8.4e Board Training Sessions

Following the citizen appointment by Town Council, training session(s) will be set up between the Board and Tom Gervais, Police Service Advisor, Operations Unit, Ministry of Community Safety and Correctional Services, Public Safety Division, sometime in February.

As requested by Mr. Gervais, the Board is asked to pass a motion approving a training session through the Ministry’s Public Safety Division.

3.1c Chief Berthiaume – Topics for Discussion:

i. Transfer to Old Court Car

The Chief explains that the transfer of the retiring court car from the Police Service fleet to the Town would result in a loss to the police budget of approximately $3000.00 as it is normal practice to send these cars to auction.

Moved by Councillor Lavigne, seconded by Mayor DiCarlo, That the transfer of the retiring court car from the Police Service fleet to the Town of Amherstburg BE DEFERRED to the January meeting of the Board. ii. Training of Board

Mr. Gervais addresses the Board and explains his role as an advisor to the Board and to the Chief. He indicates that he provides advice and information and helps to ensure that Police Services Boards such as Amherstburg, understand their role as members of the Board, and are operating within the parameters and guidelines of the Police Services Act and other regulations.

Mr. Gervais will provide a two hour training session when all the members of the Board have been appointed. As the citizen appointment will not be made until the end of January 2015, the training session will not take place until sometime in February, at the Board’s convenience.

iii. Emergency Vehicle Installation: Status re 2014 Capital Budget

The Chief reviews the situation as it relates to the emergency vehicle installation for one of the newly purchased police car in 2013. He notes that although this installation should have taken place in 2013 and charged to the 2013 capital budget, there were unavoidable delays. This resulted in the installation not taking place until 2014. Since the installation happened in 2014 it was charged to the 2014 capital budget resulting in an over expenditure. Through discussion with the Town Treasurer, this over expenditure will be funded through account rather than the 2014 capital budget.

iv. Body Worn Cameras

The Chief advises that the body-worn cameras have been tested for one year. These body worn cameras have been assigned to eight individual officers. In this way, the badge number of the officer wearing the camera is consistent. To date, the Chief is happy with the data, management and storage of the information recorded by the camera. However, there have been some issues with the hardware requiring additional training by the officers.

The Chief indicates that he has budgeted for more cameras. He also notes that requests for recorded data from the cameras are starting to come in from the courts and he is confident that the data will help to alleviate unnecessary and costly law suits in the future, as there will be no doubt as to what was said or done during a police intervention.

v. OPP Costing

The Chief advises that Town Council, at its meeting of January 15, 2014, directed that a costing be obtained from the Ontario Provincial Police to take over policing service for the Town of Amherstburg.

He notes that Council was very clear that this is not a reflection on the Amherstburg Police Service, but a matter of exercising financial due diligence.

It is noted that there is currently a moratorium on OPP costing until at least the fall of 2015. All of the existing OPP/municipal contracts are expiring this year and will be renegotiated. When the moratorium is lifted and the current contracts are put in place, the OPP will be in a position to respond to the Town’s request.

vi. Amalgamation or Regionalization

In addition to seeking out costing from the OPP, Town Council has also requested that research into the possibility of amalgamating or regionalizing police in this area (ie: LaSalle, Essex, etc.)

vii. Budget Direction from Council

Council has directed that all departments come back with five percent and ten percent budget estimates for consideration during the 2015 budget deliberations.

It is noted that the Town Council Striking Committee will meet on January 26, 2015 at which time the citizen appointment will be made, resulting in a full Board complement of five members.

- Notice Of Motion -

The Amherstburg Police Service (“APS”) will make a motion to the Ontario Civilian Police Commission on a date to be set by the Commission at Ontario Civilian Police Commission, Suite 605, 250 Dundas Street West, Toronto, Ontario.

THE MOTION IS FOR:

1. An Order striking portions of the Justin Brodie Timms-Fryer (the “Appellant”) Notice of Appeal dated June 9, 2014. These portions of the Notice of Appeal include:

1 The hearings officer:

i) failed to offer the complainant an opportunity to examine witnesses and make submissions; [set out at paragraph 2 of the Notice of Appeal]

ii) failed to ensure the Appellant was aware of his legal right, his right to retain counsel and his right to examine each witness. [set out at paragraph 5 of the Notice of Appeal]

2. An Order striking the following paragraphs of the Appellant’s factum: 7(d), 8, 26, 27, 30, 31 and 40 to 63.

3. An Order striking the following paragraphs of the Office of the Independent Police Review Director’s (the “OIPRD”) factum: 3 and 6 to 27.

THE GROUNDS FOR THE MOTION ARE:

Background

4. On December 21, 2010 the Appellant was a passenger traveling in a vehicle on a municipal road in Amherstburg, Ontario. Constable Andrew Challans (the “Respondent”) of the Amherstburg Police Service (the “Service”) stopped the vehicle.

5. As a result of the events that transpired during this roadside stop, the Appellant was charged with assaulting a police officer and resisting arrest.

6. The appellant was acquitted of these charges.

7. The Appellant filed a complaint with the Intervener in relation to the December 21, 2010 incident. The Respondent was subsequently charged with four (4) counts of misconduct under the Police Services Act R.S.O. 1990, c. P.15 (the “PSA”).

8. The Chief appointed Deputy Chief Terrence Kelly (ret.) (the “Hearings Officer”) to

2 conduct a disciplinary hearing into the allegations of misconduct.

9. The disciplinary hearing took place on several dates in 2012 and 2013. The 2012 dates include November 6, 7, and 8. The 2013 dates include September 17, 18, 19, 20, as well as December 4 and 13.

