geotechnical study. The existing long term stable slope line is located approximately 1 metre (3') to the west of the front wall of the existing dwelling. Staff has estimated the long term stable slope line based on the subsurface profile drawing which was included in the geotechnical study (Attachment 3). Most of the existing dwelling's footprint, including additions, is within an area of land that is unstable.

The geotechnical study submitted by the applicant and dated January 9, 2004 assessed the risk of slope stability associated with the existing dwelling and property only. TRCA staff agree with the conclusions outlined in the study. The conclusions include the following:

1) “The existing house is located in the creeping zone of the slope. The cracking of the foundation walls is likely the result of the shallow type movement of the slope.”

2) “In order to prevent further creeping and movement, a permanent shoring structure should be constructed and the house foundation should be underpinned and/or strengthened by other means. Conventional retaining wall construction will require deep and wide open excavation which will impose further adverse impact to the existing house foundation and is considered impractical in this case. The permanent shoring structure can consist of caisson walls or sheet piles. They must extend to a depth below the stable slope line at 1 vertical: 2.5 or + horizontal.”

3) “The shoring structure must be properly designed by a qualified structural engineer.”

Policy 4.2.2 (8) (c) of TRCA's Valley and Stream Corridor Management Program states that "the risk associated with erosion and slope instability must be addressed through geotechnical investigation and/or study having regard to erosion processes, long term slope stability and short-term stability, and demonstrate that the minor addition:

420 i) does not increase the risk associate with the existing structure or property such that:

z the existing slope's factor of safety is not reduced; z the addition is not located on an unstable valley slope;

ii) does not create or aggravate erosion or slope instability on adjacent properties;

iii) can be demonstrated that it will be safe for the life of the existing structure (assumed to be 100 years);"

Based on the information contained in the geotechnical study, the applicant has provided evidence that the proposed works would occur on unstable land, thereby increasing the risk of damage to the existing and proposed structures. The study does not address the issue of whether the additions would aggravate erosion or slope instability on adjacent properties. Finally, the study has not demonstrated that the existing or proposed structures would be safe for the life of the structure (assumed to be 100 years) without the need for remedial works.

The applicant has disregarded his own consultant's recommendations, which specify the need for on-site remedial works to address slope instability. Staff cannot support any additional development on the property until such time as the owner undertakes remedial work to the satisfaction of the applicant’s engineer and TRCA. Staff recommend that the applicant retain a qualified engineer to prepare a conceptual design for a permanent shoring structure which will stabilize the existing one storey dwelling and the table land portion of the rear yard. The design of the shoring structure should take into account any future additions to the dwelling.

CONCLUSION Staff recommend that this application be denied for the following reasons:

Under Ontario Regulation 166/06, Section 3. (1), it is in the opinion of TRCA staff that the control of erosion and conservation of land will be affected by this development; and

The development proposal does not comply with the overall objective of TRCA's Valley and Stream Corridor Management Program (VSCMP). Specifically it does not conform with Section 4.2.2 (8) (c), Development & Redevelopment/Intensification Within Non-Established Communities/Highly Urbanized Areas, Minor Additions.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 1.56 hectares (3.85 acres), more or less, consisting of an irregular shaped parcel of vacant land, said land being Part of Lots 8 and 9, Concession 3, Township of Uxbridge, in the Regional Municipality of Durham, further being described as being Part 2 on Plan 40R-24885, situated on the east side of Concession 3, north of Webb Road, be purchased from Dan and Mona Farquharson;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land required free from encumbrance, subject to existing service easements;

THAT Gardiner Roberts LLP, Barristers and Solicitors, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs and disbursements are to be paid;

AND FURTHER THAT the appropriate TRCA officials be authorized and directed to take the necessary action to finalize the transaction including execution and signing of all necessary documentation. CARRIED BACKGROUND Resolution #A260/05 at Authority Meeting #9/05, held on November 25, 2005, approved the Greenlands Acquisition Project for 2006-2010.

In this instance, TRCA will acquire 1.56 hectares (3.85 acres) of the approximate 43.30 hectare (107 acre) Farquarhson property. This area consists of a 30 metre wide section of property running east from Concession 3, then north into the southern edge of the TRCA-owned property known as the Secord Forest & Wildlife Area. This section includes old field habitat and coniferous plantation forest.

This parcel of land will allow for the Oak Ridges Trail to connect between the TRCA-owned Goodwood Resource Management Tract and the Secord Forest & Wildlife Area. The current trail connection for this area is located on Concession 3 and the off-road connection provided by this land acquisition is safer for trail users and more desirable, as it runs through greenspace.

425 Negotiations have been conducted with the property owners, Dan and Mona Farquharson and as a result TRCA has obtained an option on the property which is conditional on the necessary approvals. TRCA staff has also met with officials from the Township of Uxbridge who are in support of this proposal.

Attached is a sketch showing the location of the subject lands.

RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Duffins Creek watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. It is located in the headwaters of the Duffins Creek on the Oak Ridges Moraine. The property is designated as Natural Core Area and Natural Linkage Area under the Oak Ridges Moraine Conservation Plan and is adjacent to TRCA holdings in the area. The acquisition of this parcel will compliment TRCA’s holdings in the Duffins headwaters, will help consolidate the protection of the resource features as provided by the abutting TRCA holdings and will provide an improved trail link between our Secord Forest & Wildlife Forest and Goodwood Resource Management Tract holdings.

TAXES AND MAINTENANCE Based on the realty taxes paid on adjacent TRCA-owned lands, it is estimated that the annual taxes for the property would be approximately $200.00. On December 10, 2004, the Ontario government announced a regulation that expands the environmental criteria for lands that are eligible to receive a property tax exemption. Based on a preliminary review of the new criteria, it would appear that a portion of the subject lands would be eligible for exemption for the 2008 taxation year.

Since TRCA maintains lands in this vicinity the addition of the subject parcel of land would not significantly impact TRCA's maintenance costs at this location given that these types of land require a low degree of maintenance.

