In an article by Candice Williams in the Detroit News, “Grosse Pointe Shores Pushes County Changes,” I was quoted as explaining that the Michigan Legislature had the power to redraw county lines and so to put Grosse Pointe Shores, which is now in Wayne County, into Macomb County. August 24, 2012. In an article by Douglas Levy in Michigan Lawyers Weekly, “Actual Malice Asserted: Federal Defamation Trial Against Ex-Assistant AG Results in 4.5M Verdict,” I was quoted as saying that in First Amendment matters, there is no tort liability for statements of opinion, ‘no matter how outrageous.” I went on to say that, “But liability for statements of fact is different and fall within the framework of the U.S. Supreme Court’s 1964 decision in New York Times v. Sullivan.” I then explained that under that test in order for liability to imposed, the plaintiff must prove that the statement was knowingly false or made with reckless disregard for truth or falsity. If this test is satisfied, which is very difficult to do, there can be liability even if the plaintiff is 40 a public figure or the matter is of public concern. August 30, 2012. In article by Karen Bouffard in the Detroit News, “Board Deadlocks on Three Proposals for November ballot, I gave my opinion that under the Michigan Constitution, the Board of State Canvassers did not have the authority to refuse to certify a ballot proposal on the ground that the proposal did not comply with constitutional requirements for a ballot proposal. My opinion was that the Board’s only responsibility is to determine whether the proposal had the requisite number of signatures, and that any questions as to the validity of the proposal itself had to be determined by the courts. October 10, 2012. In an article by Niraj Warikoo in the Detroit Free Press, “Limits of Free Speech Tested as Anti-Islam Pastor Coming Back,” I noted that “In the United States, we give more protection to free speech than in other democratic countries, and that, “We protect hate speech.” I also pointed out that the police have a duty to protect the speaker from a hostile crowd, and that, “Speakers like Jones or the Christian activists with the pig’s head must be allowed to have their say.” Presentation, “The Supreme Court, The Health Care Act, and the 2012 Election,” The Humanities Center, Wayne State University Brown Bag Colloquium Series, 2012-2013, October 15, 2012. In an article by Matt Helms and Joe Guillen in the Detroit Free Press, “Experts Say EM Lawsuit Claims May have Weight,” I gave my opinion that the lawsuit challenging the Emergency Manager Law “raises a serious question of whether this violates equal protection,” because it denies self-governance to the voters of a city when an emergency manager overrides the actions of elected officials. April 3, 2013. In an article, “EM Law Heads to Court,” in the Detroit Metro Times, I discussed the Emergency Manager Law and raised questions as to the constitutionality of provisions that would enable the Emergency Financial Manger to strike down local ordinances and in effect enact new ones. I said that these provisions could e considered “a serious incursion on the rights of self-governance.” April 4, 2013. In an article by Gary Gosselin in Michigan Lawyers Weekly, “Detroit and Its EM Want to Move Forward, But Lawsuit Could Set It Back,” I was quoted as follows: “Wayne State University Law Professor Robert Sedler agrees with the assertion that cities are creatures of the state, but the state has provided the Home Rule Cities Act, which (ordinarily) gives cities a great deal of power, he said. Once you assign an EM, with the ability to take action that would otherwise require an ordinance, there could b e a problem.” I also pointed out that the challenge comes before anything has been done - the EM has not changed any ordinances or regulations - and that courts are reluctant to hear a challenge to a law on its face. I suggested that if the EM and the mayor and council can agree on ordinances or other changes, maybe the EM process will continue without a court decision. April 15, 2013. In an article by Chad Halcom, “Does Shostak loan ruling have ripple effect on EM’s power,” I commented on a recent decision of the Michigan Court of Appeals upholding the retroactivity of a law passed to protect real estate investors’ asserts against a claim that it violated federal and state constitutional provisions impairing the obligations of contracts. The Court upheld the retroactive application of the law as being necessary to protect real estate investment throughout the state. I then commented as follows: “It’s fully consistent with constitutional doctrine on modification of contracts. The court recognizes there needs to be a compelling public interest he said. But that now become a precedent if someone challenges the emergency manager’s authority on labor contracts. What is the substantial public interest that is advanced by the EM abrogating a Detroit labor contract, for example? Just saving the city money? That’s hard to advance as a sufficient public interest. Because the court referenced to prior federal court rules from 1977 and 1934, that limit the government’s power to modify contracts, Sedler said, it essentially incorporates that logic into a recent legal precedent in state courts that labor lawyers can now cite. In an article by Nancy Kaffer in the Detroit Free Press, “A Belle Isle Dream that Won’t Come True,” I discussed a proposal for the City of Detroit to sell Belle Isle to private investors and make it an “independent commonwealth.” I explained that the Constitution contains a mechanism for incorporating new territories into the United States, but that there is no way to allow a state, or a portion of a state, to regress to less-than-state status. I concluded that: “The U.S. is inviolable. Not only can the City of Detroit not do it, the U.S. Congress cannot do it. Congress cannot take a part of an American state, like Belle Isle, and turn it into a commonwealth. It’s utterly ridiculous.
