The shift to online services of the banking and financial sectors will increase the likeli- hood of cyber-attacks. Any digitalization process must be accompanied by adequate protection measures. - In May 2020, a cyber-attack against the computer communication network of an economic entity was identified.

- At the end of September 2020, threats for cyber-attacks against the infra- structure of an economic operator were identified. The attack was aimed at shutting down the services offered by this economic entity and interrupting the provider’s activity for several hours.

- Attempted cyber-attacks against the unclassified network of SHISH were identified. They failed to extract sensitive or classified information, due to the security measures in place.

- Albania law-enforcement agencies arrested a former MEK member, confis- cating his electronic devices. This individual has been suspected, arrested and prosecuted for “Unlawful theft of computer data”, “Intervention in com- puter systems”, “Misuse of electronic devices”. This individual is believed to have used various operations to perform communications through a network messaging application, to connect to the mobile phones of other citizens. Af- ter this operation, he collected the verification code of the application, using it in his computer equipment.

Regarding the involvement of SHISH in the vetting process, misunderstandings may arise caused by non-recognition of the process.

1. The official conducting the vetting process decides which person is suitable and clean and which is not. The truth is that the official (unit) responsible for the vetting process verifies information and data that exists in the databases and submits the materials to the relevant commission. The commission makes the final decision. The information gathered during the verification process is passed only to those who “need to know” it, which means that only a small number of people have access to it.

2. The vetting official digs into the applicant’s private life even outside the scope of the legal requirements. The truth is that the details of the applicant’s life are important in completing the back- ground investigation process, but only those data related to the object of vetting are checked.

3. Persons under vetting process are intercepted by SHISH. The Albanian law clearly defines when the interception of e person’s communication is ap- proved. In addition, the verification process is carried out in accordance with the vetting law and it is not the main condition for starting the interception of communications. Information and data indicating whether or not the person subject to background check is involved in criminal activities is relevant to the process.