FINANCIAL DETAILS All expenditures for this acquisition including survey, environmental and legal fees are to be charged to the TRCA land acquisition capital account.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT Tender RSD07-09 for the supply and delivery of approximately 6,000 tonnes of 3 to 5 tonne armour stone to the Mimico Waterfront Linear Park Project, City of Toronto, for the total unit price of $45.94 per tonne plus applicable taxes be awarded to P.D. Brooks Haulage and Construction, it being the lowest bid that meets Toronto and Region Conservation Authority (TRCA) specifications. CARRIED BACKGROUND Implementation of Phase 1 of the Mimico Waterfront Linear Park Project commenced on July 4, 2006 with the construction of a temporary access road and installation of the site facilities. Lakefilling for the central and west sectors (Phase 1) commenced at the south end of Superior Avenue progressing towards Norris Crescent, located at the western limit of the project. Stage 2 shoreline protection scheduled to commence in late July, 2007 includes construction of the final shoreline protection for the main headland and island features Phase 1 of the Mimico Waterfront Linear Park Project.

RATIONALE Tender RSD07-09 was publicly advertised in the Daily Commercial News. Tender packages were sent to a total of eight bidders. The Tender Opening Committee opened tenders on June 8, 2007 with the following results:

THE EXECUTIVE COMMITTEE RECOMMENDS THAT Toronto and Region Conservation Authority (TRCA) utilize, as required, the services of Sartor & Susin Limited for the supply of operated heavy construction equipment and dump trucks for the period August 1, 2007 to July 31, 2008, it being the proposal that bests meets TRCA's requirements at the lowest overall cost;

AND FURTHER THAT staff be authorized to use the next lowest tender if the need arises. CARRIED BACKGROUND Tender RSD07-11 was publicly advertised in the Daily Commercial News and provided for the supply of rental rates for operated heavy construction equipment and dump trucks to be utilized by the Restoration Services Division in carrying out the 2007/2008 work programs.

As a result of the advertisement, 15 tender packages were forwarded to potential bidders.

The Tender Opening Committee opened tenders for the supply of rental rates for operated heavy construction equipment and dump trucks on June 8, 2007. The tenders were referred to staff for review and report.

RATIONALE The tender selection process included a review of the prices submitted and an assessment of previous performance in a number of areas including, but not limited to, similar work experience, quality of work, and health and safety.

Staff's analysis of the quotations indicates that the submission from Sartor and Susin Limited is the most satisfactory and lowest overall quotation received.

In the event that Sartor & Susin Limited are not able to supply all equipment needed during the peak construction periods, staff feel it would be prudent to use equipment from the company that provided the next lowest tender price. This will be dependent on what equipment is specified and will help to ensure that equipment is always available.

FINANCIAL DETAILS The value of this contract is estimated to be approximately $900,000 based upon a review of similar workloads in previous years. An increase or decrease in workload will have an impact on the value of this contract. The operated equipment is rented on an 'as required' basis with no minimum or maximum rental hours guaranteed.

The culverts, roadway and retaining wall were previously used on the former golf course within the Morningside Tributary stream corridor and are required to be removed as a condition of the Morningside Heights Draft Plan of Subdivision. The stream will be restored to a natural state for a net gain to the fisheries along this reach.

Control of Flooding: The proposal is located within the Regional Storm floodplain but will have no impact on the control of flooding.

Pollution: Appropriate sediment controls will be in place. The works will take place in the dry by installing a sandbag weir to isolate the first culvert and divert flows to the other. Following removal of the first culvert and roadway, the stream bed will be restored with granular material and the sandbag weir will be relocated to divert flows away from the second culvert so that it, and the remainder of the roadway, may be removed and the stream bed restored. The retaining wall which is now located in the middle of the stream will be removed by hand. The works will take place within the July 1 to September 15 cold water fisheries timing window.

Erosion: The proposal will have a positive benefit to preventing the erosion due to localized flooding.

Proposal: This application has been brought forward to ratify the TRCA staff Authorization for Emergency Works under Ontario Regulation 166/06 for the emergency stabilization of the west bank of Highland Creek immediately downstream of the completed Segment 8, Phase 1, Stage 1 works, dated June 4, 2007. Staff determined that the unstable nature of this portion of bank presented an imminent risk of further failure and vegetation loss associated with the surrounding Environmentally Significant Area (ESA). Additionally, it was understood that the detailed design for the entire Phase 1, Stage 2 project area would follow shortly. The City of Toronto was therefore authorized to immediately begin the stabilization works to protect the existing natural features.

The works consisted of the installation of an armourstone wall, backfilled with coarse, free-draining material to avoid saturation from groundwater flows, and topped with local fill to create a stable slope against the bank. A temporary bypass channel was constructed so that the work could commence in the dry. The final height of the armourstone wall may be revised, based on the final design for the Phase 1, Stage 2 works.

460 Control of Flooding: No adverse impacts to the storage or conveyance of flood waters were anticipated as a result of this project.

Pollution: Appropriate controls were implemented and maintained throughout construction to prevent sediment or other deleterious substances from entering the watercourse.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal:

Status of the Berczy Box Culvert Emergency Repair TRCA received a letter from York Region (dated May 23, 2007) on May 24, 2007 stating that it was initially anticipated that grouting would be required at the base of the culvert in order to strengthen the foundation. After receiving Emergency Works Approval letters (June 16, 2006 and November 17, 2006) and Letters of Advice (June 16, 2006 and November 17, 2006) from TRCA the Region of York's contractors proceeded with the works. On December 12, 2006 the geotechnical investigation team from the Region of York and the contractor started grouting at the northeast corner of the west culvert extension to a depth of approximately 1.8 metres below the floor of the culvert. The subsurface conditions encountered included approximately 0.7 metres of concrete, directly overlying hard clayey silt till with varying amounts of sand and gravel, which was not penetrated past 1.1 metres. Based on these circumstances, it was agreed by all present that the hard till soils adjacent to the culvert foundations would not require grouting and that the culvert is founded on hard clayey silt to silty clay till soil. Immediately following this conclusion, sandbags were cleared from the west branch of the stream and the surrounding area was restored to original state. No further work at the Berczy Creek box culvert is anticipated at this time.

The following provides a description of the emergency works that were proposed and approved in two separate phases during 2006.

Phase I - 16th Avenue Concrete Box Culvert Emergency Temporary Repair Emergency works approval was issued for these works on June 16, 2006. Short term repairs for the west cell of the box culvert that were approved by TRCA included the following: z placement of a rubber caulking material to seal the gap between the separated box culvert end on the north side of the cell. z excavation of the road on to the cell to place a steel plate on top of the gap between the separated box culvert end on the north side of the cell. z repairs to the west wall of the cell by chipping decayed concrete and placing new material in the wall by pressure grouting. z completion of works solely within the dry (within the dry cell), with no impact on the diverted watercourse, with any sediment or deleterious material to be contained within the dry cell. No in-stream barriers were required at this stage of the works.

