AN ACT TO INSTITUTE THE POLICIES OF OVERSEAS EMPLOYMENT AND ESTABLISH A HIGHER STANDARD OF PROTECTION AND PROMOTION OF THE WELFARE OF MIGRANT WORKERS, THEIR FAMILIES AND OVERSEAS IN DISTRESS, AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representative of the Philippines in Congress assembled: SECTION1.ShortTitle.—ThisActshallbeknownandcitedasthe"MigrantWorkersand OverseasFilipinosActof1995." SECTION2.DeclarationofPolicies. (a) In the pursuit of an independent foreign policy and while considering national sovereignty,territorialintegrity,nationalinterestandtherighttoselfdetermination paramountinitsrelationswithotherstates,theStateshall,atalltimes,upholdthe dignityofitscitizenswhetherincountryoroverseas,ingeneral,andFilipinomigrant workers,inparticular. (b) The State shall afford full protection to labor, local and overseas, organized and unorganized, and promote full employment and equality of employment opportunitiesforall.Towardsthisend,theStateshallprovideadequateandtimely social,economicandlegalservicestoFilipinomigrantworkers. (c) While recognizing the significant contribution of Filipino migrant workers to the national economy through their foreign exchange , the State does not promoteoverseasemploymentasameanstosustaineconomicgrowthandachieve national development. The existence of the overseas employment program rests solelyontheassurancethatthedignityandfundamentalhumanrightsandfreedoms oftheFilipinocitizenshallnot,atanytime,becompromisedorviolated.TheState, therefore,shallcontinuouslycreatelocalemploymentopportunitiesandpromotethe equitabledistributionofwealthandthebenefitsofdevelopment. (d)TheStateaffirmsthefundamentalequalitybeforethelawofwomenandmenand the significant role of women in nationbuilding. Recognizing the contribution of overseasmigrantwomenworkersandtheirparticularvulnerabilities,theStateshall applygendersensitivecriteriaintheformulationandimplementationofpoliciesand programsaffectingmigrantworkersandthecompositionofbodiestaskedforthe welfareofmigrantworkers. (e)Freeaccesstothecourtsandquasijudicialbodiesandadequatelegalassistanceshall notbedeniedtoanypersonbyreasonofpoverty.Inthisregard,itisimperativethat an effective mechanism be instituted to ensure that the rights and interest of distressedoverseasFilipinos,ingeneral,andFilipinomigrantworkers,inparticular, documentedorundocumented,areadequatelyprotectedandsafeguarded. (f)TherightofFilipinomigrantworkersandalloverseasFilipinostoparticipateinthe democratic decisionmaking processes of the State and to be represented in institutionsrelevanttooverseasemploymentisrecognizedandguaranteed. (g) The State recognizes that the ultimate protection to all migrant workers is the possessionofskills.Pursuanttothisandassoonaspracticable,thegovernmentshall deployand/orallowthedeploymentonlyofskilledFilipinoworkers. (h)Nongovernmentalorganizations,dulyrecognizedaslegitimate,arepartnersofthe StateintheprotectionofFilipinomigrantworkersandinthepromotionoftheir welfare.TheStateshallcooperatewiththeminaspiritoftrustandmutualrespect. (i) Government fees and other administrative costs of recruitment, introduction, placementandassistancetomigrantworkersshallberenderedfreewithoutprejudice totheprovisionofSection36hereof. Nonetheless,thedeploymentofFilipinooverseasworkers,whetherlandbasedorseabased, by local service contractors and manning agencies employing them shall be encouraged. Appropriateincentivesmaybeextendedtothem. SECTION3.Definitions.—ForpurposesofthisAct: (a)"Migrantworker"referstoapersonwhoistobeengaged,isengagedorhasbeen engagedinaremuneratedactivityinastateofwhichheorsheisnotalegalresident; tobeusedinterchangeablywithoverseasFilipinoworker. (b) "Gendersensitivity" shall mean cognizance of the inequalities and inequities prevalentinsocietybetweenwomenandmenandacommitmenttoaddressissues withconcernfortherespectiveinterestsofthesexes. (c) "Overseas Filipinos" refers to dependents of migrant workers and other Filipino nationalsabroadwhoareindistressasmentionedinSections24and26ofthisAct. I. DEPLOYMENT SECTION4.DeploymentofMigrantWorkers.—TheStateshalldeployoverseasFilipino workersonlyincountrieswheretherightsofFilipinomigrantworkersareprotected.The government recognizes any of the following as a guarantee on the part of the receiving countryfortheprotectionandtherightsofoverseasFilipinoworkers: (a)Ithasexistinglaborandsociallawsprotectingtherightsofmigrantworkers; (b)Itisasignatorytomultilateralconventions,declarationsorresolutionsrelatingtothe protectionofmigrantworkers; (c) It has concluded a bilateral agreement or arrangement with the government protectingtherightsofoverseasFilipinoworkers;and (d)Itistakingpositive,concretemeasurestoprotecttherightsofmigrantworkers. SECTION5.TerminationorBanonDeployment.