A 1 Occasion and Purpose

The Muskauer Park, a cross-border UNESCO World Heritage site on German and Polish territory since 2004, is the largest and one of the most important landscape gardens of con- tinental Europe, with an artistic and art historical appeal that extends as far as America. It is also a place of outstanding architectural monuments, especially with the central building en- semble consisting of the New Castle, Old Castle and Cavalier House.

While the New Castle with its exhibitions, visitor information center, seminar, event and of- fice rooms, and the Old Castle with its registry office and foundation archive are subject to a balanced public usage, since its renovation in 2013, which was independent of future use, the Cavalier House has served only for seasonal art exhibitions.

In the search for a suitable concept of use for the Cavalier House, the idea was finally devel- oped to follow Prince Pückler's intention and to widen the view from his ingenious work of landscape art into the surrounding cultural landscape. An innovative exhibition in the Cava- lier House is designed to raise visitors' awareness of the unique scenic and geological at- tractions of the Muskau Arch UNESCO Geopark, with Muskauer Park at its center as a Ger- man-Polish link, and to encourage visitors to look for additional attractions around Bad Mus- kau.

The Geopark Visitors’ Center, which in the future will be located in the middle of Muskauer Park, will illustrate as a science center the important geological processes, raw material ex- traction and consequences of changes in the landscape. Furthermore, the narrative strand will pursue the interaction between climate and landscape and between raw materials and their site-specific, economic use from the Ice Age to the present, including the current struc- tural changes occurring in the former Lusatian lignite mining area.

On the basis of comparative analyses and with the involvement of the Land of Saxony Con- servation Office, ICOMOS and , as well as the Foundation's scientific advi- sory board, the Board of Trustees of the Fürst Pückler Park Bad Muskau Foundation de- cided on April 27, 2018, to implement the previously outlined concept of use: “The use for an exhibition on the Muskau Arch in the Cavalier House connects World Cul- tural Heritage and World Natural Heritage [in this case the UNESCO Geopark] trans-nation- ally in Poland, Brandenburg and Saxony.” (Statement of the Land of Saxony Conservation Office).

Goal The goal of the competition is to create a contemporary exhibition venue through a change of use and a structural expansion of the historic Cavalier House as situated within the histor- ical grounds, in the manner of the so-called C-Plan from the Hints of Landscape Gardening from 1834. To this end, a dynamic, sustainable, cost-efficient building to house the installa- tion of an integrative, scientific exhibition should be developed, complementing the historical Cavalier House, while using the basement and ground floor rooms that are especially worth keeping. The prestigious southern facade facing the New Castle and the more modest east and west facades of the Cavalier House are to be kept in the currently existing form from 1934.

The new visitor center provides an even wider range of offers not only to visitors with an in- terest in nature and culture but also to the inhabitants of the region and specifically the youth. As a result, the number of visitors to the Muskauer Park (also in winter) and the time visitors spend in Bad Muskau (on average per year) will clearly be increased by including the Muskau Arch and its associated cultural landscape.

Because of the high UNESCO protection status of the Muskauer Park and the central loca- tion of the Cavalier House and the construction site, it is indispensable that the new building structure should fit into the existing, shielding wooded area in terms of its shape and height, without entering into a visual or design correspondence with the surrounding park areas. This expressly includes the radiation of light sources and lit areas into the park, especially since the foliage-free period in Bad Muskau lasts just under six months.

A 2 Basis A 2.1 History of the Town of Bad Muskau

Mužakow (from Sorbian, roughly "men's town") was newly founded on the site of a Slavic castle as a conveniently located trading and manufacturing center on the Neisse in the 13th century in the course of German colonization. The name appeared first in a document from 1249. In 1452, the town charter was granted by Wenceslas von Bieberstein.

The Muskau estate (similar in rank to a principality, but with fewer rights) belonged until 1815 to the margraviate of Upper of the .

The lords of the manor were the Imperial Counts of Callenberg from the Thirty Years' War until 1798, then the Counts of Pückler. Hermann von Pückler-Muskau, who later became a prince, sold the estate in 1845 to the Counts of Nostitz and von Hatzfeld, who sold it just one year later to Prince Frederick of the Netherlands. From 1883 to 1945, the estate was in the hands of the Counts of Arnim.

Due to rich clay deposits, a strong pottery trade developed in Muskau. During its heyday from the 17th to the middle of the 19th century, many master workshops developed and sold their famous stoneware vessels in distant market towns (e.g. Vienna). Another important branch of the Muskau economy was alum mining, the first documented mention of which dates back to 1573. The alum smelter, built on the site of today's Spa Park, was one of the oldest in Saxony. Its operation was discontinued in 1864. In addition, brown coal was mined in the area between Bad Muskau and Weißwasser in the 19th century.

At the end of the Second World War, the town was heavily destroyed by artillery fire from the Soviet Army and the 2nd Polish Army as they pushed across the Neisse. In the spring of 1945, the Old and New Castles and large parts of the city were destroyed by arson and bombardment. In July 1945, the lord of the manor, Hermann Graf von Arnim, was informed that "the manor and all its businesses had been expropriated without compensation.” As a result of the bor- der demarcation along the Oder-Neisse line, two thirds of the park were assigned to the Re- public of Poland and, after years of searching for a name, the municipality of Łęknica was finally formed from the districts located east of the Neisse. From then on, the western part of the park belonged to the town of Bad Muskau until the Free State of Saxony took over the property in 1992.

During the summer season, the town is still a tourist magnet mainly because of its location in the middle of the unique Muskauer Park, the aesthetic appeal of which reaches far be- yond the borders of Germany. Bad Muskau also attracts many visitors because of its special location as a border town to Poland. It is also known as a traditional spa town. The spa business, which was founded in Pückler's time with the establishment of a bath, was continued in GDR times with the peat bath in the Cavalier House. This also resulted in the town's additional designation as a spa in 1961. To- day, the Fürst Pückler Park Hotel on the market square offers wellness treatments and physiotherapy. In addition to mud, brine treatments can also be offered thanks to Muskau's own spring.

A 2.2 The Muskauer Park

The fact that the Muskauer Park has been on UNESCO's World Heritage List since 2004 is largely because of Hermann Prince von Pückler Muskau (1785-1871).

Starting in 1815, he created on both sides of the Neisse a masterpiece of landscape garden art, a late, so-called "classical" landscape garden.The green prince is considered the founder of modern landscape design with influences that reach beyond Europe to America. His principles remain relevant: with his Hints on Landscape Gardening published in 1834, he wrote a much-cited textbook that is still popular among experts today. In it, he describes general principles for the creation of a park and the ideal image of his own Muskauer land- scape garden. As a basis for the restoration and conservation of the landscape artwork, which has spanned the territory of two countries since 1945, a treaty on cross-border cooperation was concluded in 1989.In the 1990s, German-Polish cooperation intensified, gradually develop- ing into a showcase project of international garden monument conservation. Thanks to a joint German-Polish application, Muskauer Park was inscribed on UNESCO's World Heritage List in 2004.This special title not only highlights the park's significance in terms of garden history, design and tourism, but also pays special tribute to the globally unique cross-border cooperation in the preservation of a bi-national cultural site. The explanation of the outstanding universal value of the landscape park can be found in Appendix C21.

