SUMMARY OF ALLEGATION

(1) Complainant alleges a number of violations by-Louis Frey and respondent

committee for which the statute of limitations has expired.

(2) T'e remaining allegation is that the $7;945.26 excess, according to a

_reort labeled "Final Report" by the Lou Frey Appreciation Committee, has not

,-been properly accounted for under §102.4(a) of the proposed regulations and

s'under 5434(b) of the statute.

PRELIMINARY LEGAL ANALYSIS

(1) The matters alleged in pars. 1, 2 and 3 of the complaint appear not to*

be within the three-year statute of limitations.

(2) The Appreciation Committee, in a letter dated July 8, 1976, attached to the

"Final Report", indicates that its only fungtion is to suOport the activities

of Congressman Frey in maintaining dongressional offices in his district.

This comnittee registered on June 12, 1972, and has been reporting since that

PRELIMINARY LEGAL ANALYSIS (Cont'd.) time. Section 102.4(a) of the proposed regulations requires a political committee without debts or obligations seeking to terminate to include a statement with its final report as to the disposition of residual funds. The letter dated Juily 8, 1976, accompanying the final report appears to satisfy this requirement. Thus, there is no reason to believe a violation of 2 U.S.C. S434 or §102.4 of the proposed regulations has occurred. Although the residue of funds can be characterized as an office account, in view of the uncertain reporting require- ments at the time of the termination report, we are of the view that the Commission's interpretation in §113 of its reported regulations should not be applied here. I wish to file a formal complaint pursuant to the Federal Election Campaign Laws involving various campaign committees of Louis Frey, Jr.

1) On February 9, 1968, $1,000.00 was allegedly donated to his cmpaign from E. G. Banks. On April 5, 1968 another $1,000.00 was allegedly donated to his campaign by E. G. Banks, and another $400.00 was allegedly donated on May 19, 1972. A search of the records by the Florida Secretary of State's Office indicates there was no contributions listed for the above dates for any campaign comnittee that they have in their files for Lou Frey or Louis Frey, Jr.

Enclose-d are clippings from the Sentinl Star Newspaper, dated March 26, 1975 in which testimony was cjivn in a conspiracy trial of former Comptroller Fred 0. Dickinson in Jacksonville, Florida.

2) On July 13, 1970 the Lou Frey AppreciAtiion Committee transferred $20,000.00 to the Lou Frey Jr. Campaign Account, and N on December 1, 1970 the Lou Frey Jr. Campaign Account reimbursed funds advanced by the Lou Frey Appreciation Dinner to,-illing $20,081.37. Where did the original $20,000.00 come from, and was it proper to use various accounts and transfers to campaign for public office?

3) in 1972, $39,026.54 was raised for the election efforts of Louis Frey for re-election to Federal office, however he was unopposed. Where did the $39,026.54 co to and what was it utilized for?

4) In regards to the Lou Frey Appreciation Committee, I.D. N .,. 017825,(h)rc -n .;P ...m..Cnd rAci sto-t-ion dated November 7,1975. In Paragraph 9 of that amended regist ration the conmittce indicated that upon disbanding thee remaining funds_ left in the account would be given to national charities, "In the event of disbanding what

disposition will be made of residual. funds? Distribution to organized national charities, (Red Cross, Salvation Army, Cancer Society, etc.)"

The Lou Frey Appreciation Committee apparntly received the above funds and apparently proceeded to use tliis as an "Office Account", receiving funds from the U.S. House of Representatives for office expense reimbursement and telephone expense reimburse- ment.

Further, travel and office expenses were paid to staff individuals, as well as Mr. Frey, and purchase of booth space at the Central Florida Fair, plus a donation of $1,000.00 on July 22, 1974 to the campaign fund of Lou Frey for a political campaign.

On July 8, 1976 a report was filed for the period of April 1, 1976 through June 30, 1976 for the Lou Frey Appreciation Committee which stated this was a final report. The cash on hand at the close of the reporting period to Section A, Line 10, was $7,045.27. Pursuant to Federal Election Commission Laws and Regulations adopted August 19, 1976, Law No. 102.4A, "Termination of Registration" states that the "Notice of Termination" shall contain a final report of receipts and disbursements, including a statement as to the disposition of residual fund.; if the committee is disbanding. There was no statement showing where the funds would be disposed of attached to the July 8, 1976 filing.

Furthermore, there has been no report filed on October 1, pursuant to the Federal Election Code, nor a report filed ten (10) days pre-election regarding this coiimittee. It would appear that the remaining balance of $7,045.27 should be accounted for in some final report, and a report has not been filed at this time.

The above complaint is made in good faith and is based upon the records that I have been able to obtain. Prior to filing this complaint, on October 22, 1976 at a press conference I called for an investigation into the campaign affairs of Mr. Louis Frey and have not received any response from anybody acting in his behalf in regards to the aforementioned points of the complaint.

I am a candidate for office in the Ninth Congressional District and file this in my own behalf.

