Saskatchewan Thoroughbred Sales provides an avenue for strategic marketing of Thoroughbred horses threefold; for the betterment of breeding in Saskatchewan and to facilitate ownership of horses for racing in Saskatchewan and to make off track thoroughbreds available for their second career. Essentially giving Thoroughbred race horses a chance for a new beginning after their racing career ends.

The Thoroughbred Sales Futurity is open to any thoroughbred yearling (foals of 2016) registered with the Jockey Club and if foaled in Canada, also registered with the Canadian Thoroughbred Horse Society.

SPECIAL NOTICE TO VENDORS & PURCHASING AGENTS Section 426 of the Criminal Code of Canada states: 1) Everyone commits an offence who: corruptly gives, offers or agrees to give an agent or, being an agent, demands, accepts or offers or agrees to accept from any person a reward, advantage or benefit of any kind as consideration for doing or forbearing to do, or for having done or forborne to do, any act relating to the affairs or business of the principal: or with intent to deceive a principal gives to an agent of that principle, or being an agent, uses with intent to deceive his principal, a receipt, account, or other writing in which the principal has a interest, that contains any statement that is false or erroneous or defective in any material particular and, that is intended to mislead the principal. 2) Everyone commits an offence who is knowingly privy to the commission of an offence under subsection (1)…(3) A person who commits an offence under this section is guilty of an indictable offence and is liable to imprisonment for two years.

NOTICE TO PROSPECTIVE BUYERS OF HORSES AT THIS SALE: **ALL PROSPECTIVE BUYERS MUST REGISTER WITH THE SALES OFFICE AND RECEIVE A NUMBER PRIOR TO BIDDING.

For All Option A yearlings (as per nomination/entry form):

All Option A consignors are liable to pay $200.00 per horse as an “In Fee”. All “In Fees” will be placed in trust to fund the following years race and are payable by the consignor whether the consignor retains ownership by successful bid, reserve bid, or because the upset price is not met and the horse is as a result unsold.

All successful bidders (including consignors bidding on their own horse or placing reserve bids on same) will pay in addition to the purchase price of each horse the sum of $200.00 to be known as the “Out fee”. If a horse is not sold because the upset price is not met, the consignor of such horse shall pay the $200.00 “Out fee” in addition to the “In Fees” and minimum commission and such horse shall be eligible for the following year’s race.

These “In” and “out” fees will be held by Thoroughbred Sales and forwarded to the Saskatoon Prairieland Park bookkeeper and be used to insure the value of the 2018 Thoroughbred Sales Futurity on a date to be announced.

Please note that the horses must meet all the following for eligibility to the 2018 Thoroughbred Sales Futurity:

(1) The horse (entered under Option A as per nomination/entry form) was offered for sale at the 2017 Thoroughbred Owners and Breeders Yearling and Mixed Sale (2) The horse has all their fees paid at the conclusion of the 2017 Thoroughbred Owners and Breeders Yearling and Mixed Sale (includes all Option A and Option B horses as per nomination/entry form).

The Thoroughbred Sales Committee and the Marquis Downs Race Manager will determine the 2018 Thoroughbred Sales Futurity purse, whether added or guaranteed as is deemed necessary by the availability of funds.

The purse will be determined based on the number of yearlings catalogued, the fees collected, and any additional monies that may be available from sponsors or the graded scale.

In the event that 6 or more horses of each gender are entered, the race will be split into a C&G and a Filly division. In the event that there are less than 6 horses entered in either division but the combined total equals 12 or more the race will be split by lot, resulting in 2 races with a Filly bonus (TBA) applying to each race. In the event that there is no Filly in one of the aforementioned races, the Filly bonus will apply to the race where the Fillies are entered. If no Fillies are entered in either split the Filly bonus will be added to the purse as listed in the condition book.

It is anticipated that the purse for the 2018 Thoroughbred Sales Futurity will be:

1) $ 7,500 colt and gelding division 2) $ 7,500 fillies division

Thoroughbred Sales places all fees in trust with Saskatoon Prairieland Park for the funding of the following year’s race. The funding goal is to ensure all reasonably potential purse liabilities can be met by the gross purse funding, as will any funding not paid out from the current year. None of the funding for the gross purse is used or directed for purposes other than as indicated. All revenues and expenses for this yearling/mixed sale are borne by Thoroughbred Sales.

GOODS AND SERVICE TAX

All horses sold in this sale will be subject to the 5% G.S.T. If you have registered your horse business for G.S.T. you may be able to recover this tax when filing your next G.S.T. return.

FOREIGN BUYERS AND THE GOODS AND SERVICES TAX Foreign buyers will not be charged the GST if they complete the pre-sale export delivery agreement, provided in this catalogue agreeing that a licensed commercial carrier will deliver the horse at their risk and expense to a location outside Canada. This agreement must be on file with the sales office prior to bidding. Foreign buyers taking delivery of a horse in Canada will be charged 5% GST but may be eligible for a rebate if the horse is not used in Canada after purchasing and is exported within 60 days. It is our understanding that the forms for rebate are available at Canada Border Services Agency at time of export.

