Meeting The Board of County Commissioners met in their room in the Court House Annex Opened on Monday, October 10, 1966. Commissioners F. B. Surguine, Jr., John H.

Talton, DonS. Evans, James T. Cooper and Cliff R. Freeman; County Attorney

Fred Ward; Clerk Arthur W. Newell and Deputy Clerk D. S. Banner were pres en

There being a quorum, the meeting was called to order by Chairman Surguine

at 9:30 A. M. The invocation was given by Rev. Rees Hay.

Minutes The minutes of the September 27th, September 29th and October 3rd meetings

were read, approved and signed.

O.E.O. Mr. Jake Braswell, 714 Palmer Street, appeared before the Board re the Program Office of Economic Opportunity Program for Orange County. He asked

Commissioner Cooper if he knew that funds are being used to pay for the

Administrative Staff salaries rather than for milk and food for the children

in Orange County. He also asked if there had been an audit made of the funds.

Commissioner Cooper stated that he had received copies of the minutes, but

that no audit of the funds would probably he made until the end of the year.

Mr. Braswell stated that out of 450 children that had been checked by the

examining physician, less than 10 were white children -- less than 2%.

He also told of the Foster Grandparents program that will be discussed on

Tuesday night. Mr. Braswell stated that it was his understanding that only memb rs

of the Retired Citizens Organization, which ha:s membership of only 4, 000, will

be allowed to work in this program. There are over 40, 000 retired citizens

in Orange County, and it is unfair to limit same to such a small group.

Chairman Surguine told Mr. Braswell that the County has only one voting member

and that they have instructed him to attend the meeting Tuesday, but they do not

instruct him how to vote.

Petition to The Board received a petition to vacate a certain platted road in Weissinger's Vacate cer­ tain Road Fairvilla Subdivision, Plat Book H, Page 93, and same was referred to the Weissinger' Fairvilla Su County Engineer for investigation.

Petition to The Board received a petition to vacate a portion of a 30 foot right of way on Vacate por­ tion of 3 0 ft. the East side of Winter Garden Manor, and same was referred to the County R/W Engineer for investigation.

Fortune The Board received report from Clerk Arthur W. Newell stating that he knew Tellers of no legal reasons why the folllowing persons should not be given permits to

obtain licenses to do business in Orange County as Fortune Tellers:

Amanda Bradford d/b/a Amanda Bradford

Lamar P. Sumner d/b/a Professor Leemar

Sally R. Russell d/b/a Sally R. Russell

Upon motion by Commissioner Evans, seconded by Commissioner Freeman, and

unanimously carried, the Board approved issuance of permits to the above person

Petition - I The Board received a petition signed by property owners on West 30th Street, West 30th St. between South Orange Bloss om Trail and Rio Grande Ave.rru.e, requesting the

County to pave their street due to conditions caused by the building of I-4 Inter-

change. The petition was referred to the Superintendent of the Road and Bridge

Department for investigation of the bad condition as outlined.

Shady Oaks It having been certified by the County Engineer that a certain street in Shady Oaks Subdivision Subdivision has been completed in form and manner acceptable for future mainten-

ance by Orange County, a motion was made by Commissioner Freeman, seconded

by Commissioner Evans, and un~nimously carried, accepting the following street

in Shady Oaks Subdivision, Plat Book l, Page 99 , for maintenance, and further,

maintenance bond in the amount of $610. 00 with Mid State Contractors, Inc., as

principal, and the General Guaranty Insurance Company as surety, guaranteeing

the work for a period of one year, was accepted and approved:

Sewer Upon motion by Commissioner Freeman, seconded by Commissioner Evans, and Revenue Bonds, unanimously carried, the Clerk was instructed to advertise that the Board of Series 2 County Commissioners will on December 1, 1966, redeem United States of

America, State of , County of Orange Sewer Revenue Bonds, Series 2,

numbers One Hundred Forty-four to One Hundred Fifty-eight, inclusive,

dated December 1, 1961, of which $15,000.00 mature December 1, 1969, together

with accrued interest.

