Ms. Kozicki distributed the Arsenic and Well Water Testing Data and Local Lab Results Summary.

Discussion on participation at the event that was held in Washington County and how to encourage property owners to get their wells tested.

Ms. Johnson expressed her concerns that she does not have the staff or the budget in her department to take one what the committee is considering. Mr. Dzwinel suggested that Ms. Johnson begin with determining what the true cost is for the program including staff time. Staff can then review what steps need to be taken. 2. Review / Approve Cooperative Landowner Funding Grant Agreement with the U.S. Fish and Wildlife Service Partners for Fish and Wildlife Program for Wetland Enhancement Activities at Virmond County Park US Fish and Wildlife (USFWS) Partners for Fish and Wildlife grant program would contribute $2,000 to the Planning & Parks Department to support a wetland enhancement project at Virmond County Park in the City of Mequon. BACKGROUND INFORMATION: This rezoning request is to amend the wetland mapping to reflect the results of a wetland delineation completed by TRC Environmental Corporation May 29, 2017 and to rezone .14 acres of wetland to non-wetland to allow filling 6,156 sqft (.14 acres) of wetland to provide improved access off State Hwy 60. Per Section 7.1305 of the Shoreland & Floodplain Zoning Ordinance a wetland or a portion thereof, in the Shoreland-Wetland District shall not be rezoned if the proposed rezoning may result in significant adverse impact upon any of the following: 1) Storm and flood water storage capacity. 2)Preservation of dry season stream flow, the discharge of groundwater to a wetland, the recharge of groundwater from a wetland to another area, or the flow of groundwater through a wetland. 3) Filtering or storage of sediments, nutrients, heavy metals, or organic compounds that would otherwise drain into navigable waters. 4) Shoreline protection against soil erosion. 5) Fish spawning, breeding, nursery or feeding grounds. 6) Wildlife habitat. 7) Areas of special recreational, scenic, or scientific interest, including scarce wetland types.

ANALYSIS: The wetland delineation reflects the actual in field wetlands which need to be reflected on the Shoreland & Floodplain Zoning Maps.

Filling of the .14 acres of wetland, the majority being in the right-of-way of State Hwy 60, will not have a significant adverse impact on those items as described in Section 7.1305 B. of the Shoreland & Floodplain Zoning Ordinance. The Wisconsin DNR is in the process of issuing a Wetland Fill Permit to allow the filling of .14 acre of wetland.

Agenda Summary Review / Approve Increase of Revenue Budget Amendment for Cooperative Landowner Funding Grant Agreement with the U.S. Fish and Wildlife Service Partners for Fish and Wildlife Program for Wetland Enhancement Activities at Virmond County Park

BACKGROUND INFORMATION: The Ozaukee County - Planning and Parks Department was awarded a cooperative landowner funding grant agreement with the US Fish and Wildlife (USFWS) Partners for Fish and Wildlife grant program to support a County-sponsored habitat restoration project. Specifically this grant will fund County activities to construct an approximately 0.3 acre ephemeral wetland pond/scrape at Virmond County Park. The Department has replaced old, existing playground equipment at Virmond County Park with newer, nature-based themed playground equipment in a different location. The site of the old equipment is routinely inundated under rain events and is adjacent to an approximately 0.5 acre forested wetland. This grant will support the construction of up to a 0.3 acre ephemeral wetland pond/scrape that is hydrologically connected to the existing wetland area suitable for herptiles (e.g., blue spotted salamanders and frogs) and other wildlife. The new wetland area will be planted with local native vegetation including native trees, shrubs, and herbaceous plants. Educational signage will be displayed in this area to explain the importance of ephemeral wetlands and discuss the species known to be in the park using these ephemeral wetlands. This grant is consistent and compatible with the existing 2016 Brookby Foundation funded grant “Improvements to the Ecology and Recreational Opportunities within Virmond County Park”, a pending Wisconsin Energies Foundation (WEF) grant, and the overall Parks and Ecological Divisions.

ANALYSIS: On June 27, 2017, USFWS staff announced that it would contribute $2,000 to the Department in support of a wetland enhancement project at Virmond County Park in the City of Mequon, and the Natural Resources Committee authorized the Planning and Parks Department to apply for the USFWS cooperative landowner funding grant at its June 8, 2017 meeting. Required match funding would come from an existing Brookby Foundation grant. This cooperative landowner funding grant agreement is consistent with on-going, federally-funded Department programs and is consistent with the Multi-jurisdictional Comprehensive Plan for Ozaukee County: 2035, Park and Open Space Plan for Ozaukee County and the Ozaukee County Land and Water Resource Management Plan.