—Notwithstanding the provisions of Section4hereof,thegovernment,inpursuitofthenationalinterestorwhenpublicwelfare so requires, may, at anytime, terminate or impose a ban on the deployment of migrant workers. II. ILLEGAL RECRUITMENT SECTION6.Definition.—ForpurposesofthisAct,illegalrecruitmentshallmeananyact ofcanvassing,enlisting,contracting,transporting,utilizing,hiring,orprocuringworkersand includes referring, contract services, promising or advertising for employment abroad, whetherforprofitornot,whenundertakenbyanonlicenseeornonholderofauthority contemplated under Article 13(f) of Presidential Decree No. 442, as amended, otherwise knownastheLaborCodeofthePhilippines:Provided,Thatanysuchnonlicenseeornon holderwho,inanymanner,offersorpromisesforafeeemploymentabroadtotwoormore personsshallbedeemedsoengaged.Itshalllikewise include the following acts, whether committed by any person, whether a nonlicensee, nonholder, licensee or holder of authority: (a)Tochargeoracceptdirectlyorindirectlyanyamountgreaterthanthatspecifiedinthe scheduleofallowablefeesprescribedbytheSecretaryofLaborandEmployment,or tomakeaworkerpayanyamountgreaterthanthatactuallyreceivedbyhimasaloan oradvance; (b)Tofurnishorpublishanyfalsenoticeorinformation or document in relation to recruitmentoremployment; (c)Togiveanyfalsenotice,testimony,informationordocumentorcommitanyactof misrepresentationforthepurposeofsecuringalicenseorauthorityundertheLabor Code; (d)Toinduceorattempttoinduceaworkeralreadyemployedtoquithisemploymentin ordertoofferhimanotherunlessthetransferisdesignedtoliberateaworkerfrom oppressivetermsandconditionsofemployment; (e)Toinfluenceorattempttoinfluenceanypersonorentitynottoemployanyworker whohasnotappliedforemploymentthroughhisagency; (f) To engage in the recruitment or placement of workers in jobs harmful to public healthormoralityortothedignityoftheRepublicofthePhilippines; (g) To obstruct or attempt to obstruct inspection by the Secretary of Labor and Employmentorbyhisdulyauthorizedrepresentative; (h) To fail to submit reports on the status of employment, placement vacancies, offoreignexchangeearnings,separationfromjobs,departuresandsuch other matters or information as may be required by the Secretary of Labor and Employment; (i)Tosubstituteoraltertotheprejudiceoftheworker,employmentcontractsapproved andverifiedbytheDepartmentofLaborandEmploymentfromthetimeofactual signingthereofbythepartiesuptoandincludingtheperiodoftheexpirationofthe samewithouttheapprovaloftheDepartmentofLaborandEmployment; (j)Foranofficeroragentofarecruitmentorplacementagencytobecomeanofficeror memberoftheBoardofanycorporationengagedintravelagencyortobeengaged directlyorindirectlyinthemanagementofatravelagency; (k)Towithholdordenytraveldocumentsfromapplicantworkersbeforedeparturefor monetaryorfinancialconsiderationsotherthanthoseauthorizedundertheLabor Codeanditsimplementingrulesandregulations; (l)FailuretoactuallydeploywithoutvalidreasonasdeterminedbytheDepartmentof LaborandEmployment;and (m) Failure to reimburse expenses incurred by the worker in connection with his documentation and processing for purposes of deployment, in cases where the deployment does not actually take place without the worker's fault. Illegal recruitmentwhencommittedbyasyndicateorinlargescaleshallbeconsideredan offenseinvolvingeconomicsabotage. Illegalrecruitmentisdeemedcommittedbyasyndicateifcarriedoutbyagroupofthree(3) ormorepersonsconspiringorconfederatingwithoneanother.Itisdeemedcommittedin largescaleifcommittedagainstthree(3)ormorepersonsindividuallyorasagroup. The persons criminally liable for the above offenses are the principals, accomplices and accessories. In case of juridical persons, the officers having control, management or directionoftheirbusinessshallbeliable. SECTION7.Penalties.— (a) Any person found guilty of illegal recruitment shall suffer the penalty of imprisonmentofnotlessthansix(6)yearsandone(1)daybutnotmorethantwelve (12)yearsandafineofnotlessthanTwohundredthousandpesos(P200,000.00)nor morethanFivehundredthousandpesos(P500,000.00). (b)ThepenaltyoflifeimprisonmentandafineofnotlessthanFivehundredthousand pesos (P500,000.00) nor more than One million pesos (P1,000,000.00) shall be imposedifillegalrecruitmentconstituteseconomicsabotageasdefinedherein. Provided, however, That the maximum penalty shall be imposed if the person illegally recruitedislessthaneighteen(18)yearsofageorcommittedbyanonlicenseeornon holderofauthority. SECTION8.ProhibitiononOfficialsandEmployees.