Forrest Par It having been certified by the County Engineer that certain streets in Forrest Unit No. 5 Park, Unit No. 5, have been completed in form and manner acceptable for future

maintenance by Orange County, a motion was made by Commissioner Freeman,

seconded by Commissioner Evans, and unanimously carried, accepting the

following streets in Forrest Park, Unit No. 5, Plat Book l, Page 98, for

maintenance, and further, maintenance bond in the amount of $1,409.00 with

Mid-State Contractors, Inc., as principal, and the General Guaranty Insurance

Company, as surety, guaranteeing the work for a period of one year, was

accepted and approved:

Petition - Mr. John C. Stine presented a petition signed by property owners in Country Fairvilla Treatment Club Estates, Spring Lake Terrace, l st Addition, Country Club of Orlando, Plant W. D. B. 0., and Magruder• s forty acres requesting the Board to consider the

possibility of sanitary sewer connection with the Fairvilla Treatment Plant.

The Board took the petition under advisement.

Drainage Upon motion by Commissioner Evans, seconded by Commissioner Talton, and Easement unanimously carried, the Board accepted the following drainage easement, and

the Clerk was instructed to have same filed for record:

R. I. B. Upon motion by Commissioner Cooper, seconded by Commissioner Evans, and Project No. 72 - unanimously carried, the Board adopted the following: Streets in Belle Isle RESOLUTION DETERMINING TO MAKE IMPROVEMENT Estates UNDER ROAD OR STREET IMPROVEMENT PROJECT NO. 72

WHEREAS, a petition has been filed with the Board asking for the improve-

ment by paving and curbing of the following described streets and the radius

turnouts on all of the side streets thereof, as shown on the Plat of Belle Isle

Estates as recorded in Plat Book L, page 58:

Delia Avenue between Matchett Road and Park Lot; Stockbridge Avenue between Gibson Drive and Delia Avenue; Gibson Drive between Lot 18, Block E, and North line of Subdivision; Cay .Circle between Gibson Drive and South line of Lot 9, Block A, extended West.

AND WHEREAS, This Board finds that the petition is sufficient in form,

substance a:Qd execution, and that the improvement should be made,

THEREFORE, BE IT RESOLVED

First. That this Board orders said improvement to be made under the

provisions of Chapter 57-1645, as amended by Chapter 59-1648.

Second. That the Clerk be instructed to forthwith record a certified copy

of this resolution in the Public Records, as a notice to the public and the abstract

companies that the assessments become liens against the abutting property as of

the date of the passage of this resolution, according to the provisions of Section 8

of the Act, although the amounts of the assessments cannot be determined until

later.

Third. That the County Engineer be designated as the one whose duty it

is to file plans and specifications and an estimate of costs with the Clerk of the

Board.

Fourth. That forthwith upon the filing of the estimate of costs with the

Clerk, he is instructed to publish a notice of a public hearing, to be held at a

a regular meeting of the Board, to hear objections of all interested persons, and

also send notices to the individual owners of property abutting on the said roads or

streets and to the holders of contracts and options to purchase said properties.

Shady Oaks Upon motion by Commissioner Freeman, seconded by Commissioner Evans, and

unanimously carried, payment from escrow funds in the amount of $4, 719.93 to

the Dev.eloper oLShady Oaks, Walton Wall, covering paving and drainage in said

Subdivision.

Hearing Notice having been given that the Board would hold a public hearing at l 0:00 A. M Glass to consider the proposal of full enforcement of Chapter 27 of the Southern Standar

Building Code entitled 11 Gl~ss 11 , ,the hour having arrived, the Clerk read the notice

Building Director Bill Ley stated that the Advisory Board had held a meeting

and recommended that they either enforce, or not enforce, this section of the

Code.

Chairman Surguine asked. M r . Ley if the Advisory Board had any recommended

limitations in this area.

Mr. Ley stated that they recommend that the County enforce the code as it stands

with the exception that a substitution may be made at the discretion of the Board.

Mr. Duke Myers, Artco Glass Company, stated they had been trying to unders

this, and he went into a discus:;;ion of glass, stating that patio doors should be

of tempered glass unless there is a horizontal bar across same. If they are

required to go completely to tempered glass, building will be slowed down.

Mr. Jack Nix, Pittsburgh Plate Glass Company, stated that the Southern Building

Code was adopted in 1965, and they are for the code. He stated they think they

should have a meeting on this.

