Answer: Attached is a listing of locally based companies which, since July 2011, have received publically announced resource based contracts to supply (Attachment A). It is estimated that o approximately 190,000 employment positions have been maintained or created as a result of these awards (value over $54 billion). As shown in the last local content parliamentary report, levels of local involvement in projects covered by State agreement acts is also increasing.

A further key priority is to enhance the competitive ability of localsuppliers. To this end a number of workshops have been conducted across the State and two rounds of financial assistance have been completed. Outcomes from round one of the industry Facilitation and Support program have seen local companies acquire contracts valued at over $120 million forthe State outlay of approximately of $1.6 million

The close rapport established with inznOr energy and project proponents has enabled the State to develop a clear understanding of future business and procurement trends and the implications for Western . Besides modular construction, focus is being given to issues around remote and automated management, floating LNG, and trade and investment opportunities in Africa.

Western Australia has been active in encouraging a more direct and specific involvement by the Commonwealth Government in supporting enhanced supplier capabilities. Achievements include modifications to the enterprise connect suite of programs and the introduction of the resources o connect initiative. Significant input was also provided to the Commonwealth reworking of their approach to the use of Australian industry participation plans for resources project. Answer: The then Department of Regional Development and Lands allocated $1 million to support regional Buy Local initiatives, divided equally between the Department of Commerce and the Small Business Development Commission (SBDC) o The Department of Coininerce utilised its allocation between November 2012 and October 2013 to undertake regional workshops and a regional round of the Industry Facilitation and Support Program

Eight regional workshops were held in Geraldton, Northam, Collie, Mandurah, Bunbury, Albany, Kalgoorlie and Karratha. The workshops were attended by over 450 businesses. Topics covered included how to sento government and resources projects, relevant policy and available assistance. On several occasionstestimonials from successful companies were part of presentations

The Department is currently monitoring outcomes achieved through the workshops.

Over $400,000 was allocated to 31 regional companies to assist in implementation of projects designed to enhance coinpetiveness and capability. Companies are required to begin to report on outcomes achieved six months, 12 months and 24 months after project completion. The first reports are due in late October and cover indicators including the value of contracts won, employment generated and apprentices engaged.

Answer: Under Australian Consumer Law, consumers have certain rights when purchasing goods and services, including the right to reject goods or services that are faulty. The possible denial of consumer rights may occur when a consumer purchases a fitting for his or her house where the sale includes installation. This can fall within the definition of a construction contract under the Consir"ciion Contracts, ;ICt2004 (CCA). The CCA allows a party to a construction contractto have a payment claim determined by a registered adjudicator. The supplier and/or installer may make a claim under the CCA when the consumer refuses payment for faulty goods or services, or may threaten to make a claim as a way offorcing the consumer to pay.

Until raised by the Standing Committee, this possible denial of consumer rights has not been raised with the Department of Commerce's Building Commission Division (Building Commission). The Building Commission has examined the record of adjudications under the CCA forthe financial years 2011-12, 2012-13 and 2013-14 for claims made against individuals, rather than corporations or businesses. . 2011-12 12 claims against individuals out of 198 claims; . 2012-13 10 claims against individuals out of 191 claims; and . 2013-14(partyear) two claims againstindividuals out of 52 claims

An examination of these claims against individuals indicates no "consumer" contracts were involved o in the circumstances outlined above.

The Building Commission would not necessarily be aware of threats to use the CCA which did not result in an application for a determination.

On the basis of the records of actual claims made under the CCA the prevalence of the practice of using the CCA to deny consumer rights appears to be low

The CCA allows for regulations to remove specified types of work, or the supply of specified types of goods and services from the operation of the Act. Answer: Applications deployed on the Worksafe information System Environment(WISE) during o 2012-13 include: I. improving functionality for auditing changes, plant registration and synchronisation between inspector computers and WISE; and 2. correcting errors.

WISE is not designed for reporting'data extraction purposes, it is a case management system. To provide reports on matters such as type of injury and diseases reported would require a new purpose built database.

Answer: Section 43 of the Occ"pationol Sty'ety, grid Health 11ct 1984 (the OSH Act) provides Worksafe inspectors with the power to enter any workplace. On occasions, Worksafe inspectors encounter workplaces where entry is questioned. If entry is refused after Worksafe inspectors have explained their powers, section 47 of the OSH Act provides for offences being committed ifa person obstructs or interferes with an inspector in the performance of their functions under the OSH Act. For the financial year 2012-13, Worksafe has not taken or initiated any prosecution action under section 47.