—Itshallbeunlawfulforanyofficial or employee of the Department of Labor and Employment, the Philippine Overseas Employment Administration (POEA), or the Overseas Workers Welfare Administration (OWWA),ortheDepartmentofForeignAffairs,orothergovernmentagenciesinvolvedin the implementation of this Act, or their relatives within the fourth civil degree of consanguinity or affinity, to engage, directly or indirectly in the business of recruiting migrantworkersasdefinedinthisAct.Thepenaltiesprovidedintheimmediatepreceding paragraphshallbeimposeduponthem. SECTION9.Venue.—Acriminalactionarisingfromillegalrecruitmentasdefinedherein shallbefiledwiththeRegionalTrialCourtoftheprovinceorcitywheretheoffensewas committedorwheretheoffendedpartyactuallyresidesatthetimeofthecommissionofthe offense: Provided, That the court where the criminal action is first filed shall acquire jurisdiction to the exclusion of other courts: Provided, however, That the aforestated provisionsshallalsoapplytothosecriminalactionsthathavealreadybeenfiledincourtat thetimeoftheeffectivityofthisAct. SECTION10.MoneyClaims.—Notwithstandinganyprovisionoflawtothecontrary,the LaborArbitersoftheNationalLaborRelationsCommission(NLRC)shallhavetheoriginal andexclusivejurisdictiontohearanddecide,withinninety(90)calendardaysafterthefiling ofthecomplaint,theclaimsarisingoutofanemployeremployeerelationshiporbyvirtueof anylaworcontractinvolvingFilipinoworkersforoverseasdeploymentincludingclaimsfor actual,moral,exemplaryandotherformsofdamages. Theliabilityoftheprincipal/employerandtherecruitment/placementagencyforanyandall claimsunderthissectionshallbejointandseveral.Thisprovisionshallbeincorporatedin thecontractforoverseasemploymentandshallbeaconditionprecedentforitsapproval. Theperformancebondtobefiledbytherecruitment/placementagency,asprovidedbylaw, shallbeanswerableforallmoneyclaimsordamagesthatmaybeawardedtotheworkers.If therecruitment/placementagencyisajuridicalbeing, the corporate officers and directors andpartnersasthecasemaybe,shallthemselvesbe jointly and solidarilyliablewith the corporationorpartnershipfortheaforesaidclaimsanddamages. Such liabilities shall continue during the entire period or duration of the employment contractandshallnotbeaffectedbyanysubstitution, amendment or modification made locallyorinaforeigncountryofthesaidcontract. Anycompromise/amicablesettlementorvoluntaryagreementonmoneyclaimsinclusiveof damagesunderthissectionshallbepaidwithinfour(4)monthsfromtheapprovalofthe settlementbytheappropriateauthority. Incaseofterminationofoverseasemploymentwithoutjust,validorauthorizedcauseas definedbylaworcontract,theworkershallbeentitled to the full reimbursement of his placement fee with interest at twelve percent (12%) per annum, plus his salaries for the unexpiredportionofhisemploymentcontractorforthree(3)monthsforeveryyearofthe unexpiredterm,whicheverisless. Noncompliance with the mandatory periods for resolutions of cases provided under this sectionshallsubjecttheresponsibleofficialstoanyorallofthefollowingpenalties: (a)Thesalaryofanysuchofficialwhofailstorenderhisdecisionorresolutionwithin the prescribed period shall be, or caused to be, withheld until the said official compliestherewith; (b)Suspensionfornotmorethanninety(90)days;or (c)Dismissalfromtheservicewithdisqualificationtoholdanyappointivepublicoffice forfive(5)years. Provided, however, That the penalties herein provided shall be without prejudice to any liabilitywhichanysuchofficialmayhaveincurredunderotherexistinglawsorrulesand regulationsasaconsequenceofviolatingtheprovisionsofthisparagraph. SECTION 11. Mandatory Periods for Resolution of Illegal Recruitment Cases. — The preliminary investigations of cases under this Act shall be terminated within a period of thirty(30)calendardaysfromthedateoftheirfiling.Wherethepreliminaryinvestigationis conductedbyaprosecutionofficerandaprimafaciecaseisestablished,thecorresponding informationshallbefiledincourtwithintwentyfour(24)hoursfromtheterminationofthe investigation.Ifthepreliminaryinvestigationisconductedbyajudgeandaprimafaciecase isfoundtoexist,thecorrespondinginformationshall be filed by the proper prosecution officerwithinfortyeight(48)hoursfromthedateofreceiptoftherecordsofthecase. SECTION 12. Prescriptive Periods. — Illegal recruitment cases under this Act shall prescribe in five (5) years: Provided, however, That illegal recruitment cases involving economicsabotageasdefinedhereinshallprescribeintwenty(20)years. SECTION13.FreeLegalAssistance;PreferentialEntitlementUndertheWitnessProtection Program.