471 z upon completion of the short term repairs, temporary placement of a filter dam 10 metres downstream to facilitate the removal of the diversion from the east cell, with the filter dam to be removed once the diversion was completed and the creek ran free of sediment.

A Letter of Advice was issued on June 16, 2006 for these Phase I works.

Phase II - 16th Avenue Concrete Box Culvert Emergency Repair Emergency works approval was issued for these works on November 17, 2006. Works were proposed to stabilize the culvert and rehabilitate the road on 16th Avenue at the crossing of Berczy Creek. These works followed the emergency approval issued June 16, 2006 for the initial repairs to the culvert resulting from settlement issues, and represented the remainder of the repair work required for this project.

Culvert stabilization works that were approved by TRCA included the following: z reinforcement of the upstream coffer dam and the installation of a coffer dam at the opposite end of the work area within the west cell. The coffer dams diverted flow back to the east cell so that work could commence in the west cell in the dry. z coring of six 4-inch diameter holes through the base slab of the west cell, and the injection of approximately 1,200 litres of grout into each hole to consolidate the ground beneath the culvert. z removal of the coffer dams from the west cell and the installation of the dams in the east cell. The coffer dams diverted flow back to the original channel in the west cell so that work could commence in the east cell in the dry. z coring of six 4-inch diameter holes through the base slab of the east cell, and the injection of approximately 1,200 litres of grout into each hole to consolidate the ground beneath the culvert. z complete removal of the barriers from the culvert.

Road rehabilitation works that were approved by TRCA included the following: z resurfacing of 100 metres of pavement over the culvert with proposed grades matching existing grades. z removal and replacement of 75 metres of curb and gutter over the culvert. z removal of the existing guard rail protecting the culvert crossing and replacement with a new steel beam guard rail. z removal of material from all areas where settlement had been experienced with areas backfilled, compacted and restored with sod. z installation of appropriate sediment and erosion controls to protect the watercourse.

A Letter of Advice was issued on November 17, 2006 for these Phase II works.

Ratification This Executive Committee Report formalizes the works that have been completed to date as outlined above, based on the following review:

Control of Flooding: Proposed works did not impact the storage or conveyance of floodwaters.

472 Pollution: Standard sediment and erosion control measures (coffer dams, etc.) were implemented and maintained for the duration of construction and until the site was stabilized and restored in order to prevent construction generated sediment from entering any watercourse.

Dynamic Beaches: Not applicable.

Erosion: There were no slope stability concerns with the proposed works.

Conservation of Land: With erosion and sedimentation control plans in effect, the potential for a harmful alteration, disruption or destruction (HADD) of fish habitat was mitigated and two Letters of Advice were written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO).

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The subject property is located at 132 King Road, on the north side of King Road, west of Yonge Street, in the Town of Richmond Hill. The purpose of the application is to construct a one-storey medical office building (gross floor area is 571.62 metres squared) with an associated parking lot at the rear (19 parking spaces provided). Currently, the site maintains a one-storey residence, which is unoccupied. The property is located on the Oak Ridges Moraine, within the Settlement Area land use designation of the Oak Ridges Moraine Conservation Plan (ORMCP) but does not maintain any natural features of concern to the TRCA and is approximately 300 metres away from any key natural heritage feature or hydrologically sensitive feature on the Oak Ridges Moraine. The subject property is also located adjacent to a Special Policy Area (SPA) and is susceptible to flooding during a Regional Storm event. Through previous discussions with TRCA staff, due to the close proximity and flood characteristics, TRCA staff were willing to consider redevelopment of this site on a similar basis to the adjacent lands within the SPA. The proposed building is located over the footprint of the existing residence on site. This proposal satisfies TRCA's technical guidelines for SPAs, and the office building will be adequately flood proofed above the Regional Storm Flood elevation, and withstand the flows and velocities associated with a Regional Storm event.

Control of Flooding: The proposed dwelling will be flood proofed above the Regional Storm Flood elevation. In addition, TRCA staff are satisfied that the proposed works will not significantly affect the storage and/or conveyance of flood waters. The design of the site incorporates safe access in accordance with provincial floodproofing requirements. Additionally, infiltration measures (two infiltration galleries) have been proposed on site to treat stormwater runoff in the parking lot.

477 Pollution: Silt fencing will be installed and maintained during all phases of construction, surrounding the construction area to impede the overland migration of construction generated sediment.

Erosion: There are no geotechnical and/or slope stability concerns associated with this project.

Proposal: The purpose of this application is to construct a 2, 741.05 square metre (29, 505.38 sq. ft.) addition to an existing industrial building located at 50 West Drive, in the City of Brampton. Portions of the existing building and proposed addition are located within the Regional Storm Floodplain of the adjacent creek. In accordance with TRCA policy, expansions to existing buildings within a floodplain are permitted if the proposed addition is considered to be 'minor works' (additions less than 50% of the existing building area), and do not adversely impact the dynamics of the system such as storage/conveyance of floodwaters and natural heritage features. The applicant has demonstrated that the addition is less than 50% of the existing structure (approximately 20% expansion), and that dry-passive floodproofing measures are not feasible given the elevation of the existing structure and nature of the industrial operations (i.e. loading docks and storage access routes). As such, the existing building and addition will be floodproofed using wet-passive measures which include elevating electrical and mechanical systems above the Regional Flood elevation, and elevating inventory to the maximum extent practicable. The building will also be able to withstand water flows and velocities expected during the Regional Storm Event.

Control of Flooding: The proposed works are located within the Regional Floodplain. TRCA Water Resources staff have confirmed that this proposal will not have any significant impacts to the storage and/or conveyance of flood waters.

Stone boulders and field stones will be placed along the channel (measuring approximately 1650 square metres) to prevent further damage to the sewer system and to provide additional stability along the slope.

Pollution: Appropriate controls will be implemented and maintained throughout construction to prevent sediment and other deleterious substances from entering the watercourse.