BACKGROUND INFORMATION: The Ozaukee County - Planning and Parks Department was awarded a cooperative landowner funding grant agreement from the US Fish and Wildlife (USFWS) Partners for Fish and Wildlife grant program to support a County-sponsored habitat restoration project. Specifically, this agreement will support County activities to remediate a fish passage impediment on Mole Creek in the Town of Saukville, which may include culvert replacement/remediation, in-stream grade controls, and bank and in-stream structure restoration. This culvert crossing is located on a snowmobile trail managed by the Ozaukee Snow Drifters Snowmobile Club and has been identified as a degraded crossing in need of improvement. This agreement is consistent with ongoing and previously completed linear connectivity and large- scale habitat enhancement projects on Mole Creek. This agreement would support the construction of a pre-fabricated snowmobile bridge and associated restoration activities. The Department has received USFWS Partners funding in every year from 2012-2016 to support multiple aquatic connectivity and habitat enhancement projects in the Milwaukee River Watershed and Lake Michigan Basin in Ozaukee County. This agreement is consistent with the Great Lakes Restoration Initiative (GLRI) Action Plan, a plan that alludes to the importance of ecosystem connectivity and the negative ecological impacts of habitat fragmentation. Improving the function and connectivity of aquatic habitat in Ozaukee County will directly improve sustainability and/or population recovery for remnant desirable, native, and/or threatened or endangered species within and beyond the county borders. Specifically, improved connectivity promotes the long-term restoration of naturally reproducing, native migratory fish, important game fish species and other fish and wildlife species. Furthermore, this project will bolster the Planning and Parks Department - Fish Passage Program’s mission to reestablish ecological and biological connections, while protecting and restoring habitat throughout the County’s watersheds. This grant is consistent with the NOAA/ARRA-funded Fish Passage Program for the Milwaukee River Watershed, the USEPA/GLRI-funded grant “Enhancing Ecological Productivity of the Milwaukee Estuary Area of Concern (AOC) Watersheds”, the US Fish and Wildlife Service (USFWS) grant “Fish Passage Restoration in the Milwaukee River Watershed” and the overall Fish Passage Program.

ANALYSIS: On June 27, 2017, USFWS staff announced that it would contribute $3,000 to the Department in support of a fish passage impediment project on Mole Creek in the Town of Saukville. The Natural Resources Committee authorized the Ozaukee County Planning and

Parks Department to apply for the USFWS cooperative landowner funding grant at its April 6, 2017 meeting. Required match funding would come from a pending WDNR Outdoor Motorized Recreational Trail Aids Bridge Rehabilitation grant and in-kind staff time. This cooperative landowner funding grant agreement is consistent with on-going, federally-funded Department programs and is consistent with the Multi-jurisdictional Comprehensive Plan for Ozaukee County: 2035, Park and Open Space Plan for Ozaukee County and the Ozaukee County Land and Water Resource Management Plan.

Agenda Summary Review / Approve Increase of Revenue Budget Amendment for Fund For Lake Michigan Grant Funding for Fish Passage and Habitat Restoration Activities on Little Menomonee River / Little Menomonee Creek

