Since January, the 74- year-old developer has hired four senior execu- tives, bought two Upper East Side apartment buildings he plans to convert to condos, and purchased a loan that he hopes to use to gain ownership of a midtown development site. Let the noncompetition begin hat’s in John W Kanas’ wallet? Five years ago, the former CEO of North Fork Bancorp sold the bank to Capital One Financial for $13.2 billion and pocketed more than $200 million. He also assured management at the Virginia-based credit card company that he wouldn’t compete against them in New York until 2012.The promise was particularly important to Capital One because Mr. Kanas is one of the city’s best-connected commercial bankers. So Capital One was most JOHN KANAS displeased when it learned in bloomberg news June that Mr. Kanas had agreed to buy a small Manhattan- based bank called Herald National. It also was miffed when he reportedly bid for Bank of Ireland’s New York commercial banking portfolio. It really fumed when it saw he had posted job listings on Monster.com seeking senior banking staff in New York. But when Mr. Kanas allegedly secured a lease at 960 Sixth Ave. for his new bank—fewer than 600 feet from a Capital One branch—that was too much. It sued Mr. Kanas for violating his noncompete agreement.

The asking rent for the new space was in the low $40s per square foot. Meanwhile, fashion designer Guess has renewed its lease for 16,000 square feet, also for 10 years. The leases of both tenants were due to expire in February. Both were considering a move, according to Cushman & Wakefield Inc. broker Tara Stacom, who, along with colleague David Green, was retained by CWCapital Asset Man- agement to reposition, lease and manage the 350,000-square-foot property. CWCapital serviced the senior loan on the property. Al- varez & Marsal is now the property’s receiver. The office building, which is owned by a partnership between George Comfort & Sons and Char- ney,has been in foreclosure since the end of 2009.One of the key tasks for Ms. Stacom and her colleagues on the deal was to convince the tenants that $7 million in renovations were funded and would be completed. “Construction had been stymied,” Ms. Stacom said. “We helped to right the ship and com- plete the asset’s transformation.” Mr. Green added: “It was hard, but we had to convince the tenants that this building would be viable in the long term. When the tenants saw progress and work on the lobby, they were convinced.” Tzell Travel, which occupied floors 13 to 15, will also take up the entire 12th floor. Guess has had its corporate offices on the entire 20th floor since 1996.