Proposal: The proposal is to excavate and shore up the excavation in order to begin the development of the "Symphony" or "Corus" development at 125 Queen's Quay at the foot of Lower and Lake Ontario. The project is the first redevelopment site in the East Bayfront. Although the final development proposal and grading is not finalized, the footprint of the building will not change. The application is for a staged permit to allow for excavation and shoring to begin in the summer of 2007, with a permit revision to allow for grading of the site, and the development of a dual tower office building on an underground garage at a later date. The Executive Committee is requested to consider the excavation and shoring permit at this time, and delegate the approval of a permit revision to allow for the grading and construction at a later date.

Control of Flooding: The site is located in the Lower Don Special Policy Area and is subject to flooding in a Regional Storm event. The site will be removed from the floodplain upon completion of the Lower Don River West Remedial Flood Protection Project, currently underway. The excavation and shoring proposal will have no impact on the control of flooding. The future grading and development of the office structure (delegated to staff) will be such that the site and all openings will be located above a minimum of the 350 year flood elevation.

Proposal: The proposal is to construct a new headworks building for fine screening and grit removal facilities to remove particulate matter. Grit removal equipment improves the quality of biosolids, as well as reduces wear and tear on pumps and other mechanical equipment. The existing plant currently employs grit removal however due to poor conditions and the current configuration of the existing system, the grit removal efficiency is inadequate.

Works will include the following: z relocation of the property gate slightly to the west of the current plant entrance location; z construction of a gravel drive to the new headworks building; z construction of the headworks building (including screening area with two channels (one with a mechanical fine screen, the other with a manual bar screen), a two tank vortex grit removal system, slide gates, influent/effluent channels and a by-pass overflow weir; and z construction of flow diversion pumps, diversion flow metre chamber, influent flow metre chamber and distribution chamber.

Groundwater will be isolated with a sheet piling system during construction. Any groundwater/trench-water for the site to be removed during construction will be pumped to the exiting Water Pollution Control Plant for treatment. If the plant is reaching capacity there will be a settling tank on site located at least 30 metres away from the Humber River to the west, for which groundwater/trench-water will be pumped to, allowed to settle and then discharged back into the environment with appropriate sediment and erosion control measures in place.

Control of Flooding: The storage or conveyance of floodwaters will not be impacted by the proposed works.

Pollution: Standard sediment and erosion control measures (silt fence, settling tanks, etc.) will be implemented and maintained for the duration of construction and until the site is stabilized and restored in order to prevent construction generated sediment from entering any watercourse/wetland features.

RATIONALE The application was reviewed by staff on the basis of the following information:

489 Proposal: The proposal is to conduct site grading, temporarily or permanently place, dump or remove any material within a Regulated Area and Regional Storm Flood Plain and alter a tributary of the Humber River, in order to carry out restoration works involving the realignment of an existing watercourse and fish habitat enhancements. The subject site is located southeast of Langstaff Road and Huntington Road, in Planning Block 57/58 West and is also part of lands that are the subject of a conditionally approved Site Plan Application (DA.06.057 -Terra Speranza Developments).

The proposed work site was initially identified for restoration in the Master Environmental Servicing Plan (MESP) for Block 57/58 West, within the City of Vaughan. Block 57/58 West is bounded by Langstaff Road to the north, Highway 407 to the south, Highway 427 to the east and Highway 50 to the west.

During the Block Plan process, TRCA staff identified this watercourse as an area of potential restoration. In consultation with the proponent, it was agreed that the east-west tributary of West Rainbow Creek (Humber River) would remain open using a natural channel design and incorporated into an open space block. Preliminary information on the slope and base width of the channel and flood plain were provided during the Block Plan process. In the end, a 40 metre wide (top width) valley corridor was provided. As such, TRCA staff is satisfied with the limits allocated for the restored tributary channel. Furthermore, an appropriate development setback was established from the limits of this open space block. The valley corridor will provide sufficient width for a meandering of the low flow channel.

The channel will continue east and blend into the West Rainbow Creek valley corridor. Ultimately, the restored channel will benefit this reach as the existing habitat consists primarily of a swale and undefined watercourse impacted by intense agricultural activities. At this time, the TRCA's Fluvial Geomorphologist has reviewed technical submissions relating to the proposed works and is satisfied in principle with the submissions. Minor comments remain outstanding with respect to landscaping and the design of the natural channel. However, these comments are to be satisfied prior to the issuance of the permit. Furthermore, authorization from Fisheries and Oceans Canada (DFO) will be required for the proposed works. Issuance of the TRCA permit will be deferred until such time as DFO authorization is provided.

Control of Flooding: TRCA staff has reviewed the technical drawings to ensure that the proposed natural channel will safely convey storm flows. As such, the storage and conveyance of flood waters is not expected to be impacted.

Pollution: Sediment control measures will be erected prior to the initiation of construction and maintained for the duration of the works to ensure sediment is not transferred to the nearby valley corridor/tributary of the Humber River.

Dynamic Beaches: Not applicable.

490 Erosion: Erosion on the work site will be minimized through the application of the aforementioned sediment and erosion control measures.

Conservation of Land: There are no geotechnical/slope stability issues associated with the proposed works. The restoration works are considered a Harmful Alteration, Disruption or Destruction (HADD) of fish habitat. As such, Fisheries Act Authorization will be required from DFO. This approval will be required prior to TRCA issuance of the subject permit. While the works are considered a HADD, the resulting situation will represent an improvement over the existing conditions; specifically with the improvement of the east/west tributary to the West Rainbow Creek and the development of a natural channel (in an area where there is at times, an ill-defined channel).

Plantings Extensive plantings will implemented in accordance with landscape planting plans submitted for the natural channel corridor.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: This permit application is to allow for the reconstruction of a (berm) water control structure to reinstate water levels in the adjacent Provincially Significant Wetland at levels previously specified by the Ministry of Natural Resources. Through the planning process associated with an adjacent estate residential subdivision (commonly known as “Arlington Homes”) wetland water levels, and the boundary of the wetland were determined by the Ministry of Natural Resources prior to the construction of the subdivision. It was recognized at that time that the wetland water levels, and consequently the extent of the wetland was being influenced by an existing berm (previously used for crossing the wetland to access the rear of the property) at the north side of the wetland. Subsequent to the construction and occupancy of some of the homes within the subdivision, the berm was apparently tampered with, which resulted in wetland water levels being reduced in the adjacent wetland, and a corresponding reduction in wetland size. The works proposed within this permit – utilizing a gabion basket covered with top soil and native seed mix to repair the berm structure – will allow wetland water levels to return to the previous levels identified by the MNR. The gabion basket construction will also reduce the possibility of future tampering with the structure. Modifications to this design which retain the intent of this permit may be required prior to issuance to address TRCA or MNR requirements.