BACKGROUND INFORMATION: The Ozaukee County - Planning and Parks Department has been awarded a grant from the Fund For Lake Michigan (FFLM) to support a County-sponsored fish and wildlife habitat project. Specifically, this grant will fund County activities to design and engineer fish passage impediment removal or remediation projects and a large scale habitat restoration project on the Little Menomonee River and Creek in the City of Mequon. These activities may include culvert replacement/remediation, flood control benefits, in-stream grade controls, stream remeandering, restoration of hydrologically and biologically functional floodplains, bank and in-stream structure restoration, wetland enhancements, invasive vegetation control, native vegetation planting and restoration, and water quality monitoring. Approximately 3.77 miles of mainstem channel on the Little Menomonee River and Little Menomonee Creek between of County Line Road and Freistadt Road has been significantly altered through construction of road and stream crossings, dredging and artificial straightening, resulting in an incised channel hydrologically disconnected from adjacent riparian floodplain and wetland areas, which provide high quality habitat for spawning northern pike and other aquatic and terrestrial species. The County Planning and Parks Department and its partners have developed and are refining a GIS-based fish and wildlife habitat decision support tool and an ecological prioritization GIS tool (Tool) to prioritize habitat improvement and restoration activities for maximum benefit. Tool outputs, coordination with the WDNR AOC program, discussions with the Mequon Preservation Partners and discussions with local fish and wildlife experts identified that projects on degraded portions of the Little Menomonee River and Little Menomonee Creek in the City of Mequon would provide significant benefits for multiple aquatic and terrestrial species as well as water quality improvements. The City of Mequon and Milwaukee Metropolitan Sewerage District (MMSD) own 8 parcels along the Little Menomonee River in Ozaukee County, consisting of approximately 247.6 acres and containing 1.77 degraded stream miles. Impediment removal or remediation projects and large scale habitat restoration projects on these publically owned lands have been identified as a priority by the Mequon Preservation Partners (MPP), MMSD, Ozaukee Washington Land Trust, the Conservation Fund, Wisconsin Wetland Association, and other partners including the WDNR as part of its Area of Concern Remedial Action Plan. In addition, the Department is also conducting water quality monitoring activities on the Little Menomonee River and Creek under other grant funding to provide baseline water quality data for TMDL implementation and pre and post habitat restoration data to analyze water quality impacts as a result of restoration activities to determine the effectiveness of

Packet Pg. 47 9.a.3 stream remeandering and culvert replacements as a best management practice to reduce pollutant loads (e.g., Total Maximum Daily Loads - TMDL’s). Specifically, this grant would support design and engineering of a large scale habitat restoration project on the Little Menomonee River and/or Little Menomonee Creek in the City of Mequon and fish passage impediment removal or remediation construction and restoration activities. Overall project costs will be significantly reduced through multiple partnerships. Specifically, the Department will work with the Southeastern Wisconsin Watersheds Trust (SWWT) and the Southeastern Wisconsin Regional Planning Commission (SEWRPC) on engineering and design activities, which will significantly reduce professional services fees. Similarly, construction and restoration activities would be completed by WDNR fisheries staff (who are currently completing similar work at the Mole Creek habitat restoration projects), Conservation Corps groups and the Ozaukee County Highway Department (as practical). These 8 publically-owned parcels provide for significant flood retention benefits, and engineering and design plans for the proposed project activities will be developed to provide additional flood control benefits on the existing parcels while recognizing flooding concerns on adjacent private parcels. The proposed work will restore function and value for fish and aquatic life within the stream corridors and historic wetland areas, and is not intended to restore the landscape to pre-settlement conditions.

ANALYSIS: The Natural Resources Committee authorized the Ozaukee County Planning and Parks Department to apply for FFLM funding at its April 6, 2017 meeting. On June 20, 2017, FFLM announced that Ozaukee County was awarded $100,000 for its “Little Menomonee River / Creek Fish Passage and Habitat Restoration Activities” project. No formal match is required, though the Department will leverage secured WDNR River Protection Planning (RPP) grants and a pending National Fish and Wildlife Foundation (NFWF) Sustain Our Great Lakes (SOGL) grant and in-kind County equipment, supplies, and staff time. This FFLM grant would also serve as match funding for existing grants. Total funding awarded under this grant is $100,000. This

Agenda Summary Review / Approve Contract with the Great Lakes Community Conservation Corps (GLCCC) to Assist the Parks Division and Ecological Division Staff with 2017 Field Activities

BACKGROUND INFORMATION: The U.S Environmental Protection Agency (USEPA) / Great Lakes Restoration Initiative (GLRI) grant “Invasive Species Control and Native Tree Planting in Ozaukee County” and Private Foundation (PF) grants require a very tight timeline to meet project goals and objectives of “control of invasive species”, “restoration of natural areas”, “skills development and engagement for youth conservation projects”, “trail and public access development”, “impediments removed”, and “stream miles made accessible”. The USEPA / GLRI and PF grants also state that “conservation corps” will conduct invasive species management and removals as well as native tree and shrub plantings. The Great Lakes Community Conservation Corps (GLCCC) is a nonprofit organization and an AmeriCorps Program affiliate that provides a valuable service to Wisconsin’s citizens and environment by engaging youth and young adults (Corps Members) in direct conservation projects in the Great Lakes Basin and Midwest. The Department will contract with GLCCC to assist with Ecological Division and Parks Division tasks, and the GLCCC has demonstrated the capacity to assist with large-scale environmental programs such as new trail construction, tree plantings and reforestation, and invasive species management.