—Amechanismforfreelegalassistanceforvictimsofillegalrecruitmentshallbe establishedwithintheDepartmentofLaborandEmploymentincludingitsregionaloffices. SuchmechanismmustincludecoordinationandcooperationwiththeDepartmentofJustice, the Integrated Bar of the Philippines, and other nongovernmental organizations and volunteergroups. TheprovisionsofRepublicActNo.6981tothecontrarynotwithstanding,anypersonwho isavictimofillegalrecruitmentshallbeentitledtotheWitnessProtectionProgramprovided thereunder. III. SERVICES SECTION14.TravelAdvisory/InformationDissemination.—Togiveutmostpriorityto the establishment of programs and services to prevent illegal recruitment, fraud and exploitation or of Filipino migrant workers, all embassies and consular offices, through the Philippine Overseas Employment Administration (POEA), shall issue travel advisories or disseminate information on labor and employment conditions, migration realitiesandotherfacts;andadherenceofparticularcountriestointernationalstandardson humanandworkers'rightswhichwilladequatelyprepareindividualsintomakinginformed andintelligentdecisionsaboutoverseasemployment.Suchadvisoryorinformationshallbe publishedinanewspaperofgeneralcirculationatleastthree(3)timesineveryquarter. SECTION15.RepatriationofWorkers;EmergencyRepatriationFund.—Therepatriation oftheworkerandthetransportofhispersonalbelongingsshallbetheprimaryresponsibility of the agency which recruited or deployed the worker overseas. All costs attendant to repatriation shall be borne by or charged to the agency concerned and/or its principal. Likewise,therepatriationofremainsandtransportofthepersonalbelongingsofadeceased worker and all costs attendant thereto shall be borne by the principal and/or the local agency.However,incaseswheretheterminationofemploymentisduesolelytothefaultof theworker,theprincipal/employeroragencyshallnotinanymannerberesponsibleforthe repatriationoftheformerand/orhisbelongings. TheOverseasWorkersWelfareAdministration(OWWA),incoordinationwithappropriate internationalagencies,shallundertaketherepatriationofworkersincasesofwar,epidemic, disasterorcalamities,naturalormanmade,andothersimilareventswithoutprejudiceto reimbursementbytheresponsibleprincipaloragency.However,incaseswheretheprincipal orrecruitmentagencycannotbeidentified,allcostsattendanttorepatriationshallbeborne bytheOWWA. For this purpose, there is hereby created andestablished an emergency repatriation fund undertheadministration,controlandsupervisionoftheOWWA,initiallytoconsistofOne hundred million pesos (P100,000,000.00), which shall be taken from the existing fund controlledandadministeredbytheOWWA. Thereafter,suchfundshallbeprovidedforintheGeneralAppropriationsActfromyearto year:Provided,Thattheamountappropriatedshall innocasebelessthanOnehundred millionpesos(P100,000,000.00),inclusiveofoutstandingbalances. SECTION16.MandatoryRepatriationofUnderageMigrantWorkers.—Upondiscovery or being informed of the presence of migrant workers whose actual ages fall below the minimumagerequirementforoverseasdeployment,theresponsibleofficersintheforeign serviceshallwithoutdelayrepatriatesaidworkersandadvisetheDepartmentofForeign Affairsthroughthefastestmeansofcommunicationavailableofsuchdiscoveryandother relevantinformation. SECTION17.EstablishmentofReplacementandMonitoringCenter.—Areplacement andmonitoringcenterisherebycreatedintheDepartmentofLaborandEmploymentfor returningFilipinomigrantworkerswhichshallprovideamechanismfortheirreintegration intothePhilippinesociety,serveasapromotionhousefortheirlocalemployment,andtap theirskillsandpotentialsfornationaldevelopment. TheDepartmentofLaborandEmployment,theOverseasWorkersWelfareAdministration, andthePhilippineOverseasEmploymentAdministrationshall,withinninety(90)daysfrom theeffectivityofthisAct,formulateaprogramthatwouldmotivatemigrantworkerstoplan forproductiveoptionssuchasentryintohighlytechnicaljobsorundertakings,livelihood andentrepreneurialdevelopment,betterwageemployment,andinvestmentofsavings. Forthispurpose,theTechnicalEducationandSkillsDevelopmentAuthority(TESDA),the TechnologyLivelihoodResourceCenter(TLRC),andothergovernmentagenciesinvolved in training and livelihood development shall give priority to returnees who had been employedasdomestichelpersandentertainers. SECTION18.FunctionsoftheReplacementandMonitoringCenter.—TheCentershall providethefollowingservices: (a)DeveloplivelihoodprogramsandprojectsforreturningFilipinomigrantworkersin coordinationwiththeprivatesector; (b) Coordinate with appropriate private and government agencies in the promotion, development,replacementandthefullutilizationoftheirpotentials; (c) Institute, in cooperation with other government agencies concerned, a computer based information system on skilled Filipino migrant workers which shall be accessibletoalllocalrecruitmentagenciesandemployers,bothpublicandprivate; (d)ProvideaperiodicstudyandassessmentofjobopportunitiesforreturningFilipino migrantworkers;and (e) Develop and implement other appropriate programs to promote the welfare of returningFilipinomigrantworkers. SECTION19.EstablishmentofaMigrantWorkersandotherOverseasFilipinosResource Center.