Control of Flooding: It is anticipated that the proposed modifications to the berm will reinstate previous wetland water levels, and reinstate the flood storage capacity that was previously provided in the wetland.

Pollution: Appropriate sediment and erosion control measures are to be installed prior to, and maintained during, all phases of construction.

The proposed works are related to a proposed industrial subdivision (21T-01001C) and Official Plan Amendment application (POPA 01-07) at the southwest corner of and Hurontario Street, in the Town of Caledon. RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: This permit application is to allow for the construction of three temporary stormwater management outfalls associated with a new residential and commercial subdivision within the West Cathedral community in the Town of Markham. The outfalls are more specifically located on lands south of Elgin Mills Road, between Highway 404 and Woodbine Avenue, along the East Branch of Carleton Creek - a tributary of the Rouge River. Two of the three proposed outfalls are associated with proposed temporary stormwater management ponds, which are required to allow for site grading and pre-servicing works to be completed on the subject property. The third outfall is being created as an outlet for major storm flows (i.e. greater than a 5 year storm event) once the residential components of the subdivision are constructed, and prior to the enhanced natural wildlife corridor for East Carleton Creek being created adjacent to this property. Stormwater from lesser storm events is being routed through existing infrastructure to a downstream pond. The two outfalls associated with the temporary ponds will be removed once the permanent stormwater management measures can be implemented. The major storm outfall will be removed and reconstructed (through a separate permit) once the natural wildlife corridor is constructed.

As a component of the master planning for the West Cathedral community, an enhanced corridor of approximate 55 metres in width was envisioned as a community amenity, and to enhance the function of East Carleton Creek. Sections of this corridor are being constructed downstream, and the construction of the corridor adjacent to the subject property has been tied to the development of the commercial lands within the subdivision. Permit applications for Carleton Creek enhancement works will be brought forward to the Executive Committee for consideration through separate, future permit applications.

Control of Flooding: No significant impacts to flood control or conveyance are anticipated as a result of these works.

The subject property is adjacent to a stream corridor, however, the proposed addition is located on the tableland portion of the property and is sufficiently setback to maintain the form and functions of the natural feature.

Proposal: The purpose of this project is to undertake works within a TRCA Regulated Area of the Rouge River Watershed in order to facilitate the construction of stormwater management infrastructure related to a draft approved plan of subdivision (SU 03 119813) located at the northwest corner of Kennedy Road and 16th Avenue, in the Town of Markham. The proposal involves alternate stormwater management measures for the proposed subdivision, which utilizes innovative best management practices (BMPs) to promote infiltration and enhance stormwater quality. In addition, the project involves the creation of a forested wetland in the lowland area of the site which currently exists as a manicured front lawn for an existing residential dwelling.

Control of Flooding: A portion of the subject property is located within the Regional Floodplain. TRCA Water Resources staff has reviewed the project and do not anticipate any significant impacts to the storage and/or conveyance of flood waters.

Pollution: Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction.

The purpose is to alter a watercourse, construct within the Regulatory Floodplain, and place fill within a Fill Regulated area, to facilitate the construction of a new enhanced stream corridor and the diversion of flows from the existing degraded stream into this corridor.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: This permit is the third of a series which are associated with the Markham Centre development, located between Warden Avenue and Kennedy Road, and between Highway 407 and Highway 7, in the Town of Markham. A permit for related stream corridor works, associated with the downstream connection of the enhanced stream corridor to a remnant tributary of the Rouge River that currently traverses the Markham Centre lands, was approved by the Executive Committee at the December 1, 2006 meeting.

500 A central component of the Markham Centre development is the creation of this new naturalized stream corridor (of approximately 60 metres in width) with associated surrounding public amenity space, which will link the community with the Rouge River corridor to the north. The proposed stream corridor will divert flows from an existing highly altered watercourse ("Tributary 4", a tributary of the Rouge River) currently located to the west of the proposed corridor, and restore a more natural channel profile. The new channel, with its natural channel design, off-line wetlands, and significant riparian plantings will provide a substantial improvement to the existing degraded channel, and a significant net environmental gain for the area.

Over the last couple of years, the proposed corridor and future stream channel has been constructed off-line, and stabilized in preparation for receiving flows from the diverted watercourse. All works associated with the corridor creation have to date been completed outside of TRCA's Regulated areas, and have not required permits from the Authority. Bringing the new corridor on-line will require permits from the TRCA for both the downstream connection (to the Rouge River), and the diversion of Tributary 4 upstream, and will require Authorization from Fisheries and Oceans Canada (DFO). This permit application is to permit the connection of the newly created corridor to the tributary to the Rouge River to the south, and the diversion of flows into the corridor. As noted above, a permit was previously approved by the Executive Committee for the downstream connection.

The in-water portion of the subject works will be subject to MNR Fisheries Timing Window restrictions, and the issuance of the requisite DFO Authorization.

Control of Flooding: A portion of the proposed works will be located within the Regulatory Floodplain associated with Tributary 4 the Rouge River, however, the proposed works are being completed in accordance with the Master Environmental Servicing Plan (MESP) for the area, and no permanent adverse impacts to the storage and/or conveyance of flood waters are anticipated.

Pollution: Appropriate sediment and erosion control measures have been proposed with this application, and will be maintained throughout all phases of construction.

Dynamic Beaches: Not applicable

Erosion: There are no geotechnical and/or slope stability concerns associated with this proposal.

Conservation of Land: The proposed channel will provide significant additional habitat, and provide for a more natural channel profile for Tributary 4. The proposed channel is considered to be a significant net ecological gain over the existing condition. The proposed diversion works require Authorization from Fisheries and Oceans Canada. Consequently, this permit will not be issued until such time as Authorization has been provided by DFO.

501 Plantings A comprehensive planting and enhancement plan has been established, and will be implemented through this permit and the associated permit approved by the Executive Committee at the December 1, 2006 meeting. This project will provide for approximately 3 hectares of new planted area, in addition to new (planted) wetland habitat.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: This permit application is to allow for the construction of a new sanitary sewer line within a Regulated area, adjacent to East Carleton Creek, in the West Cathedral community in the Town of Markham. The sanitary sewer line will be constructed within the future Woodbine Avenue Bypass right-of-way from north of Major Mackenzie Drive to north of Elgin Mills Road. Only a small portion of the subject works are located within TRCA’s Regulated Area.