ANALYSIS: GLCCC is based out of Racine, WI and works on a time and materials basis. The Planning and Parks Department, based on a review of qualifications, project scope, capacity and timeline for completion, is recommending a contractual agreement with the GLCCC for up to 11 weeks in the 2017 field season to address fieldwork identified in the USEPA / GLRI and PF grants. This contractual agreement will enable Ozaukee County to meet Ecological Division and Parks Division milestones and tasks, while the GLCCC achieves its job training goals with “real world” work. The GLCCC has prepared a contract agreement, which outlines scope of work and budgets for a total not to exceed sum of $40,000. Activities addressed under this contractual agreement are consistent with on-going, federally-funded Department programs and are consistent with goals and priorities in the Multi-jurisdictional Comprehensive Plan for Ozaukee County: 2035, A Park and Open Space Plan for Ozaukee County and the Ozaukee County Land and Water Resource Management Plan.

Contract Agreement Between Ozaukee County Planning and Parks Department and Great Lakes Community Conservation Corps

THIS CONTRACT is entered into by and between the Ozaukee County Planning & Parks Department (the Department) and Great Lakes Community Conservation Corps (GLCCC) (the Contractor) for the purposes of removing invasive species and other conservation-related services in Ozaukee County Parks to be performed by the GLCCC.

FOR AND IN CONSIDERATION of the terms and conditions contained in this contract, the above-named parties agree:

1. PERIOD OF AGREEMENT: This contract shall become effective retroactively to June 5, 2017 upon its signing by both parties and continue through Friday, July 14, 2017 excepting rain days and continuing by written instruction by Department staff for a maximum project period of 10 weeks. This Contract Agreement is at-will and may be modified by mutual consent of authorized representatives from the Department and GLCCC. In the absence of mutual agreement by the authorized representatives, this Contract Agreement shall end upon the fulfilment of the project, or when resources become depleted and no longer sufficient to support the services of the GLCCC to perform invasive species removal services

2. CANCELLATION. The Department reserves the right to cancel this contract in whole or in part, without penalty, for failure of the Contractor to comply with terms, conditions, or specifications of this contract.

3. ENTIRE CONTRACT; AMENDMENTS. This contract shall constitute the entire agreement and previous communications or agreements pertaining to the subject matter of this contract are hereby superseded. Any contractual revisions including cost adjustments and time extensions may be made only by a written amendment to this contract, signed by both parties prior to the ending date of this contract.

4. ASSIGNMENT. Neither this contract nor any right or duty in whole or in part by the Contractor under this contract may be assigned, delegated or subcontracted without the written consent of the Department. If upon the written consent of the Department this contract or any right or duty in whole or in part is assigned, the Assignee(s) shall expressly agree to assume and perform all relevant obligations expressed under the terms of this contract and be bound by the terms and conditions of this contract. Assignment in whole or in part of this contract does not absolve the Contractor of any liability or obligation expressed and agreed to hereunder.

5. DESCRIPTION OF WORK OR PRODUCTS. The Contractor agrees to provide the following to the satisfaction of the Department: a. Scope of Services: The GLCCC shall assign a crew consisting of 1 Crew Leader and 5 Corps members to perform the removal of invasive species in Ozaukee County parks weekdays from Monday, June 5, 2017 through Friday, July 14, 2017 excepting rain days and continuing by written instruction by Department staff for a maximum project period of 10 work weeks or until either 1) notice is provided by the Department to cease operations, or 2) resources become depleted and no longer sufficient to support the services of the GLCCC crew to perform invasive species removal services. Non-compensated rain days are those days where the GLCCC is notified by 2:00pm by the Department of significant rain forecasted expected to impact outdoor invasive species management work for the following work day. In the event of rain during a work day prohibiting outdoor invasive species management work and the Department terminates work activities, the GLCCC shall invoice according to the terms of the contract for hours worked on that day. The GLCCC crew shall receive initial guidance and directives from Department staff about the location and preferred procedures to remove the invasive species. The GLCCC crew shall dispose of the invasive species in accordance with the directions provided by Department