A 2.3 The UNESCO World Heritage Site Muskauer Park/Park Mużakowski

The Fürst Pückler Park Bad Muskau Foundation was established in 1993 by the Free State of Saxony as a dependent foundation under public law in the portfolio of the Saxon State Ministry of Finance. Its assets consist of the Muskauer Park with all its horticultural and structural facilities west of the . The foundation's mission is to restore and preserve the Muskauer Park ensemble, which is of national cultural and historical signifi- cance, according to historical models. The aim is to maintain and manage this monument of garden art in partnership with the Republic of Poland – specifically in the spirit of the Con- vention Concerning the Protection of the World Cultural and Natural Heritage (UNESCO World Heritage Convention). This convention stipulates the protection of cultural and natural heritage with extraordinary universal values. See Annex C.21_Declaration of the Outstand- ing Universal Value of the Park. The title of UNESCO World Heritage Site also entails a spe- cial responsibility on the part of all concerned to conserve the value of the sites specially recognized by this designation.

The foundation is advised by an international advisory board, the International Conservation Board (ICB). This board serves as an advisory council for the parks created by Pückler in Muskau/Łęknica and in Branitz (Cottbus). The board supports and advises the Foundation Council from a technical point of view in order to ensure that the same standards of interna- tional garden monument preservation are observed in the care, conservation and restoration of Pückler's heritage on both sides of the Neisse.

A 2.4 The Muskau Arch In addition to the landscape architectural features of the Muskauer Park, the surrounding landscape itself is also distinctive: the Muskau Arch, a wide geological arch formed by a push moraine.

Located in the triangular border region of Brandenburg, Saxony, and Poland, the Muskau Arch lies like a big horseshoe in the landscape. Its western part is located in Germany (Bran- denburg and Saxony), its eastern part in the Polish Voivodeship Lubuskie. An inland ice glac- ier about 500 m thick compressed the sand and lignite layers in front of and below it to form a 20 x 22 km moraine up to 180 m high. In this way, the glacier transported lignite, alumina clay, glass sand and various valuable clay raw materials to the earth's surface. Due to its geological uniqueness and its particularly beautiful formation as a geomorphological land- scape element, it was awarded the distinction of National Geotope in 2006 and 2017.

Intensive brown coal production in about 70 surface and underground mines as well as nu- merous clay pits permanently changed the landscape between 1843 and 1973. Today, the Muskau Arch is a touristically attractive, water-rich mountainous landscape with more than 300 lakes.

A 2.5 The UNESCO Geopark Muskau Arch

Since 2015, the Muskau Arch has held the status of a UNESCO Global Geopark. UNESCO Global Geoparks are –following World Heritage Sites and the Biosphere Reserves – the third category of UNESCO cultural and natural heritage sites.

There are currently 140 UNESCO Geoparks (as of September 2018), six of which are in Germany. The has a special position among them, as it is one of only four existing transna- tional Geoparks worldwide. UNESCO formulates the concerns and the goal of its Geoparks as follows: "The Geopark concept emerged in the mid-1990s in response to the need to preserve and conserve the value of geological landscapes of special significance to Earth's history.

The landscapes and geological structures are the main witnesses of the evolution of our planet and the determining factor for our future sustainable development.

From the beginning, Geoparks developed according to the “bottom up” principle …as com- munity-led structures. They ensure that extensive geological landscape elements are pre- served and that science, education and culture are promoted in them.

This applies also in relation to their sustainable economic use and responsible tourism."

The Muskau Arch offers a wonderful and unique recreational landscape in which traces of the history of diverse industries and raw materials can be found everywhere. Ten special, thematic cycling and hiking trails, three landscape parks and two historic narrow-gauge rail- roads invite visitors to extensive explorations.

The numerous mining lakes, which appear in various green, red-brown, blue and black col- ors, are a foremost attraction. They are often located close to each other and thus increase the aesthetic appeal of the walk.

Particularly impressive are the fracture fields of underground mining, large areas of which are covered by water. The trees that grew on them also became submerged and died with the lowering of the surface above the underground mine workings, which often took dec- ades. Many tree stumps now protrude from the water and these "sunken forests" give the landscape a bizarre, somewhat apocalyptic appearance.

The Cavalier House is located in the direct vicinity of the Neisse at an altitude of approx. 105 m above sea level. Its development, shape and historical use were always dominated and determined by the New Castle. This hierarchical "dress code" must be maintained at all costs.

The dense, shielding tree population around the building field to the north of the Cavalier House effectively underlines the structural and landscaping status.

Both this architectural configuration and the dense planting around the Cavalier House were Pückler's declared intentions. In his so-called C-plan overall layout adjacent to the north side of the Cavalier House becomes apparent, see following page and Appendix C.5.

The necessary but less presentable functions such as stables, carriage shed and wash house were to form a kind of three-wing complex together with the Cavalier House, which was concealed by dense planting on the west, north and east sides. Even the representative south facade of the Cavalier House was and still is concealed by an oval wooded area, again directing the main attention to the New Castle.

The construction area planned for the new building essentially comprises the areas that were to be occupied with uses in the C-Plan. In deviation from the western building line planned in the C-Plan, the construction area is indented here in order to protect the existing root and crown areas of the woody plants.

The access roads in the C-Plan, which still exist today and will continue to be used, follow the main direction coming from the castle in the south, from the west as a service road that is still in use, and from the east. Here the sponsor also sees the future access to the exhibition building.

A 3.2 The Historic Cavalier House The origins of the present Cavalier House date back to the middle of the 17th century, when a one-story "garden palace" was built on this site, probably in connection with the recon- struction of the New Castle during and after the Thirty Years' War.

This oldest core in the northern part of the present building can still be seen in its strong, for- mer exterior walls as well as the vaulted and partially stuccoed rooms on the first floor.

In the course of the following decades, there were several extensive additions and altera- tions. These initially included a structural extension of the garden palace for parallel use as a granary, and finally as a theater, at the end of the 18th century. The building was not given the name "Cavalier House" until 1862, after its extensive conver- sion into a civil servant's residence - at that time this was carried out in the neo-Renais- sance style, in keeping with the time and the architecture of the New Castle. The use as a residential building was maintained until 1945, but the facade was changed again in 1934 to neoclassical style.

The current external appearance of the building is based on the last reconstruction before the Second World War: a simple neoclassical façade designed by Herbert Lehmann, Count Arnim's building director and an associate of Alfred Breslau. It is a two-story, approximately rectangular building with a mansard roof.