The proposed sanitary sewer will be completed by the Town of Markham to service lands within the remaining phases of the West Cathedral community. This project is being completed under the integrated (streamlined) Planning Act/Environmental Assessment (EA)Act approvals process, and consequently, an EA is not required for this project.

502 No crossings of East Carleton Creek are required for the proposed sanitary sewer line. The proposed sewer line will be located adjacent to a small section of the future alignment of this watercourse - in the portion of this project that falls within an area Regulated by the TRCA. TRCA staff are satisfied that the proposed sanitary sewer will be adequately set-back from the watercourse in this area.

Although temporary dewatering of groundwater is anticipated in other sections of the project not Regulated by the TRCA, Permits to Take Water have been issued by the Ministry of the Environment, with contingency measures to reduce any impacts on natural features within the area that may be supported by groundwater flows. All ground water removed during the construction process will be discharged into municipal sanitary servicing, and not directly into East Carleton Creek. Contingency provisions have however been included for the project, to allow stream flows to be augmented if it is determined that unanticipated impacts to stream baseflow exist.

Control of Flooding: No significant impacts to flood control or conveyance are anticipated as a result of these works.

Pollution: Appropriate sediment and erosion control measures are to be installed prior to, and maintained during, all phases of construction.

Dynamic Beaches: Not applicable

Erosion: There are no slope stability and/or erosion related concerns with this application.

RATIONALE The application was reviewed by staff on the basis of the following information:

505 Proposal: The purpose of this application is to undertake works within a regulated area to facilitate the reconstruction of an existing stormwater outfall and perform bank and floodplain restoration works at the Elgin Mills Cemetery and Crematorium, located in the Town of Richmond Hill. These works are required to stabilize the banks of the receiving channel and to improve the form and functions of the floodplain and riparian zones which have been degraded as a result of non-permitted works associated with the construction of the adjacent stormwater management pond. In this regard, the works proposed with this permit are associated with a violation and the appropriate violation fee has been applied. Additionally, due to the extent of the impacts and the sensitivities of the receiving waters, TRCA and Fisheries and Oceans Canada staff are of the opinion that these restoration works must be completed prior to July 30, 2007.

Control of Flooding: TRCA technical staff have reviewed the existing and proposed conditions and determined that the conveyance and flows of floodwaters will not be adversely impacted.

Pollution: Appropriate erosion and sediment control measures have been proposed, and will be maintained through all phases of these works.

Dynamic Beaches: Not applicable

Erosion: Due to non-permitted works associated with the construction of the adjacent stormwater management pond significant bank erosion and slope instability along the receiving waters has resulted. To remediate these problems, several mitigation measures have been proposed including re-stabilizing the channel banks using sod mats, placing wattle bundles along the outfall low flow channel to reduce run-off velocity and mitigate thermal impacts of the storm run-off, as well as re-vegetating the floodplain and riparian zones using a mix of live stakes, shrubs and trees to improve the functions of the system. TRCA technical staff are satisfied that implementing these restoration works will effectively mitigate for the existing erosion and slope instability issues.

Conservation of Land: As describe above, a significant amount of floodplain and riparian zone plantings are proposed to improve the form and functions of the system in this area. In this regard, an appropriate mix of live stakes, shrubs and trees will be strategically placed throughout the corridor to create more diversity and re-stabilize the soils. There are no fisheries related concerns with this application.

Plantings All proposed plantings will be native and non-invasive species and will be consistent with TRCA's post-construction restoration guidelines.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: This permit application is to allow for the construction of a new stormwater management pond within the Beaver Creek stream corridor, located west of Highway 404, south of 16th Avenue. The lands on which the pond is to be constructed are owned and maintained by the Town of Richmond Hill.

While the proposed pond will service a new employment lands subdivision (Orlando subdivision), located north of 16th Avenue, west of Highway 404, it is also considered to be a ‘ retrofit’ opportunity, to treat an existing employment lands area north of the pond (and south of 16th Avenue) which was built with limited stormwater management measures, that do not meet current standards. While it is not feasible within the limited space available for the pond within the Beaver Creek corridor to provide a pond of sufficient size to treat the stormwater to the ‘Level 1’ quality parameters (applied to new development), the pond, and the supporting measures have been designed to provide for quality as close to this standard as is practically attainable. Mechanical separation devices will be installed upstream of the proposed pond to provide pre-treatment, and to enhance the overall quality of the stormwater that will be released into Beaver Creek. Based upon the retrofit component of this project, which will provide a significant improvement to stormwater quality for the flows generated by the current employment lands area, this project is considered to be a net gain with respect to stormwater quality and quantity.

507 As the proposed pond will be located on top of two small remnant tributaries to Beaver Creek, which currently convey storm flows from the developed upstream employment lands, approval from Fisheries and Oceans Canada (DFO) is required, with appropriate compensation. As a proponent of this project, the proponent is proposing enhancements upstream of the pond, which is anticipated to enhance fish habitat within the main branch of Beaver Creek.

Control of Flooding: No significant impacts to flood control or conveyance are anticipated as a result of these works.

Pollution: Appropriate sediment and erosion control measures are to be installed prior to, and maintained during, all phases of construction.

Dynamic Beaches: Not applicable

Erosion: There are no slope stability and/or erosion related concerns with this application.

Conservation of Land: The subject works are being completed within an area in which a substantial amount of vegetation already exists. This vegetation will need to be removed as part of this project, and will be where possible replanted within adjacent areas of the Beaver Creek corridor. Additional plantings will be provided within the corridor to compensate for those that cannot be moved, and an overall increase in tree/plant cover will be provided through this project.