specified and communicated to Department staff, and shall conclude work project activities by 2:00 p.m. daily, unless otherwise specified and communicated to Department staff, in an effort to adhere to federal wage and labor requirements that regulate an 8-hour work day. b. Duties to Communicate: The GLCCC crew shall provide to the Department sufficient levels of communication to permit adequate knowledge, understanding and expectations of work completed. The GLCCC crew shall accomplish effective communication by providing the following:

a. The GLCCC crews that alternate days of work in Ozaukee County parks shall communicate at the end of each day and, as necessary, at the beginning of each day to each other to inform the Crew Leaders and Corps members what work will be performed for the day, and where the work will be performed for the day with respect to the work that was completed on the prior day. Specifically, the A-team Crew shall inform the B-team Crew where they left off and concluded activities at the end of the day. b. The GLCCC Crew Leaders shall be responsible daily to review, reference and understand any GPS maps provided by the Department staff that illustrate the locations where the GLCCC crew is assigned to complete invasive species removal. c. The GLCCC Crew Leaders shall be responsible to daily conduct GPS/GIS mapping of the work project site to delineate, measure and upload using the ArcGIS software licensed to the GLCCC and its CERT School the locations and amount of work completed by the GLCCC crew on that day. Department staff shall be provided access to view online the GIS map of work completed and in progress by the crew for the day. d. The GLCCC Crew Leaders shall be responsible for taking daily representative pre and post photos of the work site and associated progress and for providing photo records at the time of each invoice period or as requested by the Department for reporting purposes. Photos shall be provided digitally (e.g., jpeg) and file names labeled by site and date. e. The GLCCC Crew Leader shall be responsible to daily provide an end-of-the-day email update to inform Department staff about the amount of work that was completed. Specifically, the GLCCC Crew Leader shall remit an email message at the end of each day that includes information to complete the following statement: “We think our crew finished ___% of what Department staff wanted us to complete at the project site.”

f. The GLCCC Crew Leader shall be responsible to complete a Daily Work Report and provide an electronic copy to Department staff. The Daily Work Report shall include the following information: g. The number of the GLCCC Crew Leaders and Corps members present at the work project site; h. The names of the GLCCC Crew Leaders and Corps members present at the work project site; i. The arrival time of the GLCCC Crew at the beginning of the day to the work project site; j. The departure time of the GLCCC Crew at the end of the day from the work project site; k. A written description of daily accomplishments including specific invasive species removal or management metrics as applicable (e.g., the number of bags filled with invasive species that were collected throughout the day at the work project site(s)). l. The difference between the daily accomplishments completed the previous day

day (e.g., total number of bags collected the previous day by that alternating Crew and the number of bags collected at the conclusion of the current day).

6. PAYMENT. The Contractor, for providing performance satisfactory to the Department, shall receive the following consideration:

The services to be performed by the GLCCC shall be compensated as a time-and-materials Contract Agreement with the Department. The total Contract Agreement shall not exceed $40,000.

a. Labor: GLCCC shall invoice the Department at a labor rate of $20.00 per Crew Leader hour, and $15.00 per Corps member hour. At a not-to-exceed amount of $40,000, crew labor may yield the equivalent of 422 Crew Leader hours (at $20/hour) and 2,104 Corps member hours (at $15/hour) for approximately 53 8-hour crew days of work. The Crew Leader and Corps member labor for one 8-hour day equates to $760 ([8 x $20 x 1 Crew Leader] and [8 x $15 x 5 Corps members]), and a weekly total for the Crew of $3,800 ($760 x 5 days). b. Materials and Supplies: GLCCC may procure materials, e.g. bags, herbicide, etc., only with the advance approval of Department staff for the expenditure. The Department shall reimburse the GLCCC for the cost of pre-approved purchases that are validated by receipts and/or other documentation. The cost for materials and supplies shall be deducted from the total Contract Agreement of $40,000, and may result in reducing the amount of the contract available to fund labor costs.

The Great Lakes CCC shall provide the Department with an itemization of the number of Crew Leader hours and Corps members hours served during the period. The Great Lakes CCC shall also provide copies of any receipts and/or other documentation to validate the costs for reimbursement of materials/supplies for the work project.