—WithinthepremisesandundertheadministrativejurisdictionofthePhilippine EmbassyincountrieswheretherearelargeconcentrationsofFilipinomigrantworkers,there shallbeestablishedaMigrantWorkersandOtherOverseasFilipinosResourceCenterwith thefollowingservices: (a)Counselingandlegalservices; (b)Welfareassistanceincludingtheprocurementofmedicalandhospitalizationservices; (c)Information,advisoryandprogramstopromotesocialintegrationsuchaspostarrival orientation,settlementandcommunitynetworkingservicesandactivitiesforsocial interaction; (d)Instituteaschemeofregistrationofundocumentedworkerstobringthemwithinthe purview of this Act. For this purpose, the Center is enjoined to compel existing undocumentedworkerstoregisterwithitwithinsix(6)monthsfromtheeffectivity ofthisAct,underpainofhavinghis/herpassportcancelled; (e)Humanresourcedevelopment,suchastrainingandskillsupgrading; (f)Gendersensitiveprogramandactivitiestoassistparticularneedsofwomenmigrant workers; (g)Orientationprogramforreturningworkerandothermigrants;and (h)Monitoringofdailysituations,circumstancesandactivitiesaffectingmigrantworkers andotheroverseasFilipinos. TheestablishmentandoperationsoftheCentershallbeajointundertakingofthevarious governmentagencies.TheCentershallbeopenfortwentyfour(24)hoursdailyincluding Saturdays,Sundaysandholidays,andshallbestaffedbyForeignServicepersonnel,service attaches or officers who represent other Philippine government agencies abroad and, if available,individualvolunteersandbonafidenongovernmentorganizationsfromthehost countries. In countries categorized as highly problematic by the Department of Foreign AffairsandtheDepartmentofLaborandEmploymentandwherethereisaconcentration ofFilipinomigrantworkers,thegovernmentmustprovideaandasocialworkerfor theCenter.TheLaborAttach hallcoordinatetheoperationoftheCenterandshallkeep theChiefofMissioninformedandupdatedonallmattersaffectingit. The Center shall have a counterpart 24hour information and assistance center at the DepartmentofForeignAffairstoensureacontinuousnetworkandcoordinativemechanism atthehomeoffice. SECTION20.EstablishmentofaSharedGovernmentInformationSystemforMigration. — An interagency committee composed of the Department of Foreign Affairs and its attached agency, the Commission on Filipinos Overseas, the Department of Labor and Employment,thePhilippineOverseasEmploymentAdministration,theOverseasWorkers WelfareAdministration,theDepartmentofTourism,theDepartmentofJustice,theBureau ofImmigration,theNationalBureauofInvestigation,andtheNationalStatisticsOfficeshall beestablishedtoimplementasharedgovernmentinformation system for migration. The interagencycommitteeshallinitiallymakeavailabletoitselftheinformationcontainedin existingdatabases/files.Thesecondphaseshallinvolvelinkagingofcomputerfacilitiesin ordertoallowfreeflowdataexchangesandsharingamongconcernedagencies. The interagency committee shall convene to identify existing data bases which shall be declassified and shared among member agencies. These shared data bases shall initially include,butnotbelimitedto,thefollowinginformation: (a) Masterlists of Filipino migrant workers/overseas Filipinos classified according to occupation/jobcategory,civilstatus,bycountry/stateofdestinationincludingvisa classification; (b) Inventory of pending legal cases involving Filipino migrant workers and other Filipinonationals,includingthoseservingprisonterms; (c)Masterlistofdeparting/arrivingFilipinos; (d)StatisticalprofileonFilipinomigrantworkers/overseasFilipinos/tourists; (e)Blacklistedforeigners/undesirablealiens; (f)Basicdataonlegalsystems,immigrationpolicies,marriagelawsandcivilandcriminal codesinreceivingcountriesparticularlythosewithlargenumbersofFilipinos; (g) List of labor and other human rights instruments where receiving countries are signatories; (h)Atrackingsystemofpastandpresentgenderdisaggregatedcasesinvolvingmaleand femalemigrantworkers;and (i)ListingofoverseaspostswhichmayrenderassistancetooverseasFilipinos,ingeneral, andmigrantworkers,inparticular. SECTION 21. Migrant Workers Loan Guarantee Fund. — In order to further prevent unscrupulous illegal recruiters from taking advantage of workers seeking employment abroad,theOWWA,incoordinationwithgovernmentfinancialinstitutions,shallinstitute financingschemesthat willexpandthegrantofpredeparture loan and family assistance loan.Forthispurpose,aMigrantWorkersLoanGuaranteeFundisherebycreatedandthe revolvingamountofOnehundredmillionpesos(P100,000,000.00)fromtheOWWAisset asideasaguaranteefundinfavorofparticipatinggovernmentfinancialinstitutions. SECTION 22. Rights and Enforcement Mechanism Under International and Regional HumanRightsSystems.