10. The Appellant was present throughout the disciplinary hearing.

11. On May 12, 2014 the Hearings Officer found the Respondent not guilty of each of the four (4) counts of misconduct.

12. The Appellant filed a Notice of Appeal from the Hearings Officer’s decision on June 9, 2014.

Natural Justice and Procedural Fairness

13. The Respondent Amherstburg Police Service (“APS”) submits that the allegations in the Appellant’s Notice of Appeal and factum as well as the OIPRD factum as set out above at paragraphs 2 and 3 should be struck. The APS submits that there is no factual support contained in the record of the proceedings or the proposed affidavit to support a breach of natural justice or procedural fairness outlined by either the Appellant or the OIPRD that necessitates an inquiry by the Commission.

14. The APS submits that there is nothing in the materials that the Respondent police service is seeking to strike that is substantive enough to warrant an inquiry into the legal issues or the factual matters set out therein.

15. Further, the Appellant and OIPRD have failed to indicate how the alleged breaches of natural justice or procedural fairness impacted on the conduct or actual outcome of the disciplinary hearing. The Appellant and OIPRD have not indicated what the Appellant was deprived of in terms of additional witnesses, cross-examinations or further evidence the Appellant wanted to call. There is no substantial wrong or miscarriage of justice that warrants an inquiry into the conduct of the hearing.

Prosecutorial Incompetence

16. The Appellant did not include any ground of appeal in his Notice of Appeal that concerned allegations against the Prosecutor. The Notice of Appeal focused on the actions and decisions of the Hearing Officer. On this basis the Commission should not exercise its discretion to hear any appeal on grounds based on allegations against the Prosecutor.

17. In the alternative, the Appellant’s allegations of prosecutorial incompetence fail to give rise to a breach of natural justice or procedural fairness. The Prosecutor has a wide discretion in presenting evidence to the tribunal and is under no obligation or duty to the Appellant to assist him as a party to the litigation.

18. Allegations of prosecutorial, or professional, incompetence or negligence normally exclusively fall under the Law Society of Upper Canada’s jurisdiction. The Commission should not exercise its discretion to inquire into the decisions, exercise of prosecutorial discretion or conduct of the Prosecutor on the basis of the allegations of the Appellant in the within case.

Additional Considerations

19. Should the Commission decide to exercise its discretion and hear the appeal on these issues, the parties to the proceeding will be required to provide evidence as to what occurred outside of the record. This will include evidence from the Prosecutor and Hearing Officer both of whom may require representation at the hearing of the Appeal. The OIPRD investigators who attended at the hearing, defence counsel, the court reporter and any others in attendance at the hearing are all potential relevant witnesses.

20. Furthermore, the calling of the evidence from the participants will delay the proceeding and increase costs significantly. The Commission is presiding over a labour relations matter. The Commission should decline to exercise its jurisdiction to

4 hear these issues on appeal in order to ensure the just, most expeditious and cost- effective determination of this proceeding.

21. It is submitted that prior to holding a “hearing within a hearing” consideration should be given to the significance of the allegations and in this case the Commission, in the context of these allegations, should exercise its discretion not to entertain them.

The 2013 Suspect Apprehension Pursuit Report for your perusal.

Ontario Regulation 266/10, Sec. 14 (1) under the Ontario Police Services Act states:

“If an officer engages in a suspect apprehension pursuit and the officer is a member of an Ontario police force as defined in the Interprovincial Policing Act, 2009, the police force of which the officer is a member shall ensure that the particulars of the pursuit are recorded on a form and in a manner approved by the Solicitor General.”

One pursuit was initiated in 2014. A lone male driver was stopped in the vicinity of Cty Rd. 8 in Amherstburg for an expired validation sticker. The officer entered into an investigation which dovetailed into a host of other possible offences. While the officer was in his police cruiser contining followup, the driver of the vehicle fled the scene. The officer initiated a pursuit but eventually disengaged when the driver of the suspect vehicle began to drive in a dangerous manner.

The officer elected to do follow up based on the information he was able to obtain prior to the driver fleeing. The driver was subsequently identified, and the vehicle and driver were located in Windsor. In addition to a host of Highway Traffic Act citations, a number of Criminal Code charges were laid including Dangerous Operation of a Motor Vehicle and Flight from Police.

I have reviewed the incident and find no areas of concern.

Dear Police Employers,

In the Highlights of the 2014 Labour Seminar sent to all police services boards on 5 Dec 2014, we identified several new offerings from the Treasury Board Secretariat. This email addresses one of them: access to the Government's Extranet secure labour relations website and searchable data base.

We are now calling on boards to nominate one person (either staff or board member) to register on the Treasury Board’s Labour Relations Secretariat Extranet secure website. Nominated persons will be provided with a password and encouraged to activate the ‘alerts system’ on the site, to be notified when new information is posted. Access to the Extranet will afford each Board’s designate to access a generic Costing Toolkit, Police Sector profile and data base which includes a text-searchable collective agreement data base, contract settlement updates, contract expiries, force size, and other data and collective agreement specifics. [Note: keeping the police collective agreement database complete and up to date is dependent on individual boards posting their most recent collective agreements to the site or forwarding them to the Labour Relations Secretariat for posting]. You will also have the ability to search the contract analysis data base that provides specific contract clause comparisons and analysis, for selected collective agreements in the police sector.

Notice on how to sign up/register for the Extranet will be sent out under separate cover once individual boards identify their contact person.