Plantings A substantial planting plan is proposed with this project to compensate for the vegetation that will be removed for the construction of the pond. Plantings will also be provided within and adjacent to the pond, in accordance with TRCA’s planting guidelines.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The proposal consists of the repair of two washed out areas. One area is located on the north side of a driveway culvert to a residential entrance and the other area is located on the east side of Jane Street, south of the driveway. During a recent storm there was a backwater effect at the driveway culvert which caused the erosion and slumping on the upstream side of the driveway culvert. The excessive flows also caused slumping and erosion in the ditch south of the culvert. At present the homeowner does not have plans to upsize the existing culvert. This watercourse running parallel to Jane Street in the east ditch is a tributary of the East Humber River and connects to the larger watercourse further south at a bridge north of King Road. The upstream drainage area is greater than 50 hectares and therefore, has a Regional Storm Floodplain associated with it. The site is also located within the Regulated Area, however, there are no wetlands in the vicinity. The Regional Municipality of York staff considers this project to be a Schedule A- Maintenance Project under the Environmental Assessment Act.

Control of Flooding: Fill placement will be minimized within the Regional Storm Floodplain with this infrastructure maintenance project and staff does not anticipate concerns with loss of storage or conveyance.

Pollution: Standard erosion control measures ( silt fence) will be implemented to ensure that the construction-generated sediments do not enter the watercourse.

Dynamic Beaches: Not Applicable 509 Erosion: The repairs to the washed out areas will mitigate the immediate problem with the erosion.

Conservation of Land: There will be in stream works associated with this project. Approximately 2 metres of the existing watercourse will be relocated to the west in order to work in the dry to repair the washed out and to enhance flows in the future. With erosion and sedimentation plans in effect, the potential for a harmful alteration, disruption or destruction (HADD) of fish habitat will be mitigated and a Letter of Advice will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO).

Plantings All disturbed areas will be restored with native/non-invasive species following construction.

Policy Guidelines: The proposal complies with Section 4.3- Infrastructure and Servicing of the Authority's Valley and Stream Corridor Management Program.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The proposal is to install a child's playground in an existing manicured lawn area of the City of Toronto's Bloordale Park. The playground will consist of installing an accessible playground pad, child's play structure, swings and drainage for the pad. Phase I of the project is funded through community and corporate donations for the purpose of adding updated playground equipment in the local community. It is expected that Phase II will include a water play feature, pending funding, at a later date. The playground will replace an existing deteriorated playground located approximately 40 metres to the east.

Control of Flooding: The playground is proposed within the Regional Storm Floodplain to the east of the existing Renforth Creek paved pathway. The City of Toronto Parks, Forestry and Recreation staff understands that there is an element of risk to placing the playground in this area. However, the City's position is that constraints within the park and a need to keep the playground and the future water play feature together for security purposes negates replacing the playground in an area of the park located 40 metres to the east that is not within the Regional Storm Floodplain. The playground itself will not impact the storage or conveyance of flooding as the structures are open and the grades will remain the same.

Pollution: A temporary sediment control fence will be installed during construction to keep construction debris from entering the watercourse.

Dynamic Beaches: Not applicable.

519 Erosion: The playground will be located on a flat portion of the site and therefore there are no geotechnical concerns.

Conservation of Land: The playground will be located in an area of manicured lawn. No vegetation will be impacted.

Plantings Additional plantings are not required.

Policy Guidelines: The proposal is consistent with Policy 4.1.2., New Resource based Uses, of the Valley and Stream Corridor Management Program. However, it should be noted that there is an alternative location 40 metres east of the proposed location of the playground that is large enough to accommodate the playground outside of the Regional Storm Floodplain. However, this location could not accommodate Phase II, the water play feature, if or when this Phase is constructed. Therefore, the City staff prefer the proposed location within the floodplain.

520 Proposal: The proposed works consist of constructing a new two-storey dwelling. The existing dwelling will be demolished. The site is located within the Regional Storm floodplain of the Don River, within the Hogg's Hollow District Special Policy Area (SPA). The subject property is located east of Yonge Street and south of York Mills Road within the City of Toronto.

Control of Flooding: The proposed addition will be dry floodproofed to the 350 year storm elevation. The works will not affect the storage or conveyance of flood water. The proposed new two-storey dwelling will be closer to the street line and further away from the watercourse than the original dwelling that will be demolished.

Pollution: A sediment control fence will be installed and maintained until construction is completed to ensure that no debris enters into the adjacent valley system.

CARRIED BACKGROUND In partnership with the Greater Toronto Airports Authority (GTAA), TRCA developed the GTAA Living City Project (2006). This project assessed the existing conditions of the terrestrial natural heritage system, aquatic ecosystem and stormwater infrastructure throughout the Etobicoke Creek watershed, with a specific focus around Toronto Pearson International Airport. The project offered recommendations for ecosystem improvements and sustainable development. Realizing the implementation of these recommendations would rely upon buy-in from the private sector, the report called for the creation of an eco-industrial park framework to reach out to the ICI sector surrounding Pearson Airport.

The essence of eco-industrial networking is improving the financial and environmental performance of businesses. This is achieved by reducing energy, waste and water-use through efficiencies and developing synergies between companies, where one company’s waste is another's feedstock. Eco-industrial parks are the framework within which eco-industrial networking takes place. An eco-industrial park puts an emphasis on fostering networks among businesses and the community to optimize resource-use and reduce economic and environmental costs.

The development of this eco-industrial park provides an opportunity for the GTAA, TRCA, the Regional Municipality of Peel and the business community to realize improved financial and environmental performance, offer a marketing framework to promote eco-economic development and showcase the region's leadership in environmental performance.

522 The purpose of this project is to: (1) provide a planning and implementation structure to enable the ICI sector to achieve improved financial and environmental performance through eco-industrial networking; and (2) brand the area to provide cohesion and focused eco-economic development marketing of the ICI sector surrounding Pearson Airport.

The first step in developing the eco-industrial park is completing a detailed analysis of resource flows in the study area, including electricity, gas, potable water, wastewater and solid waste. This information will be used to identify eco-industrial networking opportunities, provide a business plan for their implementation and develop an overall eco-industrial park strategy for the study area.

RATIONALE The study area comprises over 11,000 hectares of ICI-zoned lands, spanning both the Etobicoke and Mimico creeks watersheds and the municipalities of Brampton, Mississauga and Toronto. The study area will represent the largest eco-industrial park retrofit in Canada.

TRCA staff has worked with Eco-Industrial Solutions Inc. on a detailed task list and two phase process for the development of the Pearson Eco-Industrial Park resource baseline and strategy for which they have provided a quote of $140,000, plus applicable taxes. Based on several interviews, in-depth research and reference gathering, staff is of the opinion that the firm has extensive experience in the development of eco-industrial networks and the amount represents good value for the extent of work requested.