—TheDepartmentofForeignAffairsismandatedtoundertakethe necessary initiative such as promotions, acceptance or adherence of countries receiving Filipino workers to multilateral convention, declaration or resolutions pertaining to the protectionofmigrantworkers'rights. TheDepartmentofForeignAffairsisalsomandatedtomakeanassessmentofrightsand avenuesofredressunderinternationalandregionalhumanrightssystemsthatareavailable toFilipinomigrantworkerswhoarevictimsofabuseandviolationand,asfaraspracticable andthroughtheLegalAssistantforMigrantWorkersAffairscreatedunderthisAct,pursue thesameonbehalfofthevictimifitislegallyimpossibletofileindividualcomplaints.Ifa complaintsmachineryisavailableunderinternationalorregionalsystems,theDepartmentof Foreign Affairs shall fully apprise the Filipino migrant workers of the existence and effectivenessofsuchlegaloptions. IV. GOVERNMENT AGENCIES SECTION23.RoleofGovernmentAgencies.—Thefollowinggovernmentagenciesshall performthefollowingtopromotethewelfareandprotecttherightsofmigrantworkersand, asfarasapplicable,alloverseasFilipinos: (a) Department of Foreign Affairs — The Department, through its home office or foreign posts, shall take priority action or make representation with the foreign authority concerned to protect the rights of migrant workers and other overseas Filipinosandextendimmediateassistanceincludingtherepatriationofdistressedor beleagueredmigrantworkersandotheroverseasFilipinos; (b) Department of Labor and Employment — The Department of Labor and Employment shall see to it that labor 1and social welfare laws in the foreign countries are fairly applied to migrant workers and whenever applicable, to other overseasFilipinosincludingthegrantoflegalassistanceandthereferraltoproper medicalcentersorhospitals: (b.1) Philippine Overseas Employment Administration — Subject to deregulation andphaseoutasprovidedunderSections29and30herein,theAdministration shall regulate private sector participation in the recruitment and overseas placementofworkersbysettingupalicensingandregistrationsystem.Itshall also formulate and implement, in coordination with appropriate entities concerned, when necessary, a system for promoting and monitoring the overseas employment of Filipino workers taking into consideration their welfareandthedomesticmanpowerrequirements. (b.2) Overseas Workers Welfare Administration — The Welfare officer or in his absence,thecoordinatingofficershallprovidetheFilipinomigrantworkerand hisfamilyalltheassistancetheymayneedintheenforcementofcontractual obligations by agencies or entities and/or by their principals. In the performanceofthisfunction,heshallmakerepresentationandmaycallonthe agenciesorentitiesconcernedtoconferencesorconciliationmeetingsforthe purposeofsettlingthecomplaintsorproblemsbroughttohisattention. V. THE LEGAL ASSISTANT FOR MIGRANT WORKERS AFFAIRS SECTION24.LegalAssistantforMigrantWorkersAffairs.—Thereisherebycreatedthe positionofLegalAssistantforMigrantWorkersAffairsundertheDepartmentofForeign Affairswhoshallbeprimarilyresponsiblefortheprovisionandoverallcoordinationofall legal assistance services to be provided to Filipino migrant workers as well as overseas Filipinos in distress. He shall have the rank, salary and privileges equal to that of an undersecretaryofsaidDepartment. ThesaidLegalAssistantforMigrantWorkersAffairs,shallbeappointedbythePresident and must be of proven competence in the field of law with at least ten (10) years of experienceasalegalpractitionerandmustnothavebeenacandidatetoanelectiveofficein thelastlocalornationalelections. AmongthefunctionsandresponsibilitiesoftheaforesaidLegalAssistantare: (a)Toissuetheguidelines,proceduresandcriteriafortheprovisionoflegalassistance servicestoFilipinomigrantworkers; (b) To establish close linkages with the Department of Labor and Employment, the POEA,theOWWAandothergovernmentagenciesconcerned,aswellaswithnon governmental organizations assisting migrant workers, to ensure effective coordinationandcooperationintheprovisionoflegalassistancetomigrantworkers; (c)TotaptheassistanceofreputablelawfirmsandtheIntegratedBarofthePhilippines andotherbarassociationstocomplementthegovernment'seffortstoprovidelegal assistancetoourmigrantworkers; (d)ToadministerthelegalassistancefundformigrantworkersestablishedunderSection 25 thereof and to authorize disbursements therefrom in accordance with the purposesforwhichthefundwassetup;and (e)TokeepandmaintaintheinformationsystemasprovidedinSection20. TheLegalAssistantforMigrantWorkersAffairsshallhaveauthoritytohireprivate, domesticorforeign,inordertoassisthimintheeffectivedischargeoftheabovefunctions. SECTION25.LegalAssistanceFund.