Because of unfavorable structural features such as low room heights (partly < 1.70 m), low lighting and poor fire protection resulting from the historical conversions, parts of the first upper floor and the three attics cannot be used as recreation or storage rooms. Due to its architectural and local historical significance, the Cavalier House has been listed as a historic building.

Shortly after the Second World War, the largely undamaged building was occupied by the spa facility, which existed until 2010.

In the period from 2011 to 2013, the building was partially renovated in a use-neutral man- ner, with the focus on measures to secure the building's structural integrity and the require- ments of historic preservation. The rooms of the original garden palace on the first floor were made accessible again. Likewise, the load-bearing structure of the other interior rooms was renovated and the ground and second floors were made expandable.

A 3.3 Planning, Urban Development and UNESCO World Heritage Require- ments A building site to the north of the Cavalier House is available for the required new building. The permissible building development is based on § 35 BauGB Bauen im Außenbereich. According to the land use plan, development is also permissible.

The following design limitations must be observed: − The Cavalier House is protected as an individual monument and integral part of the Muskauer Park complex. − The construction site is located in a protected landscape area. In order not to act in a way that is contrary to the status of the UNESCO World Heritage Site of Muskauer Park/Park Mużakowski and thereby to endanger it, the following design prem- ises are to be complied with: − The construction height of the new exhibition building must not exceed the northern eaves height of the Kavalier- haus, corresponding to 113.6 m DHHN92 The refer- ence height +/- 0.00 = 107.00 m DHHN92 is on the ground floor of the Kavalier Haus. See B12 − Superstructures, towers or the like are not permitted. − In keeping with the restrained appearance of the Cavalier House described above, the new building should not develop an external/distant effect induced by reflective, glazed or light-generated effects. − Necessary rescue windows or openings in the facades facing the park are to be designed in such a way that reflection or light emission is prevented − The roof landscape should be developed within the specified height limit and should also have a non-reflective, non-colored surface. − The transparent roofing of the interior planting area (daylight for plants reminiscent of the Tertiary) should also be provided with surfaces that are as non-reflective as possible. − Extensive green roofs are conceivable for the roofs above the exhibition rooms. − The new building should fit into the concealing wooded area in its staggering and height, without entering into visual and design correspondence with the surround- ing park. This explicitly includes the radiation of light sources and lit areas into the park. − Safeguarding the relevant outstanding universal value (OUV)

For the sake of understanding, it should be explained that constructional developments in Muskauer Park/ Mużakowski Park must not have any negative impact on the outstanding universal value of the Muskauer Park World Heritage Site, see Appendix C.21: − Concepts for preservation and further structural and functional developments are possible only on the basis of the UNESCO World Heritage Convention and the goals of the conservation concept for the entire site. − The concerns of monument protection as well as the requirements of the UNESCO Convention Concerning the Protection of the World Cultural and Natural Heritage

shall be taken into account in a timely manner and in such a way that the cultural monuments and cultural heritage as defined by the Convention are conserved and their surroundings are appropriately designed. − Uses are to be designed in a way that is compatible with world heritage and historic monuments. − The character of the park and its material evidence must be conserved.

A 3.4 Current Traffic Development and Media Connections Bad Muskau can be reached from several directions: − from the direction of Berlin and Cottbus from the A 15 via the B 115 − from the direction of and Bautzen from the A4 via the B 156 − from the direction of Görlitz via the B 115

A visitor parking lot for cars and coaches is available for a fee on the Neißedamm. Other parking facilities are available on the Postplatz and on Görlitzer Straße (see Appendix C.6).

Muskauer Park can be reached by bicycle via several interregional bicycle paths that lead through the landscape garden along the Neisse River: − Oder-Neisse Cycle Route: 630 km from the source of the Neisse River to the Szczecin Lagoon − Fürst Pückler Trail: 500 km in the footsteps of Pückler − Frog Cycle Path: 260 km through the Upper Lusatian Heath and Pond Land- scape There is a bicycle rental shop with a workshop at the Schlossvorwerk.

Train travelers first take the Ostdeutsche Eisenbahn GmbH (ODEG) to Weißwasser. There they change to buses of the regional night service to Bad Muskau (bus line 250). The bus stop "Kirchplatz" is only a few steps away from Muskauer Park. In the season from April to October, visitors can also use the forest railroad to travel from Weißwasser to Bad Muskau.

The operational access to the Cavalier House is from Kirchstraße via Markt into the park (see Appendix C.6). From the market to the park, access is via a park path, the so-called Moorbadstraße. This is paved with natural stone and has a width of approx. 3.5 m. The parkway is used by the Foundation's vehicles: It can also be used by visitors in excep- tional cases. In addition, carriage rides cross this path directly at the park access.

For the later realization of the construction project, it should be noted that driving on this ac- cess road is only permitted with a truck up to 40 t and only during the construction phase.

A 3.5 Subsoil and Flooding From a geotechnical point of view, the existing ground conditions in the construction area can be described as relatively complicated for the planned building project. In the potential foundation area of extension buildings, there are partly deep soils with only low to very low load-bearing capacities. Only the fine-grained sands marked in orange in Annex 2 of the ge- otechnical report have significantly higher load-bearing capacities. The load-bearing capacity deficits are particularly serious in the northern part of the potential construction area, in the area of small-pile boreholes 10 and 11 (outside the construction area). From a geotechnical point of view, building in this area should be avoided if possible. If construction is unavoidable here, deep foundations are required. However, the excavation program carried out is not designed to assess this, so that significantly deeper boreholes would then have to be sunk. In the remaining area, the foundation of new buildings should in any case be executed by means of suspended slabs in connection with foundation pads. The thickness of the founda- tion pads depends on the loads to be transferred and the sensitivity of the buildings to set- tlement, but will not normally be less than 1.5... 2.0 m as a rule. Frost aprons must not be placed on the floor slabs, as otherwise no load propagation and thus no stress reduction can take place in the pad.

If, due to the design, the building has to have single and strip foundations, these must be settled with sub-concrete at least on the sandy soils.

Groundwater influences are to be expected from depths of approx. 2 ... 2.5 m below the cur- rent ground surface, so that there are no groundwater influences in the immediate founda- tion area of buildings without basements. If a level below the ground floor level of the Cava- lier House is planned for the new buildings, the base of this level should be at the level of the bottom of the basement of the existing building.

All information on the subsoil is provided in detail in the geotechnical report, see Appendix C.10.

With regard to the water levels, the following information from the State Reservoir Admin- istration is to be taken into account in the following: [HQ = floodwater discharge index] Water level at HQ 500 = 106.9 m. above sea level Water level at HQ 200 = 106.6 m. above sea level. Water level at HQ 100 = 106.5 m. above sea level

In the course of the development of new management plans for flood risk, these values will be reviewed and revised. In particular, it will be taken into account that the HQ100-value in the future is very likely to be higher than the previous HQ100-value. However, experience shows that these water levels have not been reached in the park to date. See C.11 and C.12 for annexes on flood levels.