Eco-Industrial Solutions Inc. is the only company in Canada that has experience in the field of eco-industrial networking master planning on a comprehensive basis and is currently completing similar projects for: Fort McMurray, Alberta; Hinton, Alberta; Spruce Grove, Alberta; Regina, Saskatchewan; Sudbury, Ontario; and Kunshan, China. A complete project list is attached, as are letters of recommendation from the City of Spruce Grove and the Regina Eco-Industrial Network Association.

DETAILS OF WORK TO BE DONE The project will include two phases:

Phase 1 A total of $41,000 will be paid upon the successful completion of Phase 1, involving the development of an inventory of businesses in the study area, a high-level resource baseline of the ICI sector, a stakeholder workshop and interim project report.

Phase 2 The planning of the second phase of the project will only proceed with written permission from TRCA staff upon successful completion of Phase 1 and approval of funds. The second phase will provide a much more detailed resource baseline for businesses in the study area, an in-depth data analysis, identification of eco-industrial opportunities, business case development, two stakeholder workshops and a strategy document providing an implementation strategy, management structure and marketing plan, with a total cost of $99,000 plus applicable taxes.

Eco-Industrial Solutions (EIS) has been the lead consultant on the Ross Eco-Industrial Park project for almost two years. Led by the Regina Eco-Industrial Network Association (REINA), this eco-industrial retrofit project is focusing on the Ross Industrial Park, home to more than 400 businesses. The objective is to identify and 1 implement sustainable transportation and other EIN opportunities . The basic work plan for the project involves completion of a resource baseline; establishment of performance indicators; identification of EIN opportunities; feasibility screening; and development of an implementation plan. Currently we are screening opportunites, using industry focus groups.

EIS was instrumental in acquiring the data needed to idenftify strategic EIN opportunites in the park. Once data was received, they revised / reformatted the data such that it was in a consistent format for analysis and could be loaded into a Geographic Information System (GIS). This enabled us to identify 'hot spots' of resource consumption, evaluate current land use (in)efficiencies, and identify other sector-specific patterns.

An example of an opportunity with high potential benefits is the collaborative installation of capacitor banks and high-efficiency motors. In Ross it was determined that more than 70 businsses had demand surcharges in their electricity bills and that ~$400,000 could be save collectively by the companies if they participated. REINA is now working with these companies on this initiative.

As lead consultant for the project, EIS also completed several funding proposals, and successfully generated more than $200,000 towards the project, from municipal, provincial, and federal sources. They have also supported REINA in coordinating Advisory Committee meetings for the project, diligently ensuring proper follow-up action items.

Lakefilling for the central and west sectors (Phase 1) commenced at the south end of Superior Avenue progressing towards Norris Crescent, located at the western limit of the project. Stage 2 shoreline protection scheduled to commence in late July, 2007 includes construction of the final shoreline protection for the main headland and island features in Phase 1 of the Mimico Waterfront Linear Park Project. Placement of cobble stone beach protection for the east beach component is scheduled to commence in July, 2007 to coincide with the warm water fisheries window for in-water works.

BACKGROUND The windows at the above noted property are in need of replacement due to age. These windows are very drafty and are a cause for heat loss. The tenant at this location proceeded to obtain their own quotation from a window installer and provided the Toronto and Region Conservation Authority (TRCA) with this price. TRCA staff proceeded to contact two other window contractors to visit the site and provide a quotation. We are recommending this company because they did spend a considerable amount of time with the tenants to record the style of window and measurements. The lowest bidder would have to return to the site and sit down with the tenants to obtain this information. To avoid any further delay it is recommended that we award the contract to Welda Windows Industries. There is a four week delivery time and TRCA staff would like to have the windows installed before fall. Reference checks were conducted and the TRCA received two good recommendations for Welda Windows Industries. 532 Funds are available in the TRCA rental budget.

RECOMMENDATION

THAT the contract for janitorial/cleaning services for the new Restoration Services Centre be awarded to Do It Right Cleaning Services for an annual cost not to exceed $21,600, plus applicable taxes.

In December 2005, the contract for janitorial/cleaning services was awarded to MBM Cleaning Services Inc. to service the Head Office, Downsview Park Office, Boyd Office and Kortright Centre for Conservation.

The new Restoration Services Centre has been added to the list of Toronto and Region Conservation Authority (TRCA) locations requiring cleaning services and MBM Cleaning Services Inc. was asked to provide a quote for cleaning services of this new centre. MBM quoted $1,758.00/month, plus applicable taxes.

TRCA also requested a quotation from Do It Right Cleaning Services (D.I.R.), the janitorial services company used by Percon Construction to clean the building prior to it being occupied by TRCA staff. Do It Right Cleaning Services quoted $1,800/month, plus applicable taxes.

Staff was impressed with the service provided by D.I.R, and since their quote is not substantially higher that the one provided by MBM Cleaning Services (a difference of $42.00/month) staff is recommending that D.I.R. Cleaning Services be awarded the contract for one year. Staff will use D.I.R. as a benchmark to measure the level of service we are currently getting from MBM Cleaning Services.

534 RES.#B81/07 - CONSERVATION AUTHORITIES ACT AMENDMENT Quorum Change From One Third to One Half. Proclamation of the Ontario Clean Water Act includes an amendment to the Conservation Authorities Act changing quorum requirements.

IT IS RECOMMENDED THAT the report dated July 4, 2007, on the amendment to the Conservation Authorities Act to change quorum requirements from one third to one half, be received. CARRIED RATIONALE As a result of the proclamation of the Ontario Clean Water Act on July 3, 2007, section 16 (2) of the Conservation Authorities Act has been amended to provide that the quorum for meetings of Authorities is changed to one half of the members from one third of the members.

This change ensures that the quorum requirements for Authority meetings are the same as the quorum requirements for meetings of Source Protections Authorities which are established under the provisions of the Ontario Clean Water Act.

Members are asked to note this change which means that 14 of 28 members must be present for meetings of the Authority. Under the Toronto and Region Conservation Authority (TRCA) Rules of Conduct, quorum for the advisory boards has always been one half of the members. Quorum for Executive Committee meetings will remain at majority.

TRCA staff will be notifying the offices of TRCA members who have staff arranging their schedules of the change and the need for Members to attend and to advise TRCA staff if they are not able to attend.