—Thereisherebyestablishedalegalassistancefund formigrantworkers,hereinafterreferredtoastheLegalAssistanceFund,intheamountof Onehundredmillionpesos(P100,000,000.00)tobeconstitutedfromthefollowingsources: Fiftymillionpesos(P50,000,000.00)fromtheContingencyFundofthePresident; Thirtymillionpesos(P30,000,000.00)fromthePresidentialSocialFund;and Twenty million pesos (P20,000,000.00) from the Welfare Fund for Overseas Workers establishedunderLetterofInstructionNo.537,asamendedbyPresidentialDecreeNos. 1694and1809. Anybalancesofexistingfundswhichhavebeensetasidebythegovernmentspecificallyas legalassistanceordefensefundtohelpmigrantworkersshall,uponeffectivityofthisAct,be turnedoverto,andformpartof,theFundcreatedunderthisAct. SECTION26.UsesoftheLegalAssistanceFund.—TheLegalAssistanceFundcreated undertheprecedingsectionshallbeusedexclusively to provide legal services to migrant workers and overseas Filipinos in distress in accordance with the guidelines, criteria and procedurespromulgatedinaccordancewithSection24(a)hereof.Theexpenditurestobe chargedagainsttheFundshallincludethefeesfortheforeignlawyerstobehiredbythe Legal Assistant for Migrant Workers Affairs to represent migrant workers facing charges abroad,bailbondstosecurethetemporaryreleaseofworkersunderdetention,courtfees andchargesandotherlitigationexpenses. VI. COUNTRY-TEAM APPROACH SECTION27.PriorityConcernsofPhilippineForeignServicePosts.—Thecountryteam approach,asenunciatedunderExecutiveOrderNo.74,seriesof1993,shallbethemode underwhichPhilippineembassiesortheirpersonnelwilloperateintheprotectionofthe Filipinomigrantworkersaswellasinthepromotionoftheirwelfare.Theprotectionofthe Filipino migrant workers and the promotion of their welfare, in particular, and the protectionofthedignityandfundamentalrightsandfreedomsoftheFilipinocitizenabroad, ingeneral,shallbethehighestpriorityconcernsoftheSecretaryofForeignAffairsandthe PhilippineForeignServicePosts. SECTION28.CountryTeamApproach.—Underthecountryteamapproach,allofficers, representatives and personnel of the Philippine government posted abroad regardless of theirmotheragenciesshall,onapercountrybasis,actasonecountryteamwithamission undertheleadershipoftheambassador.Inthisregardtheambassadormayrecommendto theSecretaryoftheDepartmentofForeignAffairstherecallofofficers,representativesand personnel of the Philippine government posted abroad for acts inimical to the national interestsuchas,butnotlimitedto,failuretoprovidethenecessaryservicestoprotectthe rightsofoverseasFilipinos. Uponreceiptoftherecommendationoftheambassador,theSecretaryoftheDepartmentof Foreign Affairs shall, in the case of officers, representatives and personnel of other departments, endorse such recommendation to the department secretary concerned for appropriate action. Pending investigation by an appropriate body in the Philippines, the person recommended for recall may be placed under preventive suspension by the ambassador. InhostcountrieswheretherearePhilippineconsulates,suchconsulatesshallalsoconstitute partofthecountryteamundertheleadershipoftheambassador. Intheimplementationofthecountryteamapproach,visitingPhilippinedelegationsshallbe providedfullsupportandinformation. VII. DEREGULATION AND PHASE-OUT SECTION29.ComprehensiveDeregulationPlanonRecruitmentActivities.—Pursuantto aprogressivepolicyofderegulationwherebythemigration of workers becomes strictly a matterbetweentheworkerandhisforeignemployer,theDOLE,withinone(1)yearfrom the effectivity of this Act, is hereby mandated to formulate a fiveyear comprehensive deregulation plan on recruitment activities taking into account labor market trends, economic conditions of the country and emerging circumstances which may affect the welfareofmigrantworkers. SECTION30.GradualPhaseoutofRegulatoryFunctions.—Withinaperiodoffive(5) yearsfromtheeffectivityofthisAct,theDOLEshallphaseouttheregulatoryfunctionsof thePOEApursuanttotheobjectivesofderegulation. VIII. PROFESSIONAL AND OTHER HIGHLY-SKILLED FILIPINOS ABROAD SECTION31.IncentivestoProfessionalsandOtherHighlySkilledFilipinosAbroad.