A 3.6 Exhibition Contents as well as their Presentation Methodology and De- sign Exhibition place With the Muskauer Park (UNESCO World Heritage Site) and the Muskau Arch (UNESCO Geopark), two UNESCO sites are located in one place. Both parks are located on the Polish as well as on the German side. Both sites are significant for their scenic character: the Muskau Arch as a result of glacial climate change as well as a water-rich post-mining landscape, the Muskauer Park as Prince Pückler’s masterpiece of landscape art. Exhibition content: The exhibition has two thematic strands. 1. The exhibition shows how changing climatic conditions have shaped the typical lo- cal landscapes: the formation of coal in the Tertiary and the morphology of the Muskau Arch in the Pleistocene. The excursion through the history of the earth documents that climate is subject to constant change and that climate change is not an exclusive phenomenon of to- day. In contrast to today's cultural landscape, the landscape of the Muskau Arch was essentially shaped exclusively by the changing climates until the active inter- vention of man (the Anthropocene). The exhibition considers the climatic and geological processes that "formed" and "made available" raw materials in the folded-arc region. 2. The use of raw materials is subject to permanent dynamics as a result of changing socio-economic conditions. Structural change and structural breaks occur. In the present, these two thematic strands meet: In order to mitigate anthropogenic CO2 emissions and their influence on the increase of the annual mean temperature, a "political" structural change was decided on the basis of the Paris Climate Protec- tion Agreement of 2015, which puts an end to the mining and energetic use of lig- nite in the folded arc region. This topic is discussed extremely controversially. The exhibition aims to provide neutral guidance, to explain the motives and concepts of the actors involved, and to playfully ad- dress the question of the future for the Lusatia region using a wide variety of approaches. The visitor and education center is designed as a "hybrid" between − a display of exhibits and − a science center with models and experiment stations. The maxim for this is "learning by doing" Since the thematic spectrum of the exhibition is very demanding, the structure, layout, mate- rials and circular route are designed to help visitors maintain an overview and concentration.

Numerous exhibits on display are newly developed. They do not yet exist in this form in other exhibitions. Note: Appendices C.23 and C.24 detail the planned exhibition themes and their contents and requirements. For a complete understanding of the complex exhibition theme, the exhibition will have a clear thematic and chronological sequence, see section A 4.4 Space and exhibition pro- gram. Therefore, the visitor should find a structural path that enables him to experience ex- actly this sequence from the beginning to the end of the exhibition. Structural shortcuts ("by- passes") within the thematic segments are conceivable in order to enable specific segments to be reached by a short route.

In addition, the exhibition will be complemented by a generous Tertiary comparative planting ("green patio"), which will be covered in winter and available as an exhibition space.

There is no need to provide space for temporary or special exhibitions in the new building; space for these is available in the exhibition rooms of the New Palace.

The exhibition concept is based on an estimated 50,000 visitors per year and year-round opening. Depending on the decisions of the foundation's bodies, the aim is not to charge an entrance fee in order to avoid the difficult and costly problem of separating the streams of visitors and to ensure a sufficient number of visitors to operate the café economically. A possible retrofit is nevertheless to be considered.

A 4 Planning task A 4.1 Exhibition Building - Existing and New Construction For the exhibition building, the sponsor envisions an aesthetic, albeit restrained structure in harmony with the historic Cavalier House. The "space" framed by the existing woody plants is to be designed simply yet effectively. A high degree of functionality is expected of the new building in that it is tailored to the spe- cial features of the exhibition and that a special, creative formulation is displayed in the inte- rior. The external appearance of the new building should be restrained and blend in with the given vegetation. An unobtrusive choice of colors and materials as well as the avoidance of reflective surfaces and light/light pollution emitting from the building should support this.

This constituent principle of the World Heritage status of Muskauer Park must be main- tained, see Appendix C.21, for an explanation of the outstanding universal value of the park.

The exhibition will also include rooms in the Cavalier House, so that a structural connection to the historic building is necessary. The north façade of the Cavalier House may be adapted for this connection. In contrast, the west and especially the south facade of the Cavalier House, in the direction of the New Cas- tle, are to be retained unchanged due to monument conservation requirements.

Based on preliminary investigations, the sponsor envisions that barrier-free access can be implemented on the east side of the Cavalier House. This is necessary because the café is to be operated independently of the exhibition, and the main access on the south side of the Cavalier House cannot be converted and used for this purpose for reasons of monument conservation.

The exhibition will cover an area of approximately 3,500 square meters, which will be pro- portionally located in the structure of the existing Cavalier House and the independent new building attached to the historic Cavalier House. When the term exhibition building is used in the following, both parts of the exhibition are meant. For the barrier-free visitor route within the exhibition, at least one elevator is needed.

A 4.2 Dealing with the Historic Cavalier House The Cavalier House was originally a baroque garden palace. It dates from the first half of the 17th century and has a skewed floor plan measuring approximately 22 x 10 meters. On the first floor, the original vaulted structures are preserved, as well as some later Baroque ornaments dating from the 18th century (room in front of the former bath room; room no. 004). Both the original vaulted ceilings with their 1930s decorations and the baroque stucco must be preserved at all costs.

The garden house was overbuilt in the last third of the 18th century with a secular and prag- matic functional building. The former, mighty outer walls remained unchanged inside the building and could be experienced on the first floor. In this way, the equally formative and functionally constricting configuration of a kind of "house-within-a-house" was created, which must be retained as an architectural feature. For it is precisely in these rooms that the valua- ble, historic finishes are located, which are to remain and be upgraded.

Large parts of the first upper floor of the Cavalier House, on the other hand, cannot be used for the exhibition due to the staggered ceiling heights resulting from the great floor height of the oldest part of the first floor (room height < 1.70 m). The remaining rooms with appropri- ate room height could accommodate the museum education rooms as well as technical, storage and social rooms. Neither are the attics usable for exhibition or storage purposes because they lack accessibil- ity, escape and rescue routes, and have insufficient load-bearing capacity.

Use of the ground floor The sponsor is considering using the representative rooms with the architectural vault struc- tures in the northern middle section of the ground floor for a café with approx. 50 seats. Ar- eas for kitchen, sanitary and storage rooms could be provided in the western part of the ground and upper floor. The café is to be supplemented with a terrace, which will provide a view of the exhibition, possibly the "Tertiary forest", as well as accommodating café furniture and being available for use in winter.

Use of the basement

The use of the basement with its large barrel vaults is conceivable in principle, but in order not to damage the historic monument, the historically proven condition of the present struc- ture should not be fundamentally changed. An economical and, if necessary, robust furnish- ing and use of the rooms similar to other exhibition areas located in flood situations, for ex- ample the Dresden Fortress casemates, is conceivable.