CONDITIONS OF SALE

IMPORTANT NOTICES - PLEASE READ

This sale is governed by these Conditions of Sale and all announcements from the auctioneer's stand or otherwise ("Announcements"). All sellers, prospective bidders/buyers, all other interested parties and all sales are bound by and subject to the provisions of the Conditions of Sale as set forth in this catalogue and Announcements.

All prospective bidders are urged to carefully examine horses in which they may be interested personally and/or by agents or veterinarians of their choosing before bidding as they are accepting any horse purchased with all conditions and defects except those conditions and defects which are specifically warranted in these Conditions of Sale and were not so announced prior to sale.

Consignors may make arrangements with prospective bidders/buyers prior to sale which differ from these Conditions. In such events Saskatchewan Thoroughbred Sales (herein known as the "Thoroughbred Sales") shall have no responsibility in regard to any such agreements, and the enforcement thereof shall be the responsibility of the parties to the agreement.

FIRST – “APPLICATION LAW:” All horses in this sale are offered According to the laws of Saskatchewan. The right to bid as provided under Law is reserved for all consignors unless otherwise announced. A consignor or his agent may bid on his own consignment. The consignor may bid on his/her own consignment. The consignor may place a reserve bid on his/her consignment which may, at the option of the consignor be announced.

SECOND – THERE IS NO WARRANTY EXPRESSED OR IMPLIED BY THE CONSIGNOR AND THOROUGHBRED SALES AS TO THE SOUNDNESS, FITNESS OR MERCHANTABILITY FOR ANY PARTICULAR PURPOSE OF ANY HORSE OFFERED IN THIS SALE. ALL HORSES ARE SOLD ‘AS IS; AND WITH ALL DEFECTS EXCEPT AS SET FORTH IN CONDITIONS EIGHTH AND NINTH BELOW.

THIRD – BIDDING PROCEDURE: There is an upset price of $1,000 for yearlings which cannot be waived, unless prior arrangements have been made with the auctioneer. The upset price for all other horses listed in this catalogue is $ 500.00. If an opening bid of the upset price is not immediately forthcoming to the auctioneer’s call, the horse shall be led out unsold, at which time the consignor of the horse) shall be liable to submit the “In Fee”, “Out Fee”, and minimum commission. Note: “in” and “out” fees apply only to sale yearlings. Minimum acceptable increases in bidding are $100.00 for yearlings and $50.00 for all others. The person making the highest bid as recognized by the auctioneer shall be the buyer.

FOURTH –BIDDING DISPUTES: Should any dispute arise between or among two or more bidders, the auctioneer shall forthwith adjudicate the dispute, and his decision shall be absolute, final and binding on all parties. Bids tendered after the fall of the hammer are not valid grounds for dispute. Bids received by personnel employed by the undersigned or auctioneer have the same stature as bids received by the auctioneer. In case of dispute, which the auctioneer cannot resolve, the bidding shall be reopened for advanced bids, and if there is no advance bids the horse is sold to the person from whom the auctioneer recognized the last bid. Advanced bidding shall be restricted to the disputing parties, unless the bid be reduced below the level of the recognized bid at commencement of dispute, in which case bidding is reopened to all. The Saskatchewan Thoroughbred Sales reserves the right to reject any or all bids.

FIFTH – TITLE AND DELIVERY; Title passes to the buyer at the fall of the hammer. All risk of injury to the horse becomes the buyer’s risk at passing of the title. Horses will be held by consignor for buyer until buyer makes settlement as provided in CONDITION SIXTH below. Buyer shall immediately present himself to make settlement if requested by Saskatchewan Thoroughbred Sales. But in any case shall so present himself within thirty minutes of conclusion of the sales session which the horse was presented. Upon settlement by the buyer, horse will be delivered by means of a “stable release” provided by the undersigned to buyer or his representative. Buyer or his representative shall present “stable release” to designee of undersigned to remove horse from sales premises after taking possession: but in any case taking possession of the horse by buyer or his representative shall constitute delivery. A buyer with the stable release, upon delivery, shall remove the horse from the sales premises.

Buyer shall cause horse to be removed promptly from the sales premises or shall be subject to stable charges as determined by the undersigned. In addition should purchaser fail to cause horse to be removed after the selling session in which the horse was sold, the undersigned may cause horse to be removed from sales premises at buyer’s risk and expense.

SIXTH –TERM FOR SETTLEMENT: Buyer shall make settlement with cashier of the undersigned. Payments to others including consignors or their representatives do not constitute settlement. Buyer shall present himself/herself to make settlement as provided above for the full purchase price, such settlement to be in the form of Canadian currency, Travellers Cheques, e-transfers or pre-approved bank cheques to the cashier of the undersigned. Any cheques dishonored by the bank are subject to a fifty dollar service charge.

All horses must be paid for directly following the sale and removed from the grounds via gate releases by 6 p.m. on September 4th, 2017.

