    A Producer's Handbook

DEVELOPMENT AND OTHER CHALLENGES A PRODUCER’S HANDBOOK by Kathy Avrich-Johnson Edited by Daphne Park Rehdner Summer 2002 Introduction and Disclaimer This handbook addresses business issues and considerations related to certain aspects of the production process, namely development and the acquisition of rights, producer relationships and low budget production. There is no neat title that encompasses these topics but what ties them together is that they are all areas that present particular challenges to emerging producers. In the course of researching this book, the issues that came up repeatedly are those that arise at the earlier stages of the production process or at the earlier stages of the producer’s career. If not properly addressed these will be certain to bite you in the end. There is more discussion of various considerations than in Canadian Production Finance: A Producer’s Handbook due to the nature of the topics. I have sought not to replicate any of the material covered in that book. What I have sought to provide is practical guidance through some tricky territory. There are often as many different agreements and approaches to many of the topics discussed as there are producers and no two productions are the same. The content of this handbook is designed for informational purposes only. It is by no means a comprehensive statement of available options, information, resources or alternatives related to Canadian development and production. The content does not purport to provide legal or accounting advice and must not be construed as doing so. The information contained in this handbook is not intended to substitute for informed, specific professional advice.

OPTION AND PURCHASE AGREEMENT EXPLANATORY NOTES USING THE EXPLANATORY NOTES The Explanatory Notes are intended to provide more detailed explanations of certain clauses in this sample agreement or to give more detail about the law involved. The Explanatory Notes DO NOT form part of the agreement and should not be included in your final redrafted agreement. The Explanatory Notes are not intended as legal advice and should be considered information only. You should contact Arts Law for specific legal advice. PARTIES The agreement should clearly identify the name and address, and preferably the telephone and fax numbers, of the persons or organisations entering into the agreement (parties). Throughout the rest of the agreement, the parties are referred to or "defined" by shorthand terms for ease of reference, for example Producer. Other terms could be used, or the parties could simply use their own names. If a party has an Australian Business Number (ABN), Australian Company Number (ACN) or Australian Registered Body Number (ARBN), the number must be included. The ABN is important for GST purposes. If either party is a company, its Australian Company Number (ACN) and the address of its registered office must be stated. BUYING THE FILM RIGHTS TO AN EXISTING WORK Under the Copyright Act 1968 (Cth), the author of a literary or dramatic work (such as a book, play or screenplay) has the right to control reproduction, adaptation and publication of that work. This means that film makers who want to adapt an existing work into a film must buy the rights. If they do not, they risk an action for copyright infringement.

And while movies like, Guardians of the Galaxy, The Avengers, Spider-Man, Batman, are all based on famous comic book properties, Hollywood’s hunger for the graphic novel has turned such spandex-free indie titles as Persepolis, 30 Days of Night, 300, A History of Violence, American Splendor, and Art School Confidential, into wonderful films in their own right. In 2013, 13 comic-based movies were released, and almost 15 percent of U.S. box office revenue was based on comic book properties in 2012.1 In fact in 2010, revenues from films and licensing combined accounted for over 85% of Marvel’s gross profits.2 1 Rise Of The Superheroes: Winners And Losers, NPR Webiste, Adam Frank (http://www.npr.org/blogs/13.7/2013/05/07/181856139/rise-of-the-superheroes-winners-and- losers?utm_source=NPR&utm_medium=facebook&utm_campaign=20130507) Accessed May 7, 2013 2 Joshua L. Crew Agnieszka Holland: Challenging Holocaust Memory and Representation in Film by Patrick Joseph Thomas Thesis Presented to the Faculty of the Graduate School of The University of Texas at Austin in Partial Fulfillment of the Requirements for the Degree of Master of Arts The University of Texas at Austin August, 2018 Abstract Agnieszka Holland: Challenging Holocaust Memory and Representation in Film Patrick Joseph Thomas, M.A. The University of Texas at Austin, 2018 Supervisor: Tatjana Lichtenstein The following investigation into the Holocaust films of Polish-Jewish filmmaker Agnieszka Holland aims to identify the ways in which Holland both pushes the genre forward and challenges the traditional memory of the war in Poland. Rather than adhering to formalist conventions in portraying the Holocaust in cinema, Holland breaks the genre’s representational taboos, avoiding a binary narrative and instead engaging in a morally challenging confrontation with the past. Moreover, by focusing on the shared suffering of Poles and Jews during the war and occupation, Holland’s Holocaust films recast the memory of the war to better reflect its complex and at times ambiguous nature. This critical perspective offers a reconciliatory discourse in the competing national memories of both Catholic Poles and Jewish Poles. Specifically, this investigation examines Angry Harvest, Europa Europa, and In Darkness to conclude that the Holocaust films of Agnieszka Holland present a more complete and nuanced portrait of wartime conditions during World War II in Eastern Europe, and Poland in particular.

Open Cultural Studies 2018; 2: 103–113 Research Article Elżbieta Ostrowska* “Exquisite cadaver” according to Stanisław Lem and Andrzej Wajda https://doi.org/10.1515/culture-2018-0010 Received January 4, 2018; accepted May 16, 2018 Abstract: The article examines Andrzej Wajda’s Roly Poly (Przekładaniec, 1968), a 35-minute film made for Polish public television, that is an expanded version of Stanisław Lem’s short grotesque play Do You Exist Mister Johns? (Czy Pan istnieje Panie Johns?) published in 1955. Roly Poly tells a story of a car race driver, Ryszard Fox. A victim of several car crashes, he gets so many transplants from other victims of these collisions, with his brother being a first donor, that eventually he becomes a mix of different organisms, including female and animal parts. Wajda presents the whole story in brief scenes and episodes using an aesthetic mix of black humor, grotesque, absurdism, surrealism, and pop art imagery. The author argues that with its narrative focus on transplant experiments and aesthetic concoction of different styles, Roly Poly becomes a cinematic variant of the surrealist parlor-game of exquisite cadaver, where an often accidental collection of words or images is assembled into a new entity. Furthermore, the article claims that the film presents a dystopian variant of Bakhtinian grotesque body and as such it opposes the concept of ideal, uniform, and homogenized communist/national body. Eventually, the body of transplants displays a transgressive potential of trespassing different divisions and hierarchies and as such it indirectly subverts the main premises of nationalistic politics led by Polish communist party in the late 1960s.