For the exhibition conversion of the basement, it would make sense to lower the top of the present floor in order to improve the usability of the rooms by increasing the room height somewhat. According to current knowledge, however, this lowering is only possible to a lim- ited extent up to approx. -3.60 meters without additional foundations. Extensive structural or foundation engineering measures should be avoided in the interests of the monument and in view of the costs.

In addition, the flood situation must be taken into account for each use of the rooms (rapid dismantling of exhibits, low-hazard installation of technology, closure to the adjacent new exhibition rooms, etc.) and other protection goals agreed upon.

Similarly, sensible measures appropriate to the monument and its history must be taken into account in view of the moisture currently present and the associated salt transmission in the walls. The same applies to renewed moisture penetration in the event of flooding and due to warm, humid outside air in the summer months.

Use of the basement for selected topics seems plausible, see Section A 4.4. but is not es- sential.

A 4.3 The New Building A construction area north of the existing building is planned for the new building in accord- ance with Appendix C.3. It must be taken into account that valuable trees are directly adja- cent to its eastern and western borders. The root and crown areas of trees/woody plants to be protected, as designated in the plan, must not be damaged or impaired by the future de- velopment. See B 11 Binding requirements.

Because of the high priority placed on monument conservation and in order to avoid possi- ble negative effects on the World Heritage Site and the coordination that has taken place so far in the foundation committees, the new building should be based on the style of the three- wing complex depicted in Pückler's "C-Plan" from 1834. Relevant here are the dimensions and the orientation of the building structures. If the design is based on a U-shape formed by the two historic wing buildings, a connection would be desirable in order to close the visitor circuit.

The area/patio necessary for the establishment of the Tertiary comparison planting (Tertiary Grove) should be able to be roofed over in a simple manner to allow year-round use and to protect the plants in winter. Ideally, the cover can be opened generously in the summer half of the year or even removed completely. Likewise, ventilation must be possible in winter to regulate temperatures according to the plants' requirements.

For the design of the roof structure, aspects such as repair, maintenance, and appropriate safety devices must be considered in addition to cost, choice of materials, and easy use.

A direct access opening into the planting yard is to be provided for maintenance and care of the plant system. Since smaller (garden) vehicles are also to pass, a size of approx. 3.2 x 3.0 meters is necessary.

Although the new building will be two-story in parts due to the desired visual relationships within the exhibition, it may not exceed in any place the maximum permissible height of the northern eaves cornice on the Cavalier House. The requirements for this and for the desired restrained external effect are summarized in sections A.3.3 and B.12.

A 4.4 Space and Exhibition Program There is an elaborated concept for the exhibition, which has a clear thematic sequence in the form of a "string of pearls", see Appendix C.24. This thematic chain consists of 14 chap- ters, which are connected with certain room sizes and into which several larger presentation objects are inserted. Their arrangement in the room is subject to a certain flexibility without changing the given thematic sequence in order to enable the understanding of the complex topics; see also: section 3.6 on the exhibition contents as well as their presentation method- ology and design.

Appendix C.25 provides a comprehensive, tabular overview of the exhibition concept, its contents, and the resulting structural requirements for the size, location, and equipment of the premises to be planned.

The tour conceived during the development of the exhibition concept is as follows: Visitors enter via a small, attractive forecourt the newly created entrance hall with check- rooms, lockers and ample space for groups.

The walking tour begins with introductory topics up to the “Layerology,” then through the "Tertiary Plant World” and to the basement of the Cavalier House. From the basement, visitors return to the new build- ing, climb to ground level, walk along the green center ("Tertiary Plant World") and finally enter the ground floor of the Cavalier House with the themes "Lusatian Parliament" and "Springboard to the Region.” There they can then leave the exhibition to go outside or di- rectly to the adjacent café, which provides a view into the exhibition and the "Tertiary plant world.”

Although it is possible to leave the exhibition directly from the first floor of the Cavalier House, there should also be an interior path to reach the checkroom and lockers in the en- trance.

The exhibition spaces in the Cavalier House should make visible the characteristics of the historic building. For example, the character of the basement with its stone-faced barrel vaults would lend itself to a theme as “The Anthropocene – underground mining, raw mate- rial use."

For exhibition use of the basement, the information on handling the present structure as given in Section A 4.2 would have to be taken into account. Since the exhibits are less valuable and, like the exhibition equipment, should be easy to dismantle and transport, rapid dismantling in the event of flooding (up to now with a warning period of 24 hours) is possible.

The exhibition areas in the new building can contrast with the historic rooms in the Cavalier House. Spacious rooms with a clear geometry and a staging of the interior spaces through exciting views of the patio are conceivable here. For the spatial design, large exhibits such as the construction of a glacier model in Depart- ment 6 "Pleistocene" and likewise the group of large mammals, which is to be viewed from two levels, are to be considered.

A subdivision of the exhibition space into strictly separated individual rooms is not desired.

An essential part of the exhibition, the experimental tables of approx. 1.5 x 2.5 m, which may be surrounded by groups of up to 15 visitors, have an influence on the room geometry. For a guided tour through the exhibition, the groups should not be larger than 15 persons in order to provide good visibility for all visitors and to be able to guide the group well. Despite group-encircled experiment tables, other visitors should be able to pass through or see the exhibits in the relevant sections of the exhibition without constraint. A room width of approx. 8.0 m is considered sufficient for this purpose.

In the roofed patio, a fascinating plant world should be presented in the form of a planting comparable to Tertiary flora, reminiscent of the Tertiary 20-50 million years ago.

The ground of this planting should be on the same level as the basement of the Cavalier House in order to achieve a plausible plant size. The temperature of the planting area should be separately controlled from that of the adjacent exhibition areas because the well- being of the plants in this area will require a minimum temperature of 8 to 10 °C in winter.

From this inner, green world, a visitor path can optionally lead to the outdoor area adjoining to the north of the construction site, where the exhibition themes will continue with additional plantings and a body of water, forming a theme path. See A 4.11 on outdoor design.

Although references from inside to outside are possible, it should be mentioned again that a design impact on the surrounding park landscape is expressly not desired. See B.12 on binding requirements

A 4.5 Expansion Requirements For the design of the exhibition spaces certain characteristics are desirable: colors and fin- ishes. Materials, colors, and textures for walls, floors, and ceilings shall be selected to match the themes of the exhibit; they may support specific themes or the path of visitors by means of selected colors or textures. Notwithstanding the foregoing, surfaces, especially floors, shall be appropriate for the mechanical stresses of an exhibition, particularly with respect to the sandy surfaces of the water-bound paths of the parkways leading to the exhibition building.

The wall surfaces shall also be suitable for the application of plotter/foil lettering.

Ceilings

For media technology and projections, the ceiling height in the new building should be 4.0 m if possible. In the Cavalier House, the ceilings in particular are to be restored with original decorations from the period of construction in coordination with the conservation authorities.