— Pursuant to the objective of encouraging professionals and other highlyskilled Filipinos abroadespeciallyinthefieldofscienceandtechnologytoparticipatein,andcontributeto national development, the government shall provide proper and adequate incentives and programs so as to secure their services in priority development areas of the public and privatesectors. IX. MISCELLANEOUS PROVISIONS SECTION32.POEAandOWWABoard;AdditionalMemberships. — Notwithstanding anyprovisionoflawtothecontrary,therespectiveBoardsofthePOEAandtheOWWA shall,inadditiontotheirpresentcomposition,havethree(3)memberseachwhoshallcome from the women, seabased and landbased sectors respectively, to be appointed by the Presidentinthesamemannerastheothermembers. SECTION33.ReporttoCongress.—InordertoinformthePhilippineCongressonthe implementationofthepolicyenunciatedinSection 4 hereof, the Department of Foreign AffairsandtheDepartmentofLaborandEmploymentshallsubmittothesaidbodyasemi annual report of Philippine foreign posts located in countries hosting Filipino migrant workers.Thereportshallinclude,butshallnotbelimitedto,thefollowinginformation: (a)MasterlistofFilipinomigrantworkers,andinventoryofpendinglegalcasesinvolving themandotherFilipinonationalsincludingthoseservingprisonterms; (b)WorkingconditionsofFilipinomigrantworkers; (c)Problemsencounteredbythemigrantworkers,specificallyviolationsoftheirrights; (d)Initiatives/actionstakenbythePhilippineforeignpoststoaddresstheproblemsof Filipinomigrantworkers; (e)Changesinthelawsandpoliciesofhostcountries;and (f)StatusofnegotiationsonbilaterallaboragreementsbetweenthePhilippinesandthe hostcountry. Anyofficerofthegovernmentwhofailstoreportasstatedintheprecedingsectionshallbe subjecttoadministrativepenalty. SECTION34.RepresentationinCongress.—PursuanttoSection5(2),ArticleVIofthe ConstitutionandinlinewiththeobjectiveofempoweringoverseasFilipinostoparticipatein the policy making process to address Filipino migrant concerns, two (2) sectoral representativesformigrantworkersintheHouseofRepresentativesshallbeappointedby thePresidentfromtheranksofmigrantworkers:Provided,Thatatleastone(1)ofthetwo (2)sectoralrepresentativesshallcomefromthewomenmigrantworkerssector:Provided, further,Thatallnomineesmusthaveatleasttwo(2)yearsexperienceasamigrantworker. SECTION35.ExemptionfromTravelTaxandAirportFee.—Alllawstothecontrary notwithstanding,themigrantworkershallbeexempt from the payment of travel tax and airportfeeuponpropershowingofproofofentitlementbythePOEA. SECTION36.NonincreaseofFees;AbolitionofRepatriationBond.—Uponapprovalof thisAct,allfeesbeingchargedbyanygovernmentofficeonmigrantworkersshallremainat theirpresentlevelsandtherepatriationbondshallbeabolished. SECTION37.TheCongressionalMigrantWorkersScholarshipFund.—Thereishereby createda CongressionalMigrant Workers Scholarship Fund which shall benefit deserving migrant workers and/or their immediate descendants below twentyone (21) years of age whointendtopursuecoursesortrainingprimarilyinthefieldofscienceandtechnology. TheinitialseedfundofTwohundredmillionpesos(P200,000,000.00)shallbeconstituted fromthefollowingsources: (a) Fifty million pesos (P50,000,000.00) from the unexpended Countrywide DevelopmentFundfor1995inequalsharingbyallMembersofCongress;and (b)TheremainingOnehundredfiftymillionpesos(P150,000,000.00)shallbefunded fromtheproceedsofLottodraws. The Congressional Migrant Workers Scholarship Fund as herein created shall be administeredbytheDOLEincoordinationwiththeDepartmentofScienceandTechnology (DOST). To carry out the objectives of this section, the DOLE and the DOST shall formulatethenecessaryrulesandregulations. SECTION38.AppropriationandOtherSourcesofFunding.—Theamountnecessaryto carryouttheprovisionsofthisActshallbeprovidedforintheGeneralAppropriationsAct oftheyearfollowingitsenactmentintolawandthereafter. SECTION39.MigrantWorkersDay.—ThedayofsigningbythePresidentofthisAct shallbedesignatedastheMigrantWorkersDayandshallhenceforthbecommemoratedas suchannually. SECTION 40. Implementing Rules and Regulations. — The departments and agencies chargedwithcarryingouttheprovisionsofthisActshall,withinninety(90)daysafterthe effectivity of this Act, formulate the necessary rules and regulations for its effective implementation. SECTION 41. Repealing Clause. — All laws, decrees, executive orders, rules and regulations,orpartsthereofinconsistentwiththeprovisionsofthisActareherebyrepealed ormodifiedaccordingly. SECTION42.SeparabilityClause.—If,foranyreason,anysectionorprovisionofthisAct is held unconstitutional or invalid, the other sections or provisions hereof shall not be affectedthereby. SECTION43.EffectivityClause.—ThisActshalltakeeffectafterfifteen(15)daysfromits publication in the Official Gazette or in at least two (2) national newspapers of general circulationwhichevercomesearlier.