The Department shall make its best effort to remit payment of the invoiced amount within 15 work days of the date of receipt of the invoice from the Great Lakes CCC.

Billings by the Contractor shall be quarterly and made for review and acceptance to:

7. RECORDS, ACCESS. The Contractor shall, for a period of three (3) years after completion and acceptance by the Department, maintain books, records, documents and other evidence directly pertinent to performance on work under this contract in accordance with generally accepted accounting principles and practices. The Contractor shall maintain and retain applicable supporting financial information and data used in the preparation or support of cost expenditures invoiced to the Department. The Department, its agents and its duly-authorized representatives shall have access to such books, records, documents, and other evidence for the purpose of inspection, audit and copying. The Contractor shall provide proper facilities for such access and inspection. In addition, those records which relate to any dispute, appeal, litigation, performance, claim, exception, or costs or items to which an audit exception has been taken, or the settlement of claims arising out of such dispute, appeal, litigation, performance, claim, exception, or costs or items to which an audit exception has been taken, shall be maintained and made available until three years after the date of resolution of such dispute, appeal, litigation, performance, claim,

8. INDEPENDENT CONTRACTOR. The Contractor is an Independent Contractor for all purposes and is not an employee or agent of the Department.

9. INDEMNIFICATION. The Contractor agrees to save, keep harmless, defend and indemnify Ozaukee County, the Planning and Parks Department and all its officers, employees and agents, against any and all liability, claims and costs of whatever kind and nature, for injury to or death of any person or persons, and for loss or damage to any property (County or other) occurring in connection with or in any way incident to or arising out of the occupancy, use, service, operation or performance of work in connection with this contract or omissions of Contractor's employees, agents or representatives.

10. INSURANCE AND LIABILITY. The work to be performed under this contract is to be performed entirely at Contractor’s risk. Contractor hereby assumes all liability for all work and all services to be provided by the Contractor under this contract. The Department may seek indemnification from the contractor should claims arise against the Department for injury to or death of any person or persons, and/or for loss or damage to any property (county or other) occurring in connection with or in any way incident to or arising out of the performance of work in connection with this contract.

To that end, the contractor shall maintain, during the term of this contract, worker's compensation insurance if required by Wisconsin Statute for all employees engaged in the work and sufficient public liability, property damage and automobile insurance against any claims which might occur in carrying out this contract.

The Contractor shall not commence work under a Contract until he has obtained all insurance required under this paragraph, has named the County as additional insured, and has filed certificates thereof with the Owner, nor shall the Contractor allow a Subcontractor to commence work until all similar insurance required has been so obtained and filed.

A. Workmen’s Compensation

Statutory coverages as required by chapter 102 of the Revised Statutes of the State of Wisconsin for the year 1967 and all acts amendatory thereof and supplementary thereto, for all employees of the contractor. All subcontractors and shall furnish to the Contractor and to Ozaukee County, evidence of similar insurance for all of their respective employees unless such employees are covered by the protection afforded by the contractor.

11. NONDISCRIMINATION. In connection with the performance of work under this contract, the

of age, race, religion, color, handicap, sex, physical condition, developmental disability as defined in section 51.01(5), Wis. Stats., sexual orientation or national origin. This provision shall include, but not be limited to, the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. Except with respect to sexual orientation, the Contractor further agrees to take affirmative action to ensure equal employment opportunities. The Contractor agrees to post in conspicuous places, available for employees and applicants for employment, notices to be provided by the Department setting forth the provisions of this nondiscrimination clause. Failure to comply with the conditions of this clause may result in the Contractor being declared an "ineligible" contractor, termination of the contract, or withholding of payment.

12. AFFIRMATIVE ACTION. If this contract is for an amount of twenty-five thousand dollars ($25,000) or more the Contractor agrees to submit a written affirmative action plan to the Department within 15 business days after the contract commences if an acceptable plan is not already on file with the State of Wisconsin and Ozaukee County. (Contractors with an annual work force of fewer than twenty-five employees are exempted from this requirement.) Failure to comply with the conditions of this clause may result in the Contractor being declared an "ineligible" contractor, termination of the contract, or withholding of payment.

13. GUARANTEED DELIVERY. Failure of the Contractor to adhere to delivery schedules as specified or to promptly replace rejected materials shall render the Contractor liable for all costs in excess of the contract price when alternate procurement is necessary. Excess costs shall include the Department's administrative costs.