Shading Although there are preferably no window openings to the outside/towards the park in the new building except for possibly necessary rescue windows, the solar radiation resulting from the view relations to the "Tertiary forest" and the radiation through the roofing must be taken into account. Openings to exhibition rooms in the new building as well as the windows in the Cavalier House must be equipped with shading elements to allow glare-free viewing of exhibition objects or video/immersive sequences. The shading elements (screens) should allow for separate (independent) operation of each screen.

A 4.6 Support Structure and Building Shell For the support structure, there is initially a choice of systems. However, the requirements indicated in the subsoil survey and the flood levels in particular must be taken into account. In addition, the loads from the patio roof of the planting area must be transferred. The exhibition rooms in the new building are intended to have as few columns as possible. For the choice of the constructive system and materials, references to the historical sur- roundings, to nature or the exhibition themes can be considered.

For the building shell, a contemporary, energy-saving concept is expected, which takes into account the sustainability of the thermal insulation and is also consistent with including the necessary building services equipment.

A 4.7 Technical Building Equipment For the technical building equipment, a concept is expected that includes energy-saving systems and technologies and uses synergy effects such as ventilation technology with WRG. Factors to which the user attaches importance are summarized below. However, all the usual groups of systems must be included in the consideration of technical building equipment.

Passenger elevator The required elevator should be suitable to transport a group of up to 10 people. The equip- ment should be barrier-free according to the two-senses principle, with tactile operating ele- ments. A freight elevator is not needed.

Acoustics There are high requirements concerning acoustics. High noise levels are expected due to school classes, guided tours and heavy visitor traffic at peak times. In addition, the exhibi- tion will be presented in various media sections. Acoustically effective measures are to be provided so that an undisturbed visit to the exhibi- tion is possible despite the interconnected rooms and the possibly connected patio.

Room climate There are no special conservation requirements for the indoor climate of the exhibition. In- sofar as exhibits require air conditioning, this is achieved via showcase air conditioning.

LED lighting should preferably be used in the exhibition rooms. In addition, there will also be media, lighting, and other building services that contribute heat. This heat input as well as the heat generated by the visitors is to be counteracted by measures of the building services engineering and/or by structural measures.

For plants of the “Tertiary Grove,” frost-free conditions and temperatures of at least 8 to 10°C as well as sufficient light must be ensured. Likewise, water and sewage connections for plant care should be provided. A water connection should also be inserted for the irrigation of the outdoor plants.

Light For the exhibition rooms, 3-phase tracks, preferably as recessed luminaires, are preferred due to their multiple use. These can also be used for cleaning light or media technology. The backup power supply system, including the safety lighting, is to be provided in accord- ance with the requirements of the guidelines for places of assembly.

Media connections for the exhibition In the exhibition rooms, electrical and network connections are to be provided in the walls and ceilings in numbers customary for exhibitions.

In-built media connections in the floors are necessary for all-round accessibility of the exhib- its and experiment tables. For this purpose, ducts should be planned in which all media (electrical and network) are laid and which can be opened at the required point. In addition to electrical and data connections, water and wastewater connections at 4 locations should also be considered for the experiment tables.

In the exhibition rooms in the Cavalier House, electrical and data connections can be sup- plied via floor tanks in a regular grid.

As consistent with contemporary equipment, W-LAN should be available in all areas.

Admission control Based on a number of visitors of approx. 50,000 per year and a year-round opening, the aim initially is not to charge an entrance fee in order to avoid the difficult and costly problem of separating the streams of visitors and to ensure a sufficient number of visitors for the eco- nomic operation of the café. Nevertheless, this question is still open for resolution by the foundation bodies, so a future entrance fee should be considered as an option and should be included in the later planning of the technical equipment. For this purpose, modern electronic systems are to be provided that also enable repeated entry to the exhibition, e.g. after a visit to the café. Access to the gastronomical business should always be free of charge.

Video surveillance Based on the experience gained in the New Castle, video surveillance is to be installed at the future entrances/exits of the exhibition in the Visitor and Education Center in order to be able to provide visitors with targeted assistance in the event of problems with the access system.

A 4.8 Energy Concept The sponsors want a building with an intelligent and creative approach to sustainability. An economical use of building technology plays just as important a role as the conscious use of construction and materials.

The concept is to be outlined in the explanatory report. This should include statements on the ventilation / temperature control of the planting area as well as information on the loca- tion of the technical areas, taking into account the flood situation.

In the further course of planning, the guidelines for sustainable building (BMI) are to be ap- plied in principle; this topic is not dealt with in depth in the competition procedure. Consider- ation of the principles of sustainable development should become an integral part of all plan- ning and decision-making processes over the life cycle of a property.

A 4.9 Development and Accessibility According to SächsBO § 50 para. 2 and 3, public buildings must be made barrier-free. As a contemporary building, the exhibition building should enable everyone to experience and grasp things. In this context, the following requirements, among others, must be met: − Application of DIN 18040-1 and -3 − A barrier-free access free of steps to the new building but also to the Cavalier House independent of the exhibition for the exclusive visit of the café. For this purpose, the installation of an elevator on the east side of the Cavalier House is to be examined and developed. The existing, historic exterior staircase on the east side should be preserved. − Within the exhibition/new building, depending on use and function, access should also preferably be provided by an elevator. − Lowering of counters in the cashier / service area − Ensuring the required movement areas and doorway widths for wheelchair users in all public areas − Installation of universally accessible toilets for the disabled

Measures for people with visual, hearing or other disabilities must also be taken into ac- count. This includes: − tactile room and orientation plan in the foyer and exhibition rooms − digital and analog guidance systems throughout the building for orientation pur- poses − induction loops for hard-of-hearing visitors − exhibition media that address several senses, the so-called two-senses principle − high-contrast and simplicity-reduced typography of all exhibition texts and inscrip- tion panels; if necessary, simple language − high-contrast illumination of all objects and inscription panels

A 4.10 Fire Protection As a matter of principle, fire protection issues, in particular escape and rescue routes, must be taken into account for the entire building. The Saxon Building Code (Sächsische Bauordnung), latest version 2016, applies.

A 4.11 Design of Outdoor Spaces Outdoor planning in this context comprises two tasks: On the one hand, the outdoor areas immediately adjacent to the building are to be arranged and designed as part of the building design to be provided on the specified construction site. The existing trees/woody plants at the construction site boundaries are to be taken into ac- count and their crown/root area is not to be damaged. This also applies during the time of construction.

The planting around the new building is to be selected in such a way that the new building is largely "hidden" from park visitors, in keeping with the equally dense planting in Pückler's C- Plan.

Despite the desired dense planting, escape routes and parking areas for fire engines must be taken into account and made accessible. see also Section A 4.10 Fire Protection.

For inspection, maintenance and upkeep purposes, a path – drivable for small vehicles – must be created from the park to the building. In particular, the existing path coming from the south-west is to be continued for this purpose.