The purpose of this press conference is to call for an investigation

into the campaign affairs of Mr. Louis Frey.

1. Why don't the contribution reports of any of the campaign

committees operating on behalf of Mr. Frey reflect the alleged

donations amounting to $2,400.00 from E.G. Banks as reported in the

Sentinel Star on Wednesday, March 26, 1975? $1,000.00 was allegedly donated on February 9, 1968; $1,000.00 was allegedly donated on April 5, 1968; and $400.00 was dillegedly donated on May 19, 1972.

2. Why on July 13, 1970 did the Lou Frey Appreciation Committee transfer to Lou Frey Jr. Campaign Account the sum of $20,000.00,

and then on December 1, 1970 the Lou Frey Jr. Campaign Account transferred back to the Lou Frey Appreciation Dinner the sum of

$20,081.37?

3. In 1972 where did t.he $39,026.54 from the Lou Frey Appreciation Dinner go?

4. Where did the remaining funds frow the Lou Frey Appreciation

Comnittee go? On july 1, 1976 a Final Report was filed showing that there remained $7,045.26. There is no report filed for this committee on October 1, 1976 pursuant to Federal Law. There is no statement filed indicating that the funds were transferred to another committee.

5. Why has he received contributions in the amount of $8,800.00

from such groups as: ACRE, Fla. Bankpac, Sun Political Action

Conittee, Fla. Dental Political Action Comittee Campaign Fund, Good Government Conm]ttee or First Federal Savings of Miami, Pace, Realtors Political Action Conittee, Life and several others?

Dear Sir:

I wish to file a formal complaint pursuant to the Federal Election Campaign Laws involving various campaign committees of Louis Frey, Jr.

1) On February 9, 1968, $1,000.00 was allegedly donated to his campaign from E. G. Banks. On April 5, 1968 another $1,000.00 was allegedly donated to his campaign by E. G. Banks, and another $400.00 was allegedly donated on May 19, 1972. A search of the records by the Florida Secretary of State's Office indicates there was no contributions listed for the above dates for any campaign committee that they have in their files for Lou Frey or Louis Frey, Jr. r- Enclosed are clippings from the Sentinel Star Newspaper, dated March 26, 1975 in which testimony 'was given in a conspiracy trial of former Comptroller Fred 0. Dickinson in Jacksonville, Florida.

2) On July 13, 1970 the Lou Frey Appreciation Committee transferred $20,000.00 to the Lou Frey Jr. Campaign Account, and on December 1, 1970 the Lou Frey Jr. Campaign Account reimbursed funds advanced by the Lou Frey Appreciation Dinner totalling $20,081.37. Where did the original $20,000.00 come from, and was it proper to use various accounts and transfers to campaign for public office?

3) in 1972, $39,026.54 was raised for the election efforts of Louis Frey for re-election to Federal office, however he was unopposed. Where did the $39,026.54 go to and what was it utilized for?

4) In regards to the Lou Frey Appreciation Committee, I.D. No. HR 017825, there was an amended registration dated November 7,1975. In Paragraph 9 of that amended registration the committee indicated that upon disbanding the remaining funds left in the account would be given to national charities, "In the event of disbanding what Federal Election Commission October 27, 1976 Page (2) Two disposition will be made of residual funds? Distribution to organized national charities, (Red Cross, Salvation Army, Cancer Society, etc.)"1 The Lou Frey Appreciation Committee apparently received the above funds and apparently proceeded to use this as an "Office Account", receiving funds from the U.S. House of Representatives for office expense reimbursement and telephone expense reimburse- ment. Further, travel and office expenses were paid to staff individuals, as well as Mr. Frey, and purchase of booth space at the Central Florida Fair, plus a donation of $1,000.00 on July 22, 1974 to the campaign fund of Lou Frey for a political campaign. On July 8, 1976 a report was filed for the period of April 1, 1976 through June 30, 1976 for the Lou Frey Appreciation Committee which stated this was a final report. The cash on hand at the close of the reporting period to Section A, Line 10, was $7,045.27. Pursuant to Federal Election Commission Laws and Regulations adopted August 19, 1976, Law No. 102.4A, "Termination of Registration" states that the "Notice of Termination" shall contain a final report of receipts and disbursements, including a statement as to the disposition of residual funds if the committee is disbanding. There was no statement showing where the funds would be disposed of attached to the July 8, 1976 filing.

Furthermore, there has been no report filed on October 1, pursuant to the Federal Election Code, nor a report filed ten (10) days pre-election regarding this committee. It would appear that the remaining balance of $7,045.27 should be accounted for in some final report, and a report has not been filed at this time. N The above complaint is made in good faith and is based upon N the records that I have been able to obtain. Prior to filing this complaint, on October 22, 1976 at a press conference I called for an investigation into the campaign affairs of Mr. Louis Frey and have not received any response from anybody acting in his behalf in regards to the aforementioned points of the complaint.
