Sri Kadem Mallesh, Ranga Reddy District -500 048 has filed 2nd appeal dated 22-12-2017 which was received by this Commission on 22-12-2017 for not getting the information sought by him from the PIO /The Special Deputy Collector, Land Acquisition, IAP, O/o. the Collector, Ranga Reddy District, Khairathabad Post, Lakdikapool, Hyderabad 500 004 and 1st Appellate Authority / The Joint Collector, Ranga Reddy District

The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 18-09-2017 before the PIO requesting to furnish the information under Sec.6(1) of theTSIC RTI Act, 2005, on the following points mentioned in his application:

The Public Information Officer has not furnished the information to the appellant.

Since the appellant did not receive the information from the Public Information Officer, he filed 1st appeal dated 21-11-2017 before the 1st Appellate Authority requesting him to furnish the information sought by him u/s 19(1) of the RTI Act, 2005.

As the appellant did not get the information from the Public Information Officer / 1st Appellate Authority even after 30 days of filing his 1st appeal, he preferred this 2nd appeal before this Commission requesting to take action against the PIO and 1st Appellate Authority for not furnishing information sought by him and also to arrange to furnish the information sought by him u/s 19(3) of the RTI Act, 2005.

The 2nd appeal was taken on file and notices were issued to both the parties for hearing on 4-10-2018.

On 4-10-2018 the case is called. The appellant and the Public Information Officer, Spl. Dy. Collector, LA, IAP, O/o the Collector, R.R. District are present.

The appellant submitted that he did not receive complete information from the PIO.

The Public Information Officer submitted that the application filed by the appellant was transferred U/s 6(3) to the Public Information Officer, Tahsildar, Shankerpally vide letter dated 26.09.2017 for taking necessary action in the matter.

Heard the parties and perused the records.

The Commission observed that the appellant filed 6(1) application seeking action taken on his petition dated 04.09.2017 submitted in Prajavani Programme. With regard to petition dated 04.09.2017 filed in Prajavani Programme the Public Information Officer submitted that it was sent to SE, TRANSCO for necessary action. But she did not file any letter in proof of having sent the same to SE, TRANSCO.

The appellant submitted that three high tension wires were going through his fields. On his complaint, he got compensation for two lines but did not get compensation for the third line. He requires the G.O. showing the guidelines issued for payment of compensation in the matter.

The Public Information Officer could not inform about the review made on the prajavani petition sent to TRANSCO department.

The case was adjourned.

On 19-9-2019 the case is called.

The appellant is absent. The Public Information Officers, Spl. Dy. Collectyor, LA, IAP, Collectorate, R.R. District and Supdt., Engr., TS TRANSCO are present.

When the case was earlier called on 04.10.2018 the appellant submitted that he did not receive complete information from the PIO. The Public Information Officer, SE, TRANSCO submitted that with reference to the prajavani petition dated 04.09.2017 a field inspection was done in the presence of the petitioner. He further submitted that three 400 KV lines are passing over the appellant’s land in Sy.No.300/E among which two lines belong to TSTRANSCO and the third line belongs to M/s.Maheshwaram Power Transmission Ltd., New Delhi. Compensation was paid to the appellant for two TRANSCO lines passing through his fields. With regard to the third line, the petitioner was requested to contact the concerned. He further submitted that the District Collector, R.R. District through proceedings dated 08.08.2014 issued orders fixing the payment of compensation to the affected farmers.

Heard the Public Information Officers and perused the records.

It is clear that pursuant to the petition filed by the Appellant field inspection was held and the factual position was informed to the Appellant on 14-9-2017. The record reveals that the Appellant filed another appeal (Appeal No.26820/CIC-Peshi-2/2017) which was heard and disposed of on 30-11-2018. However, the Commission directs the Public Information Officer, SE, TS TRANSCO to furnish a copy of the District Collector’s proceedings dated 08.08.2014 and copy of the letter dated 14-9-2017 to the appellant once again within one week from the date of receipt of this order.

With the above direction, the appeal is closed.