Secondly, a fantastic plant world for the representation of the Tertiary woody plant flora (through analogous species) is to be provided as part of the exhibition presentation. This flora is planted inside the building, can only develop there in compact growth forms due to the height ("macro-bonsai") and should therefore continue to the outside with contrasting, free-growing forms. The interior planting area shall form the green center/covered patio and include the plants listed in the exhibition matrix (App. C 25) under Tertiary "Plants become native lignite", which require an indoor climate of at least 8-10° C. This part of the exhibition is supple- mented by water areas and paths and walkways leading through the plant world. The following should also be considered: − At least one passage for gardeners to the outside service road, − A possible additional exit/access point for visitors who wish to view the planned thematic outdoor facilities − Areas for cherry pickers or other maintenance vehicles to carry out work on larger plants and on the underside of the roof

For the external part of the "Tertiary Grove", which will be bordered by the newly planted, thematically appropriate trees, the motif of a body of water is conceivable. In addition, a path on the theme of "Pest & Disease" is to be laid out in the "Climate Arboretum", see also Ap- pendix C.25 Exhibition Matrix, which will make it possible to complete the tour back into the exhibition building.

The area available for this Tertiary grove is shown in the plan of the construction site. During the development of the outdoor areas, the existing trees along with their root and crown areas must remain unimpaired.

A 4.12 Cost Planning and Economic Efficiency The planned project is a subsidized construction and is jointly financed by the Federal Gov- ernment (BKM) and the Free State of Saxony. The awarding authority therefore attaches particular importance to an appropriate, economical and sustainable solution and compli- ance with the cost limit.

The cost framework comprises approx. 16 million EUR incl. VAT for KG 300 + KG 400 and approx. 1.4 million EUR incl. VAT for KG 500. In addition to the cost framework, the anticipated operating and follow-up costs in particular must be taken into account when selecting the structures, materials and plant technology, and value must be placed on environmentally friendly, durable and CO2-neutral decisions.

The cost targets are to be met by considering the following aspects, among others: − optimal floor plan solution with compact arrangement of the areas of use − economic standards in the structural and technical building development, as well as − economical construction solutions for the building shell (roof and facades)

The costs are checked comparatively on the basis of the information submitted by the par- ticipants on the types of area (NUF, TF, VF) and enclosed space as well as the resulting characteristic values on the basis of cost parameters. The results will be made available to the judges to assess the economic viability of the project.

The budget available for the overall project for the artistic equipment (KG 640) “Public Art on Buildings" is not taken into account in the procedure and will be awarded in separate proce- dures.

B 1 Occasion and Purpose of the Procedure An innovative exhibition in the Cavalier House next to the New Castle in the Fürst Pückler Park in Bad Muskau is intended to sensitize visitors to the unique scenic and geological at- tractions of the UNESCO Geopark Muskauer Faltenbogen/Muskau Arch with the Muskauer Park at its center and to encourage further discoveries about the Muskauer Faltenbogen and the town of Bad Muskau.

The aim of the competition is the development of an exhibition building consisting of a his- torical structure and a new building, which on the one hand follows Pückler's design philoso- phy and thus complies with the UNESCO World Heritage conventions, and at the same time offers appropriate space for the exciting theme of the Muskau Arch and the aspects con- nected with it.

B 3 Registration with the Saxony Chamber of Architects The Saxony Chamber of Architects acted in an advisory capacity during the preparation of the competition in accordance with the regulations of the RPW 2013. The procedural conditions were checked for compliance with the RPW 2013.

The competition is registered under the number 02 / 2021 as of 04.03.2021.

B 4 Subject and Nature of the Procedure The object of the competition is to obtain a design for the exhibition building consisting of a new building and conversion of the historic Cavalier House, including the design of the open spaces around the building as part of the exhibition. The procedure will be conducted as an open, 2-phase, interdisciplinary competition in accordance with § 3 (4) RPW 2013 in conjunc- tion with § 69 ff VgV and § 78 ff VgV 2016. The competition is based on the Guidelines for Planning Competitions (RPW 2013), unless otherwise stated below. 1. Competition phase: basic urban and open space planning concept on a scale of 1:500, including distribution of functions in existing and new buildings

2. Competition phase with 12 selected participants: in-depth elaboration on a scale of 1:200, utilization concept for buildings and open space, development structure, open space concept, development concept

The invitation to tender is linked to the intention to implement (see Section B 14). However, implementation is subject to securing the overall financing of the project. In accordance with the regulations of the RPW 2013, Section 1 (4), the anonymity of the competition entries will be maintained throughout both phases until the conclusion of the procedure. The competition language is German. The competition announcement will be published in Polish and English. The competition works, explanatory texts and calculations are to be submitted in German.

Notice: The submission of evidence of suitability and bids in the negotiated procedure following the competition must be in German only. All supporting documents must be submitted in Ger- man or along with a certified translation into German.

B 5 Further Award Procedure The award procedure will be conducted as an open, 2-phase, interdisciplinary realization competition in accordance with RPW 2013. The procedure, conditions and task of the com- petition are described below. The submission of the competition services will not take place electronically. The application of §§ 9 (1) and 10 VgV 2016 is excluded for the submission of the competition services. The contract sum is above the threshold value under public procurement law of currently EUR 214,000. The awarding authority intends to commission one of the prize winners with the planning af- ter the conclusion of the competition, provided that there is no important reason for not do- ing so. The awarding authority will conduct a negotiated procedure without a competition in accord- ance with Section 70 VgV 2016 following the competition procedure with all prize winners. This procedure will be conducted by electronic means. The suitability criteria are explained below, the award criteria are attached. A winning submission can only be commissioned if it fulfills the suitability criteria and there is agreement on the terms of the contract and the fee. Evidence of the suitability criteria must be submitted by all awardees upon request following the competition procedure. All evidence must be submitted in German or with a certified translation into German. In the case of a bidding consortium, the self-declaration form must be completed separately by each member of the bidding consortium.

Eligibility criteria The following eligibility criteria must be fulfilled by the awardees (minimum requirements): if necessary, the awardee may form a working/bidding consortium to fully demonstrate suita- bility. a) Proof of professional qualification must be submitted by all awardees upon request, fol- lowing the competition procedure. See also B.6 Competitors b) Proof of professional liability insurance The participant must provide proof of professional liability insurance to cover all claims for damages and/or recourse for personal injury and other damages. The insurance certificate must not be older than 12 months at the time of submission. Liability coverage amount for personal injuries: 3.0 million EUR Professional liability insurance with coverage for personal injury of EUR 3.0 million and cov- erage for other damages of EUR 3.0 million must be taken out with an insurance company licensed in a member state of the EU or a contracting state of the Agreement on the Euro- pean Economic Area prior to conclusion of the contract, and proof must be provided. Professional liability insurance must be maintained and evidenced throughout the term of the contract. It must be ensured that insurance coverage, in the amount specified as the

coverage sum, exists to cover a claim arising from the contract. B 6 Competition Participants Participation is open to persons who are entitled to use the professional title of architect or landscape architect under the laws governing architects or the laws of the German Federal Lands, or who are entitled to work as architects / landscape architects in the Federal Repub- lic of Germany under the EC Directives, in particular the Directive on the Mutual Recognition of Diplomas in the Field of Architecture/Landscape Architecture or the Directive on the Mu- tual Recognition of University Degrees. The competition work/plans and the model are each to be submitted under the key word "Realisierungswettbewerb Besucher- und Bildungszentrum Bad Muskau" in packaging suita- ble for transport in sealed condition. To ensure anonymity, the address of the recipient must be entered as the sender. The mailing of plans and the model must be free of postage and delivery charges for the recipient.