14. APPLICABLE LAW. This contract shall be governed by the laws of the State of Wisconsin. The Contractor shall at all times comply with all federal, state and local laws, ordinances and regulations in effect during the period of this contract.

15. PAYMENT TERMS AND INVOICING. Payment shall be considered timely if the payment is mailed, delivered, or transferred by the later of the following:

a) The date specified on a properly completed invoice for the amount specified in the order or contract, or

b) Within thirty (30) days after receipt of a properly completed invoice or receipt and acceptance of the property or service under the order or contract or within thirty (30) days after receipt of an improperly completed invoice or receipt and acceptance of the property or service under the order or contract, whichever is later if the Department does not notify the sender of receipt of an improperly completed invoice within ten (10) working days after it receives the invoice of the reason it is improperly completed.

16. TAXES. The Department is exempt from payment of all sales and use tax on its purchases. The Department may be subject to other states' taxes on its purchases in that state depending on the laws of that state. Contractors performing construction activities are required to pay state use tax on the cost of materials.

Agenda Summary Review / Approve a Memorandum of Agreement (MOA) and Contract by and between the Ozaukee County Planning and Parks Department (County) and the Wisconsin Department of Natural Resources (WDNR) for Habitat Improvement and Restoration Activities on Mole Creek in the Town of Saukville

BACKGROUND INFORMATION: The Ozaukee County - Planning and Parks Department proposes signing a Memorandum of Agreement (MOA) by and between the County and WDNR for habitat improvement and restoration activities on Mole Creek, Ozaukee County’s only cool/cold water stream. Specifically, the MOA would support County activities to construct Phase II of a large scale habitat restoration and enhancement project on Mole Creek in the Town of Saukville, immediately downstream of ongoing large scale habitat restoration and enhancement activities completed with WDNR assistance. To date, the County has completed 35 fish passage impediment removal or remediation projects on Mole Creek, opening the majority of the Mole Creek watershed to the free passage of aquatic life. However, approximately 2,700 linear feet of mainstem channel north of Cedar Sauk Road has been significantly altered through dredging and artificial straightening, resulting in an incised channel hydrologically disconnected from adjacent riparian floodplain and wetland areas, which provide high quality habitat for spawning northern pike and other aquatic and terrestrial species. The County and its partners have developed and are refining a GIS-based fish and wildlife habitat decision support tool (Tool) to prioritize habitat improvement and restoration activities for maximum benefit. Tool outputs and discussions with local fish and wildlife experts and WDNR fisheries biologists identified that a project on the degraded portion of Mole Creek in the Town of Saukville downstream of ongoing habitat improvement and enhancement activities would provide significant benefits for multiple aquatic and terrestrial species as well as water quality improvements. Final plans include stream remeandering, restoration of hydrologically, ecologically and biologically functional floodplains, bank and in-stream structure restoration, wetland enhancements, invasive vegetation control, and native vegetation restoration. This MOA provides for and formalizes WDNR assistance to assist with implementation of the final project plans within WDNR-owned conservation easements and further specifies WDNR’s rates and description of projected WDNR staff and equipment, payment terms, the County’s funding commitment via existing grant funds, and the project period of performance. Specifically, WDNR staff will complete the majority of construction and restoration activities at the Mole Creek habitat restoration Phase II project area with assistance from Planning and Parks Department staff and volunteers. This project is consistent with the USEPA/GLRI-funded grant “Enhancing Ecological Productivity of the Milwaukee Estuary Area of Concern (AOC) Watersheds,” the US Fish and Wildlife Service (USFWS) grant “Fish Passage Restoration in the

Milwaukee River Watershed - Crystal Springs Creek, Mole Creek, Riveredge Creek, Kaul Creek, Mud Lake Outlet, Mineral Springs Creek, and Ehlers Creek,” the WDNR River Protection Management grant “Mole Creek Habitat Enhancement - Phase II,” the WDNR River Protection Planning grants “Water Quality Monitoring on Mole and Ulao Creeks 2016” and “Water Quality Monitoring on Mole Creek and the LMR”, the National Fish and Wildlife Foundation (NFWF) Sustain Our Great Lakes (SOGL) grant “Mole Creek Stream and Riparian Enhancement,” and the overall Fish Passage Program.