SEVENTH - DEFAULTERS: Should the buyer fail to comply in any respect with CONDITIONS FIFTH AND SIXTH above, the undersigned may, in its absolute discretion, pursue any remedy against defaulting buyer, including but not limited to, taking possession of the horse, resale of the horse at public auction, or by private treaty for account of the defaulter. In such case defaulter shall be liable for any deficit after all costs of maintenance and resale, attorney fees, cost of litigation and damages available to seller by law. Conditions fifth and sixth apply, for the purpose of delivery, removal and payment of fees to consignors whose horses have not sold because the upset price is not met.

EIGHTH -- WARRANTIES AS TO DESCRITION: Any horse sold on or after July 1 of its yearling year which is described at the time of the sale as a colt, and does not at such time have two testes descended to the scrotum; and any horse of any age which is described at the time of sales as a ridgling, and is at such time a gelding; or is described at time of the sale as a gelding and is at such time a ridgling, or any male horse described at the time of the sale as a female; or any female horse described at the time of the sale as a male, shall be subject to return to the consignor as provided at CONDITION TENTH below.

NINTH “WARRANTIES AS TO SOUNDNESS’: Unless expressly announced from the Auction Stand or by official publication of the undersigned or as hereinafter provided, there is no guarantee of any kind as to the soundness or condition, or other quality of any horse sold in this sale. Horses with impaired vision or injury to the eye must be so announced. Cribbers and wobblers must be so announced. Should a horse be a twin or be required by the Jockey Club to be registered as of “dual parentage” such must be announced. There is no guarantee as to soundness of wind.

TENTH—RIGHT OF RETURN: Any horse sold in this sale whose condition must be announced as provided for at CONDITIONS EIGHTH AND NINTH above and is not so announced shall be subject to return to the consignor with refund of the purchase price and reimbursement for reasonable expenses for keep, maintenance and transportation of the horse from the fall of the hammer, provided that the undersigned is notified within seven (7) days of the date of the sale. The rights of the buyer to return the horse as provided herein shall be his sole and exclusive remedies against the undersigned with respect to warranties, and undersigned shall not be liable for any further actual or consequential damages other than those set forth herein.

ELEVENTH –SALES BOOK AND ANNOUNCEMENTS: Horses catalogued in this sale are offered with their pedigrees, racing records, eligibility for incentive programs, engagement, breeders record and location where bred, as represented by consignor, and the undersigned is not responsible for the accuracy of the information provided. In case of error or omission, buyer shall seek redress only from consignor. While certain information may have been procured by undersigned, from third parties on behalf of consignor, or the consignors information may be reproduced in error, it is nonetheless solely the responsibility of consignor to verify the accuracy of such information and to notify of any corrections prior to the sale.

TWELFTH - AGENTS; Person(s) acting as agents for principals must file notarized letters of authorization from the principals stating that the agent is acting on their behalf and that said principal is responsible for agent sales or purchases. Failure to comply with this condition of sale will impose personal liability upon such agent with respect to all matters in connection with or arising out of this sale.

OPTION B – The following yearlings will not be offered for public auction at the

2017 Thoroughbred Owners and Breeders of Saskatchewan Sale.

Consignors will be required to pay the ‘in’ and ‘out’ nomination fees to remain eligible for the 2018 Thoroughbred Sales Futurity race. The ‘in’ and ‘out’ nomination/entry fees for Option B yearlings is $500 each. Nomination fees will be due on September 4th, 2017 at 3 p.m. at the Thoroughbred Sales office at Marquis Downs.

This initiative has been implemented to enable consignors who do not want to sell their yearlings at public auction, but wish to make them eligible for the 2018 Thoroughbred Sales Futurity.

On behalf of The Committee for Sustainability and Future of Horse Racing in Saskatchewan

Horse racing makes Saskatchewan's horse industry stronger. The money generated by the industry contributes to many of the things that we enjoy as horse owners. Without racing, we would have fewer equine vets, fewer farriers, fewer massage therapists and fewer fields seeded to hay and oats. Local feed stores and tack shops would have trouble staying afloat. The industry contributes to a strong foundation for all horse activities.

The overall economic contribution of the horse industry in Saskatchewan was $723M in 2009. Horse racing specifically contributed over $37M to the province’s economy in 2010, according to a study commissioned by Equine Canada.

Over 500 people are licensed to work in the industry each year. For these people, racing is a way of life. Many families have been a part of the sport for several generations, sharing in the excitement and challenges of horse life with their children and grandchildren.

In 2016, 47.6% of horses at Marquis Downs were owned by people of First Nation or Metis heritage, who also make up 43% of trainers, 39% of owners, 25% of jockeys, 39% of pari-mutuel clerks and 40% of racing officials.

Unfortunately for all of us, racing is facing tough times in the province. The total number of starters is diminishing as Saskatchewan's purse pool is less than half that of neighbouring provinces and shrinking.

Average purses at Marquis Downs are $3000 - $5,500, compared to Edmonton with $5,500 - $20,000 or Winnipeg with $7,500 - $15,000.

The average earning of horses at Marquis Downs in 2016 was $2,212. As anyone who owns a horse knows, this isn't enough money to keep a horse in training for 6 months, let alone cover the purchase price, feed, vet and farrier, or the cost to winter them.

The top earner in Saskatchewan in 2016 would have ranked 81st in Manitoba, 194th in Alberta and 202nd in British Colombia.