The following applies to submissions in both phases: The time of delivery shall be deemed to be: - the date and time indicated on the acknowledgement of receipt, if the work/model is de- livered in person to the address indicated, - the date indicated on the delivery bill, irrespective of the time, if the work/model is handed in at the post office or another transport company.

The participant shall ensure that he/she can provide proof of timely posting. Since the (date/mail/day) stamp on the mail item or the accompanying note may show a date that is after the submission deadline, the posting receipt is authoritative. Consignment bills must therefore be retained until the procedure has been completed and must be pre- sented on request.

B 9 Competition Submissions General Each participant may submit only one work.

Labelling All competition submissions should be labelled in the upper right corner by a code number consisting of six different, non-consecutive, Arabic numerals with a height of 1 cm and a length of 6 cm.

Submissions 1. COMPETITION PHASE

The competition work of the 1st phase should be presented on only one plan. The size can be chosen according to the scope of the presentation and should not be larger than DIN A0 portrait format. The plan should be submitted unfolded and rolled and not mounted on boards or cardboard. For the 1st phase, the type of presentation is not prescribed by the sponsor. However, a site plan (M.1:500) as well as floor plans, elevations and sections (M 1:500) should be pre- sented for better comparability and readability. Beyond that, however, the sponsor expects—the visualization of the initial design idea, the approach, the methodology—corresponding to this special place. This can be done by means of sketches, perspective diagrams, photos of material collages, etc. The following submissions are required for the preliminary review:

B 11 Evaluation Criteria All works will be admitted for evaluation, that − comply with the formal conditions of the terms of reference, − correspond in essential parts to the required scope of services, − are received on time − do not violate any binding requirements − do not show any violation of the principle of anonymity. The jury decides on the admission.

The admitted works of the 1st competition phase will be judged on the basis of the following criteria: − Design idea/architecture and landscape architecture − Quality of the conceptual connection between existing and new buildings − Logic and plausibility of the schematically depicted development and functional con- cept of the entire complex The order of the criteria does not represent a weighting.

The accepted works of the 2nd competition phase will be judged on the basis of the following criteria: − Integration of the new building including the reference to the urban context and the existing historic buildings − Consideration of functional specifications from the task definition − Quality of the development concept, structuring of the ground floor − Quality of the open space concept for indoor and outdoor space − Implementation of the utilization concept − Economic efficiency and cost targets − Fulfillment of the area requirements The order of the criteria does not represent a weighting.

B 12 Binding Specifications The new building is to blend in with the surroundings of the World Heritage Site. Therefore, the following binding specifications must be complied with without exception, as any devia- tion in planning will jeopardize the UNESCO World Heritage status. Due to the high UNESCO protection status of Muskauer Park and the central location of the Cavalier House and the construction site, it is essential that: − the boundaries of the competition area are respected, − the construction height of the new exhibition building must not exceed the northern eaves height of the Cavalier House, corresponding to 113.6 m DHHN92, at any

point. The reference height +/- 0.00 = 107.00 m DHHN92 is located on the ground floor of the Cavalier House (southern entrance).

Any transgression of the height and the construction area will result in the exclusion of the submitted work from the competition procedure.

In addition, planning in the open space must assure that root and crown areas of trees/woody vegetation to be protected, as designated on the plan, are not damaged or im- pacted by distance from future development.

B 13 Award For the competition a total sum of 165, 000.00 € gross is provided. Of this, 120,000.00 € will be used as a processing fee for the participants of the 2nd competition phase (10,000.00 € per participant x 12 participants) and 45,000.00 € as prize money. The prize money will be distributed in accordance with RPW 2013, Annex II, 3:

1st prize (40 %) 18.000,00 € 2nd prize (25 %) 11.250,00 € 3rd prize (15 %) 6.750,00 € recognitions (20 %) 9.000,00 € Wettbewerbssumme: 45.000,00 € gross

The jury is authorized, by unanimous decision, to distribute the prize money differently than shown.

B 14 Further Processing The awarding authority will conduct negotiations with all prize-winners, taking into account the recommendation of the jury, with the aim of awarding at least the planning services for the object planning of buildings, work phases 2 to 5 according to HOAI § 34 (fee zone IV) and the object planning of outdoor facilities, work phases 2 to 5 according to HOAI § 39 (fee zone IV), if and as soon as the competition task is implemented and there is no important reason for not awarding the contract. In the event of further processing, the basic services of service phase 2 already performed by the award winner as a result of the competition will not be remunerated again up to the amount of the price share awarded for the corresponding basic services (RPW 2013, Sec- tion 8, Paragraph 2), if and to the extent that the competition design is based in its essential parts on further work. The awarding authority intends to commission further service phases up to and including service phase 9 in accordance with HOAI 2021. The contract is awarded in stages. There is no legal claim to the commissioning of all

service phases. Likewise, there is no legal claim to further commissioning after the first ser- vice phases have been completed. The participants are obligated to take on additional work in the event that they are commis- sioned by the awarding authority.

B 15 Publication and Copyright The submitted documents of the awarded works become the property of the awarding au- thority. The author retains the copyright, including protection against copying, and the right of publication. The awarding authority has the right to use the work of the author to whom further planning services are assigned, for the intended purpose. The awarding authority has the right of first publication.

B 16 Return of the Work Non-awarded works will be made available for collection or returned free of charge by the awarding authority, only at the request of the participants, within 4 weeks after receipt of the protocol. Works that have not been submitted in rolled packaging will be sent at a charge. The corresponding models can be collected from the awarding authority. If no request is made within this period, the participant thereby declares that he/she relin- quishes his/her ownership of the work. The organizer is liable for damage or loss of submitted works only in the case of demonstrably culpable conduct.

B 17 Author's Declaration The content of the participant's declaration is specified by the awarding authority. The en- closed form (Appendix C.17) is to be used. The declaration in the prescribed form must be attached to the documents to be submitted. In it, the participants also declare their willingness to be available for taking over further planning steps. The data provided will be used exclusively for the execution of the procedure and the negoti- ations. After completion of the procedure, the data will be completely deleted.