ANALYSIS: Ozaukee County and project partners have identified a habitat improvement and restoration site along Mole Creek in WDNR-owned streambank easements in the Town of Saukville to provide maximum ecological benefit. The County cannot complete project activities at this location without a MOA with WDNR, which further details project partner responsibilities. The Ozaukee County Planning and Parks Department signed an initial MOA with WDNR for completion of Phase I activities at the Mole Creek habitat restoration project. The County will reimburse WDNR for project expenses up to $30,000 from existing National Fish and Wildlife Foundation (NFWF) Sustain Our Great Lakes (SOGL) grant funds for completion of the Phase II project area. This project is consistent is consistent with on-going, federally-funded Department programs and is consistent with the Multi-jurisdictional Comprehensive Plan for Ozaukee County: 2035, Park and Open Space Plan for Ozaukee County and the Ozaukee County Land and Water Resource Management Plan.

GOLF COURSES — MEE-KWON PARK AND HAWTHORNE HILLS  To date we have had 49 days with rain this year, 24 of those days we were not able to use carts. Our totals through June 20th is: 2017 March-June 20 rounds of golf – 20,342, 2016 March-June 20 rounds of golf – 23,293, PLANNING & PARKS 2017 March-June 20 carts – 12,144, and 2016 March-June 20 carts – 13,893. The good news is that the golf courses are in excellent shape. DEPARTMENT  We had no significant increase in public green fees during the US Open week compared to previous years during the same time period. The integration of uniform policies at both facilities has been achieved.  Jodi’s 19th tee is making inferences that this will be their last year. They have another two years on their con- tract. We are actively looking for a new vendor should they make the decision final. CURRENT PROJECTS & REPORT  Maintenance staff worked on ash tree removals and tree plantings under the USEPA GLRI Invasive Species and USFS Tree Planting Grants. ECOLOGICAL DIVISION

BIRD CONSERVATION / BIRD CITY WISCONSIN Ozaukee County was again awarded “High Flyer” status for its Bird City Wisconsin renewal in 2017. The “High Flyer” status is the highest level of achievement under Bird City Wisconsin and Ozaukee County was the first County in the State to achieve “High Flyer” status and is one of only 22 communities to accomplish this highest level out of 101 Bird City Wisconsin communities in Wisconsin. Continuing monitoring, soliciting volunteers and maintenance of bluebird, kestrel, purple martin and wood duck nest boxes under multiple existing grants. Completed installation of 10 kestrel and 10 bluebird nest boxes and completing final reporting for two grants (e.g. WCBM and WDNR CCA) FISH PASSAGE PROGRAM Aquatic Connectivity Projects: Coordinated work and contract management with a private contractor for the Mineral Springs Creek—Park Street project (Pre-con meeting 06/08/17); coordination with landowners, local municipalities, and the Ozaukee County Highway Department for completion of 2017 construction and site restoration including a snowmobile bridge replacement on Mole Creek in the Pleasant Valley Nature Preserve. Continued stream impedi- ment and habitat inventories on direct Lake Michigan tributary streams and habitat inventory planning for AOC grant. Habitat Improvement Projects: General project coordination for additional phases at the Ulao Creek and Kaul Creek Habitat Restoration projects, including permitting activities, landowner coordination and meetings, project planning, and oversight of construction and restoration activities at Kaul Creek and HWY Q wetland/pond with a private contrac- tor. Ongoing general project planning for phase II of the Mole Creek Habitat Restoration project with WDNR and Project Engineer, including landowner coordination/meetings and surveying, tree inventory, engineering, & permitting. Environmental Monitoring: Continued analysis and reporting of fish, avian, wildlife, and water quality sampling data. Installation and maintenance of continuous water quality systems, supplies and materials acquisition, project planning and implementation of 2017 fisheries and water quality monitoring activities (“dry” grab sample taken on 6/27/17—Ulao and Mole Creeks). Coordinated monitoring of the underwater camera at MT Fishway and continued 2017 fish, wildlife, and avian monitoring activities including QAPP Development. Met with MMSD staff (6/6/17 & 6/22/17) on continuous water quality monitoring, taking water quality grab samples and sharing data and coordination of fish passage projects. Education and Outreach Activities: On-going distribution, release, and impact evaluation of the educational video. On-going website and social media development and refinement of multiple education/outreach materials for events.