Chairman Surguine asked Mr. Ley to set up a meeting with the industry on this

and to submit recommendations back to the Board on same.

Mr. Ley stated that we are either going to have to enforce this , or not enforce it

since it is a part of the building code.

After further discussion, a motion was made by Commissioner Cooper, seconded

by Commissioner Freeman, that the County delete that Section of 27 dealing

with Glass until November 7th, at which time the Building Advisory Committee

will present written recommendations as to the enforcement of this Section, and

any.: modifications or substitutions thereof. The motion passed.

Zellwood Upon motion by Commissioner Talton, seconded by Commissioner Evans, and Fire Con­ trol Distric unanimously carried, the Board concurred with the Zellwood Fire Control

District Commissioners in awarding the bid to the low bidder A:rn:!rican LaFrance

Company in the amount of $25 , 248~ 00 for the purchase of a new Fire Truck for

use by the District.

Hazelhurst Upon motion by Commissioner Talton, seconded by Commissioner Evans, and Avenue unanimously carried, the Board approved the extension of.Hazelhurst Avenue

from U.S. 441 to proposed U.S. 441 By-Pass, and the County Right of Way

Agent was authorized to obtain right of way for said extension.

Lake Mr. Sidney Berkowitz, State Board of Health, appeared before the Board Shadow stating that they are carrying on an intensive investigation and study of the

situation on Lake Shadow. He stated that Mr. David Lee was promised on

Tuesday following the showing of the film in Orlando, and again on Sunday

following the showing of the film in Jacksonville that he would be given a transcri

of the data, but that he had never received same. He said they were h·andicapped

in not receiving this data. However, they are preparing a report as rapidly as

possible, and where action is necessary and appropriate it will be taken.

Chairman Surguine asked AtL orney Salfi about the transcript that was promised

to the State Health Department, and he replied that the same presentation was

made in Jacksonville that was made in Orlando, and that the State Board of Health

had made a recording of this meeting at Jacksonville, and they have all the

material presented to the County Commission. He said that Mr. Berkowitz

stated they were making further studies but that it sure does not take an expert

to go out there and see this overflow. He stated they were hoping that the State

Board of Health would come forward and present the County Commission a

report on what had been done to cure the current problem, and that Mr. Berkowit

had not even stated that they had been out there to look at it, or that the owners

of the sewer plant had been contacted. He read a few statements taken from

sworn testimony from residents in that area on July 23, 1966, as some of the

statements were left out of the film on account of the time problem. He said they

had no less than 15 sworn statements regarding the overflow during the past few

years. He asked if the Commissioners would do anything at this time to

speed up the processes as the State Board of Health had indicated they were not

able to give any time as to when the investigation would be completed.

County Attorney Ward asked Attorney Salfi if he would give a transcript to Mr.

Berkowitz as he had stated it would assist them in helping make their investigatio

Mr. Ward stated further that he had asked him by phone for a copy of the transcr t

and had followed up that request by letter , and had even offered to pay the cost

reproducing a copy of the transcript and exhibits, and had been advised that it

being typed, but that it had never been received.

Mr. Salfi stated that it was with much reluctance that they had not turned over the script . He said that after the meeting wit.h the County it was their understanding from a member of the press that the Commissioners had made statements to the effect that the film was a fraud, and if these statements were true, they had chosen to fight the people of Lake Shadow.

The · County Attorney asked him who had made such a statement, but Mr. Salfi refused to say who had made such a statement. Mr. Ward then asked the

Commissioners if they had made such a statement, and the reply was that they had not. County Attorney Ward then stated that this was a very serious charge to bring against any public body, and that it had been denied by the Commission.

Mr. Salfi stated that they had doubts about the goodfaith of the Commissioners as had not been out there to make visual inspection, and they are in a desperate situation out there -- this water is flowing, and it flowed as late as ten days ago.

Something has to be done.

County Attorney Ward again asked Mr. Salfi why they would compile this informa­ tion and not want to give it to anyone --the Board can't say what position they will take until they receive the data.

Mr. Salfi stated that this data would be made available to anyone who shows good faith -- if the Commissioners show good faith the script will be given to them.

He stated once again that the State Board of Health has a recording of this mater

Mr. Berkowitz stated they have no copy of the transcript which had been promised to Mr. Lee. This data would assist them in their investigations -- they do have a tape recording, but not a transcript. He stated that his staff was down.here investigating every facet of the treatment area and making all necessary studies.

He stated further that he did not like to have his integrity impugned, and that he would not argue the matter . He stated that he would have to leave at this time for another appointment.

Mr. W. B. Whittaker stated that the manhole had been checked twice daily for the past two weeks, and that it had not overflowed during that time.

Mr. Salfi stated that it had overflowed twice during the past two weeks.

Mr. Don Rider stated that Mr. Salfi did not refer to him by name, but that he did recognize some of the things made in his statements. He said that it reminde him of something· that he had read recently about a man and a speech -- the one he wrote, the one he gave, and the way it was written in the paper were all different.

He stated that what he had said did not come out in the same context in Mr. Salfi' s statements.

Commissioner Freeman stated that he had investigated the situation, also that

he would be willing to go with Mr. Salfi to view same. He stated further that

he could not understand why the people would think they did not want to help.

He told Mr. Salfi that he, County Attorney Ward and County Engineer DeWitt

would meet him after the meeting and go out and view the situation.

Bids - Consulting Engineer Floyd Groo recommended that the Board reject the bids Little Econ on the Little Econ and readvertise for bids at a later date.

Upon motion by Commissioner Freeman, seconded by Commissioner Evans,

and unanimously carried, the Board rejected the bids on the Water Control

Structure No. CS-4, Little Econ, and the Clerk was instructed to return the

Certified Bid Checks to the bidders.

County Upon motion by Commissioner Evans, seconded by Commissioner Talton, and Parental Home unanimously carried, Davey Tree Expert Company was authorized to remove

two trees and trim the other trees on the County Parental Home property

at a cost of $690.00.

Upon motion by Commissioner Evans, seconded by Commissioner Cooper, and

unanimously carried, the purchase of two Aiir conditioning units from Heinmiller

Heating & Cooling, Inc., at a cost of $414.00 each, for use at the County

Parental Home was authorized.

Hearing - Upon motion by Commissioner Freeman, seconded by Commissioner Evans, Lake Sybelia and and unanimously carried, the Board scheduled a public hearing at 11:00 A. M, Lilly Lake November 14, 1966 to hear all interested parties on the setting of proper

water levels on Lake Sybelia and Lilly Lake.

tract for purchase by Paul Z. Fletcher to be included in the 160 apartment unit

complex, provided the ditch on the East line of the Fletcher Tract is kept open.

unanimously carried, the Board will interpose no objection to the annexation by

the City of Orlando of a tract of land located on the West of Lake Barton Road

and South of Lake Underhill Drive described as follows :

WHEREAS the Board of County Commissione r s (herein sometimes referred to as "Applicant") desires to acquire and develop certain land known as Little Econlockhatchee Conservation and Recreation Area and Lake Lawne Park, which land is to b e held and used for permanent open space land for conservation and recreation uses; and

WHEREAS Title VI of the Civil Rights Act of 1964 , :).nr1 t. h• '\:gul.c,tions of the Department of Housing and Urban Development effectuating that Title, provide that no person shall be discriminated against because of race, color, or national origin in the use of land acquired and/ or developed; and

WHEREAS it is recognized that the contract for Federal grant will impose certain obligations and responsibilities upon the Applicant and will re­ quire among other things (1) assurances that families and individuals dis­ placed as a result of the open space land project are offered decent, safe and sanitary housing, (2) compliance with Federal labor standards, and (3) compliance with-Federal requirements relating to equal employment oppor­ tunity; and

WHEREAS it is estimated that the cost of acquiring said interest will be $321, 008; and

WHEREAS it is estimated that the cost of development of said land will be $90, 54 7; and

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS:

1. That an application be made to the Department of Housing and Urban Development for a grant in an amount authorized by Title VII of the Housing Act of 1961, as amended, which amount is presently estimated to be $205, 777.50, and that the Applicant will pay the balance of the cost from other funds, available to it.

2.
